    La rappresentazione del patrimonio storico-scolastico attraverso la voce dei maestri

    The article aims to contribute to the reflection on the potential of oral sources in the representation of the evolution of school buildings and school furnishings within the Public History of Education included within the activities of the Third Mission conducted by the University’s research group of Molise. Specifically, the examination of some excerpts of interviews from the audiovisual series “School Memories” administered to teachers born in the 1920s will be functional in illustrating the contribution of individual memories in the construction of a collective memory relating to the educational space. We will try to draw attention to how the choice to carry out the interviews at school institutes and/or school history museums is decisive in terms of results in the process of co-construction of the individual and collective memory of the historical-scholastic heritage thanks to the evocative power of the objects preserved there

    Il contributo è inserito nella rubrica Il ParlaggioEn este trabajo trabajamos el espacio teatral como un ente que configura y construye una vi sión de mundo, funcionando, tal como lo señala Pavis, como un signo doble que contiene en sí mi smo un significado y un significante, que muestra al mismo tiempo que simboliza. En nuestro análi sis de los textos El cabaret Montmartre (1919) del dramaturgo argentino Alberto Novión y El rey del cabaret (1923) del uruguayo Alberto T. Weisbach y el argentino Manuel Romero se observa esa cua lidad de signo doble del espacio y sus componen tes, en donde, al mismo tiempo que se proyecta tal visión de mundo, se (re)crea una imaginería de sentidos. Tal imaginería penetra en el receptor hi stórico y en su propio horizonte y, en algunos ca sos, traspasa ese momento histórico particular que le da génesis para permanecer en el reperto rio posterior del campo intelectual.In this article we present the notion of space in theater. Space, which functions as an entity and builds a view of the world, working, as Pavis points out, as a double sign that contains in itself a signified and a significant, which, at the same time, shows and symbolizes. In our analysis of the plays El cabaret Montmartre (1919) by the Argen tinean Alberto Novión and El rey del cabaret (1923) by the Uruguayan Alberto T. Weisbach and the Argentinean Manuel Romero, this quality of double sign of space is observed, where, at the same time in which such a view of the world is shown, an imagery of senses is (re)created. Such imagery enters the historical receiver and his own horizon and, in some cases, goes beyond that par ticular historical moment to remain in the subse quent repertoire of the intellectual field

    Nel contesto del recente conflitto israelo-palestinese, l’Unione europea ha prospettato la possibilità di sospendere l’assistenza finanziaria alla Palestina per evitare il rischio di finanziare gruppi terroristici. Traendo ispirazione dai fatti recenti, il presente contributo esplora taluni profili critici della cooperazione europea allo sviluppo nel diritto dell’Unione europea. A tal fine, in riferimento all’eventuale decisione dell’Unione di sospendere gli aiuti alla Palestina, lo scritto ne indaga: le procedure di comitologia applicabili ai sensi del regolamento 2021/947; la compatibilità con gli obiettivi della cooperazione allo sviluppo previsti dai Trattati; le eventuali implicazioni sui programmi nazionali di assistenza, dal momento che la competenza dell’Unione in materia di cooperazione allo sviluppo è parallela a quella degli Stati membri.In the context of the Israeli-Palestinian conflict, the European Union has announced the possibility to suspend financial assistance to Palestine in order to avoid the risk of financing terrorist groups. Drawing inspiration from recent events, the article aims to point out some critical profiles of development cooperation in European Union law. To this end, in relation to the possible Union’s decision to suspend aid to Palestine, the paper investigates: the applicable comitology procedures in accordance with Regulation (EU) 2021/947; their compatibility with the development cooperation objectives laid down in the Treaties; the possible implications on national bilateral assistance programs considering that the Union competence in the field of development cooperation is parallel to that of Member States

    Il presente lavoro prende atto di uno iato tra gli obiettivi dell’UE nella PESC e l’effettiva capacità di perseguirli in ragione degli strumenti giuridici messi a disposizione dal Trattato di Lisbona. In considerazione dell’impossibilità di trovare soluzioni confacenti in assenza di un intervento normativo, si valorizza la portata innovativa della blockchain, ipotizzando, sulla base delle sperimentazioni fin qui condotte, un suo ruolo attivo nell’avvicinamento degli eserciti europei.This work takes note of a gap between the EU’s objectives in the CFSP and the actual ability to pursue them due to the legal instruments made available by the Treaty of Lisbon. In consideration of the impossibility of finding suitable solutions in the absence of regulatory intervention, the innovative potential of the blockchain is highlighted, hypothesizing, on the basis of the experiments conducted so far, its active role in bringing European armies closer together

    The paradox of Roman-Dutch law in Holland.

    The term Roman-Dutch law was first used by the Dutch jurist Simon van Leeuwen, but was not current in his time or province. The nomenclature was revived after the annexation of Natalia by the British empire in 1845 and became associated with the South African legal system during the twentieth century. This paper explores why the terminology “Roman-Dutch” is not appropriate to the jurisprudence of the Dutch republic. This republic owed her existence to the resistance of the provinces in the Low Countries, to the new age and new republic emerging from the Middle Ages, which the Hapsburg monarchy attempted to introduce in these regions. The Dutch aristocracy, the wealthy urban bourgeoisie of Holland as well as the working classes clung to the medieval status quo in terms of which they continued to govern their prosperous towns and provinces retaining their identities. This resistance gave birth to an innovative paradigm of constitutional law, but continued the medieval legal pluralism. Both were reactions against the constitutional theories derived from Roman law by the absolute monarchies of the developing national states and the concomitant drive to legal unification on the basis of Roman law. In consequence, the jurisprudence of Holland rowed upstream against the tide of the times, which can de deduced from the academic lectures delivered at the university of Leiden by Dionysius van der Keessel on the eve of the incorporation of the Dutch state into the French empire of Napoleon. This paper attempts to establish the links and conflicts between the various forces in politics and socio-economics at the fault zones between communitarianism and individualism, parochialism and globalisation avant la lettre and unification against pluralism

    La disciplina della legge applicabile nella proposta di regolamento in materia di filiazione

    Le norme sulla libera circolazione delle persone incoraggiano frequenti movimenti dei cittadini europei che determinano un carattere di transnazionalità delle famiglie. Il modello tradizionale, caratterizzato dal legame di due persone di sesso diverso unite dal vincolo matrimoniale, si sta progressivamente disgregando, lasciando spazio alla diffusione su larga scala di nuovi modelli familiari. Garantire la continuità degli status all’interno del territorio dell’Unione da sempre solleva una serie di questioni giuridiche di non pronta soluzione. Molto spesso a farne le spese sono i diritti dei soggetti coinvolti che vedono ampliarsi o restringersi i margini di tutela accordati, a discapito dell’uniformità e della certezza del diritto. Di recente la Commissione europea è intervenuta presentando una proposta di regolamento in materia di genitorialità. La proposta mira ad introdurre una disciplina unitaria sotto il profilo della legge applicabile, della giurisdizione, del riconoscimento e dell’esecuzione di atti e decisioni, seppure con uno sforzo che non si rivela sempre coerente. Il contributo esamina la disciplina della legge applicabile nella proposta e i possibili limiti.The rules on the free movement of persons foster frequent movements of European citizens, leading to a transnational character of families. The traditional model, consisting of two persons of different sexes bound by marriage, is gradually falling apart, leaving room for the large-scale spread of new family models. Ensuring cross-border continuity of family status within the territory of the Union has always raised a number of legal issues that are not straightforward to solve. Very often it is the rights of those involved that suffer, as they see the margins of protection granted widening or narrowing, to the detriment of uniformity and legal certainty. Recently, the European Commission took action by presenting a proposal for a regulation on parenthood. The proposal aims to introduce unified rules in terms of applicable law, jurisdiction, recognition and enforcement of acts and decisions, albeit with an effort that does not always prove to be coherent. The contribution examines the regulation of applicable law in the proposal and its possible limitations
