Publiczne prezentowanie zdjęć martwych płodów jako wybryk zakłócenia spokoju i porządku publicznego bądź wywołania zgorszenia (art. 51 § 1 Kodeksu wykroczeń)
The aim of the article is to demonstrate the possibility and validity of classifying the actions of pro-life activists who display photos of dead human foetuses in public spaces as falling under Article 51 para. 1 of the Code of Petty Offences. For this purpose, linguistic, historical, teleological, comparative and systemic interpretation was used. The article demonstrates that presenting large-format pictures of bloody, sometimes fragmented human foetuses on billboards, in public spaces such as streets, squares and parking lots, disturbs public peace, causes a scandal and may even disturb public order. The conduct of pro-life activists can also be classed as public indecency. In Poland it is not acceptable, nor is it compatible with common custom or the norms of social coexistence, to impose on people in public spaces photographs of bloody, torn apart human corpses. The intentional conduct of pro-life activists with regard to the actions taken is sufficient to hold them accountable. Yet as described in Article 51 para. 1 of the CoPO, the effects do not have to be intentional; it is enough that they envisaged or at least could have predicted that their actions would disturb the peace or public order, or cause a scandal. For the application of Article 51 para. 1 of the CoPO it is also enough that the disturbance of peace or public order or a scandal is caused by at least one individual.Celem artykułu jest wykazanie możliwości i trafności kwalifikowania z art. 51 § 1 Kodeksu wykroczeń zachowań działaczy pro-life rozmieszczających w przestrzeni publicznej zdjęcia martwych ludzkich płodów. W tym celu posłużono się wykładnią językową, historyczną, historyczną celowościową, prawnoporównawczą oraz systemową. Wykazano, że prezentowanie na ulicach, placach, parkingach, billboardach barwnych, nieraz wielkoformatowych zdjęć zakrwawionych (czasem rozczłonkowanych) ludzkich płodów narusza spokój publiczny, wywołuje zgorszenie, a nawet może zakłócać porządek publiczny. Zachowanie działaczy pro-life realizuje również znamię wybryku. We wskazanych przestrzeniach publicznych nie jest w Polsce przyjęte, nie jest zgodne ze zwyczajami i zwykłymi normami ludzkiego współżycia narzucanie odbioru zdjęć zakrwawionych, porozrywanych ludzkich zwłok. Dla pociągnięcia do odpowiedzialności wystarczająca jest umyślność zachowania działaczy pro-life w stosunku do podejmowanych działań. Natomiast opisane w art. 51 § 1 k.w. skutki nie muszą być objęte umyślnością, wystarczy, że osoby te przewidują albo chociaż mogły przewidzieć, że ich akcje zakłócą spokój lub porządek publiczny albo wywołają zgorszenie. Dla zastosowania art. 51 § 1 k.w. wystarczy również stwierdzenie zakłócenia spokoju lub porządku publicznego albo wywołanie zgorszenia po stronie choćby jednej osoby

Nadmierny formalizm procesowy jako naruszenie art. 6 ust. 1 Konwencji o ochronie praw człowieka i podstawowych wolności
All judicial proceedings are inevitably based on the formalized procedures. Procedural provisions pursue many important objectives, such ensuring the effectiveness of proceedings or protecting legal certainty by regulating the competences of procedural bodies and the rights and duties of parties. At the same time, excessive procedural formalism may disproportionately limit the right to court, making access to court illusory. Within the framework of the European Convention on Human Rights, the permissible limits of procedural formalism are set by Article 6(1). The European Court of Human Rights, assessing whether excessive formalism has occurred in a given case, examines whether relevant formal requirements served a legitimate purpose, in particular legal certainty and proper administration of justice, and did not lead to a disproportionate restriction of the right of access to court. This assessment is made on the basis of all relevant circumstances of the case, such as the stage at which the proceedings were terminated, the type of proceedings, the party’s due diligence, the existence of circumstances justifying failure to comply with a formal requirement or the fact that the party was represented by a professional representative. Therefore, not only the content of national provisions is important, but also the manner of their application by courts.All judicial proceedings are inevitably based on the formalized procedures. Zakres podmiotowy ustawy z przeciwdziałaniu praniu pieniędzy w świetle znowelizowanych przepisów
This study is devoted to issues associated with counteracting money laundering. The analysis of the current regulations forms the basis for presenting the changes in the system of money laundering prevention that were introduced by the Act of 1 March 2018 on Counteracting Money Laundering and Terrorist Financing. At the same time, its entry into force is an expression of the implementation of EU obligations related to the need to implement the AML IV and V Directive in the national legal order. This enables both the presentation of applicable regulations and the assessment of the adaptation of Polish provisions to applicable EU regulations. The issue is all the more important because some provisions of the ‘Fifth’ AML Directive have been not transposed into the national Act, despite the deadline expiring on 10 January 2020. This justifies putting forward the appropriate de lege ferenda postulates. At the same time, due to the broad nature of the issue discussed in this study, the arguments made are limited to the subjective scope of the Act of 1 March 2018.Analiza bieżących uregulowań dotyczących przeciwdziałania praniu pieniędzy stanowi podstawę do ukazania zmian, jakie w systemie prewencji przed tym procederem przyniosła ustawa z 1 marca 2018 r. o przeciwdziałaniu praniu pieniędzy oraz finansowaniu terroryzmu. Wejście w życie tej ustawy jest wyrazem realizacji zobowiązań związanych z koniecznością implementacji do krajowego porządku prawnego IV i V dyrektywy Anti-Money Laundering (AML). Celem opracowania jest jednak nie tylko analiza zmian, jakie w systemie przeciwdziałania praniu pieniędzy przyniosła kompleksowa nowelizacja ustawy AML. Jest nim przede wszystkim wskazanie na te z postanowień V dyrektywy UE, które nie doczekały się transponowania do rodzimych przepisów. To natomiast uzasadnia wysunięcie stosownych postulatów de lege ferenda dotyczących propozycji wprowadzenia zmian do ustawy z 1 marca 2018 r. Kwestia ta nabiera zaś szczególnego znaczenia, jeżeli mieć na uwadze to, że termin implementacji V dyrektywy upłynął 10 stycznia 2020 r. Zarazem jednak, z uwagi na obszerny charakter zagadnienia poruszanego w tym opracowaniu, poczynione w nim wywody zostały ograniczone do zakresu podmiotowego
Pandemia COVID-19: wielopłaszczyznowość problemu dostępu do szczepionek i innych produktów leczniczych na tle filozofii prawa własności intelektualnej
The isolation and characterization of the full genetic sequence of the acute respiratory syndrome coronavirus SARS-CoV-2 triggered a global debate on the scope and conditions of access to vaccines and other medicinal products to combat the COVID-19 pandemic. In our opinion, the problem of the availability of a future vaccine for COVID-19 and the subsequent discussion related to it exemplify the theory of hard cases. From this perspective, an essential contribution to this debate is the preservation of homeostasis between the right to protect the interests resulting from intellectual activity and the right to health. When looking for instruments that can help to prevent abuses of intellectual property rights, it is impossible not to refer to the content of the instruments shaping the international system of human rights protection. The spread of the COVID-19 pandemic and the associated need to provide the appropriate medicines to millions of infected people justify the need to recognize the right of access to medicines as a fundamental category of human rights. While states are primarily responsible for implementing this right, they are under an obligation to undertake international cooperation to this end. Responsibility for ensuring access to medicinal products, however, rests not only with national governments, but also with transnational corporations as members of the international community.Wyizolowanie i scharakteryzowanie pełnej sekwencji genetycznej koronawirusa zespołu ostrej niewydolności oddechowej przyczyniło się do zainicjowania ogólnoświatowej debaty na temat zakresu i warunków dostępu do szczepionek i innych produktów leczniczych służących walce z pandemią COVID-19. W naszej ocenie problem dostępności przyszłej szczepionki przeciwko chorobie koronawirusowej i związana z nim dalsza dyskusja stanowią egzemplifikację teorii trudnych przypadków. Z jej perspektywy zasadniczym przyczynkiem do wspomnianej debaty pozostaje zachowanie swoistej homeostazy między prawem do ochrony interesów wynikających z działalności intelektualnej a prawem do ochrony zdrowia. Poszukując instrumentów mogących przysłużyć się zapobieganiu nadużyciom praw własności intelektualnej, nie sposób bowiem nie odwołać się do treści instrumentów kształtujących międzynarodowy system ochrony praw człowieka. Rozprzestrzenienie się pandemii COVID-19 oraz związana z tym potrzeba zapewnienia odpowiednich produktów leczniczych milionom zakażonych sprawiły, że uzasadniona wydaje się teza o potrzebie uznania prawa dostępu do produktów leczniczych za jedną z podstawowych kategorii praw człowieka. Chociaż obowiązek realizacji wspomnianego prawa spoczywa zasadniczo na państwach, mają one obowiązek podjęcia w tym celu współpracy międzynarodowej. Odpowiedzialność w zakresie zapewnienia dostępu do produktów leczniczych spoczywa jednak nie tylko na rządach poszczególnych państw, lecz także na korporacjach transnarodowych jako członkach społeczności międzynarodowej
Politically correct hate speech
In the paper we discuss the reasons behind a specific permissiveness of the Polish judicial authorities with regard to hate speech. Hate speech is criminalized by various provisions of the Polish Criminal Code. But as conducted surveys and statistics show, these regulations do not seem to be used adequately. The acceptance of hate speech does not necessarily result from the fact that we are a less tolerant society, but also to a large extent, from the fact that the scope of what is allowed to be said, especially publicly, is in Poland very broad. Paradoxically, it seems that in this ‘new democracy’ there is more freedom of speech than in Western countries, where political correctness plays a very important role in public and social life. The lack of responsibility that goes with freedom of speech and of boundaries on what might be expressed in public, the scurrilous language used also by high-ranking officials, influence the rules of socially acceptable behaviour. These rules also influence the scope of what is considered criminal behaviour. When tackling the problem of the acceptance of hate speech, it is also very important to remember that legal acts, especially criminal law, might not necessarily be the best way to change the attitudes in a society. Restrictions on freedom of speech might not only have a freezing effect but also be counterproductive – that which it is prohibited to say tends to be said more. The problem is to strike the right balance between those two possible outcomes
Israel’s defence ethos: military service as a turning point
Jewish culture deals a lot with survival stories – most of them became myths, especially since the establishment of the state of Israel. The Jewish ‘survival ethos’ is assimilated in Israel mostly by customs, traditions, and education. Above all, it has been claimed that military service in the Israel Defence Forces (IDF) is the most significant institution that empowers the survival ethos. As a result, it is assumed that those who serve in the IDF are characterized by hatred towards Arabs, and by being extreme nationalists. This claim is examined in the current article, which analyses the level of the sense of security threat among Israelis during the last decade, draws on data on military service and levels of trust in Israeli government institutions, and reveals an essential finding: Israeli’s survival ethos is being eroded among IDF soldiers. This finding, followed by the fact that the leaders of the liberal party in the Israeli parliament are former military generals, indicates that military service in Israel does not empower extreme nationalism; on the contrary, service in the IDF has become a moderating social mechanism.

Sprostowanie orzeczenia w polskim, słowackim i czeskim postępowaniu sądowoadministracyjnym
Judgments (rulings and decisions) issued in administrative court procedures can be affected by minor defects which, while not impacting their legal existence, must nevertheless be remedied. If a judgment contains inaccuracies, clerical and accounting errors, or other obvious mistakes, a corrective measure in the form of a rectification is applied (ex officio or upon application). This procedural institution exists in the Polish administrative court procedure (Article156§ 1 p.p.s.a.) as well as in the Slovak (§ 143 sentence 1 s.s.p.) and the Czech (§ 54(4) sentence 1 s.ř.s.) procedures. Despite the differences, which predominantly concern the effect of the application of this measure, in each of the procedures discussed herein, rectification consists in an exception from the self-binding effect and serves to eliminate the minor defects of a judgment, which is in the interests of both the judiciary and parties to proceedings.Orzeczenia (wyroki i postanowienia) wydawane w postępowaniu sądowoadministracyjnym mogą być dotknięte wadami nieistotnymi, niewpływającymi na ich byt prawnych, ale wymagającymi ich usunięcia. Wystąpienie w orzeczeniu niedokładności, błędów pisarskich albo rachunkowych lub innych oczywistych omyłek otwiera drogę do zastosowania (z urzędu lub na wniosek) środka rektyfikacyjnego w postaci sprostowania. O właściwościach utworu audiowizualnego „jako całości”
One of the controversial issues in copyright law is how an audiovisual work is to be defined and understood. Part of the jurisprudence and doctrine is of the opinion that an audiovisual work constitutes a whole, it is a single work and not a collection of various so-called ‘contribution’ works. The article presents the thesis on maintaining the status quo with regard to contribution works, especially from the perspective of Article 70 para. 2.1 of the Act on Copyright and Related Rights of 4 February 1994.Jednym z kontrowersyjnych zagadnień w prawie autorskim jest pojmowanie utworu audiowizualnego. Część orzecznictwa i doktryny stoi na stanowisku, że utwór audiowizualny stanowi całość, jest jednym utworem, a nie zbiorem różnych utworów tzw. „wkładowych”.
