Automated Decision Making and right to explanation. The right of access as ex post information.
The data sets, the processes that determine an algorithmic decision, the rationale of a certain automated decision affecting the legal sphere of a natural person should be traceable, transparent, explained; this is also in order to enable the individual affected to challenge the contents of an unfair decision. Instead, they are rarely so: either by choice - for reasons of competition, of protection of know-how - or because of technological limitations: this is the case of those algorithms that appropriately are referred to as 'black-box'; systems whose inferential mechanisms are not (completely) predictable ex ante or which, in any case, do not always make it possible to explain why an automated decision-making model has generated a particular outcome (and what combination of factors contributed to it). Having affirmed the existence of an ethical duty to transparency of the algorithm and explanation of the (individual) decision reached by automated means, this Paper wonders whether there is a corresponding right on the level of positive law - and what are its limits, of legal but also technological nature. Critically drawing on the most important scholarly opinions on the subject, the right to explanation of the automated decision-making is identified, in the context of the GDPR, in the right of access under Article 15 of the Regulation

Prison is not a secret, neither hidden nor unknown. It works as a pivot for a new way to punish: the modern one. Perhaps it is true that we have emerged from Modernity, if convicted, in prison, learn their destiny instead of re-educating themselves. This case is different. After viewing the documentation - the diaries of operators and prisoners as well as their artifacts (poems, writings but also bread pieces and plaster casts) - I tried to re-collect their “adventure”. Following the events and the comments of the protagonists, I have chosen to exercise clinical attention. My interpretation work – imaginative rather than descriptive, yet selective in terms of references, judgments, notes – aims at practicing the attitude of one who looks closely at data to say it. I have tried to let papers talk, according to the style Michel Foucault gives to doctors when they knew how to match words to things without violating bodies. A living body, not dead, is the true protagonist of this narrative.Riassunto: Il carcere non è, non dovrebbe essere, una segreta: nascosto e non saputo. È piuttosto il perno di un nuovo modo di punire; quello moderno. Forse è vero che siamo usciti dalla Modernità, se i detenuti, più che rieducarsi, vi apprendono del loro destino. Diverso il caso in oggetto. Visionata la documentazione – in particolare: i diari degli operatori e di alcuni dei detenuti e gli artefatti: poesie, ma anche forme di pane e calchi in gesso – ho provato a riscostruirne «l’avventura». Seguendo il filo degli avvenimenti e i commenti dei protagonisti, ho inteso esercitare un’attenzione clinica sul materiale. Il mio lavoro interpretativo – immaginativo più che descrittivo, già selettivo per riferimenti, giudizi e note – ha voluto praticare l’atteggiamento di chi si china sul dato per dirlo. Ho provato a far parlare le carte secondo quell’“ascolto loquace” che Michel Foucault attribuisce ai medici quando sapevano far corrispondere le parole alle cose senza violare le profondità di un corpo. Il corpo vivo, non cadavere, è infatti il protagonista di questa narrazione
L’inclusione della disabilità: dinamiche socio-pedagogiche del presente a confronto con alcuni processi storici
The question of inclusion of people with disabilities is increasingly topical and is a specific aspect of our time. This issue has to deal with some long-standing social and cultural issues through which historical societies have dealt with disability. The present social and pedagogical perspectives that deal with disability issues cannot ignore them. The anthropology that inferiorises people with disabilities is so deeply rooted that it is also found in the new definitions of disability and inclusion.Riassunto: Il tema dell’inclusione delle persone con disabilità è sempre più attuale ed è un aspetto specifico del nostro tempo. Tale questione si confronta con alcune questioni sociali e culturali di lunga durata attraverso cui le società storiche hanno affrontato i temi della disabilità. Il presente, nelle prospettive sociali e pedagogiche che affrontano i temi della disabilità, non può ignorarle. L’antropologia che inferiorizza le persone con disabilità è talmente radicata che la si ritrova anche nelle nuove definizioni di disabilità e inclusione

PRATICHE DI SFRUTTAMENTO NEL LAVORO COGNITIVO E RIDEFINIZIONE DELLA MEMORIA COLLETTIVA COME STRATEGIA PER LA COSTRUZIONE DELLA SOGGETTIVITÀ NEOLIBERISTA/EXPLOITATION PRACTICES OF COGNITIVE LABOUR AND THE RE-DEFINITION OF COLLECTIVE MEMORY AS A STRATEGY FOR THE CONSTRUCTION OF THE NEOLIBERAL SUBJECTIVITY
The aim of the paper is to analyses the transformation of work in the era of late-neoliberalism. Specifically, the author focuses on the dynamics of cognitive capitalism and the new types of exploitation in contemporary work by exploring how neoliberal strategy remoulds a form of neoliberal subjectivity also through the construction of a new collective memory. In this regard, the author describes the controversial legacy of 1968. Fifty years later we can assert with certainty that the long-term consequences of the 1968 mobilizations were antithetical to the anti-classist and anti-authoritarian aspirations of its young activists. To make this claim, the author uses two central concepts among social movement scholars: that of collective memory and that of the outcomes of social movements. As is argued, since the 1980s the memory of 1968 has been strongly influenced by the context of neoliberal restructuring. This process has removed the movement’s struggle for social justice and its structuralist elements from collective memory, emphasizing instead its libertarian and individualist aspects; more compatible with a neoliberal development model which supports an atomized view of society devoid of strong institutions. Il regime di responsabilità da cose in custodia tra questioni tradizionali e “responsabilità da algoritmo” | The regime of liability from things in custody between traditional issues and 'algorithm liability’
Di recente, la dottrina si interroga sulla riconduzione delle nuove ipotesi di responsabilità civile per l’intelligenza artificiale nell’alveo di taluni modelli di responsabilità civile extracontrattuale, previsti dal nostro sistema ordinamentale e, nello specifico, se sia applicabile, in determinate fattispecie, l’articolo 2051 c.c., alla luce dei princìpi sviluppatisi in ambito giurisprudenziale. Il contributo evidenzia come la disciplina codicistica della responsabilità da cose in custodia sia tuttora oggetto di interpretazioni giurisprudenziali innovative in riferimento alla natura della responsabilità, di guisa da delineare schemi poliedrici.Recently, doctrine has questioned whether the new cases of civil liability for artificial intelligence can be brought within the scope of certain non-contractual liability models provided for by our legal system and specifically whether, in certain cases, Article 2051 of the Civil Code is applicable, in light of the principles developed in case law. The contribution highlights how the codified regulation of liability for things in custody is still subject to innovative jurisprudential interpretations with reference to the nature of liability, so as to outline polyhedric schemes
La pedagogia penitenziaria: da nera a verde speranza
The article focuses on the penalty of life imprisonment, underlying the significative diversification, with respect to the Italian general punitive system, of the criminal discipline reserved for minors. It critically traces the past, analyses the present, with reference to the most recent decisions of the ECHR and the Italian Constitutional Court, and prefigures a possible future. Life imprisonment takes on the aspect of one of the most important pedagogical issues. The main topic is the goal of re-education set out in the third paragraph of Article 27 of the Italian Constitution. A perpetual punishment that excludes from society for the duration of life can be said to be aimed at re-education when this, if achieved, will be for a life in prison without relations with the social environment? Any punishment without a future is like torture, depriving the person of the meaning of actions during the imprisonment. Acting without hope is acting without perspective and ends up identifying the prisoner with the penitentiary institution, as his only possible existential condition, without any new possibility.Riassunto: L’articolo si sofferma sulla pena detentiva perpetua e sottolinea una incisiva diversificazione, rispetto al sistema punitivo generale, del trattamento penalistico dei minorenni. L’autrice ripercorre criticamente il passato, analizza il presente, con il riferimento alle più recenti decisioni della Corte Edu e della Corte costituzionale italiana, e prefigura un possibile futuro. Il fine pena mai assume l’aspetto di una delle più importanti questioni pedagogiche. Al centro la finalità rieducativa enunciata nell’art. 27 della Costituzione, terzo comma. Una pena perpetua che esclude dalla società per la durata della vita può dirsi finalizzata alla rieducazione quando questa, se conseguita, sarà per una vita in carcere priva di relazioni con l’ambiente sociale? Ogni pena senza futuro è una tortura, priva la persona del significato del suo agire durante il percorso detentivo. L’agire senza speranza è un agire senza prospettiva e finisce con l’identificare il detenuto con l’istituzione penitenziaria, quale unica condizione esistenziale possibile, senza nessuna nuova possibilità
