La protezione temporanea dei minori in fuga dall’Ucraina: teoria e pratica di un istituto alla prova della sua prima applicazione
No full textLa protezione temporanea è stata introdotta nell’ordinamento dell’Unione
europea con la Direttiva 2001/55/CE. Dalla sua entrata in vigore più di 20 anni fa, lo
strumento non è mai stato attivato, portando la Commissione europea a richiederne
l’abrogazione. Il 4 marzo 2022, pochi giorni dopo l’inizio dell’aggressione russa
contro l’Ucraina, il Consiglio dell’Unione europea ha deciso all’unanimità di attivare
lo strumento in questione per fornire protezione immediata agli sfollati provenienti
dall’Ucraina mediante uno status che prevede il diritto al soggiorno temporaneo,
accesso all’istruzione, al mercato del lavoro e ad altri servizi sociali. Questa decisione
senza precedenti ha dimostrato che, quando c’è la volontà politica, gli Stati membri
sono capaci di coordinarsi in tempi stretti per gestire massicci afflussi di migranti.
Analizzando la prima attivazione dello strumento nel caso ucraino, l’articolo
ricostruisce il regime della protezione temporanea e si occupa della tutela assicurata
ai minori. Nelle conclusioni, si sofferma su alcuni punti critici del regime di
protezione temporanea, sottolineando che esso costituisce, ad ogni modo, una soluzione provvisoria e che, in ragione della persistenza del conflitto, non si può
prescindere dalla riflessione sui passi da intraprendere per favorire soluzioni più
stabili, in particolare per proteggere una delle categorie più vulnerabili di migranti,
quale quella dei minori.Temporary protection has been introduced in the European Union legal
order by Directive 2001/55/EC. In more than twenty years from its entry into force,
the tool has never been activated, leading the European Commission to consider its
repeal. However, on 4 March 2022, a few days after the beginning of the Russian
aggression against Ukraine, the Council of the European Union unanimously decided
to trigger it for the very first time to give people fleeing the war immediate protection
with a status which includes a temporary residence permit, access to education, labor
market and other social service benefits. The unprecedented decision testifies that the
EU is legally equipped to manage mass influx of migrants assumed there is the
political will to do it. Analyzing the first activation of the instrument in the Ukrainian
case, the article reconstructs the temporary protection regime and deals with the
protection ensured to minors. In its conclusions, it focuses on some critical points of
the temporary protection regime, underlining that it constitutes, in any case, an
interim solution and that, due to the persistence of the conflict, it is essential to start
reflecting upon the next steps to take to promote more stable solutions, in particular
to protect one of the most vulnerable categories of migrants, such as minors

No full textLa giurisprudenza della Corte di giustizia dell’Unione europea nei noti casi
Coman e Pancharevo ha affermato l’obbligo degli Stati membri di riconoscere i
rapporti di filiazione accertati in altri Stati membri, seppur nell’ottica dell’esercizio
dei diritti inerenti alla libertà di circolazione. La proposta di regolamento oggetto di
analisi mira a introdurre appositi meccanismi di cooperazione giudiziaria necessari al
fine di garantire la tutela dei diritti fondamentali coinvolti. L’alto tasso di
globalizzazione e i crescenti flussi migratori verso il territorio europeo in provenienza
da paesi terzi impongono una riflessione sulle relazioni tra la proposta di regolamento
e gli ordinamenti di Stati terzi, che il presente contributo si propone di evidenziare,
con specifico riguardo ai profili di giurisdizione, legge applicabile e riconoscimento
ed esecuzione delle decisioni giudiziarie.The case law of the Court of Justice of the European Union in the landmark
cases Coman and Pancharevo affirmed the obligation of Member States to recognise
parenthood established in other Member States, albeit with the aim of guaranteeing the exercise of the rights inherent to freedom of movement. The proposal for a
regulation under analysis aims to introduce special judicial cooperation mechanisms
necessary in order to ensure the protection of the fundamental rights involved. The
high level of globalisation and the increasing migratory flows to European territory
from third countries impose a reflection on the relations between the proposal for a
regulation and the legal orders of third States, which this contribution aims to
highlight, with specific reference to the aspects of jurisdiction, applicable law and
recognition and enforcement of judicial decisions
Molecular Properties Via Induced Current Densities
Full text link2021 - 2022The PhD thesis written by Francesco F. Summa on Molecular Properties via
Induced Current Densities is a careful report of a highly qualified and innovative research. Sixteen
peer-reviewed publications on renowned journals in the chemical physics and theoretical chemistry
areas have originated from the work reported in the thesis, besides other six publications, also co-
authored by F. F. Summa on different subjects. The number, excellent quality and originality of the
16 papers mentioned above is far beyond any usual standard for a PhD student, even when the
worldwide reckoned scientific excellence of the research group(s) within which the work has been
performed is properly taken into account.
The work done in the thesis consists of three well identified parts: theory development, SW
implementation of the developed theory into the freely available SYSMOIC package and test
applications of the newly developed theory and SW on a good number of carefully selected cases.
All three mentioned steps of the PhD work are reported in the thesis with great clarity, perfect
progression and concatenation. The writing is terse and quite accurate. After a brief and clear
introduction, the general quantum mechanical framework for the treatment of a molecular system
interacting with electric and magnetic time dependent fields is elegantly recapped and exposed.
Chapter 3 introduces the equations defining the total current density induced by a time-independent
magnetic field and illustrates in detail the procedures aimed at solving the problem of the origin
dependence of the computed current density vector field. Chapter 4 deals with time-dependent
perturbations and how they do result into time-dependent charge and current densities. Chapter 5
reports a number of very interesting applications, both in the static and in the dynamic regimes, of
the theoretical and SW developments illustrated in the Chapter 3 and 4. The work performed in the
thesis and the writing thereof both show a very high command of symmetry analysis of systems in a
magnetic field and of the topological analysis and classification of current densities, two subjects
which are not at all trivial. The provided list of acronyms, in the initial pages of the thesis, is highly
appreciated. Overall, this thesis provides an extremely recommendable reading for those who are
interested or want to be acquainted with the most recent progresses on the subject of Molecular

Full text linkCon un pensiero a Dante Della Terza, l’articolo prende in esame due racconti di Michelangelo Antonioni dalla raccolta Quel bowling sul Tevere e mette in luce come gli elementi che resistono ogni spiegazione allontanano il racconto da ogni logica riduttiva e lo avvicinano al realismo intenso che Antonioni auspicava per un cinema veramente moderno. Inoltre, proprio questi elementi ignoti e forse inconoscibili rafforzano la dialettica destabilizzante tra oggetto rappresentato e soggetto dello sguardo che si riscontra in tutti i film di Antonioni.The article, with a thought to Dante Della Terza, analyzes two stories by Michelangelo Antonioni from the collection That Bowling Alley By the Tiber and highlights how inexplicable elements reject prescribed logical structures and get the narratives closer to the more intense realism that Antonioni meant modern cinema to achieve. Also, precisely these unknown and perhaps unknowable elements reinforce the destabilizing dialectic between represented object and watching subject that lies at the basis of all Antonioni’s films

questione al centro delle diatribe politiche, spesso esagerandone la portata e comunque
sfruttandola per questione di mero calcolo elettorale. L’idea è di utilizzare un boardgame
per raccontare la complessità dei fenomeni migratori portando le persone (principalmente i
giovani) a comprendere e riflettere sui meccanismi che portano la questione a diventare
tematica di consenso politico, spesso ignorando sia le reali cause delle migrazioni sia il
fatto che le decisioni prese per alleviare i timori dell’elettorato si riflettono sulla vita reale
di persone senza alcuna voce nelle stesse
