    The principle purpose of the thesis is to inquire into the interference between the law of contract and fundamental rights, dealing with those cases of admixture between personhood and business relationships that U.S. legal doctrine usually means by the label of “commodification”. The purpose is to apply the results of this research to those typical situations of interference between market logic and requirements of personal protection, such as (but not only) the right of publicity and general situations of commercial exploitation of personhood. In our legal system, such as in others, the legal doctrine has usually discussed these phenomena sometimes looking at them in a dualistic perspective: on one hand the right of personhood, on the other side the property right on the economic object, built in the form of copyright. This dualistic conception did not lead to satisfactory solutions on both fields: of damages and special rules for the consensus. For both, the dualistic perspective has often failed to analyze problems in a dynamic dimension: the dimension of the conflict between the holder's identity, changing over time, and the binding nature of contract. Starting from the conflict between the holder's identity, changing over time, and the binding nature of contract, the scope of inquiry being extended by encompassing the point of view of Legal Pluralism, especially with reference to scientific computing offered by the socio-legal German doctrine (Ehrlich, Luhman, Teubner etc.). The perspective of “interlegality” linked with personal identity could be an effective key concept in view of recognizing and understanding identity-choices: in other words, choices that are incomprehensible under the label of pure consumption choice (market choice and economic efficiency principle). Such a dynamic perspective involves the overcoming of the classical conception of fundamental right and private choice, understood as the consumption choice: a measure of autonomy based on rationality of efficiency, made out of time and by an absolutely selfish person

    Tourism, as the force through which places are experienced, can be qualified as a means of intervening in reality, offering an interpretation to places by giving them shape (Medina Lasansky, D., McLaren, B., 2004). The ability of tourism to organize territories and cities is our starting point and the tool through which we will attempt to comprehend and interpret the phenomenon, on the basis of its expansion and recent changes.\ud Changes in tourism, described by recent theories, represent a common ground which has given rise to a series of new questions in many disciplines and also represents the framework in which our research will be carried out. Our study provides a close-up and crosssectional look inside this change, as our objective is to understand spatial consequences whilst considering the interdisciplinary junction where the phenomenon is inevitably revealed.\ud The dissolution of precise spatial, temporal, functional and semantic scans of industrial cities and tourist areas, proposed by leisure studies, sociology and anthropology, has exposed the limits of tourism as an industry for leisure and entertainment (see for example Savelli, A., 2004). According to a trend observed in recent decades, tourism, cultural activities and leisure have become vehicles for the economic development and improvement\ud of the image of cities, increasing the livability of areas for both tourists and locals.\ud In this complex scenario, the tourism industry seems to adopt varying strategies; it proposes the construction of new artificial attractions, makes creative offers in sectors which are no longer limited to traditional areas and adopts arguments which were once considered unrelated to the phenomenon (Ninot, R., P., Vilanova Claret, J. M., 2011).\ud The object of the study therefore includes constructions and products in the tourism industry, as well as those processes that are halfway between original locations and new destinations, for example projects which redefine the identity of post-industrial territories as touristic and cultural, the creative experience and events promotion, in an attempt to create a common dimension for both locals and tourists.\ud The geographical context is not predetermined by a single and main reality, but rather concerns a debate and international plan, even if it is Europe which offers the largest source of information, research and experience. The reason for this is that such geographical regions constitute primary destinations in terms of tourist arrivals, in particular from within the country itself, and are considered mature destinations. They are a laboratory\ud of complex phenomena, whether already consolidated or still in its experimental stages.\ud A conscious effort was made to detach our research from so called ethnic tourism, so as not to run the risk of delving into an anthropological study of cultures affected by the phenomenon and in order to avoid the danger that tourism will continue to be interpreted in a negative way. In effect this is not a study on cities and territories affected by tourism. We are nonetheless aware of new entries into the tourism market by many Asian and African\ud countries, which for too long have been neglected by international tourist flows and which represent a new fountain of active tourism and new tourist destinations.\ud Both developed and emerging countries, in varying roles and at different times, are now placing tourism at the center of the debate on the development and transformation of territories.\ud Objectives\ud Given our belief that tourism, society and the construction of space share a close relationship, our study provides an insight into the primary methods of the spatialisation of tourism, taking note of settlement logic and primary planning tools.\ud Furthermore, by reflecting on the evolution of the concept of tourism from the perspective of intensification and progress, considering tourism as a tool for development and urban regeneration, our work proposes a reinterpretation of its spatial application.\ud The progress of tourism has reached a level of consistency forcing us to consider its new spatial significance, demonstrating the coexistence of elements and logics which previously belonged to different spheres. The dichotomy between industrial cities and tourism spaces is subsequently being overcome, in much the same way as the boundaries between the city and the countryside were dissolved in the 20th century (Ninot, R. P., Vilanova\ud Claret, J. M., 2011).\ud The core of this new orientation has led to a new concept of tourism which aims to identify possible tourism spaces and cities, associated with the notion of overcoming the idea of tourism as the mere flow of people towards a destination, thereby achieving a complex and multidimensional space.\ud Interest in this new approach to tourism can be translated into project outcomes and is determined by the desire to challenge the traditional concept of tourism as the consumption of products and false representations adapted to mass tourism, rather creating a model in which people and places interact together with tourists.\ud By analyzing the process by which tourism transformation methods are defined, our study leads to the formation of an opinion about the architectural features of spaces, without\ud focusing on the results of the languages used. We are not seeking an exhaustive or complete view of the current situation, but rather the definition of a possible framework and the foreshadowing of its potential.\ud We consider the results of our research to be a starting point and at the same time a contribution to the analysis of the relationship between tourism and the construction of its spaces.\ud Division in chapters\ud The research is theoretical-analytical and is aimed towards providing an understanding of the evolutionary relationship between tourism and the organization of spaces. The study\ud has been divided into a foreword, three main chapters.\ud In the foreword we describe the point of departure. Since the 80s, critical planning production pertaining to the postmodern theory has focused its attention on tourism theories (see D., Mac Cannell, J., Urry, Savelli, a., Simonicca, A.). The clear divide between the vision of tourism as specialized in time and place and the progress of a widespread and usable reality, has created the need for an explanation of the process involved in the design of tourism spaces, without prejudice.\ud Drawing from leisure studies, cultural studies and anthropology, we have determined the perspective from which to view the phenomenon. The interpretational tools that have\ud emerged have proven to be appropriate and useful in order to comprehend the construction of tourism spaces.\ud In the first chapter we therefore provide a reference framework for the relationship between tourism, architecture and the construction of spaces.\ud Using an iconographic tool illustrated across a timeline, we have presented the physical data of architectural designs in relation to the phenomenon. Three reading keys have been selected as a lens through which to deal with and understand the spatialisation of tourism, procedures for the construction of sites, primary settlements and planning tools associated with tourism.\ud The three themes represent the planning processes at the foundation of tourism spaces, represented over a course of time according to the events and transformations that have\ud affected the world over the last two centuries and according to cultural, leisure and anthropology studies concerning mankind and behavior in relation to space.\ud The first theme views tourism as a genuine form of leisure, therefore capable of creating the need for new types of spaces facilitating the achievement of such an experience.\ud The second theme examines theories of gaze as a cultural and technological transformation process, whereby the use of a visual image connects a tangible resource (a tourist\ud attraction) to its subsequent mediation, conversion and appreciation. This change, expressed in the relationship between touristicity and touristification and conveyed by tools such as maps, images and tourist guides, intersects with the planning of spaces, revealing possibilities to invent new ways of looking, mapping, and building tourism landscapes.\ud The third theme examines the meeting, or rather the complex anthropic dimension between people, between people and places and between tourists and locals. The meeting is a space for interaction, a scenario of presence amongst people that can be influenced, denied by the organization and materiality of a site. The elaboration of the background is defined through an interdisciplinary analysis based on theories of leisure, gaze and the meeting paradigm, making reference to principal debates on tourism space and architectural projects. The picture which emerges, where images, landscapes, sites, fragments of\ud cities, itineraries, monuments and debates coexist, invites us to grasp the overall significance of tourism spaces in terms of their relationship with their constructed environment, their mediation and design.\ud This chapter does not seek to reconstruct the history of tourist settlements, but rather demonstrate the ways in which the principles of spatial organization can be identified in tourism, which has been structured and modified over time to become one of the major agents of the transformation of territories and cities.\ud In the second chapter, the question of how tourism organizes spaces is analyzed through a reflection on the intensification of tourism in post-industrial cities. What kind of spaces are produced today? Whilst in the 60s projects for cities of leisure and entertainment were largely opposed in favor of everyday life (Ninot, R.P., Vilanova Claret, J.M., 2011), today a strong alliance exists between tourism and the transformation of cities,\ud with tourism now viewed as a valuable tool for development and improvement. This trend has revealed that leisure is becoming increasingly associated with everyday activities;\ud resources, now greater and more attractive, are becoming more creative and not necessarily tied to the environmental and historical heritage of countries, but rather are immaterial and intangible; the spaces that tourists are looking for are becoming increasingly alternative and are in contrast with enclave-like forms. Faced with these last requirements, the contrast between architecture for tourism and the production of new spaces reopens the door to possible architectural designs with respect to the organizing principles analyzed in the first chapter. We are able to confirm that the design approach for tourism experiences, forming the basis on which the challenge for tourism spaces is played out, will need to provide a response to the following question: which solutions exist for the creation of spaces FOR tourists, and which exist for the creation of spaces WITH tourists?\ud The concept of creating a space FOR or WITH tourists, marks the passage from the interpretation of tourism as an industrial sector which produces specialised spaces, to its interpretation as a creative process which transforms territories and understands the dimensions of meetings between people and places, the creative experience and movement paradigms, measuring the possible translation of space and design.\ud The third chapter is a narrative project of the well-defined framework which emerges from the first two chapters. It constitutes a reflection on tourism spaces and recounts the emblematic characters of which the contemporary world of tourism is composed.\ud Each space expresses an extreme character, conceived with respect to the three planning tools which emerged from the first chapter, therefore based on settlement methods\ud associated with leisure, the relationship between touristicity and touristification and between\ud tourists and locals, with the inclusion of recent developments described in the second chapter.\ud The chosen spaces, which highlight differences and emphasise a character of their own, represent an archetypal idea of space. Their narration implicitly poses the question of design.\ud The assessment, performed during an internship in the Department of Leisure Studies at the University of Tilburg with Prof. Greg Richards, is the result of an analysis performed together with a tourism expert, through the selection and examination of real tourism spaces in the Netherlands which are alongside extreme spaces.\ud From this perspective it is possible to draw the first conclusions, making an attempt to separate and propose two meanings of construction in tourism spaces; creating a space\ud FOR tourists and creating a space WITH tourists.\ud The conclusions look to the future; creating a space WITH tourists represents a spatial and planning conception of tourism today, based on which architecture needs to reflect in order to interpret and introduce the question of tourism and leisure into contemporary cities

    La contrarietà percettiva nell'esperienza spaziale di soggetti ciechi congeniti.

    Il punto di partenza sperimentale di questo lavoro è costituito dalla studio fenomenologico-sperimentale della relazione di contrarietà nell’esperienza diretta di spazio di soggetti adulti normodotati (Savardi, U. & Bianchi, I. 2000).\ud In quello studio era emerso che 74 sono le proprietà spaziali di base e che esse individuano 37 dimensioni bipolari (strutture/organizzazioni polarizzate e graduate). Queste evidenze hanno portato a suggerire i) che la percezione dello spazio di un soggetto normodotato si organizzi secondo strutture di contrarietà e ii) che la contrarietà sia una relazione saliente nell’organizzazione ecologica dello spazio fenomenico. Questo secondo aspetto è stato successivamente approfondito e meglio chiarito in lavori sperimentali di fenomenologia della percezione (Savardi & Bianchi, 2009) e di psicofisica fenomenologica (Bianchi, Savardi, Kubovy, 2010; Burro, 2009).\ud La ricerca che è l’oggetto di questa tesi si è proposta di confrontare la descrizione delle dimensioni spaziali fornita dai partecipanti normodotati con la descrizione delle medesime dimensioni spaziali fornita da ciechi congeniti (ossia da partecipanti che non hanno mai avuto accesso a informazioni visive di spazio). In particolare si è inteso chiarire se: \ud 1) la struttura contraria dello spazio sia legata all'esperienza percettiva visiva o sia intermodalmente esperita. Se la struttura contraria dello spazio emersa con i soggetti normodotati è fortemente dipendente dalla vista, i ciechi congeniti non dovrebbero esperire/condividere la maggior parte delle qualità contrarie spaziali individuate dai vedenti.\ud Se invece è un’esperienza intermodale embodied (cioè legata all’esperienza dello schema corporeo e della corporeità del percettore), allora i ciechi congeniti dovrebbero poter esperire la maggior parte delle qualità spaziali contrarie descritte dai vedenti come dimensioni di base dell’esperienza fenomenica di spazio;\ud 2) la descrizione metrica e topologica delle dimensioni contrarie subisca variazioni in relazione alle due diverse modalità di esperienza spaziale: visiva e centrata sia allocentricamente che egocentricamente quella dei vedenti; tattile e centrata egocentricamente la seconda.\ud La condivisione percettiva delle coppie di contrari, la struttura metrica e topologica delle tre componenti della dimensione (Polo A, Intermedio e Polo B), l’importanza di ciascuna dimensione e di ciascun polo nell’esperienza fenomenica di spazio dei ciechi congeniti, costituiscono le variabili analizzate nella ricerca. Il metodo utilizzato per raccogliere i dati è stato il risultato di una mediazione fra quello utilizzato con i normodotati e le specifiche esigenze e competenze dei partecipanti ciechi congeniti.\ud I partecipanti sono 10 ciechi congeniti: 6 maschi e 4 femmine di età compresa fra i 26 e i 64 anni (con una età media di 36,3 anni). Dopo una fase pilota condotta con due partecipanti cieche congenite che ha consentito di ottimizzare il questionario e di circoscrivere a 29 le dimensioni spaziali, si è passati alla fase sperimentale che è stata di 37 incontri individuali della durata media di 70 minuti ciascuno. Gli incontri sono stati audioregistrati interamente previa autorizzazione del partecipante. \ud I dati raccolti sono sia discorsivi (consistenti in interazioni verbali estese ed articolate - sono dati relativi alla contestualizzazione della dimensione e al tipo di canale sensoriale e di strategia esplorativa utilizzata per esperirla), sia quantitativi o categoriali (emersi dai campi dell’intervista strutturata che ha inteso indagare la condivisione e l’importanza delle dimensioni, la struttura metrica e topologica delle dimensioni e l’anisotropia dei poli). \ud I risultati hanno rilevato una sostanziale condivisione delle dimensioni bipolari che caratterizzano l’esperienza spaziale dei ciechi congeniti e dei vedenti e la centralità delle dimensioni legate alla posizione dello spazio (in particolare all’asse coronale, sagittale, gravitazionale, a cui corrispondono rispettivamente destra-sinistra, davanti-dietro, sopra-sotto) che sono risultate più importanti delle dimensioni della classe estensione e della classe forma. A fronte di una sostanziale condivisione delle dimensioni contrarie che articolano l’esperienza percettiva di spazio di vedenti e ciechi congeniti, le analisi metriche e topologiche della struttura delle dimensioni hanno messo in rilievo alcune discordanze con la struttura delle stesse dimensioni nei normodotati: una fra tutte la frequente assenza della componente di intermedietà che caratterizza invece molte delle dimensioni spaziali per i vedenti, disegnando quindi uno spazio ancor più polarizzato di quello dei vedenti.\ud I risultati discussi, pur emersi da uno studio che ha utilizzato metodi e approcci diversi da quelli della letteratura esistente, confermano alcuni dati presenti in letteratura - per esempio in merito alla salienza percettiva di alcune dimensioni come lontano-vicino, asimmetrico-simmetrico e verticale-orizzontale - rilevando le stesse differenze tra sistema spaziale dei vedenti e dei ciechi congeniti, già evidenziate in bibliografia.\ud La differenza nella caratterizzazione metrica e topologica delle dimensioni fra vedenti e ciechi congeniti indirizza alla ricerca di quali aspetti della struttura fenomenica dello spazio siano specificatamente veicolati dalla modalità sensoriale visiva e di quali siano invece riconducibili un ad più complesso sistema di percezione spaziale che è cinestesico-motorio e non esclusivamente visivo. A fronte di queste differenze la salienza della contrarietà in entrambe i sistemi spaziali costituisce una verifica significativa dell’ipotesi teorica generale che anche questa ricerca intendeva verificare, e cioè che la contrarietà sia una relazione che ha un fondamento primitivo nell’esperienza spaziale (grounded/embodied cognition)

    Supporting Tutoring by Improved Statistical Analysis of Discussion Forums.

    Fostering collaboration among pupils in a Learning Management System is certainly a great challenge for tutors and teachers. In order to assist the instructors in this task, a possible solution might consists in a technological artefact which could support the tutoring process at different levels.\ud Unfortunately, while the research has spent a great effort to the techniques devoted to manage knowledge, less attention has been focused on making the process of creation of new knowledge – and the reflection on such process – more effective. Moreover, the concept of level of collaboration in a virtual community is hard to be descrive in terms of a formal representation suitable for a software implementation. In addition, such implementation should be computationally efficient because the available time during the interaction is limited.\ud In this research, a possible solution is pursued by isolating the most interesting phases that occur during a forum session from a collaborative standpoint and finding out the necessary conditions on their basis. Then, such empirical observation are used for implementing a software library which measures such conditions and suggests the current phase according to an internal representation of the evolution of collaboration inside a learning community. From a formal point of view, the metrics adopted are based on the statistical analysis of the language used in the messages and on the dynamics of posting of the contributes.\ud Despite the simplicity of this approach, the results obtained are encouraging because\ud the system discovers with a reasonable delay the main changes in the collaboration\ud level of the community

    La giuridificazione della storia: leggi sulla memoria, negazionismo, responsabilità.

    La tesi si incentra su un tema raramente frequentato dallo studioso del diritto comparato, ed in genere dal giurista, ma che assume oggi rilevanza teorica e pratica: la “giuridificazione della storia”, ossia la moltiplicazione delle regole aventi ad oggetto eventi della storia contemporanea. La ricerca si concentra su tre aspetti essenziali, che toccano tre differenti livelli del diritto: a) la restrizione in via giurisprudenziale della libertà della ricerca storica; b) analisi comparata della legislazione in tema di negazionismo e obblighi di memoria; c) responsabilità civile per illeciti di massa di rilevanza storica. I tre aspetti, benché logicamente distinti, appaiono strettamente correlati. \ud Il punto di partenza del processo di “giuridificazione della storia” si può far coincidere con la fine della seconda guerra mondiale. In quel periodo l’approccio alla storia e segnatamente a crimini ed ingiustizie del passato, subisce un cambiamento radicale, essendo attratto dalla politica al diritto e dalla prospettiva municipale a quella internazionale. E’ in quell’occasione che sono stati deferiti, per la prima volta, dinanzi ad una corte internazionale, i responsabili dei più gravi crimini commessi ai danni della collettività, dal genocidio ai crimini di guerra, a quelli contro l'umanità. È in questo stesso periodo che cominceranno a diffondersi le pubblicazioni di stampo negazionista, finalizzate a contestare i crimini discussi dinanzi alla Corte di Norimberga.\ud Nonostante le numerose problematiche che la punibilità delle tesi negazioniste incontra a più livelli del diritto positivo (diritto costituzionale in primis, ma anche diritto penale e civile), la seconda fase del processo di giuridificazione si caratterizza per la proliferazione in tutta Europa, a partire dagli anni ’90, di obblighi di commemorazione e leggi c.d. memoriali, che impongono come dovere istituzionale la rievocazione di fatti della storia nazionale cui lo Stato attribuisce riconoscimento giuridico di memoria ufficiale.\ud Nel lavoro di ricerca vengono messi in risalto i molteplici limiti relativi alla istituzionalizzazione della memoria e ai pericoli che da essa derivano, considerando che il “dovere di memoria” ha ormai invaso il discorso politico e lo spazio dei mass media. Da una parte si assiste al riconoscimento della libertà di pensiero e di parola come situazioni soggettive che l’ordinamento si impegna a garantire, dall’altra siamo testimoni di una tendenza volta a caratterizzarsi per comportamenti restrittivi e punitivi che sviluppano il timore di subire discriminazioni o restrizioni della libertà personale a causa delle opinioni manifestate pubblicamente. \ud È ineluttabile, inoltre, riflettere sul fatto che le disposizioni memoriali abbiano l’effetto di conferire una grande visibilità al negazionismo e al negazionista stesso; quest’ultimo è così in grado di diffondere anche più efficacemente i propri precetti, guadagnando copertura mediatica per la propria causa e dichiarandosi pubblicamente, a fronte degli obblighi legislativi di censura, “martire” della libertà. Le leggi contro la negazione dell’Olocausto hanno avuto, per esempio, un effetto esattamente contrario a quello desiderato: hanno sollevato dubbi sulla Shoah, hanno portato la più parte degli Stati ad emularsi vicendevolmente nella introduzione di limiti alla libertà di parola all’interno dei rispettivi codici, le leggi sono diventate oggetto mediatico, di talché la spettacolarizzazione del passato ha finito per fare pubblicità e per concedere visibilità ai negazionisti.\ud Ed invero, sebbene la pratica della negazione di ogni evidenza storica sia un fenomeno in crescita, non può non rilevarsi che i meccanismi ad oggi adottati sembrano tante volte inidonei a debellare un fenomeno, mirando piuttosto a punire incondizionatamente. \ud Il legislatore europeo, preoccupato dell’intervento limitativo della libertà di espressione da parte degli stati membri, e con l’obiettivo di uniformare le regole in materia di xenofobia, razzismo e negazionismo, evitando che gli autori di tali reati sfruttassero le divergenze esistenti tra le legislazioni penali degli Stati, è intervenuto nel 2008 con l’emanazione di una Decisione Quadro. Diversamente dalla più parte delle legislazioni adottate dagli Stati membri, il Consiglio d’Europa ha inserito nella Decisione, quale elemento di bilanciamento, una clausola di pericolo, cosicché gli Stati possono decidere di rendere punibili soltanto i comportamenti “atti a turbare la quiete pubblica o che siano minacciosi, vessatori o insultanti” e non già qualsiasi condotta xenofoba e razzista. \ud Accanto alle prime due fasi di “giuridificazione” del passato, se n’è riscontrata una terza, ugualmente di recente elaborazione almeno nella sua massima diffusione, caratterizzata dalla moltiplicazione dei meccanismi di regolamentazione giuridica della storia, sino al crescente ricorso al sistema della responsabilità civile. L'alternativa radicale all'esercizio della giurisdizione penale e internazionale si è concretizzata negli ultimi anni, in una progressiva “privatizzazione” delle controversie relative ad eventi del passato; in particolare, i tribunali hanno cominciato ad accordare risarcimenti in ordine agli illeciti di massa di rilevanza storica. Per l’osservatore italiano può essere assunto come emblematico di questo terzo aspetto, l’intervento della Corte di Cassazione penale italiana del 2008 in cui la Germania è stata condannata a risarcire i familiari delle vittime delle stragi naziste in Italia, perché responsabile dei crimini di «violazione, particolarmente grave per intensità o sistematicità […] dei diritti fondamentali della persona umana, la cui tutela è affidata a norme inderogabili che si collocano al vertice dell’ordinamento internazionale, prevalendo su ogni altra norma, sia di carattere convenzionale che consuetudinario […] e quindi anche su quelle in tema di immunità.\ud Tale pronunzia, sebbene non sia stata confermata dalla Corte internazionale di Giustizia dell’Aja, investita della questione dalla Repubblica Federale tedesca, non costituisce un esempio isolato. L’idea della riparazione in sede civile dei danni della storia trae origine dalla Shoah, tragedia che non finisce di tormentare l’Occidente e dalla cultura liberale degli Stati Uniti: azioni risarcitorie sono state proposte di fronte ai tribunali statunitensi nei confronti di istituti bancari svizzeri accusati di illecita distrazione dei fondi depositati da parte di persone perite nell’Olocausto, e contro altre imprese, nonché Stati europei poi. Il caso americano (Holocaust Litigation,) e quello italiano hanno in comune l’uso massivo dello strumento della responsabilità civile. In questo modo, la regolazione del passato viene affidata ad un processo di privatizzazione crescente, ad un percorso volto a reintegrare le parti fin dove possibile, convertendo qualsiasi danno, di qualsiasi entità in una somma di denaro. \ud Il fatto che nell’attualità abbia preso corpo una pratica “infima”, fino ad imporre che nelle aule dei tribunali e dei Parlamenti si discorra, in maniera probabilmente incompetente e incompleta, tanto di verità storica, quanto di anacronistico ritorno al passato attraverso mezzi recenti, non può che condizionare il futuro dei procedimenti giudiziari. Così, se la storia compie un’operazione di investigazione del passato, l’obiezione principale mossa dagli storici è proprio la manipolazione della storia e della memoria da parte della politica e del legislatore, con una conseguente e inevitabile conclusione: ”l’histoire est saisie par le droit”.\ud \u

    La tesi si compone di quattro capitoli, più le conclusioni e un’appendice. \ud Nel primo capitolo, Dolores Prato, donna e intellettuale tra Otto e Novecento, si ripercorre la biografia della scrittrice in modo particolareggiato e con un taglio nuovo rispetto alla letteratura disponibile: vi si approfondisce sia la continua ricerca di un universo di valori in cui credere e in cui identificarsi tra cattolicesimo, comunismo e nonviolenza, che ha permeato l’intera vita di Prato; sia la lotta piccola e privata contro il Fascismo di un’insegnante degli anni Trenta, con riferimenti al periodo trascorso da Prato a San Ginesio, e con il supporto di scritti rari e di un “testamento ideologico” inedito. Il capitolo si chiude con un confronto con Sibilla Aleramo, un’altra giornalista e donna vissuta a cavallo fra i due secoli, legata anch’essa, peraltro, alla provincia di Macerata (si ricordi il lungo soggiorno giovanile a Civitanova che costituisce il nucleo centrale di Una donna) ponendo l’accento su alcuni punti comuni. \ud Nel secondo capitolo, dedicato a Giornalista a Roma, si legge un ulteriore confronto con un’altra nota pubblicista e scrittrice italiana, Matilde Serao, questa volta concentrato sull’aspetto della produzione giornalistica: in particolare si profila un parallelismo tra Il ventre di Napoli di Serao e il corpus degli articoli su Roma scritti da Prato, oggetto centrale della ricerca, assimilabili a una sorta di “ventre di Roma”. Il capitolo riporta anche una bibliografia degli articoli di Dolores Prato rinvenuti, tra rari, editi e inediti, e ricostruisce il panorama editoriale e giornalistico in cui si muove Prato, dal 1950 al 1980 circa. \ud Il terzo capitolo, invece, presenta la sfortunata vicenda editoriale del pamphlet su Roma che Dolores Prato aveva pensato, e in parte scritto, per il centenario della presa di Porta Pia, nel 1970: in “Voce fuori coro”: il libro su Roma mai pubblicato, Polci studia, analizza, e in parte riporta, un testo originale, e in qualche misura unico, che descrive le trasformazioni subite da Roma nel suo divenire di capitale d’Italia. \ud L’ultimo e quarto capitolo, infine, Mito e antimito di una capitale, contestualizza storicamente il materiale raccolto nel suo complesso, con una panoramica sul Risorgimento italiano e un focus sullo spostamento della capitale del Regno d’Italia a Roma, con i “guasti” e le “devastazioni” che ne seguirono per la città, indagati prevalentemente sul filo degli articoli giornalistici di Prato e di Voce fuori coro. Proseguendo con un’analisi del periodo fascista, limitata alle influenze urbanistiche e architettoniche del regime sulla città, e descrivendo le celebrazioni ufficiali della sua erezione a capitale fino al 1970, Polci rileva, da parte di Dolores Prato, la costruzione di un antimito che si contrappone, e a volte si confonde, con il mito di Roma proposto da politica e letteratura. Il taglio particolare degli scritti di Prato su Roma, definibile come “papista” in quanto nostalgico della città come capitale universale del cattolicesimo – si tratta, del resto, di una posizione condivisa da illustri predecessori favorevoli alla causa dell’unità italiana, come lo storico tedesco Ferdinand Gregorovius – spiega la difficoltà (della quale l’autrice si duole amaramente nel suo epistolario) che testate progressiste come “Paese Sera” ebbero, a metà del XX secolo, ad accettare gli articoli, e dunque anche l’alta percentuale di inediti in un corpus di rara qualità letteraria. \ud In appendice, Polci ha trascritto il volume degli articoli rari, editi e inediti di Dolores Prato – in tutto 69 quelli raccolti - di cui più della metà sicuramente pubblicati dall’autrice su diversi quotidiani nazionali, quali “Paese Sera”, “Il Globo”, “La via”,“Il Quotidiano”, “Nuova “Repubblica”, con otto scritti inediti sull’amore. \ud \u

    Il lavoro tratta della realizzazione conversazionale della tecnica della Moviola, propria del cognitivismo post razionalista. Essa è una tecnica di rielaborazione delle narrative autobiografiche (Dodet, 2001).\ud L’obiettivo di fondo che si persegue quando si applica la tecnica della Moviola è quello di promuovere il “cambiamento del punto di vista” del paziente. Nonostante la realizzazione di quest’azione sia fondamentale, le ricerche condotte in ambito terapeutico con la metodologia dell’Analisi Conversazionale (AC) non hanno indagato questo aspetto (Peräkylä, 1995, 2003, 2008, Bercelli, 2008, 2004, 1999, Leonardi, 1999, 1983, Viaro, 2008, 2004, 1999, 1983). Tali studi si sono concentrati piuttosto sull’identificazione delle diverse mosse e manovre, su specifici tipi di attività interni alle sedute o sulla configurazione complessiva sia di sedute singole che di intere serie di sedute, senza tuttavia descrivere la combinazione sequenziale di tali mosse, dall’avvio della tecnica alla sua conclusione, in quest’azione specifica.\ud Nel presente lavoro, invece, usando la metodologia dell’Analisi Conversazionale (Schegloff, Sacks, 1973, Jefferson, 1972), ci siamo focalizzati, in particolare, sulla realizzazione di questo specifico obiettivo conversazionale, il “cambiamento del punto di vista” da parte di pazienti con una Organizzazione di Significato Personale di tipo depressivo (Guidano, Liotti, 1983, Mannino, 2005). Tali pazienti, attraverso l’applicazione della Moviola, rielaborano episodi in cui hanno sperimentato un particolare stato, il senso di colpa e/o inadeguatezza (Guidano 1991/1992).\ud Il corpus consta di una selezione di ventuno estratti di testi trascritti, tratte da altrettante sedute, condotte da tre diverse terapeute provenienti dalla stessa scuola di formazione.\ud Abbiamo identificato, nella organizzazione strutturale complessiva della Moviola, nel nostro corpus, delle micro-strutture o pattern conversazionali realizzati, quindi realizzabili, per ciascuna fase della Moviola: dieci micro-strutture nella fase di avvio, undici micro-strutture nella fase di svolgimento, dieci micro-strutture della fase di chiusura che, in seguito ad un’attenta analisi qualitativa, sono state raggruppate in soli tre gruppi. Le micro-strutture individuate mostrano un grado di complessità crescente, ove per complessità s’ intende la compresenza di più mosse conversazionali che convergono per contribuire al raggiungimento di una specifica attività. Esse possono avere, inoltre, carattere “peculiare” ovvero essere usate solo da una terapeuta e mai dalle altre; “ricorrente” ovvero utilizzate da quattro volte in su da una o più terapeute; “peculiare e ricorrente”; “trasversale” quindi utilizzate da due o più terapeute diverse; “trasversale e ricorrente”; “multifunzionale” cioè essere usate da terapeute diverse o dalla stessa terapeuta per assolvere a più di una funzione conversazionale, quindi per raggiungere scopi diversi.\ud Alcune di queste micro-strutture sembra occorrano, insieme ad altri due fenomeni indagati – la lunghezza dell’intervento e le pause intra e inter-turno – in estratti di sedute ove l’obiettivo conversazionale del cambiamento del punto di vista si realizza positivamente.\ud E’ discussa, inoltre, l’implicazione di queste micro-strutture conversazionali e di questi fenomeni indagati, rispetto alla realizzazione della tecnica della Moviola volta al cambiamento del punto di vista. \ud \ud \ud Bibliografia\ud • Bercelli, F., Lenzi, S.     Il presente studio e' rivolto alla comprensione del ruolo che le analisi delle prestazioni energetiche degli edifici hanno nello studio e nella pratica della progettazione architettonica.\ud In accordo con i principi fondamentali della Progettazione Ambientale si sostiene che aspetti come le prestazioni termiche, il comfort acustico, i livelli di illuminazione naturale, siano di fondamentale importanza nella progettazione di tutti gli edifici e che debbano essere valutati gia' nelle prime fasi del processo di progettazione. In tal senso, gli strumenti di simulazione e\ud analisi delle prestazioni energetiche sono, oggi, in grado di supportare i progettisti nelle prime fasi del processo.\ud Con l’obbiettivo di sperimentare rapidamente gli effetti energetico-prestazionali gia' delle prime rudimentali soluzioni architettoniche in base all’orientamento, ai materiali, dimensioni e distribuzione delle aperture, dispositivi di ombreggiatura, ecc; gli strumenti di\ud analisi e di simulazione possono accompagnare, con rapidi e semplici riscontri, il processo di progettazione sino all’individuazione della soluzione formale e funzionale del progetto.\ud L’integrazione, sin dalle prime fasi, di veloci ed efficaci analisi avra' come risultato non solo un miglioramento delle prestazioni energetiche finali dell’edificio, ma permettera' di conoscere e valutare gli effetti e le conseguenze di ogni singola scelta progettuale e comprendere cosi' le ragioni della prestazione energetica finale stessa.\ud The aim of this study is the understanding of the role that building energy performance has in the study and practice of building design. According to the main principles of the\ud Environmental Design, it argues that conditions such as thermal performance, acoustic comfort, lighting levels, are of fundamental importance in the building design and that these aspects should be considered at the very earliest stages of the design process. Now, energy building design tools are able to support designers in the early design stages.\ud The aim is to allow the designers to begin with rudimentary forms, experimenting with effects of orientation, materials, window size and distribution, shading systems, etc. Energy building design tools can follow, quickly and in a smart manner, the design process until the final functional and formal solution of the project. Integrating, fast and efficient, energy performance analysis into the initial stages of design, will not only improve the whole energy building performance, but allow to understand the effects of each design decision and, thus, to understand why building will perform in this way.\ud The aim of this research is to discuss the role that building performance modeling and simulation plays in the study and practice of Architecture. It argues that energy performances and indoor comfort levels are of fundamental importance in the design of all buildings and should therefore be considered by the design architects at the very earliest stages of the design process.\ud This work basically agrees with the proposition that design is no longer dominated by physical structure thinking but by performance and system based concerns. However, is possible to recognise the need to find appropriate criteria, which are directly related to design actions, to evaluate performance and therefore effectively relate design decisions to simulation results. It is believed that the best way to set up a conversation between designers and simulationists isn’t to swing between the two points of view but to establish a unified framework for discussion disconnected from any specific tool or performance target.\ud The state of the art presented by SERI (Sustainable European Research Institute) in 1985 acknowledged the fact that a comprehensive design process for energy efficient\ud buildings was nonexistent due to complex and case-by-case interactions between the weather and the building surroundings, usage, client preferences, etc. and this view is still valid today. The challenge of reducing energy consumption as a new design issue is still there in terms of architecture. The difference between 1985 and today is that “environmentally friendly” components and simulation tools to evaluate building performance are now quite well developed, but much is still to be done with regards to the overall building context. In either case the identified need is to deal with the building as a whole not by assemblage of components.\ud We are now in an age where building performance targets will not only be set but will be explicitly measured as well, so architects who do not integrate creativity and rational technology risk becoming purely professional specifiers of “environmentally friendly” components that\ud might even influence the overall performance of a building depending on the overall context they are put into. It seems to be a contradiction to think that Architecture is not making it happen, and it is the aim of this study to understand why and to start a discussion about a possible way to overcome this problem.\ud The starting point is a review of the methods currently used to analyse simulation tool results, as well as the methods used to integrate simulation tool results into the design process. This research try to illustrate the main trends and to identify the overall reasons for this integration and to propose to integrate simulation tools into the design process by setting up a common framework

    Energy carriers and other co-products from microalgae:\ud Sustainability aspects and feasibility of different production pathways

    The cultivation and conversion of algae for biofuels emerged as one silver bullet technological solution over the last few years, in order to decrease our dependency from fossil fuels.\ud This thesis is based on an extensive literature review started in 2008 in order to put some clarity in the algae-to-energy sector, to discern overstatements about algae productivity and possible uses and to assess how this technology could contribute to sustainable development. The aim of the thesis is to identify promising technological solutions and algae-based production options, and to\ud assess the viability of different pathways for energy production.\ud The main findings of the review are summarized in the first part of this thesis together with a characterization of promising algae strains.\ud A special focus is given to thermochemical conversion and biorefinery processes, as well as to sustainability impacts.\ud A second part of this thesis is focused on applying this knowledge to a specific case study: the Austrian context. Two promising algae species have been identified and some results of a project comparing different energy production pathways from algae in Austria are reported. Scenarios are\ud drawn for 2020 and 2050.\ud Hydrothermal processes applied to algal biomass such as Scenedesmus obliquus grown in wastewater appears to be a viable solution in the Austrian context, able to achieve a positive energy balance. The main products of the process would be bio-coal and heat or, alternatively, a syngas\ud rich in methane and hydrogen.\ud The research highlights that, although a promising solution, the use of algae for large-scale production of biofuels is still unpractical given some major technological bottlenecks especially at the cultivation and separation phases. The co-production of non-energy products together with bioenergy can improve significantly the overall viability and sustainability of the process but, to\ud this end, their production scales and market potentials must be compatible
