    Geheimnisschutz zwischen Arbeitsrecht, Datenschutz und Gesellschaftsrecht

    Die Dissertation „Geheimnisschutz zwischen Arbeitsrecht, Datenschutz und Gesellschaftsrecht“ befasst sich mit den rechtlichen Rahmenbedingungen und Herausforderungen des Schutzes von Geschäftsgeheimnissen im Beschäftigungskontext. Ziel der Untersuchung ist es, die maßgeblichen arbeits- und datenschutzrechtlichen Implikationen des Geschäftsgeheimnisschutzes unter Beachtung betriebsverfassungsrechtlicher Spezifika zu beleuchten und deren Auswirkungen auf das gesellschaftsrechtliche Pflichtengefüge zu analysieren. Dazu nähert sich die Dissertation den bestehenden Rechtsunsicherheiten rechtsdogmatisch anhand der bekannten Auslegungskriterien. Im Zentrum steht die Frage, unter welchen Voraussetzungen betriebliche Informationen dem Schutzregime des GeschGehG unterfallen und inwieweit gegenläufige Interessen diesen Schutz einschränken können. Schwerpunkte der Analyse bilden die Schutzfähigkeit rechtswidriger Informationen und die Anforderungen an angemessene Geheimhaltungsmaßnahmen. Hierzu gibt die Arbeit einen dezidierten Überblick über mögliche Geheimhaltungsmaßnahmen im Beschäftigungskontext (insb. arbeitsvertragliche Sicherungsmechanismen, Überwachungsmaßnahmen und Bewerberprüfungen), einschließlich der Frage, inwieweit rechtswidrige Maßnahmen berücksichtigungsfähig sind. Ein besonderer Fokus der Arbeit liegt auf der Schnittstelle zum Hinweisgeberschutz. Die Dissertation zeigt, dass § 6 Abs. 1 HinSchG dem Whistleblower eine Prüfobliegenheit auferlegt, aus der ein Vorrang des internen Meldewegs resultieren kann. Mögliche Anreize zur Nutzung interner Kanäle sind eine interne Meldepflicht sowie die Erhöhung des Identitätsschutzes, wobei die datenschutzrechtlichen Betroffenenrechten stets mitzudenken sind. Die Untersuchung verdeutlicht, dass sich der Identitätsschutz in §§ 8, 9 HinSchG nicht über die datenschutzrechtlichen Betroffenenrechte hinwegsetzen kann. Im Rahmen der Datenauskunft sind Arbeitgeber nur insoweit nach Art. 15 Abs. 4 DS-GVO berechtigt, schutzwürdige Informationen unkenntlich zu machen, wenn dies durch berechtigte Geheimhaltungsinteressen geboten ist. Das Einsichtsrecht des § 83 Abs. 1 S. 1 BetrVG tritt dabei neben das Recht auf Datenauskunft. Abschließend skizziert ein Ausblick Wege zur Erschließung neuen exklusiven Wissens, ehe das Resümee der Arbeit in 25 Thesen die zentralen Ergebnisse prägnant zusammenfasst. Im Ergebnis erweist sich der Schutz von Geschäftsgeheimnissen im Beschäftigungskontext als ein rechtlich komplexes und praktisch konfliktträchtiges Feld, das einen ständigen Balanceakt zwischen Innovationsschutz und Rechtskonformität erfordert. Unbestimmt ist nahezu alles - umstritten Vieles. Umso dringlicher ist der Bedarf an verlässlicher rechtlicher Orientierung. Die vorliegende Dissertation hat sich dem angenommen und konkrete Leitlinien für die Auslegung der einschlägigen Vorschriften herausgebildet, die insbesondere der rechtsanwendenden Praxis eine belastbare Entscheidungsgrundlage bieten soll

    Advancing Computational Quantum Chemistry with Machine Learning

    This thesis focuses on advancing quantum chemistry using machine learning methods. For this purpose, a dataset for the lanthanoid elements is generated, conformer ranking is addressed leveraging novel machine learning architectures and the widely used extended tight-binding model is enhanced with automatic differentiation. The LnQM dataset, a comprehensive benchmark of 17269 mono-lanthanoid complexes optimized at PBE0-D4/def2-SVP level, enables systematic evaluations of quantum chemical and machine learning methods across the lanthanoid series. It features geometric, energetic, molecular and electronic properties at ωB97M-V/def2-SVPD level, granting insights into lanthanoid chemistry and highlighting limitations of current atomic charge models. The ConfRank ansatz improves conformer ranking through pairwise training of state-of-the-art machine learning models. Utilizing the DimeNet++ architecture, the accuracy of relative energy prediction on GMKTN55 conformational subsets is improved by 29% on average. Moreover, a considerable 100-fold computational speed-up compared to the currently used GFN2-xTB method is achieved using GPU infrastructure. The dxTB model, a PyTorch implementation of GFN-xTB, demonstrates a novel integration of quantum chemical algorithms into machine learning frameworks. It allows for differentiation of any input parameters to arbitrary order, achieving similar runtimes as the original Fortran implementation, which in turn lacks automatic differentiation. Moreover, parameter optimization can now be conducted using backpropagation, harnessing the extensive existing machine learning infrastructure, opening up possibilities to investigate new functional forms of internal xTB procedures and to develop individual, problem-specific GFN parametrizations. Together, these contributions chart new directions across different dimensions of computational research, ranging from data science aspects to model development. This thesis conduces to the ongoing advancement of machine learning in the domain of computational quantum chemistry and aims to offer a valuable contribution on the path to improved material sciences, healthcare and beyond

    Anfall und Epilepsie: Morphometrische Kurz- und Langzeitkorrelate im mesialen Temporallappen

    Epilepsie zählt zu den häufigsten chronischen neurologischen Erkrankungen, wobei die mesiale Temporallappenepilepsie (mTLE) die häufigste Form therapieresistenter Anfälle bei Erwachsenen darstellt. Die häufigste histopathologische Ursache ist die Hippocampussklerose (HS), deren Subtypen mit unterschiedlichen chirurgischen Prognosen assoziiert sind. Konventionelle volumetrische Magnetresonanztomographische (MRT)-Analysen stoßen jedoch insbesondere bei MRT-negativer mTLE an ihre diagnostischen Grenzen. Die Studie von Fischbach et al. (2023) untersucht, ob ein neuartiges, differenzialgeometriebasiertes Analyseverfahren eine präzisere morphometrische Beurteilung des Hippocampus ermöglicht. Zentraler methodischer Bestandteil ist ein differenzialgeometrischer Ansatz, der ein individuelles Koordinatensystem des Hippocampuskörpers etabliert und damit eine hochauflösende, subfeldunabhängige Analyse geometrischer Parameter wie Dicke, Krümmung und Fluid Attenuated Inversion Recovery (FLAIR)-Signalintensität entlang konsistenter anatomischer Achsen erlaubt. Für die Studie wurde eine Gruppe von 204 Patienten/Patientinnen mit mTLE und 57 alters- und geschlechtsangepassten gesunde Probanden/Probandinnen analysiert. Die Studie liefert Hinweise darauf, dass MRT-negative mTLE ein eigenständiges Krankheitsbild darstellen könnte und hippocampale Veränderungen nicht nur als Ursache, sondern auch als Folge rezidivierender epileptischer Anfälle interpretiert werden können. Die punktuelle Analyse erweist sich dabei als sinnvolle und diagnostisch gewinnbringende Ergänzung zur klassischen Volumetrie

    Untersuchung des Menopausenalters und anderer fertilitätsreduzierender Faktoren bei 167 Lynch-Syndrom-Patientinnen

    Das Lynch Syndrom ist eines der häufigsten monogen erblichen Tumorsyndrome. Ursächlich sind heterozygote pathogene Keimbahnvarianten in einem der vier DNA-Missmatch-Reparatur-Gene (MLH1, MSH2, MSH6 und PMS2). Für diese Gene, vor allem für MLH1, wurde zudem eine entscheidende Bedeutung während der Meiose beschrieben. In dieser Studie wurde untersucht, ob ein signifikanter Unterschied im Menopausenalter zwischen den 167 gesicherten Lynch-Syndrom-Patientinnen und der Allgemeinbevölkerung besteht und ob diese aufgrund einer möglicherweise gestörten Meiose eine vorzeitige Ovarialinsuffizienz aufweisen. Außerdem wurde überprüft, ob durch die malignen Tumoren und die damit verbundenen Therapien eine geringere fertile Phase für die Familienplanung zur Verfügung steht. Es konnte allerdings kein signifikanter Unterschied zwischen dem Menopausenalter der Lynch-Syndrom-Patientinnen und der Allgemeinbevölkerung festgestellt werden. Auch ein erhöhtes Risiko für eine vorzeitige Ovarialinsuffizienz konnte nicht nachgewiesen werden. Allerdings hatten 35% der Patientinnen unter 45 Jahren bereits prämenopausal ein Carcinom sowie damit verbundene Therapien mit fertilitätsreduzierenden Maßnahmen. Aus diesem Grund könnte die Familienplanung möglicherweise nicht vollumfänglich realisiert werden. Die Lynch-Syndrom-Patientinnen sollten deshalb über das prämenopausale Tumorrisiko sowie die möglichen Auswirkungen auf die Familienplanung informiert werden. Aufgrund des stetig steigenden Alters der Mutter beim ersten Kind wird dieses Thema zunehmend wichtiger

    Investigating the role of genotype, field design and environment in cereal/legume intercropping systems

    Cropping system diversification through annual intercropping, such as cereal/legume, provides a pathway for agricultural production with reduced inputs of fertilizer and pesticides. However, a significant research gap still demands further investigation regarding understanding species/genotypes, field management, and their environmental interactions. However, testing all meaningful combinations (genotype x genotype x environment x management) is impossible and necessitates using agroecosystem models to understand and support intercropping design for improved resource use efficiency and gain an intended advantage. Previous studies on intercrop models have been limited by relatively small datasets, predominantly assessing aboveground plant growth and performance to evaluate the models. These studies often ignored different management strategies, such as cultivar choice and sowing densities. To contribute to the understanding of how genotype × cropping system interactions affect mixture performance and identify the mechanisms underlying the interactions between genotype and cropping system. Furthermore, we calibrated and evaluated a new process-based intercrop model using an extensive experimental dataset to test whether the model is suitable for comparing intercrop management strategies. Additionally, we applied the model with field experiments to explore how the dynamics of crop resources, including radiation, water, and soil nitrogen (N) acquisition and use, drive productivity in intercropping systems across diverse environmental conditions. The results highlight the importance of genotype selection for better cereal/legume intercropping productivity. The tested intercrop model was capable of simulating the absolute mixture (intercrop) effects (AME) for grain yield, above-ground biomass, and topsoil root biomass for both crops. Additionally, the intercrop model reasonably predicted the differences between species and between spring wheat cultivars for grain yield and aboveground plant biomass. This should be of particular interest as such models can also help to interpret experimental results regarding crop growth dynamics and resource acquisition. The assessment of resource acquisition and use efficiency by applying a calibrated and tested intercrop model showed that increased productivity of intercropping systems compared to monocultures was primarily driven by improved resource acquisition, particularly N uptake, and, to some extent, enhanced water use efficiency. However, the degree of these benefits was influenced by environmental conditions. Moreover, the robustly tested process-based model can be helpful in designing and pre-evaluating multiple combinations of partner species, genotypes, and management options suitable for intercropping in diverse environmental conditions

    Three Essays on the Macroeconomic Consequences of Labor Market Risk

    This dissertation consists of three self-contained essays that examine the macroeconomic consequences of labor market risk. The first two chapters focus on heterogeneity in labor market risk and its consequences on life-cycle earnings dynamics, wealth accumulation, and the design of optimal pension systems. Chapter 1 shows that heterogeneity in employment stability and the resulting earnings dynamics are a key driver of household saving behavior and wealth accumulation. In Chapter 2, I show that accounting for heterogeneity in employment stability makes the optimal pension system more progressive relative to the current U.S. system. Chapter 3 investigates how labor market shocks affecting the working-age population spill over to older households through the housing market. In Chapter 1, which is joint work with Moritz Kuhn and Gašper Ploj, we explore how heterogeneity in employment stability shapes earnings dynamics and savings behavior of workers. Such heterogeneity is a salient feature of labor markets where some workers hold stable, lifetime jobs, while others cycle frequently in and out of employment. Despite its prevalence, the economic consequences of this labor market feature remain underexplored. We fill this gap using both empirical analysis and quantitative modeling. We first document two new empirical facts: (1) workers with more stable employment experience faster earnings growth, and (2) they accumulate more wealth per dollar of income. Second, we develop a life-cycle model that combines a labor market search model with an incomplete markets model of saving behavior. We use the model to interpret the empirical facts, to establish a causal link from employment stability to wealth accumulation, and to quantify the drivers of the underlying mechanism. Our results support an important role of labor market heterogeneity to account for differences in wealth accumulation in financial markets. Chapter 2 explores the policy implications of heterogeneity in employment stability. Employment stability has important consequences for individual welfare as interrupted work histories and the consequent earnings losses lower pension entitlements and hinder the accumulation of life-cycle savings. This chapter studies how a progressive pension system can optimally account for such heterogeneity and quantifies the resulting welfare gains. Higher pension progressivity offers insurance against employment instability and helps to reduce lifetime earnings inequality, but comes at the cost of distorting human capital investment and retirement decisions. Using a life-cycle model with heterogeneous employment stability, endogenous human capital accumulation, and retirement decision, I find that abolishing the Social Security cap and increasing progressivity relative to the current U.S. pension system is optimal. The optimal pension system leads to a welfare gain equivalent to 0.75 % of lifetime consumption for new labor market entrants. Following the observed macroeconomic shift in the labor market towards higher employment stability since the 1990s, the optimal pension system becomes less progressive, yet still delivers substantial welfare improvements. Chapter 3 studies the consequences of labor market shocks on the housing market. Unemployment leads to large and persistent income losses for workers. Higher unemployment in the labor market therefore has spillover effects on the housing market. This paper studies such spillover effects from both empirical and theoretical perspectives. Using data from the Current Population Survey (CPS), I show that a 1 percentage point increase in the unemployment rate leads to a 1.55% decline in housing prices. Theoretically, I develop an overlapping generations model with a housing market. The calibrated model replicates the empirically observed spillover effect for the U.S. economy. Higher income uncertainty is the main driver of the spillover effect during periods of high unemployment, rather than the actual income losses. The spillover effect transmits one-third of the welfare losses of workers due to higher unemployment in the labor market to older, retired households by reducing their housing wealth. Younger workers benefit in part by buying houses at depressed prices. The magnitude of the spillover effect is shaped by the demographic structure of the population and the specific age groups affected by unemployment shocks. I find that increasing the generosity of unemployment insurance stabilizes the housing market, although it only partially mitigates the spillover effect

    Assessment of a novel active packaging material to improve the resource efficiency of food production by increasing the safety and shelf life of perishable products

    The objective of this thesis was the assessment of novel active packaging materials containing the polymer poly-[2-(tert-butylamino) methylstyrene] (poly(TBAMS)) for the application in perishable food supply chains. Furthermore, the potential of active packaging materials to increase the safety and shelf life of perishable products and thus to improve the resource efficiency of food production was assessed. The influence of food components, environmental factors, and different processing steps was analysed on the antimicrobial activity of 24 different processed materials containing poly(TBAMS). In total 714 samples containing poly(TBAMS) and 1032 references were investigated. Based on the results, certain kinds of packaging prototypes were produced for storage tests. 883 samples were tested in 15 storage trials with perishable product to assess the effect of poly(TBAMS) on product specific microbial, sensory, quality and chemical parameters. The modelling of the growth of spoilage and pathogenic bacteria, yeasts and moulds and the shelf life determination were conducted by using the modified Gompertz function. Based on all results, a standardized evaluation scheme for the assessment of active packaging materials` ability to increase the safety and shelf life of perishable foods were developed. Further an approach to analyse the cost and benefits by implementation of active packagings were developed. Calculations were exemplified for poly(TBAMS) packagings. Different materials containing poly(TBAMS) showed a high antimicrobial activity against spoilage and pathogenic organisms relevant for perishable products. The food components (especially proteins), temperature, gas atmosphere and the processing of the polymer itself influenced the activity. The activity depended on the availability of functional groups of poly(TBAMS) on the polymeric surface, which increased by increasing the concentration or enlarging the surface. A multilayer foil containing 15 % of poly(TBAMS) in the inner layer increased the microbial safety and shelf life of products with low protein contents, such as R-T-E vegetables, and of processed meat products. Thus, the novel packaging solutions have high potential to reduce food waste by increasing the safety and shelf life of perishable foods. The developed evaluation scheme allows the identification of the application area where an active material delivers the highest benefit during the development phase. The cost–benefit analysis represents a new approach for the calculation of the economic and resource-efficient impact by implementation of different active packaging materials. Both can lead to a reduction of time and costs during developing of antimicrobial packaging materials.Bewertung eines neuartigen aktiven Verpackungsmaterials zur Steigerung der Ressourceneffizienz der Lebensmittelproduktion durch eine Erhöhung der Sicherheit und Haltbarkeit leichtverderblicher Produkte Ziel der Arbeit war die Bewertung neuartiger aktiver Verpackungsmaterialien auf Basis von poly-[2-(tert-butylamino) methylstyrene] (poly(TBAMS)) hinsichtlich der Anwendung in Wertschöpfungskette für leichtverderbliche Lebensmittel. Weiterhin wurde im Rahmen der Arbeit eine standardisierte Vorgehensweise entwickelt, um das Potential von aktiven Verpackungen zur Erhöhung der Sicherheit und Haltbarkeit leicht verderblicher Produkte sowie deren Beitrag zur Verbesserung der Ressourceneffizienz zu bewerten. Für die Bewertung des neuen Polymers wurde der Einfluss von Lebensmittelinhaltsstoffen, Umweltfaktoren und verschiedener Verfahrenstechniken bei der Herstellung der Verpackungsmaterialien auf die antimikrobielle Aktivität analysiert. Insgesamt wurden 714 poly(TBAMS) enthaltende Materialproben und 1032 Referenzen untersucht. Basierend auf den Ergebnissen erfolgte die Herstellung verschiedener Folien und Vliese für die Lagerungstests. 883 Proben wurden in 15 Zeitreihen mit leicht verderblichen Lebensmitteln getestet, um den Effekt von poly(TBAMS) auf produktspezifische Parameter zu bewerten. Die Modellierung des Wachstums verschiedener Bakterien, Hefen und Pilze, und die Ermittl-ung der Haltbarkeitszeiten erfolgte mit der modifizierten Gompertzfunktion. Auf Grundlage aller Analysen wurde ein Prüfschema zur Bewertung aktiver Materialien im Hinblick auf ihre Eignung, die Haltbarkeit leicht verderblicher Lebensmittel zu erhöhen, entwickelt. Zudem wurde eine Vorgehensweise entwickelt, um die Kosten und Nutzen von aktiven Verpackungen für die unterschiedlichen Stufen der Wertschöpfungskette zu berechnen. Verschiedene poly(TBAMS) enthaltende Materialen zeigten eine hohe antimikrobielle Aktivität gegen eine Vielzahl Verderbnis erregende und pathogene Bakterien. Einige Lebensmittelinhaltstoffe (insbesondere Proteine), die Temperaturbedingungen und die Compoundierung des Polymers mit verschiedenen Matrixpolymeren beeinflussten die Wirksamkeit. Die Aktivität des Polymers konnte mit der Erhöhung der Konzentration von poly(TBAMS) oder durch eine größere Polymeroberfläche gesteigert werden. So zeigte eine Mehrschichtfolie mit 15 % poly(TBAMS) in der Innenschicht eine Haltbarkeitsverlängerung bei Fleischprodukten und bei proteinarmen Lebensmitteln, wie zum Verzehr fertiges Gemüse. Das entwickelte Prüfschema sowie die Kosten-Nutzen Analyse ermöglichen es, geeignete Anwendungsgebiete antimikrobieller Polymere schon während der Entwicklungsphase zu identifizieren. Dadurch können die Entwicklungszeiten und -kosten deutlich reduziert werden und durch verlängerte Haltbarkeitszeiten wichtige Ressourcen geschont werden
