Human Rights Violation by Overseas Subsidiary and Private International Law : Analysis of Nevsun Resources Ltd. v. Araya

Araya, a Canadian company which developed a mine in Eritrea through its subsidiaries was sued by Eritrean refugees for human rights abuses such as forced labor, torture, slavery, crimes against humanity, and cruel, inhuman, or degrading treatment. The Supreme Court of Canada did not exclude the corporation’s direct liability under customary international law. Multinational companies based in Japan can also be sued for human rights abuses committed by their subsidiaries. This article focuses on Nevsun Resources Ltd. v. Araya in order to explore the possibility of Japanese courts applying customary international law which imposes civil liability on corporations for human rights abuses. This article also focuses on the possibility of indirectly applying international treaties regarding human rights under the public order clause in private international law.journal articl

An Extended Scheme for Shape Matching with Local Descriptors
application/pdfShape matching with local descriptors is an underlyingscheme in shape analysis. We can visually confirm the matching results andalso assess them for shape classification. Generally, shape matching is im-plemented by determining the correspondence between shapes that are rep-resented by their respective sets of sampled points. Some matching meth-ods have already been proposed; the main difference between them lies intheir choice of matching cost function. This function measures the dissim-ilarity between the local distribution of sampled points around a focusingpoint of one shape and the local distribution of sampled points around areferring point of another shape. A local descriptor is used to describe thedistribution of sampled points around the point of the shape. In this paper,we propose an extended scheme for shape matching that can compensatefor errors in existing local descriptors. It is convenient for local descriptorsto adopt our scheme because it does not require the local descriptors to bemodified. The main idea of our scheme is to consider the correspondenceof neighboring sampled points to a focusing point when determining thecorrespondence of the focusing point. This is useful because it increasesthe chance of finding a suitable correspondence. However, considering thecorrespondence of neighboring points causes a problem regarding compu-tational feasibility, because there is a substantial increase in the numberof possible correspondences that need to be considered in shape match-ing. We solve this problem using a branch-and-bound algorithm, for effi-cient approximation. Using several shape datasets, we demonstrate that ourscheme yields a more suitable matching than the conventional scheme thatdoes not consider the correspondence of neighboring sampled points, eventhough our scheme requires only a small increase in execution time.journal articl
Statistical Dialogue System Considering Non-verbal Emotion Expression
application/pdfTo deal with user’s emotion on rule-based dialogue system, vast number of rules should be prepared because the number of rules are multiplied by the type of emotions. On the other hand, although statistical dialogue system is robust for various inputs, it can deal with only text information. This paper proposes a statistical dialogue system which can deal with user’s emotions by converting them into emojis. The user’s emotion is estimated from tone of the user’s voice and appended to the tail of input sentence as an emoji. Then, emoji in output sentence is considered as the agent’s emotion when the output voice is synthesized. The question-answer pairs including emojis are collected from tweet-reply pairs on Twitter, and the pairs are also used for finetuning. Experimental result revealed that reply utterances by the proposed method were more suitable for user’s emotions than that by no-emoji method.4E2-OS-11b-03
