Get PDFThe body plays a central role in training processes. The action and the gesture manifest in the training experience a potential that is often underestimated and that some contexts, such as that of prison, are able to exploit in relevant and meaningful ways on a pedagogical, performative and transformative level. The article, starting from the suggestions opened by the chronophotos of the project carried out in Poggioreale in the perspective of embodied education, tries to thematize from a pedagogical perspective the crucial relationship between the body that forms and the performative body.Riassunto: Il corpo ha un ruolo centrale nei processi formativi. L’azione e il gesto manifestano nell’esperienza formativa una potenzialità che spesso viene sottovalutata e che taluni contesti, come per esempio quello del carcere, riescono a valorizzare in modi rilevanti e significativi sul piano pedagogico, performativo e trasformativo. No full textThe article focuses on the concept of living labour as a subjective expression of labour capacity in today’s platform-based, bio-cognitive capitalism. Unlike Fordist labour force, contemporary living labour is presented as a life force, no longer measurable in temporal units. At the very moment when human life becomes the main source of value being put to labour, the labour theory of value enters a measurement crisis. The consequences of this crisis affect the remuneration processes (the spread of unpaid work), the increase in precariousness – which is increasingly existential – and the form of work as a human activity to the point of making the difference between concrete and abstract labour increasingly indistinguishable. As is discussed, the case of network-value (i.e. the transformation of the use value of individuals’ daily life data into an exchange value highly profitable for platform managers) is the most paradigmatic example of what may be defined as “life subsumption”. Nascono nuovi soggetti, beni, opportunità e problemi, che pongono l’esigenza di nuove discipline e finanche di nuove tecniche normative idonee a regolamentare lo spazio a-territoriale di internet. Rispetto alla concezione tradizionale del mercato, la disciplina degli scambi che avvengono nella E-Agorà sfugge alla sovranità dei legislatori dei singoli stati territoriali e richiede la virtuosa collaborazione dei protagonisti e, in particolare, proprio delle piattaforme digitali, in un’ottica di co-regolazione tra pubblico e privato, agevolata dal ruolo delle Authorities di settore, anche in applicazione del principio di sussidiarietà.Contracts regulation is - like the whole society - revolutionised by the advent of digital platforms. New subjects, goods, opportunities, and problems arise, creating the need for new disciplines and even new regulatory techniques capable of regulating the a-territorial space of the Internet. Compared to the traditional conception of the market, the regulation of the exchanges that take place in the E-Agorà escapes the sovereignty of the legislators of the single territorial states and requires the virtuous collaboration of the protagonists and, in particular, of the digital platforms, in a perspective of coregulation between public and private, facilitated by the role of the sector Authorities, also in the application of the principle of subsidiarity
Circolarità economica e trasparenza del prodotto | Economic circularity and product transparency
Get PDFLa riflessione svolta nell’articolo induce a dover necessariamente conformare la tutela consumeristica agli obiettivi generali dell’economia circolare. A livello ordinamentale si rende necessaria una rivisitazione normativa alla luce della diversa ponderazione di valori che, sovverte il rapporto persona/profitto in nome dell’incremento di possibilità di vita delle generazioni future. Nello stesso senso, l’adeguamento alla logica di sostenibilità del mercato implica un cambiamento nei contenuti del diritto all’informazione garantito al consumatore, che deve orientare le sue scelte in modo sostenibile. In tale ottica, la tutela del consumatore, ben oltre il rapido e aggressivo svolgimento dei meccanismi di consumo, dovrà estendersi nella direzione di privilegiare scelte coerenti in un contesto di mercato equo, sostenibile e solidale. In questo contesto, la trasparenza nell’etichettatura, la configurazione di un nuovo ambito di illiceità connotato dalla violazione della sostenibilità ambientale, costituzionalmente protetta, nonché il rafforzamento delle garanzie di durata dei beni di consumo sono fattori che convergono nel senso dell’instaurazione dell’economia circolare.__________________________________________________________________The reflection carried out in the article leads to the need to necessarily conform consumer protection to the general objectives of the circular economy. At the legal level, a regulatory review is necessary in light of the different weighting of values which subverts the person / profit relationship in the name of increasing the possibility of life for future generations. In the same sense, the adaptation to the logic of market sustainability implies a change in the contents of the right to information guaranteed to the consumer, who must guide his choices in a sustainable way. In this perspective, consumer protection, well beyond the rapid and aggressive development of consumption mechanisms, must extend in the direction of favoring coherent choices in a fair, sustainable and supportive market context. In this context, transparency in labeling, the configuration of a new area of illegality characterized by the violation of environmental sustainability, constitutionally protected, as well as the strengthening of the durability guarantees of consumer goods are factors that converge in the sense of establishing circular economy
Transparency at any cost? Consumer protection in peer-to-peer finance
No full textDigital financial services are arguably complex and puzzling for consumers, but how to make them more transparent for users is an open problem. In peer-to-peer (or collaborative) finance, where consumers directly conclude financial transactions with each other, the opacity of the intermediaries’ practices calls forth transparency regulation as the primary policy response. Accordingly, information obligations play a crucial role in the recently adopted EU 2020/1503 Regulation. More broadly, newer doctrines, positive law, and regulatory undertakings in this or neighbour domains rely on a fine-tuned set of disclosure techniques to overcome the traditional criticism of transparency regulation. Through the normative lens of financial regulation, the article questions the recourse to mandated disclosure – an approach rhetorically dumped but practically iterated – to regulate peer-to-peer finance. After reviewing four emerging paradigms of transparency, identified as economic, procedural, substantial, and design transparency, the work concludes that peer-to-peer transactions pose threats to users that go well beyond the reach of even a well-designed information regulation. Regulators should, instead, opt for more effective regulatory techniques such as conduct rules, product regulation, and guarantee schemes to absorb potential losses

L’attenzione è alle mura esterne dell’Istituto Penitenziario, che guardano e ‘parlano’ alla città. Nasce così l’idea per “La materia dell’Ucciardone”. La materia delle mura perimetrali del carcere dell’Ucciardone di Palermo sono il pretesto dell’artista per la realizzazione di disegni che raccontino un paesaggio immaginato racchiuso dalle mura

No full textThis article considers the social protection scheme for labour insertion – conventionally called welfare-to-work (Workfare) – from the perspective of the neoliberal transformation of the Welfare State. Through a historical approach, it confronts a widespread yet fallacious thesis: that the so-called Workfare represents an anomaly in the idealised history of the Welfare State which has guaranteed, particularly between 1945 and 1973, fair economic growth and equal social citizenship. This depiction can be substantially rethought by mapping the intense international debate on Workfare occurring mostly in the last twenty years (2000-2021). As is argued, the Welfare State has not been a paradise of social rights and equal economic growth, and Workfare is neither an exception nor an anomaly within a uniform history. Instead, workfare is a political rationality which has been strengthened by recent welfare state policies. Keywords:Workfare, Welfare, Active Labour, Market Policies
