    Una breve nota sull’impatto della sentenza Dobbs in Ungheria

    In September 2022, a ministerial decree caused a stir in Hungary. The decree in question was intended to require doctors to have the woman listen to the vital signs of the foetus (or embryo) before signing the medical records required to apply for the termination of the pregnancy. The influence of the Dobbs ruling, published by the US Supreme Court two months earlier, comes inevitably to mind. This short note offers a context to and a reflection on this development in Hungary.Nel settembre 2022, un decreto ministeriale ha suscitato scalpore in Ungheria. Tale decreto impone ai medici di far ascoltare i segni vitali del feto (o embrione) alla donna incinta prima di firmare la cartella clinica necessaria per richiedere l’interruzione della gravidanza. Viene spontaneo pensare ad un’associazione con la sentenza Dobbs, pubblicata dalla Corte suprema statunitense due mesi prima. Questa breve nota offre un contesto ed una riflessione su tali sviluppi in Ungheria

    The essay traces the main stages of constitutional jurisprudence on artificial insemination, taking the science/law dialectic as a perspective point of view. The essay dwells on the vulnus that the rhetorical use of the scientific argument causes to the overall coherence of the legal system and in this perspective analyses the most recent decisions of the constitutional judge on the status of children born of procreative techniques still prohibited in Italy.Il saggio ripercorre le principali tappe della giurisprudenza costituzionale in materia di fecondazione artificiale, assumendo come punto di vista prospettico la dialettica scienza/diritto. Il saggio si sofferma sul vulnus che l’utilizzo retorico dell’argomento scientifico arreca alla complessiva coerenza del sistema giuridico ed in quest’ottica analizza le più recenti decisioni del giudice costituzionale in materia di status dei bambini nati da tecniche procreative ancora vietate in Italia

    The paper puts forward a fundamental question: which rules for ChatGPT? It starts with an examination of the state of the art, which oscillates between the zero rules of the Digital Services Act and the over-regulation of the Proposal for a Regulation on Artificial Intelligence. The Parliament’s amendments to the proposal (May 11th 2023) intervene on some issues: they transform the solitary and quasi-objective accountability of the provider into the chain of accountability between the former and the developer. But grey areas remain in the absence of prior control over the fake information generated by our Chat. The Author concludes by steering the regulatory regime to the goal of combining fundamental freedoms with technical innovation. This work has been developed by Prof. De Minico within the framework of the PNRR MUR Project PE0000013-FAIR.The paper puts forward a fundamental question: which rules for ChatGPT?     A bio-civil code for China: articles 1006–1009 of the new Chinese Civil Code

    Amongst the many achievements of the first Chinese Civil Code, one of the most discussed is the provision of the so-called biorights. This paper focuses on articles 1006 to 1009, which mainly cover the new regulations on bioethics, biorights and new technologies, to show the breakthroughs made by the Chinese Civil Code. Despite the incomplete solutions provided for the referred norms and its blurred content, the code is a most welcome innovation in a country still seeking a bioregulation capable of handling its astonishing scientific achievements. &nbsp

    This paper aims to analyze the end-of-life regulation in the Swiss legal system in order to understand the phenomenon of suicide tourism from Italy to Switzerland. First, the Author focuses on the analysis of the Swiss regulatory sources, both at the federal and cantonal level, and of the supranational and federal case-law. Secondly, the novelties in the Italian panorama are examined. Finally, the Author focuses on the phenomenon that connects the two systems: suicide tourism, that has also spread due to the activity carried out by suicide assistance associations.Il presente contributo intende analizzare la disciplina del fine vita nell’ordinamento elvetico al fine di comprendere il fenomeno del suicide tourism dall’Italia alla Svizzera. In primo luogo, l’Autrice si concentra sull’esame delle fonti normative elvetiche, sia a livello federale sia a livello cantonale, e della giurisprudenza, sia della Corte EDU sia del Tribunale federale. In secondo luogo, si esaminano le novità nel panorama italiano.     The article offers a review of Islamic sources and their interpretations of the main bioethical issues: from abortion, which is treated as a paradigmatic case, to euthanasia, organ transplantation and the donation of breast milk to milk banks. Not only the interpretations of the legal-theological tradition are presented, but also numerous stances of jurists and health organisations of the present time. A clear picture emerges of the underlying principles, trends and discussions on these issues in Islam today.L’articolo offre una rassegna delle fonti islamiche e delle loro interpretazioni delle principali questioni bioetiche: dall\u27aborto, trattato come caso paradigmatico, all\u27eutanasia, al trapianto di organi e alla donazione di latte materno alle banche del latte. Vengono presentate non solo le interpretazioni della tradizione giuridico-teologica, ma anche numerose prese di posizione di giuristi e organizzazioni sanitarie del giorno d\u27oggi.     Considering Rosmini’s political works in comparison with his metaphysical and anthropological essays, and starting from Rosmini\u27s project of a code of law that, in the author’s opinion, can guarantee the fundamental human rights, this article discusses the concept of justice between citizens and outsiders. Its first part is an analysis of Rosmini’s juridical fundaments, which takes into account also some objections historically moved against it.
