Discriminazioni algoritmiche e tutela dei consumatori vulnerabili nell’accesso al credito
No full textConsumer credit carries risks of discrimination against certain categories of customers. This was originally due to people\u27s involvement in evaluating credit applications. As a consequence, since the 80s intermediaries have used automated data processing systems, which are today complemented by AI models. Despite the several advantages, AI entails the risk of discriminatory consumer classification. This paper proposes an analysis of credit-scoring AI systems under the spectrum of Italian and EU legislation to understand whether they provide an adequate level of protection against the risk of algorithmic discrimination, also from a remedial point of view.Il credito al consumo si caratterizza per il rischio di discriminazioni nei confronti di particolari categorie di clienti. Ciò in origine era dovuto all’impiego di persone fisiche nell’attività di verifica prodromica alla concessione del credito. Anche per tale ragione già a partire dagli anni 80’ gli intermediari si sono avvalsi di sistemi automatizzati di elaborazione dati, oggi affiancati da modelli di IA. A fronte dei vantaggi, l’IA comporta rischi di classificazioni discriminatorie dei consumatori. Lo scritto propone un\u27analisi dell’impiego di sistemi di IA nella verifica del merito creditizio dei consumatori, alla luce della legislazione nazionale e sovranazionale, onde comprendere se fornisca un adeguato livello di tutela contro il rischio di discriminazione algoritmica, anche sotto il profilo rimediale

No full textThe under-representation of women, older people and ethnic minorities in clinical trials of drugs and medical devices has the potential to significantly impact the health protection of these clinical populations. Adopting an intersectional perspective, the article first reconstructs the causes of this phenomenon and illustrates its serious consequences, and then proposes the identification of (de iure condito and de iure condendo) legal solutions that could facilitate the circulation of more inclusive trial protocols.La diffusa tendenza alla sottorappresentazione di donne, anziani e minoranze etniche nelle sperimentazioni cliniche di farmaci e dispositivi medici costituisce un fattore capace di incidere fortemente sulla tutela della salute di queste popolazioni cliniche. L’articolo adotta una prospettiva intersezionale e, una volta ricostruite le cause del fenomeno e illustrati i suoi gravi effetti, si propone di individuare alcune soluzioni giuridiche che, de iure condito e de iure condendo, possano favorire la diffusione di protocolli sperimentali maggiormente inclusivi

No full textThe origin and development of Bioethics have gone hand in hand with bioethics committees, so it can be said that our Bioethics is a collegial one, not in terms of its foundation, but in terms of its working methodology. No full textThe paper highlights the theme of legal protection reserved to human dignity in public employment, according to the global spread of digital era, including the A.I. development in decision making process of the public administration. The target is remarking attention on the risks probably occuring to consider the implementation of A.I. in connection with the reduction of human apport to set public functions and services, despite the development of roboethics principles and first legal rules, that seems not yet able to generate a clear order, also referring to the aim to preserve human nature at the base of law principles.Il lavoro pone l’attenzione sul tema della dignità personale e sociale del pubblico dipendente nell’evolversi del modello “datoriale” di pubblica amministrazione robotizzata. La prospettiva, pertanto, non è quella dei rapporti tra pubblica amministrazione e terzi, rispetto alle decisioni amministrative automatizzate o, comunque, influenzate dall’A.I., ma e’ quella della dimensione organizzativa interna e della sua difficoltà di contemperare diritto, etica, cultura con lo sviluppo dell’intelligenza artificiale, il cui profilo di interesse non si esaurisce nella esigenza di preservazione della dignità del dipendente pubblico, ma anche della stessa natura umana sottostante i principi di ogni stato di diritto

The issue concluded almost a decade of collaborations and meetings that had opened the Italian scene to the European artistic and literary avant-gardes. After a reconstruction of the way in which Italian media reported on the events following the launch of the Sputnik, the paper places the authors and articles in the context of Cold War anxieties. Get PDFFrom the immediate postwar period to the mid-1960s, the kitchen environment represents a social and cultural topos in Italy; as such it is influenced by gender stereotypes and embodies reflections and research developed by contemporaneous architects and by the renewed, or new, furniture industry. In a landscape tinged with the adhesion to or re-elaboration of the models offered by the European rationalist kitchen or the United States typologies, select women architects and interior designers experiment with different approaches, which hint at a different spatial and existential concept of the kitchen. No full textThe article, structured in intercon-nected notes, aims to offer an initial overview of what we have called "literature of detachment". This is a literary tendency, increasingly defined and widespread in Italy, consisting of memoirs focused on the story of a loss and the mourning that follows it. This tendency, which is developing in an era strongly influenced by the imagery of death and the victim paradigm, should be included in the vast sphere of life narratives, even though it retains its own characteristics, both formal and thematic. This contribution attempts to investigate these both levels through the analysis of a few representative samples. What emerges from this analysis is the strong metaliterary vocation of these texts, the critical reading of which can offer a new insight into the way the literary word is conceived in Italy today.L’articolo, strutturato in note tra loro collegate, vuole offrire una prima panoramica su quella che abbiamo voluto chiamare letteratura del distacco. Si tratta di un filone letterario, sempre più definito e sempre più diffuso in Italia, composto di testi memoriali incentrati sul racconto di una perdita e del lutto conseguente ad essa. Tale filone, che si sviluppa in un’epoca fortemente influenzata dall’immaginario della morte e dal paradigma vittimario-testimonale, va ricondotto al vasto alveo delle life narratives, sebbene conservi delle caratteristiche affatto proprie, a livello formale e tematico. Il contributo cerca di indagare entrambi i livelli attraverso l’analisi di alcuni campioni reputati rappresentativi. Ciò che emerge da questa analisi è la forte vocazione metaletteraria di questi testi, la cui lettura critica può offrire un nuovo sguardo sul modo di concepire la parola letteraria oggi in Italia
