The (in)adequacy of the law to new technologies: the example of the Google/Cnil and Facebook cases before the Court of Justice of the European Union
The paper starts with the analysis of the two recent decisions of the Court of Justice of the European Union on the Google/CNIL and Facebook cases, also in the light of the GDPR.The digital revolution is giving one of the greatest transformations to the world since the era of the industrial revolution and is equally aware that we must be ready for the ever-greater penetration of new technologies into our lives. With specific regard to the right to be forgotten, the real problem lies in the fact that personal data become substantially indelible once they have been published online and the only possibility is to think about a possible balance between innovation and the protection of fundamental rights.For this reason, this paper highlights how both the legislator and the Courts do not pay the due attention to the new technologies behind the law, suggesting a technological approach to law as a way to better protect fundamental rights in the digital age
Il diritto “ad essere dimenticati”: l’evoluzione normativo-giurisprudenziale del diritto all’oblio ed i rapporti con il diritto di cronaca in un’ottica costituzionalmente orientata
For long time, the need to fully recognize the right to be forgotten as a fundamental right of the person has been felt, both at national and European level. However, in many cases it’s necessary to make a balance between the over-mentioned right and other equally relevant rights. In this perspective, the identification of the balancing criteria between the “right to be forgotten” and “the right to report” is placed.Da anni è ormai avvertita, tanto in ambito nazionale quanto a livello europeo, l’esigenza di riconoscere pienamente il diritto all’oblio come diritto fondamentale della persona. Spesso, tuttavia, è necessario operare un contemperamento fra quest’ultimo ed altri diritti altrettanto rilevanti. In tale ottica si colloca l’individuazione dei criteri di bilanciamento fra il “diritto ad essere dimenticati” ed il diritto di cronaca. Incompatibilities of the introduction of the new data protection rules applied to the spanish electoral system in the light of STC 76/2019
Data protection is a particularly relevant subject for the protection of fundamental rights such as the privacy of individuals. This right must be especially protected in the field of electoral processes, where Spanish legislation has undergone some changes that are analysed in this article. In this sense, the focus of this paper is on the recent judgement of the Spanish Constitutional Court, which annuls article 58.1 bis LOREG for incompatibility with the constitutional ordination and with certain aspects of European and national legislation on the matter. As a result, this paper tries to contribute to the discussion about this recent judgement as well as to determinate the implications of this constitutional incompatibility in the matter of data protection applied to electoral processes

Patients and Privacy: GDPR compliance for healthcare organizations in the Czech Republic
At first sight, 25 May 2018 brought no revolution to Czech health care regarding data protection. The practice of the providers of health services related to medical records has already been aptly regulated by the Act on Health Services of 2011. Nevertheless, GDPR has caused several dilemmas, most importantly in the area of medical research and particularly biobanks. The paper focuses on selected questions related to GDPR compliance in Czech health care and medical research, outlining the answer to the question of what changed with GDPR and what it means to the relevant subjects
