    Le régime juridique des servitudes mis à l'épreuve par l'art. 15a LAT

Un enjeu majeur est décelé : si le contenu de la servitude foncière est conforme au droit public de l’aménagement du territoire et aux actes de planification qui en découlent au moment de sa constitution, il n’en va pas de même ultérieurement. La deuxième partie débute par une présentation du droit d’application cantonal de l’art. 15a LAT en vue de la levée de servitudes foncières. Une analyse de l’art. 36 Cst., qui prévoit des restrictions à la garantie de la propriété au sens de l’art. 26 Cst., est apportée dans ce contexte. Les servitudes foncières qui nécessitent la mise en oeuvre du droit d’application cantonal de l’art. 15a LAT en vue de leur levée sont ensuite cernées. Les servitudes de restriction des droits à bâtir sont ainsi appréhendées. L’expropriation de telles servitudes est analysée dans le cadre de la planification territoriale, en particulier, à la lumière de l’art. 15, al. 4, let. b et d, LAT selon lequel leur prise en compte n’est plus une question d’opportunité mais de légalité. Un hiatus entre le droit et la pratique est pointé du doigt. La thématique est encore abordée sous le prisme du droit procédural. Un « labyrinthe » de procédures administratives et civiles contraires à l’économie de procédure est mis en évidence. La troisième et dernière partie débute par une recommandation à l’intention de l’autorité de planification de prendre en considération les servitudes de restriction des droits à bâtir pour garantir la disponibilité des terrains au sens des art. 15 al. 4 let. d et 15a LAT. Des propositions de solutions élaborée sur mesure suivent en vue de résoudre un conflit entre une servitude et la réalisation de la densification intérieure. La première est celle d’un accord tripartite scellé par un contrat de planification et un contrat d’extinction de servitude. La deuxième est celle de la conciliation extrajudiciaire ancrée dans la procédure d’autorisation de construire. Une troisième et dernière piste est étudiée. Elle n’est, quant à elle, pas une solution consensuelle, mais s’inscrit dans la procédure judiciaire relative à l’art. 736 al. 2 CC. La servitude de restriction du droit à bâtir devrait être reconnue comme une charge hors de proportion avec l’intérêt à son maintien, dès lors que le fonds grevé fait l’objet d’une obligation de construire. La servitude empêche effectivement une utilisation rationnelle du fonds servant, notion qui est étudiée à la lumière de la jurisprudence du Tribunal fédéral. The first part of the thesis comprises an in-depth discussion of the notion of easements and Art. 15a of the Spatial Planning Act (SPA). It identifies a major issue: while the content of an easement may comply with public law on spatial planning and the ensuing planning applications when it is drafted, this may not necessarily remain the case thereafter. The second part begins with a presentation of cantonal law implementing art. 15a SPA with a view to lifting easements. Art. 36 of the Federal Constitution (FC), which provides for restrictions on the guarantee of ownership under Art. 26 FC, is analysed in this context, and the difficulties involved in expropriating an easement are outlined Land easements that require the application of cantonal implementing legislation of Art. 15a SPA in order to be lifted are then identified. This includes easements restricting building rights. The expropriation of such easements is analysed in the context of spatial planning, in particular in the light of art. 15 para. 4, lit. b and d SPA, according to which their consideration is no longer a question of expediency but of legality. A gap between law and practice is pointed out. The topic is then examined from a procedural law perspective, revealing a highly inefficient « maze » of administrative and civil decision-making. The third and final part begins with a recommendation for planning authorities to take easements that restrict building rights into consideration in order to guarantee the availability of land as required under Art. 15 para. 4 let. d and Art. 15a SPA. Targeted solutions are proposed with a view to resolving the conflict between easements and the implementation of interior development plans. The first of these is a tripartite agreement sealed via a planning contract and a contract extinguishing the easement. The second is out-of-court conciliation based on the procedure for building permits. A third, non-consensual option is also investigated. It is based on the judicial procedure relating to Art. 736 para. 2 of the Swiss Civil Code. The easement restricting building rights must be recognised as an encumbrance disproportionate to the benefit of maintaining it if the encumbered property is subject to an obligation to build. Indeed, such easement effectively prevents the reasonable use of the servient property – this notion is discussed in light of the Federal Supreme Court’s jurisprudence

    Pseudonyme, Humor und Ironie bei Søren Kierkegaard. Die Verfahren der indirekten und der direkt-indirekten Mitteilung

    Les pseudonymes apparaissent de différentes manières dans les œuvres de Kierkegaard. En étudiant l'utilisation variée et imaginative que Kierkegaard fait de ses pseudonymes, on ne peut s'empêcher de sourire. Ce sourire a fait naître l'hypothèse que l'utilisation de pseudonymes par Kierkegaard pourrait être décrite comme un moyen de générer de l'humour et/ou de l'ironie. Lors de l'étude initiale de cette hypothèse, la recherche bibliographique a montré que la communication sous pseudonyme est souvent attribuée à la communication indirecte. Lorsque l'on a analysé de plus près l'engagement de Kierkegaard dans l'écriture sous une plume pseudonyme et la communication indirecte ou la communication éthique de Kierkegaard, on a dû constater que Kierkegaard différenciait encore un autre type de communication. Il s'agit de la communication directe-indirecte ou de la communication éthique-religieuse du savoir-faire. Dans la communication indirecte de Kierkegaard, le rapport à la réalité est donné par le fait que le destinataire sait toujours qui se cache réellement derrière l'auteur pseudonyme. La communication indirecte, par son rapport à la réalité, a toujours déjà pour conséquence un contraste entre la réalité et une possibilité, c'est-à-dire l'ironie. La communication directe-indirecte, en revanche, entraîne généralement son destinataire dans une possibilité crédiblesous un « je » ou un « je » poétique qui n'est pas le vrai "je » de l'auteur. Dans cette mesure, le destinataire d'une communication directe-indirecte est ensuite en mesure de contraster cette possibilité crédibleavec d'autres possibilités, ce qui peut être considéré comme de l'humour au sens de Kierkegaard. L'étude de la communication indirecte et de la communication directe-indirecte permet de conclure que, selon Kierkegaard, il y a quelque chose d'ironique dans la communication indirecte et quelque chose d'humoristique dans la communication directe-indirecte.Pseudonyms appear in Kierkegaard's works in a variety of ways. Anyone who studies Kierkegaard's varied and imaginative use of his pseudonyms is bound to smile. This smirk gave rise to the hypothesis that Kierkegaard's use of pseudonyms could be described as a means of creating humour and/or irony. During the initial exploration of this hypothesis, the literature research revealed that communication under a pseudonym is often attributed to indirect communication. When Kierkegaard's writing under pseudonymous authorship and the indirect communication or the ethical skill communication of Kierkegaard were analysed in more detail, it was found that Kierkegaard differentiated yet another type of communication. We are talking about the direct-indirect communication or the ethical-religious communication of ability. In Kierkegaard's indirect communication, the reference to reality is given by the fact that the recipient always realises who is really behind the pseudonymous author. With its reference to reality, the indirect communication always results in a contrasting of reality with a possibility, i.e. irony. The direct-indirect message, on the other hand, usually seduces its recipient under an ego or poetic ego, which is not the real ego of the author, into a crediblepossibility. In this respect, the recipient of a direct-indirect message is then in a position to contrast this crediblepossibility with other possibilities, which can be understood as humour in Kierkegaard's sense. The study of indirect communication and direct-indirect communication leads to the conclusion that, according to Kierkegaard, there is something ironic about indirect communication and something humorous about direct-indirect communication.Pseudonyme tauchen in Kierkegaards Werken auf unterschiedliche Art und Weise auf. Wer Kierkegaards vielfältigen und phantasievollen Einsatz seiner Pseudonyme studiert, gerät zwangsweise in ein Schmunzeln. Dieses Schmunzeln liess die Hypothese aufkommen, dass die Kierkegaards Verwendung von Pseudonymen als Mittel zur Erzeugung von Humor und/oder Ironie beschrieben werden könnte. Bei der anfänglichen Beschäftigung mit dieser Hypothese, zeigte sich in der Literaturrecherche, dass die Mitteilung unter pseudonymer Verfasserschaft vielfach gerne der indirekten Mitteilung zugeschrieben wird. Als Kierkegaards schriftstellerischer Einsatz unter pseudonymer Verfasserschaft und die indirekte Mitteilung bzw. die ethische Könnens-Mitteilung Kierkegaards genauer analysiert wurde, musste festgestellt werden, dass Kierkegaard noch eine weitere Art der Mitteilung differenzierte. Die Rede ist von der direkt-indirekten Mitteilung bzw. der ethisch-religiösen Könnens-Mitteilung. Der Bezug zur Wirklichkeit wird in Kierkegaards indirekter Mitteilung dadurch gegeben, dass dem Empfänger jeweils klar ist, wer wirklich hinter dem pseudonymen Verfasser steckt. Die indirekte Mitteilung hat mit ihrem Bezug zur Wirklichkeit immer schon eine Kontrastierung der Wirklichkeit mit einer Möglichkeit, also Ironie, zur Folge. Die direkt-indirekte Mitteilung hingegen verführt ihren Empfänger meist unter einem Ich bzw. dichterischem Ich, welches nicht das wirkliche Ich des Verfassers ist, in eine glaubhafte Möglichkeit. Insofern ist der Empfänger einer direkt-indirekten Mitteilung danach in der Lage, diese glaubhafte Möglichkeit mit weiteren Möglichkeiten zu kontrastieren, was im Sinne Kierkegaards als Humor aufgefasst werden kann. Mit dem Studium der indirekten Mitteilung und der direkt-indirekten Mitteilung ergibt sich die Schlussfolgerung, dass gemäss Kierkegaard der indirekten Mitteilung etwas Ironisches und der direkt-indirekten Mitteilung etwas Humoristisches anhaftet

    What Is the Nexus between Migration and Mobility? A Framework to Understand the Interplay between Different Ideal Types of Human Movement

    Categorising certain forms of human movement as ‘migration’ and others as ‘mobility’ has far-reaching consequences. We introduce the migration–mobility nexus as a framework for other researchers to interrogate the relationship between these two categories of human movement and explain how they shape different social representations. Our framework articulates four ideal-typical interplays between categories of migration and categories of mobility: continuum (fluid mobilities transform into more stable forms of migration and vice versa), enablement (migration requires mobility, and mobility can trigger migration), hierarchy (migration and mobility are political categories that legitimise hierarchies of movement) and opposition (migration and mobility are pitted against each other). These interplays reveal the normative underpinnings of different categories, which we argue are too often implicit and unacknowledged
