    SOCIAL MEDIA AND ETHICAL LIMITATIONS TO MALAYSIAN JUDICIARY

    The use of social media is widely accepted as an important tool to spread information easily and quickly. Judges must read and share opinions towards current and latest information using social media. As such, compliance with the adoption and exchange of information through the responsible use of social media for joint discussions is expected from judges and judicial members. The public confidence in the judicial system will diminish if the judges display improper online conduct. Therefore, the objective of this article is to identify the ethical limitation of the judges’ capacity in using social media for the maintenance of judicial integrity. By summarizing and reviewing the existing relevant framework, this article proposes a persistent and reasonable guideline on the use of social media for the judiciary following the growing risks posed by social media. Furthermore, judges and judicial officers might better exercise extreme care while requesting and accepting friend requests, including social media postings to avoid the manifestation of safety. Local judicial ethics advisory opinions are needed to prepare revised guidelines following the changing social media features

    FREEDOM OF INFORMATION IN MALAYSIA: INTERNATIONAL LEGAL INSTRUMENTS AND RESTRICTIONS UNDER NATIONAL LAW

    The acceptance of Freedom of Information (FOI) as a fundamental mechanism for enhancing accountability and transparency in the public sector is widely recognized. Numerous international legal instruments (Conventions) have advocated for the establishment and enforcement of legal frameworks pertaining to the FOI. The FOI legislation serves two essential functions, namely enhancing democratic engagement and mitigating corruption within the public sphere. Despite the acceptability of FOI on the global stage, Malaysia lacks a comprehensive legal framework to address the right to access information, except for Selangor and Penang. Additionally, there are various national legislations that hinder the exercise of FOI. This article’s objective is to examine the use of the FOI concept within the framework of international legal instruments as well as the challenges posed by Malaysian national laws that impose limitations on its implementation. The objective is achieved by employing a doctrinal methodology that incorporates international legal instruments as well as Malaysia’s legislations (Constitution, Acts and Enactments) pertaining to the FOI. The findings show the restrictions under national law make it difficult to implement FOI legal regimes in Malaysia. This paper argues that implementing FOI can only be materialized through a comprehensive review of existing laws and administrative structure reform by adapting universal standards on FOI as stated under international legal instruments. This article serves as guidelines for policymakers intending to address FOI as the anti-corruption mechanism in public sectors. Moreover, recommendations are made for the implementation of FOI into Malaysia’s domestic laws

    THE VALUATION PRACTICE FOR INTELLECTUAL PROPERTY IN MALAYSIA

    Background/Aim- Intellectual Property valuation refers to the valuation of property rights for creations of the mind such as patent, trademark and copyright. The selection of valuation approach for Intellectual Property is often difficult as there is a lack of availability of information for this sector. However, there is inconsistency in the recognition and measurement of Intellectual Property. Moreover, valuation practice is always subject to the appraisers’ subjectivity. Thus, the purpose of this paper is to identify the criteria for the practice in conducting valuation for Intellectual Property. The data collection by using semistructured interview was adopted with the certified Intellectual Property valuers who were experienced in the practice of Intellectual Property valuation and been analysed using thematic data analysis. This paper identified the elements for Intellectual Property valuation as practiced by the Malaysian certifiedIntellectual Property valuers. The findings are beneficial to practitioners in Intellectual Property valuation as well as policy makers in Malaysia Intellectual Property industry

    EXAMINING THE EFFECTS OF GOVERNANCE INDICATORS ON ECONOMIC GROWTH IN NIGERIA: AN ARDL APPROACH

    The effects of certain governance indicators on economic growth in an African country (Nigeria) have been researched in this study. Governance indicators such as institutional quality, and rule of law are analysed to understand their effect and direction on economic growth. The data are from the World Development and Governance Indicators (WDI & WGI) and cover the years 1996 to 2016. Using the autoregressive distributed lag (ARDL) approach to estimate the relationship, we discovered that the coefficient of governance indicators produces mixed results, even though the index of governance has a negative influence on economic growth. Furthermore, uni-directional causality was evident between certain governance indicators and trade openness. Significant policy implications suggested by the findings include the government of this African country should put in more effort into improving the general governance structure toward stability. Hence, this will lead to increased investor confidence in the countries’ economies

    The purpose of the study in this paper is to provide details regarding the initiatives and programs for utilizing the untapped potentials of the users present on different social media sites by training them or guiding them to use their energy in something which will bring good results for them and make them digital influencers. Researchers who are working effectively in this research field are utilizing the qualitative research method. The research data related to it was obtained from Amazon programs, blogs, social media, and e-commerce sites, and it is shared descriptively. The finding from this paper indicates that the creation of programs like this will undoubtedly benefit social media users and improve the way social media is currently used by most people. The way forward to make it possible, multiple hurdles need to be passed for successfully implementing this program. The paper will be limited to the extent to which the motive behind it is clearly described, then describe the possible ways for creating this program and how it will work, and lastly, what effect the initiative will have on the social media users and the e-commerce market.&nbsp

    AGRICULTURAL PROGRAMME AND NATIONAL DEVELOPMENT IN NIGERIA: ASSESSING THE IMPACT OF THE ANCHOR BORROWERS PROGRAMME

    The Anchor Borrower Programme (ABP) was introduced in 2015 by the Federal Government of Nigeria to provide loans for farmers,create jobs, increase agricultural productivity, and create employment to ensure national development. The study employed ordinary least squares regression analysis to examine the program’s impact on national development. The explanatory variables considered include employment in agriculture, food export bill, and food import bill, while the dependent variable is gross domestic product (GDP). The findings revealed that the Food Import Bill, which was 0.2694 (27%) before the program, reduced to 0.0102 (1.02) after the program. Also, the country’s food export bill, which was 0.2884 (28%) before the program, was reduced to (1.7). In contrast, employment in agriculture, which was -0.0534 (-5.3) before the program, further deteriorated to -0.8200 (-82%) after the anchor borrowers’ program. This implies that the anchor borrow program failed to meet the desired expectations. Other findings of the study identified late disbursement of loans to non-farmers, disbursement of funds during off-farming seasons, ineffective loan recovery mechanisms, diversion of loans for non-agricultural purposes, insecurity challenges, and climatic conditions as some of the factors that militate against the efficacy of the program. The paper, therefore, recommends the inclusion of community leaders in identifying agricultural practitioners for loan disbursement and recovery, prompt disbursement of funds, the supply of farm equipment and seedlings rather than cash, and the inclusion of insurance coverage to mitigate the effects of other risks associated with insecurity and climatic trajectories.

    DEMOCRACY, FEDERALISM AND GOVERNANCE IN NIGERIA

    Nigeria became one of the federal societies under the supervision of the British colonial government in 1954. Federalism and democracy ceased when the military government usurped and suspended the Republican Constitution in 1966. The periods of military rule witnessed over-centralization of power at the centre, while the federating states became Lilliputians. The usurpation of jurisdictional competencies and centralization of power made the federating states and local governments default on their socio-economic responsibilities. The paper aims to elucidate the intricate relationship between federalism and democracy in Nigeria, shedding light on the repercussions of their erosion during military rule. Through a comprehensive review of historical events and constitutional changes, this study examined the consequences of over-centralization and jurisdictional encroachments during military governance. The paper revealed that the institutionalization of federalism once embraced without due consideration, led to detrimental adjustments and crises during military rule, significantly impeding socio-economic and political development. The paper concluded that democracy and federalism are twins ‘brothers’ and will remain relevant and last long when Nigerian leaders, particularly elected representatives, undertake constitutional reforms that prioritized power devolution to states and local governments. This adjustment, rooted in justice and fairness, will rejuvenate the symbiotic relationship between democracy and federalism, ensuring lasting relevance

    IMPACT OF SOCIAL POLICY ON CPI IN MALAYSIA BETWEEN 2005-2023

    The social policy that the government in Malaysia implemented had positive influences on the local community and economy in Malaysia as well, which focused on the Consumer Price Index (CPI) and the idea that the trend would change if social policy were made. A study focused on the effect of social policy specified in Malaysia’s education, health, and housing areas on CPI. This study used the quantitative method based on the model of ordinary least squares (OLS), and CPI (Y) was the dependent variable, while government education spending (X1), government health spending (X2), and government housing spending (X3) were the independent variables. According to the results of this research, it seems that there was a positive impact of social policy on the CPI, but no significant social policy that the Malaysian government implemented had a determined power over the CPI. Most country research on the impact of social policy on CPI was also insignificant, based on the previous studies. These findings found that CPI was affected by other factors apart from social policy as well and need to be studied as potential factors in the future, as there was a slight significance. To emphasize this study, ARMA is the best-suggested way to analyse the trend of CPI in Malaysia.

    Online Machine Learning from Non-stationary Data Streams in the Presence of Concept Drift and Class Imbalance: A Systematic Review

    In IoT environment applications generate continuous non-stationary data streams with in-built problems of concept drift and class imbalance which cause classifier performance degradation. The imbalanced data affects the classifier during concept detection and concept adaptation. In general, for concept detection, a separate mechanism is added in parallel with the classifier to detect the concept drift called a drift detector. For concept adaptation, the classifier updates itself or trains a new classifier to replace the older one. In case, the data stream faces a class imbalance issue, the classifier may not properly adapt to the latest concept. In this survey, we study how the existing work addresses the issues of class imbalance and concept drift while learning from nonstationarydata streams. We further highlight the limitation of existing work and challenges caused by other factors of class imbalance alongwith concept drift in data stream classification. Results of our survey found that, out of 1110 studies, by using our inclusion and exclusion criteria, we were able to narrow the pool of articles down to 35 that directly addressed our study objectives. The study found that issues such as multiple concept drift types, dynamic class imbalance ratio, and multi-class imbalance in presence of concept drift are still open for further research. We also observed that, while major research efforts have been dedicated to resolving concept drift and class imbalance, not much attention has been given to with-in-class imbalance, rear examples, and borderline instances when they exist with concept drift in multi-class data. This paper concludes with some suggested future directions

    BRIDGING THE DIVIDE: ADDRESSING SOCIOECONOMIC INEQUALITY IN POST-APARTHEID SOUTH AFRICA WITHIN THE FRAMEWORK OF MILLENNIUM DEVELOPMENT GOALS (2000-2015)

    The practice of the apartheid system in South Africa has been widely condemned for perpetuating enduring socio-economic inequality and for its detrimental impacts on the lives of millions of citizens. While many studies have strongly affirmed this assertion, socio-economic inequality continues to arguably engender a long-lasting struggle among the black and colored communities in post-apartheid South Africa. This places a burden on the country’s successive governments to implement long-term policies that can rectify the plight of the people. Consequently, the adoption of the Millennium Development Goals (MDGs) in 2000 becomes an important reference tool for the African National Congress (ANC)-dominated government, which has initiated and implemented policies to combat inequality in the post-apartheid era. This study examines the roles and measures taken by the ANC government to address racially discriminated economic and social inequality within the framework of the MDGs. Using qualitative research methods, the study explores the background framework of the MDGs and analyzes socio-economic measures implemented by successive ANC governments between 2000 and 2015, focusing on areas such as education, poverty eradication, and healthcare. Primary and secondary sources are utilized to provide insights and support the analysis. The findings reveal that the ANC-dominated government effectively incorporated the frameworks of the MDGs into its formulation and execution of policy measures to eradicatesocial inequality in South Africa. The study concludes that the effective implementation of these measures has yielded considerableprogress, effectively addressing multifaceted issues such as poverty, healthcare, education, and unemployment. This conclusion alignswith the official South African MDG report, which unequivocally highlights the several achievements of MDG targets through policyimplementation from 2000 to 2015.
