German dissatisfaction compared to Spanish self-satisfaction regarding the regulation of dependency protection as a true Social Security contingency of the 21st century: Regarding the 2023 German Law on Support and Relief for Dependency Care
La regulación de la protección por dependencia, a considerar (como ya sucede en Alemania, a diferencia de lo que padecemos aún en España) como verdadera contingencia de seguridad social del siglo XXI, ha dejado de interesar a un autocomplaciente legislador español, a diferencia de lo que sucede con el inconformista legislador alemán. Este último no deja en el olvido la regulación contenida en su Libro xi del Código de Seguridad Social, procediendo a efectuar retoques continuos de mejora, siempre en el marco diseñado por el artículo 34 de la Carta de los Fundamentales de la Unión Europea (lamentablemente desatendido en España). Últimamente, de manera muy sustancial, por medio de la Ley de Apoyo y alivio para la atención por dependencia de 2023, que busca reforzar ante todo la contributividad del sistema, la protección del cuidador de dependientes y la utilización de los recursos de digitalización.The regulation of dependency protection, which should be considered (as is already the case in Germany, unlike the situation in Spain) a true social security contingency of the 21st century, has ceased to interest a complacent Spanish legislator. This is in contrast to the proactive German legislator, who continuously revises the regulations contained in the Social Code Book XI, always within the framework set by Article 34 of the EU Charter of Fundamental Rights (unfortunately overlooked in Spain). Most recently, significant improvements have been introduced through the 2023 Law on Support and Relief for Dependency Care, which seeks to strengthen the contributory nature of the system, protect caregivers, and utilize digital resources
Migration and Rights: Theory and Ideology
El fenómeno migratorio es una realidad compleja y proteiforme: constituye un “hecho social total”. Inevitablemente, las políticas del Derecho también lo son, pues han de atender a la complejidad de la realidad social sin ser un mero reflejo de ella: políticas de inmigración y de emigración (oscilantes o cíclicas en su variabilidad y desenvolvimiento); migraciones por razones de persecución o por causas principalmente económicas; políticas de integración/inclusión en las diversas vertientes socio-laborales, económicas, culturales, políticas y jurídicas en el enfoque y “lenguaje de los derechos”, lo que nos lleva no sólo a grandes declaraciones ideales y morales de justificación, sino también, y ante todo, a normas internacionales y constitucionales que los garantizan e imponen (y no solo legitiman) deberes de acción positivas de actuación de los poderes públicos internacionales y estatales. Las migraciones constituyen un exponente privilegiado para captar la entidad las transformaciones sociales, culturales e institucionales que se están produciendo en las sociedades fragmentadas del capitalismo tardío en un contexto transnacionalizado.The migratory phenomenon is a complex and proteiform reality: it constitutes a “total social fact”. Inevitably, the policies of the Law are also so, since they have to attend to the complexity of the social reality without being a mere reflection of it: immigration and emigration policies (oscillating or cyclical in their variability and development); migration for reasons of persecution or mainly economic causes; integration/inclusion policies in the various socio-labor, economic, cultural, political and legal aspects in the approach and “language of rights”, which leads us not only to great ideal and moral declarations of justification, but also, and above all, to international and constitutional norms that guarantee them and impose (and not only legitimize) positive duties of action on the part of international and state public authorities. Migrations constitute a privileged exponent to capture the entity of the social, cultural and institutional transformations that are taking place in the fragmented societies of late capitalism in a transnationalized context
Dejudicialization as a necessary strategy to guarantee the sustainability of the brazilian social protection system
Este artículo examina los problemas críticos que enfrenta el sistema de protección social brasileño, con énfasis en la excesiva judicialización de las demandas de la ciudadanía sobre previsión y asistencia sociales. La judicialización, muchas veces resultante de la ineficiencia de la máquina administrativa, genera un ciclo de ineficiencias que compromete la sostenibilidad del sistema de protección social. El análisis destaca la importancia de la desjudicialización como estrategia necesaria para reducir la sobrecarga del Poder Judicial y mejorar la eficiencia de los procesos administrativos. La investigación también enfatiza la necesidad de realizar inversiones significativas en tecnología e inteligencia artificial para modernizar la administración pública y garantizar una resolución de conflictos más eficaz y transparente. Al adoptar métodos alternativos de resolución de conflictos, debemos alinear las regulaciones internas con precedentes calificados y fortalecer la administración pública, así el sistema de protección social brasileño podrá cumplir mejor su papel de promover la igualdad, reducir las desigualdades sociales y proteger los derechos de los ciudadanos sin depender excesivamente del poder judicial. La discusión concluye que, si bien el acceso a la justicia es un derecho fundamental, la desjudicialización sirve como un enfoque complementario para mejorar este derecho, asegurando un sistema más eficiente, equitativo y sostenible.This article examines the critical issues facing the Brazilian social protection system, particularly the excessive judicialization of social security and welfare matters. Judicialization, often resulting from the inefficiency of the administrative machinery, leads to a cycle of inefficiencies that undermine the sustainability of the social protection system. The analysis highlights the importance of dejudicialization as a necessary strategy to reduce the burden on the judiciary and improve the efficiency of administrative processes. The article also emphasizes the need for significant investments in technology and artificial intelligence to modernize public administration and ensure more effective and transparent conflict resolution. By adopting alternative dispute resolution methods, aligning internal regulations with qualified precedents, and strengthening public administration, the Brazilian social protection system can better fulfill its role in promoting equality, reducing social inequalities, and protecting citizens’ rights without over-relying on the judiciary. Stability, labor market, old age and labor training: proposals and lights from the dismissal cause of business needs in Chile, the sustainability of Pensions and the ILO Recommendations
Chile presenta un escenario demográfico cuyas instituciones legales propias del Derecho del Trabajo y la Seguridad Social no han sido capaces de entender ni de comprehender dentro de sus dinámicas tutelares. En efecto, el envejecimiento activo forma parte de una realidad que, dentro de canales laborales, se ve esquiva en el análisis jurídico y, mucho más, en la operatividad del entramado legal vigente. A modo ejemplar, no existen consideraciones desde la perspectiva del trabajador anciano vigente y la inexistencia de limitaciones al libre despido enmascarado por la causal de necesidades de la empresa, sin limitaciones en consideración a la ausencia de capacitación. Tampoco hay revisión de las condiciones estructurales legales desde una visión que contemple las particularidades referentes a la calidad del empleo disponible para el trabajador adulto mayor. Todo, en un marco de febles pensiones y de trabajo en condiciones no decentes. Se emplean dentro de la siguiente investigación los parámetros de la Organización Internacional del Trabajo (OIT) contenidos en su Recomendaciones, en pro del debate y desarrollo de propuestas analíticas y de lege ferenda para Chile.Chile presents a demographic scenario whose legal institutions of Labor Law and Social Security have not been able to understand or comprehend within their protective dynamics. Indeed, active aging is part of a reality that, within labor channels, is elusive in the legal analysis and, much more, in the operability of the current legal framework. As an example, there are no considerations from the perspective of the elderly worker in force and the non-existence of limitations to free dismissal masked by the cause of the company’s needs, without limitations in consideration of the lack of training. There is also no review of the legal structural conditions from a vision that contemplates the particularities regarding the quality of employment available to the older worker. All this, in a framework of weak pensions and work in non-decent conditions. Considerando el Derecho Internacional de la Seguridad Social, el objetivo del presente artículo es examinar las desigualdades existentes entre ciudadanos nacionales y no nacionales en materia de Seguridad Social en los países del bloque iberoamericano que han ratificado la Convención nº 102 de la OIT, en relación con el requisito del tiempo mínimo de residencia para tener derecho a la prestación asistencial no contributiva. Se analizarán los sistemas de los países iberoamericanos que han ratificado la Convención nº 102 de la OIT para verificar la situación descrita anteriormente. Al final, se demostrará que la heterogeneidad de los sistemas nacionales, especialmente en lo que respecta al requisito del tiempo de residencia, tiene el potencial de generar desigualdad, vulnerando el ideal de igualdad entre nacionales y no nacionales, previsto en la Convención nº 102 de la OIT, y generando impactos en el derecho internacional de las migraciones.Considering International Social Security Law, the aim of this article is to examine the existing inequalities between national and non-national citizens concerning Social Security in Ibero-American countries that have ratified ILO Convention No. 102, specifically regarding the minimum residency requirement to qualify for non-contributory social benefits. The article will analyze the systems of Ibero-American countries that have ratified ILO Convention No. 102 to verify the described situation. In the end, it will be demonstrated that the heterogeneity of national systems, especially regarding the residency requirement, has the potential to create inequality, undermining the ideal of equality between nationals and non-nationals as stipulated in ILO Convention No. 102, and impacting international migration law

The digitalization of society has conditioned the functioning and dynamics of the family, changing its way of responding to certain needs and demands. It is possible to appreciate that key aspects such as communication or care have been affected by digital transformation. In this sense, the change experienced in relationships and attention to the needs of the elderly has been especially significant. As a result, we are witnessing new ways of doing and being in the family that complement the traditional transactions and tasks within the family system.La digitalización de la sociedad ha condicionado el funcionamiento y la dinámica de la familia, cambiando su forma de dar respuesta a ciertas necesidades y demandas. Es posible apreciar que, aspectos claves como la comunicación o el cuidado se han visto afectados por la transformación digital. En este sentido, ha sido especialmente significativo el cambio experimentado en las relaciones y la atención a las necesidades de las personas mayores. Basic Income and Social Security: A Crucial Dialogue for the Construction of a New Social Protection System
The so-called Fourth Industrial Revolution is accompanied by a profound change in the labor market. The new technologies bring with them new ways of providing services and new professional activities, but they will also lead to the disappearance of many jobs. All this, added to demographic problems, and changes linked to the climate crisis, will mean an enormous challenge for our Social State and, without a doubt, a new and different effort from the existing reality when its original structure was configured. The Social Security System, as the main instrument of social protection and the main guarantor of our Social State, will have to adapt both its structure and financing, if it wants to fulfill its purposes. In this context, the Universal Basic Income is emerging as an interesting proposal that will be analyzed in this paper.La denominada Cuarta Revolución Industrial viene acompañada de una alteración profunda del mercado laboral. Las nuevas tecnologías traen consigo nuevas formas de prestación de servicios y nuevas actividades profesionales, pero también conllevará la desaparición de numerosos puestos de trabajo. Esto sumado a los problemas demográficos y los cambios vinculados a la crisis climática, supondrá para nuestro Estado Social un enorme reto y, sin duda, un esfuerzo nuevo y diferente a la realidad existente cuando se configuró su estructura original. El Sistema de Seguridad Social, como principal instrumento de protección social, garante de nuestro Estado Social, si quiere cumplir con esa finalidad tendrá que adaptarse. En este contexto, la Renta Básica Universal se perfila como una interesante propuesta que será objeto de análisis en este artículo
The time on temporary lay-off due to the COVID furlough does not count as a contribution for the purposes of new unemployment benefit: Commentary on Supreme Court Ruling 980/2023 of 16 November
La pandemia del COVID-19 originó un enjambre normativo en materia de Derecho del Trabajo y de la Seguridad Social. Los expedientes de regulación de empleo (ERTE) se erigieron como una de las principales medidas para paliar los efectos del estancamiento económico. Se desarrollaron mediante normativa extraordinaria que aún tiene efectos en la actualidad. Para sostener a los trabajadores en ERTE por causas COVID se desplegó la prestación por desempleo. Una cuestión hasta ahora no resuelta es si el periodo en el que los trabajadores percibieron la prestación por desempleo debido a estar sujetos a un ERTE COVID computa como cotizado a efectos de generar futuras prestaciones de desempleo. La STS 980/2023, de 16 de noviembre resuelve esta cuestión en casación entendiendo que no. El tribunal sigue la doctrina del “periodo de ocupación cotizada”. Para que se cause derecho a la prestación por desempleo se debe haber realizado prestación efectiva de trabajo. No cabe equiparar el periodo de suspensión ERTE COVID a efectivamente trabajado, sino a cotizado para otros efectos.The COVID-19 pandemic led to a regulatory quagmire in the field of Employment Law and Social Security. Furloughs were one of the main measures to alleviate the effects of economic stagnation. They were developed through extraordinary regulations that still have effects today. To support workers on furlough due to the COVID pandemic, the unemployment benefit was deployed. A hitherto unresolved question is whether the period in which workers received unemployment benefit due to COVID-related furlough counts as a contribution for future unemployment benefits. Supreme Court Ruling 980/2023 of 16 November resolved this question in cassation on the understanding that it does not. The court followed the legal principle of the “period of qualifying employment”. In order to be entitled to unemployment benefit, the employee must have physically worked. The lay-off period due to COVID-related furlough cannot be compared to a period in which the employee has actually worked, but should be considered as [Social Security] ‘contribution for other purposes’
