    The prospects of legal design applied to privacy documents in light of the innovations introduced by the GDPR

    Everyday people, both as individuals and families and as businesses, are forced to interface with contracts, documents and legal procedures often without having the appropriate skills to “navigate” these systems. In many countries, the difficulty of bureaucracy and legal language often puts citizens in difficulty causing a sense of inadequacy towards the legal system but also the feeling of not having full control of their situation. So, some researchers have begun to discuss how the legal system could be rethought in terms of language and tools through the design approach. The discipline that tries to answer this question has been called “Legal Design” and aims to bring the legal world closer to people who have no training or experience in the legal field. In general terms, Legal Design is inspired by the concepts of Design Thinking and User Experience (UX): the intent is to maintain an approach that puts people at the center of the design and delivery of services also in the legal world to make the more intuitive, usable and inclusive user-experience. Not only does a graphic and visual form made more effective in terms of Visual Law help to understand the content of a privacy document, but it can also help the understanding of the related legal process. In essence, the goal is to make citizens more aware with welldesigned rules and procedures in terms of “Legal Design”, also towards the production of documents – just even in the Privacy’s field - that are simple, clear but above all attractive to the recipients

    Facial recognition: a challenge for europe or a threat to human rights?

    This article deals with the issue of the use of facial recognition, mainly in the European Union. Its purpose is to provide a thorough and coherent analysis of its lawfulness in accordance with the European legislation. Even though there is a concrete legal background provided by European Directives and Regulations, many EU member states apply facial recognition without a solid legal basis. Therefore, the article pursues to offer valid answers to data rights issues that arise. For this purpose, the study is divided into three axes. The first chapter provides a wide analysis of the European legislation which governs the use of facial recognition. Into the second chapter, special emphasis is given to the application of this method at national level. A critical approach is attempted with the aim to define the legal basis and illuminate the legal gaps raised. The third chapter gives an alternative approach of the issue since it demonstrates the wide use of facial technology at international level and its different legal regulation. The final conclusions not only reflect the research’s findings but also propose effective safeguards for the lawful application of the facial recognition in order to improve the European digital strategy.

    En el presente asunto una entidad denominada Digital Rights considera que la la Directiva 2006/24 es nula debido a que esta normativa impone a los proveedores de servicios de comunicación telefónica la obligación de conservar los datos de tráfico y localización relativos a las comunicaciones que estas empresas controlan. En este sentido, la Directiva establece como justificación para la conservación de tales datos con fines de prevención, investigación, detección y enjuiciamiento de delitos graves. Se duda por tanto de la legalidad de la medida a través de la cual esos proveedores y en base a las exigencias de las autoridades, deben de conservar los datos durante un determinado periodo de tiempo y pueden acceder a un sinfín de datos personales de gran cantidad de personas

    La fortuna pedagogica del De liberis educandis tra Umanesimo ed età moderna

    The essay discusses, in a pedagogical perspective, the long fortune of the De liberis educandis, starting from the Latin translation by Guarino Veronese, one of the most illustrious exponents of Humanism, the vast and polycentric cultural movement that will leave a long-term mark on the ideas of education and society, as well as on the relationship between teacher and student in the teaching-learning processes, which were renewed thanks to the rediscovery of the Ancients. In particular, some topoi are ana­lyzed, which have been reinterpreted between Humanism and the modern age. Despite the different meanings attributed to them in specific contexts and circumstances, all of these topoi draw inspiration from some passages of the De liberis educandis, a book that over the centuries has become an authoritative text for all those who wanted to write about education.Riassunto: Nel saggio si discute della lunga fortuna del De liberis educandis in prospettiva pedagogica, a partire dalla traduzione latina di Guarino Veronese, uno degli esponenti più illustri dell’Umanesimo, quel vasto, variegato e policentrico movimento culturale che lascerà un segno di lungo periodo nelle idee di educazione e di società, oltre che del rap­porto tra maestro e allievo nei processi d’insegnamento-apprendimento, rinnovati grazie a una riscoperta dell’antico. In particolare poi si analiz­zano alcuni topoi che, tra Umanesimo ed età moderna, sono stati rime­ditati e rivisti con diverse valenze in contesti e circostanze differenti, ma che traggono spunto da passaggi del De liberis educandis divenuto nei secoli uno dei testi autoritativi capaci di avvalorare l’opera di chi voleva scrivere di educazione

    Un fatto sociale totale. L’antica definizione messa a punto un centinaio d’anni fa (1923-24) da Marcel Mauss (2002) a partire dalla ricostruzione delle pratiche di “dono” indica fenomeni della vita sociale che, pur specifici, appaiono tuttavia in relazione con tutti gli altri, rendendo possibile attraverso la loro analisi la lettura complessiva di un’intera società. La definizione è stata evocata da molti studiosi nel dibattito pubblico che ha accompagnato la pandemia da Sars-CoV-2.[...]Un’opportunità per le scienze sociali? Un’opportunità sicuramente ma, a giudicare dai fatti, un’opportunità alquanto disattesa o, almeno, non colta fino in fondo. Malgrado l’evidente peso della componente sociale nella diffusione della pandemia, nelle sue cause e nei suoi effetti, le scienze sociali sono restate ampiamente ai margini nel grande gioco delle scienze cui il virus ha dato vita, marginali nei circuiti della comunicazione mainstream e soprattutto nei processi decisionali di governo della crisi. [...]Il senso – ancora completamente aperto – della frase “andrà tutto bene”, non potrà che dipendere interamente da tali scelte: compito della sociologia è soltanto far «conoscere in modo più ampio l’origine sociale, collettivamente occultata, della disgrazia, in tutte le sue forme, comprese le più intime e segrete», nella piena consapevolezza che «rendere coscienti i meccanismi che rendono la vita dolorosa, persino invivibile, non significa neutralizzarli; portare alla luce le contraddizioni non significa risolverle»; significa semplicemente che «quello che il mondo sociale ha fatto, il mondo sociale, armato di questo sapere, può disfarlo» e «che che ogni politica che non sfrutti pienamente le pur ridotte possibilità d’azione, che la scienza può aiutare a scoprire, può essere considerata colpevole di omissione di soccorso nei confronti di una persona in pericolo» (Bourdieu 2015, p. 854, passim). Mostrare le alternative che il corpo sociale continua spontaneamente a generare a dispetto dei “There Is No Alternative” che il discorso pubblico incessantemente riproduce, opporre al “mondo così com’è” del racconto neoliberale la realtà spesso cruda del “mondo che c’è”, costituisce, in ogni caso, l’unico modo che conosciamo per contrastare le tentazioni di “fine del mondo” che ogni crisi fa puntualmente emergere: la nostra forma di (dolorosa) consapevolezza della irrinunciabile necessità della presenza (De Martino 2002)
