    The massive spread of the Internet, the growing use of social networks and the creation of apps have increased and simplified the activity of unaware profiling of users. The phenomenon becomes much more serious when it affects vulnerable users. The GDPR 679/2016 deals very precisely with the issue of profiling personal data by offering adequate protection in several articles by providing adequate security measures to protect users of new technologies and paying particular attention to vulnerable users

    La proposta pedagogica di Platone tra Repubblica e Leggi

    This paper analyses the role played by paideia in Plato’s philosophy. In particular, it examines whether it is possible to find in Plato not only a theory of education in the widest sense but a more specific pedagogical focus, i.e. a reflection on children and their formation. After describing the historical context of ancient education, we compare and contrast the proposal of the Republic, where the educational process is primarily ad­dressed to the soul, with that of the Laws, in which education is spelled out as introjection of norms and consent building. Discrepancies and affinities thus emerge between the two treatments, as does the constant concern, on Plato’s part, for political stability and social cohesion. This concern is ad­dressed in both cases through a re-articulation of the public-private axis. It is possible to conclude that, although a specific analysis of childhood and its education can sometimes be detected in Plato, the author’s pedagogical interest is always subordinate to the broader aims of political theory. Riassunto: Il contributo esamina il ruolo della paideia nella filosofia platoni­ca, domandandosi in particolare se in quest’ultima si possa rintracciare non soltanto una teoria dell’educazione in senso esteso, ma una vera e propria teoria pedagogica, ovvero una riflessione sull’infanzia e sulla formazione del bambino. Dopo aver tracciato il contesto storico in cui si inserisce la riflessione platonica in materia educativa, si pone a con­fronto la proposta della Repubblica, dove il processo educativo è rivol­to primariamente all’anima, con quella delle Leggi, in cui l’educazione si configura come introiezione di norme e costruzione del consenso. Emergono così discrepanze e affinità tra le due trattazioni, in primis una preoccupazione costante, da parte di Platone, per la stabilità dell’asset­to politico e per la coesione sociale, che passa per una riarticolazione – variamente declinata – dell’asse pubblico-privato. Si conclude che, benché si trovi talvolta una specifica analisi del bambino e della sua formazione, l’interesse pedagogico di Platone è sempre finalizzato al più ampio contesto della teoria politica

    En el presente caso se interpone recurso contra la resolución de la Agencia Estatal de Protección de Datos, que había desestimado previamente un recurso de reposición contra una resolución que impuso una multa de 50.000.000 ptas, a “Servicios Jurídicos Alaveses S.A”por infracción del artículo 7.2 LOPD, conllevando una sanción de carácter grave del artículo 43.4.c LOPD. Los hechos tuvieron lugar cuando D. Javier, director del Viceconsejo de Seguridad del Gobierno Vasco, recibe una publicidad, en su lugar de trabajo, referente a un Hotel que le invitaba a una fiesta. En el sobre se hacía contar: nombre y apellidos, dirección y las siglas del PNV. La propietaria del hotel es la responsable de un fichero denominado “Mailing98MDB” y “Mailing.MDB”, en los mismos aparecen: su nombre, apellidos, cargo, institución, domicilio laboral. El titular de los datos impugna que dicho fichero contenga informaciones como la relativa a su orientación política, cuestión a la que se opone en el recurso el responsable del fichero, y al mismo tiempo propietaria del hotel, ya que considera que son datos notorios y públicos que constan en la guía de comunicación del gobierno vasco

    Get Well Soon’ is a leading pharmaceutical company co-headquartered in Italy and the United Kingdom. Amongst others, ‘Get Well Soon’ focuses on developing smart medical devices many of which can be remotely managed via ad hoc mobile apps. The Head of IT, Davide, is currently developing a new mobile app which links to a smart toothbrush: any data collected via the use of such device is then processed in the backend and shown to users in an intelligible form. Davide has recently completed his mandatory GDPR training. Having learnt that by law privacy shall be baked into any project development lifecycle from the outset, he is now concerned that his new app, as well as any other app developed by his team is not fully compliant with the applicable data protection legislations. As such, he immediately contacts the Global Privacy Team of ‘Get Well Soon’ seeking for advice

    Data processing technologies have become more pervasive than ever in recent years, making EU citizens subject to profiling and automated decisions. This article aims to address the issues related to the widely ranging interpretations of the notion of personal data, and to evaluate the extent to which the existing regulatory framework in the EU provides adequate safeguards to the protection of individuals’ rights and freedoms in the context of both personal and non-personal data processing operations, identifying the key gaps in the current legal framework that the European Commission and other relevant bodies will need to address to adequately protect EU consumers.
