Ausländerstimmrecht. Über das Verständnis der Zentrumsparteien Die Mitte und FDP in den Kantonen Appenzell Ausserrhoden und Zürich
En Suisse, le droit de vote des étrangers est réglé au niveau cantonal et constitue un sujet de controverse. Dans le canton d'Appenzell Rhodes-Extérieures, les communes peuvent décider si elles souhaitent étendre le droit de vote et d'éligibilité aux étrangers. En outre, dans le cadre de la révision de la Constitution cantonale, celui-ci pourrait être introduit sur l'ensemble du territoire et le droit de vote pourrait également être introduit au niveau cantonal. Dans le canton de Zurich, la première option a été rejetée à plusieurs reprises. Les Rhodes-Extérieures ont souvent voté de manière plus restrictive que le canton de Zurich sur les questions de migration. Le présent travail de master analyse la compréhension de l'extension du droit de vote aux étrangers par Le Centre et le PLR dans les cantons d'Appenzell Rhodes-Extérieures et de Zurich. L'accent est mis sur ces partis du centre, car on leur attribue la fonction d'obtenir la majorité. Pour répondre à la question de recherche, dix interviews d'experts ont été menées avec des représentants des partis cantonaux. Les facteurs individuels et contextuels sont analysés à l'aide de la théorie du choix rationnel ainsi que de la dépendance du chemin et de la commande politique. La perception des problèmes cantonaux ainsi que des objectifs politiques des partis, la compréhension de l'équité et les expériences intracantonales avec le droit de vote des étrangers au niveau communal marquent l'attitude envers le droit de vote des étrangers. Les partis centristes des Rhodes-Extérieures sont nettement plus ouverts au droit de vote des étrangers au niveau communal et cantonal que ceux du canton de Zurich, bien qu'il soit également controversé dans le premier. Cela peut s'expliquer par l'existence d'un droit de vote facultatif des étrangers, les expériences accumulées, la perception des étrangers comme faisant partie de la communauté et, du moins en partie, une autre conception de l'équité. Dans le canton de Zurich, la compréhension d'une démocratie citoyenne est nettement plus présente qu'en Appenzell Rhodes-Extérieures. Cela peut s'expliquer par l'objectif de politique publique des partis du centre de réduire la proportion d'étrangers par le biais de naturalisations, de sorte que les droits et les devoirs soient les mêmes. Dans le canton de Zurich, les inconvénients redoutés pour les Suisses et la perception d'un désavantage l'emporteraient nettement en cas d'introduction. En Appenzell Rhodes-Extérieures, les thèmes étudiés et le droit de vote des étrangers en tant que tel sont associés à moins de préoccupations ou d'inconvénients pour le canton ou la population.Das Ausländerstimmrecht ist in der Schweiz kantonal geregelt und ein umstrittenes Anliegen. Im Kanton Appenzell Ausserrhoden können die Gemeinden entscheiden, ob sie das Stimm- und Wahlrecht auf AusländerInnen ausweiten möchten. Zudem könnte dieses im Rahmen der Revision der Kantonsverfassung flächendeckend und das Stimmrecht auch kantonal eingeführt werden. Im Kanton Zürich wurde Ersteres wiederholt abgelehnt. Die AusserrhoderInnen haben in Migrationsfragen oftmals restriktiver abgestimmt als der Kanton Zürich. Die vorliegende Masterarbeit analysiert das Verständnis der Stimmrechtausweitung auf AusländerInnen von Die Mitte und FDP in den Kantonen Appenzell Ausserrhoden und Zürich. Der Fokus liegt auf diesen Zentrumsparteien, da ihnen die Funktion als Mehrheitsbeschafferinnen zugeschrieben wird. Zur Beantwortung der Forschungsfrage wurden insgesamt zehn Experteninterviews mit RepräsentantInnen der Kantonalparteien durchgeführt. Mittels der Theorie der rationalen Wahl sowie der Pfadabhängigkeit und des Politikerbes werden individuelle und kontextuelle Faktoren untersucht. Die Wahrnehmung kantonaler Problemlagen sowie parteipolitischer Ziele, das Verständnis von Fairness und die innerkantonalen Erfahrungen mit dem kommunalen Ausländerstimmrecht prägen die Haltung gegenüber dem Ausländerstimmrecht. Die Ausserrhoder Zentrumsparteien sind gegenüber dem kommunalen und kantonalen Ausländerstimmrecht deutlich offener als jene des Kantons Zürich, wobei es in Ersterem ebenfalls umstritten ist. Dies kann mit dem bestehenden fakultativen Ausländerstimmrecht, den gesammelten Erfahrungen, der Wahrnehmung der AusländerInnen als Teil der Gemeinschaft und zumindest teilweise einem anderen Verständnis von Fairness begründet werden. Im Kanton Zürich ist das Verständnis einer Bürgerdemokratie deutlich präsenter als in Appenzell Ausserrhoden. Erklären lässt sich dies mit dem staatspolitischen Ziel der Zentrumsparteien der Reduktion des Ausländeranteils mittels Einbürgerungen, so dass gleiche Rechte und Pflichten bestehen. Im Kanton Zürich würden die befürchteten Nachteile für die SchweizerInnen und Wahrnehmung einer Benachteiligung bei einer Einführung deutlich überwiegen. In Appenzell Ausserrhoden werden die untersuchten Themen und das Ausländerstimmrecht als solches mit weniger Bedenken oder Nachteilen für den Kanton oder die Bevölkerung verknüpft.In Switzerland, the right of foreigners to vote is regulated at cantonal level and is a controversial issue. In the canton of Appenzell Outer Rhodes, the municipalities can decide whether they wish to extend voting rights to foreigners. In addition, this could be introduced nationwide as part of the revision of the cantonal constitution and voting rights could also be introduced at cantonal level. In the canton of Zurich, the former was repeatedly rejected. The people of Outer Rhodes have often voted more restrictively on migration issues than the canton of Zurich. This master’s thesis analyzes the understanding of the extension of voting rights to foreigners by The Center (Die Mitte) and the Liberals (FDP) in the cantons of Appenzell Outer Rhodes and Zurich. The focus is on these centrist parties, as they are attributed the function of majority procurers. To answer the research question, a total of ten expert interviews were conducted with representatives of the cantonal parties. Individual and contextual factors were examined using the theory of rational choice, path dependency and political inheritance. The perception of cantonal problems and party-political goals, the understanding of fairness and the experience with communal voting rights for foreigners within the canton shape the attitude towards voting rights for foreigners. The center parties in Outer Rhodes are much more open to communal and cantonal voting rights for foreigners than those in the canton of Zurich, although it is also controversial in the former. This can be explained by the existing optional right to vote for foreigners, the experience gained, the perception of foreigners as part of the community and, at least in part, a different understanding of fairness. In the canton of Zurich, the understanding of civic democracy is much more present than in Appenzell Outer Rhodes. This can be explained by the political goal of the center parties to reduce the proportion of foreigners by means of naturalization, so that equal rights and obligations exist. In the canton of Zurich, the feared disadvantages for Swiss nationals and the perception of a disadvantage would clearly outweigh the disadvantages if naturalization were introduced. In Appenzell Outer Rhodes, the issues examined and the right to vote for foreigners as such are associated with fewer concerns or disadvantages for the canton or the population
L'exploitabilité de l'image vidéo en procédure pénale : "in dubio pro vidéo?" : analyse au regard de la production d'enregistrements vidéo à des fins probatoires

La science juridique semble toutefois éprouver certaines difficultés d’adaptation face aux dernières possibilités offertes par les nouvelles technologies et à ce monde en constante évolution . En somme, ce qui était certain hier ne l’est plus aujourd’hui . Il apparaît ainsi plus difficile pour le législateur de définir les comportements dont il ne veut pas en société.
Cette problématique d’ordre général est renforcée en procédure pénale dans le domaine particulier des preuves illicites récoltées par des personnes privées, dès lors que le législateur a de longue date laissé le soin aux tribunaux de trancher au cas par cas cette épineuse question .
Or, amené à se prononcer quant à l’exploitation de prises de vue effectuées en violation des principes de la protection des données via une dashcam privée, le Tribunal fédéral a procédé en septembre 2019 à un revirement jurisprudentiel en ce qui concerne l’exploitation des preuves illicites récoltées par des particuliers . A cette occasion, les juges fédéraux ont effectivement validé un durcissement des conditions d’admission de tels moyens de preuve en appliquant par analogie le mécanisme de l’art. 141 al. 2 CPP aux particuliers. Dans la foulée, un nombre significatif d’affaires pénales relatives à l’exploitation de preuves vidéo récoltées par des particuliers a été porté jusque devant notre Cour suprême.
La présente contribution vise dès lors à s’interroger quant à l’admission des preuves vidéo au procès pénal. Malgré leur indéniable force probante, l’exploitation de ce type de preuve n’est pas automatique, en particulier lorsqu’il est question d’enregistrements vidéo privés. Pourtant, qu’on le veuille ou non, il n’y a pour ainsi dire plus un événement critique se déroulant dans l’espace public qui ne soit pas filmé, d’une manière ou d’une autre, notamment par des particuliers. Les autorités de poursuite pénale, chargées d’établir le déroulement des faits pour des événements auxquels elles étaient absentes, ont un intérêt évident à exploiter ces images.
L’usage des caméras « réglementées » ne pose que peu de problèmes puisque celles-ci sont utilisées de manière licite et sont en principe exploitables sans restriction au procès pénal.
En ce qui concerne l’usage de dispositifs privés non-conformes à la protection des données , la question de leur exploitation au fond est en revanche particulièrement délicate et sujette à une large interprétation des différents critères jurisprudentiels dédiés.
Nous proposons ici une comparaison du cadre légal dévolu aux autorités pénales et aux particuliers en matière de moyens de preuve de type vidéo et suggérons des propositions d’amélioration, notamment l’adoption d’une règle topique pour régler le sort des preuves illicites récoltées par les particuliers en lieu et place du recours à l’analogie préconisé par le TF
Disrupting the social and time vacuum: A systemic and lifespan perspective on job insecurity
In their lead article, Klug et al. conceptualize job insecurity as a multilevel construct whereby individuals are situated in mesolevel and macrolevel contexts. In our article, we advocate deepening the current conceptual model with two partially intertwined perspectives. First, we suggest adding a systemic perspective at the mesolevel that considers individuals' nestedness in family and relationship systems, thus looking into how individuals' job insecurity affects close others (i.e., [romantic] partners and family members) and how close others affect individuals' experience of and reactions to job insecurity. To illustrate our propositions, we draw on the crossover model and the systemic‐transactional model of stress processes within romantic couples. Second, we suggest adding a lifespan perspective that considers biographic time as a facet of the individual level in addition to historical time on the macrolevel. In doing so, we draw on the notion of path dependence and processes related to social learning. We advocate for future research taking into account the various, intertwined levels on which job insecurity operates to fully understand job insecurity as well as its consequences and remedies
Strategic Linear Contextual Bandits
Motivated by the phenomenon of strategic agents gaming a recommender system to maximize the number of times they are recommended to users, we study a strategic variant of the linear contextual bandit problem, where the arms can strategically misreport privately observed contexts to the learner. We treat the algorithm design problem as one of mechanism design under uncertainty and propose the Optimistic Grim Trigger Mechanism (OptGTM) that incentivizes the agents (i.e., arms) to report their contexts truthfully while simultaneously minimizing regret. We also show that failing to account for the strategic nature of the agents results in linear regret. However, a trade-off between mechanism design and regret minimization appears to be unavoidable. More broadly, this work aims to provide insight into the intersection of online learning and mechanism design
From hunter‐gatherers to food producers: New dental insights into the Nile Valley population history (Late Paleolithic–Neolithic)
AbstractObjectivesThis study presents biological affinities between the last hunter‐fisher‐gatherers and first food‐producing societies from the Nile Valley. We investigate odontometric and dental tissue proportion changes between these populations from the Middle Nile Valley and acknowledge the biological processes behind them.Materials and MethodsDental remains of 329 individuals from Nubia and Central Sudan that date from the Late Pleistocene to the mid‐Holocene are studied. Using 3D imaging techniques, we investigated outer and inner metric aspects of upper central incisors, and first and second upper molars.ResultsLate Paleolithic and Mesolithic foragers display homogeneous crown dimensions, dental tissue proportions, and enamel thickness distribution. This contrasts with Neolithic trends for significant differences from earlier samples on inner and outer aspects. Finally, within the Neolithic sample differences are found between Nubian and Central Sudanese sites.DiscussionSubstantial dental variation appears to have occurred around 6000 bce in the Nile Valley, coinciding with the emergence of food‐producing societies in the region. Archeological and biological records suggest little differences in dietary habits and dental health during this transition. Furthermore, the substantial variations identified here would have happened in an extremely short time, a few centuries at most. This does not support in situ diet‐related adaptation. Rather, we suggest these data are consistent with some level of population discontinuity between the Mesolithic and Neolithic samples considered here. Complex settlement processes could also explain the differences between Nubia and Central Sudan, and with previous results based on nonmetric traits.</jats:sec

Barefoot Academic Teaching: Performing arts as a pedagogical tools in higher education
This book delves into essential, yet often overlooked, aspects of educational and scientific c practices: the involvement of the body in knowledge acquisition and production, the collective nature of creativity, and the potent role of improvisation in all living actions. It is the culmination of a 4-year research endeavour on Performing Arts as a Pedagogical Tool in Higher Education, conducted in collaboration between the School of Engineering at the Ecole Polytechnique Fédérale de Lausanne (EPFL) and the Institute of Psychology and Education at the University of Neuchâtel (UNINE). The authors meticulously describe, analyse, and evaluate two courses – one in engineering and the other in psychology – that employ performing arts practices to enhance students’ learning processes and facilitate boundary crossing from school to out-of-school contexts, as well as between theory and practice. From the diversity of perspectives and forms, inherent in the encounter between vastly different disciplines and cultures, there emerges a compelling plea for an education that integrates art and science within the same scenario
Generative AI-Enabled Conversational Interaction to Support Self-Directed Learning Experiences in Transversal Computational Thinking
As computational thinking (CT) becomes increasingly acknowledged as an important skill in education, self-directed learning (SDL) emerges as a key strategy for developing this capability. The advent of generative AI (GenAI) conversational agents has disrupted the landscape of SDL. However, many questions still arise about several user experience aspects of these agents. This paper focuses on two of these questions: personalization and long-term support. As such, the first part of this study explores the effectiveness of personalizing GenAI through prompt-tuning using a CT-based prompt for solving programming challenges. The second part focuses on identifying the strengths and weaknesses of a GenAI model in a semester-long programming project. Our findings indicate that while prompt-tuning could hinder ease of use and perceived learning assistance, it might lead to higher learning outcomes. Results from a thematic analysis also indicate that GenAI is useful for programming and debugging, but it presents challenges such as over-reliance and diminishing utility over time
Quantitative pathogenicity and host adaptation in a fungal plant pathogen revealed by whole-genome sequencing
Knowledge of genetic determinism and evolutionary dynamics mediating host-pathogen interactions is essential to manage fungal plant diseases. Studies on the genetic architecture of fungal pathogenicity often focus on large-effect effector genes triggering strong, qualitative resistance. It is not clear how this translates to predominately quantitative interactions. Here, we use the Zymoseptoria tritici-wheat model to elucidate the genetic architecture of quantitative pathogenicity and mechanisms mediating host adaptation. With a multi-host genome-wide association study, we identify 19 high-confidence candidate genes associated with quantitative pathogenicity. Analysis of genetic diversity reveals that sequence polymorphism is the main evolutionary process mediating differences in quantitative pathogenicity, a process that is likely facilitated by genetic recombination and transposable element dynamics. Finally, we use functional approaches to confirm the role of an effector-like gene and a methyltransferase in phenotypic variation. This study highlights the complex genetic architecture of quantitative pathogenicity, extensive diversifying selection and plausible mechanisms facilitating pathogen adaptation
