The Role of the Central Java Regional Police in Overcoming Religious and Political Radicalism Crimes
This study examines the role of the Police as law enforcement officers in dealing with and preventing criminal acts of radical movements with an understanding that can give rise to rebellions that have similarities with terrorism because they are categorized as two threats to the unity and security of the state through religion and politics. The factor that causes this radicalism is because the understanding of religion is still fragmented, as a result of which they feel that religion and themselves are the most correct so that they have the desire to change the current system of government and replace it with Islamic law. This research uses a literature approach, namely by collecting data from various literatures which are then used to analyze and solve the problems studied. This research focuses on the crime of radicalism committed by the Islamic State of Indonesia with the intention of overthrowing the government with the arrest of the Governor of NII and several of his staff in the Central Java Police. The findings of this study are important for law enforcers, especially the Police because as law enforcement officers the Police must have a good strategy to be able to overcome, prevent, and overcome radicalism and terrorism. With this research, it can be a very important support as a means of law enforcement to achieve legal certainty, create justice, and maintain public order
REDESAIN LEMBAGA PENGAWASMAHKAMAH KONSTITUSI SEBAGAI UPAYA PENGUATANLEMBAGA PENEGAK KONSTITUSI
Reformasi melahirkan amandemen konstitusi, hal tersebut menjadi tonggak lahirnya berbagai dinamika ketatanegaraan yang dianggap lebih baik dari konstitusi sebelumnya. Pasca reformasi lahirlah Mahkamah Konstitusi (MK) yang pada pokoknya sejalan dengan karakteristik negara hukum menurut Internasional Comission of Jurists (ICJ), salah satunya adanya lembaga kehakiman yang independen dan tidak memihak. Menariknya MK tidak memiliki pengawas diluar tubuhnya sendiri, sehingga menarik untuk mengkaji bagaimana mekanisme pengawasan yang ideal terhadap MK. Jenis penelitian adalah penelitian hukum normative dengan analisis data menggunakan metode kualitatif. Sehingga hasil kajian akan memfokuskan pada Pola berjalannya MK: antara tugas institutional vs independensi personality Hakim MK.; Dinamika Lembaga pengawas MK; Problem Pengawasan MK saat ini; dan Aspeek etik sebagai guiden dalam tubuh MK. Simpulan penelitian menunjukan bahwa tidak diperlukan pengawasan eksternal diluar MK, karena jika terbentuk lembaga pengawas, maka akan lebih mudah diintervensi oleh Lembaga lain karena ada konflik kepentingan yang sangat kuat. Pengawasan terhadap MK dapat berjalan ketika terjadi suatu indikasi pelanggaran yang harus segera ditindaklanjuti oleh Dewan Etik. Sehingga mekanisme penyelesaian dengan pembentukan MKMK secara ad hoc akan lebih efektif dalam menindaklanjuti dugaan pelanggaran terhadap Hakim MK. MKMK yang bersifat ad hoc akan didudukan sebagai Lembaga pengawas yang akan meminimalisir konflik kepentingan
Ketahanan Nasional dan Penguasaan Tanah oleh Warga Negara Asing di Bali: Tantangan dan Solusi
Penguasaan tanah oleh warga negara asing (WNA) di Bali memiliki dampak signifikan terhadap ketahanan nasional Indonesia, terutama dalam aspek kedaulatan, ekonomi, pangan, dan sosial budaya. Meskipun Undang Undang Nomor 5 Tahun 1960 tentang Pokok-Pokok Agraria (UUPA) melarang WNA memiliki hak milik atas tanah namun, praktik seperti nominee agreement membuka celah hukum yang dapat merugikan kepentingan nasional. Penelitian ini bertujuan untuk mengidentifikasi dampak penguasaan tanah oleh WNA di Bali terhadap ketahanan nasional Indonesia, serta memberikan solusi komprehensif terkait pengelolaan tanah yang memperhatikan kepentingan nasional. Dengan menggunakan metode hukum normatif melalui pendekatan undang-undang (statute approach) serta pendekatan konseptual (conceptual approach) dan menggunakan bahan hukum primer dan sekunder untuk menganalisis permasalahan yang ada pada akhirnya didapatkan hasil bahwa penguasaan tanah oleh WNA berpotensi mengancam kedaulatan negara. Pemerintah Bali menghadapi tantangan dalam mengatur penguasaan tanah oleh WNA dikarenakan regulasi yang tidak konsisten, pengawasan yang lemah, serta praktik manipulasi hukum melalui penggunaan proxy. Untuk itu, diperlukan pendekatan komprehensif dalam pengelolaan tanah, melalui penguatan regulasi, kebijakan yang berpihak pada masyarakat lokal, dan alternatif investasi yang tidak merugikan kepentingan nasional. Dengan langkah-langkah tersebut, Indonesia dapat memanfaatkan potensi investasi asing tanpa mengorbankan kedaulatan negara dan ketahanan nasional.
Analisis Hukum Perizinan Tenaga Kerja Asing Pasca Undang-Undang Nomor 6 tahun 2023 dan Pengaruh terhadap Keberadaan Tenaga Kerja Lokal
Jumlah Tenaga Kerja Asing (TKA) Di Indonesia terus meningkat dalam beberapa tahun terakhir. Hal ini menyebabkan terjadinya pergeseran paradigma pemerintah dalam mengelola tenaga kerja asing dari pendekatan administratif dan proteksionis menjadi pendekatan yang lebih fleksibel dan pro-investasi. Perubahan ini berdampak signifikan terhadap dinamika ketenagakerjaan di Indonesia. Bahkan, di tengah kemudahan perizinan tersebut, muncul berbagai tantangan yang menimbulkan kekhawatiran di kalangan pekerja dalam negeri. Hal ini menimbulkan pertanyaan besar mengenai efektivitas kebijakan penyederhanaan perizinan tenaga kerja asing jika tidak dibarengi dengan penguatan kapasitas sumber daya manusia lokal. Dalam jangka panjang, keseimbangan antara efisiensi investasi dan perlindungan tenaga kerja akan menciptakan sistem pasar tenaga kerja di Indonesia yang lebih sehat, lebih kompetitif, dan berkelanjutan, terutama dalam jangka panjang
THE PHENOMENON OF CHILDFREE AS A CULTURE THAT CONTRADICTS PATRIARCHAL IDEOLOGY IN INDONESIA
Based on the National Socioeconomic Survey conducted by the Central Statistics Agency in 2022, 8% of Indonesian women (equivalent to 71,000 people) aged 15-49 chose to be childfree. This phenomenon is considered deviant from norms, religion, and culture. In addition, it also has a negative impact on the population and the existence of the country. This study aims to identify and analyze the causes of childfree in Indonesia and the government\u27s response to this phenomenon. The research method used is sociological-legal with a qualitative approach. The results of the study indicate that childfree in Indonesia is caused by internal and external cultural impacts, economic and psychological factors, environmental and demographic issues, technological development, and reproductive health. Government actions to anticipate the spread of the childfree movement include developing programs that enhance family resilience and well-being. This study employs Schutz\u27s phenomenological theory, gender theory (nature, nurture, and equilibrium), and James E. Anderson\u27s public policy theory. Schutz\u27s phenomenological theory helps understand the meaning of childfree for its adherents as an expression of individual freedom perceived to bring happiness. Gender theory explains the relationship between patriarchy and childfree. Patriarchy emerges from the nature approach, while childfree from nurture. Gender equilibrium theory serves as a mediating solution by balancing individual rights and social interests. James E. Anderson\u27s public policy theory is used to assess the urgency of the issue and formulate relevant policies
Constitutional Guarantee of Legal Protection for Freelance Workers from a Social Justice Perspective
This research investigates the absence of constitutional protection for freelance workers, particularly freelance models, within Indonesia’s labor law framework. While the Constitution of the Republic of Indonesia guarantees the right to work and to fair and decent remuneration, these protections are primarily structured around formal employment relationships, thereby excluding a growing segment of the labor force that operates within non-standard, flexible arrangements. The study aims to analyze the extent to which the current legal system, particularly Law No. 13 of 2003 on Manpower, as amended by Law No. 6 of 2023 on Job Creation accommodates or neglects freelance workers in terms of legal recognition, job security, and social protections. Using a normative juridical method with a statute and conceptual approach, this research draws from doctrinal legal analysis to critically evaluate the legal construction of employment relationships. The findings reveal significant normative gaps that leave freelance models vulnerable to exploitation, lacking access to written employment contracts, social security, and fair dispute resolution mechanisms. The study proposes a reconfiguration of legal norms to introduce a Constitutional Employment Contract model, which accounts for the flexible nature of freelance work while ensuring fundamental labor rights. Additionally, the paper recommends the establishment of an independent regulatory body to provide legal oversight and advocacy for flexible workers. Ultimately, this research concludes that achieving social justice for all workers in the modern labor market necessitates a transformation of Indonesia’s labor law regime toward a more inclusive and responsive constitutional framework
Tinjauan Viktimologis Eksploitasi Seksual Terhadap Anak: Studi Kasus Putusan Nomor 253/Pid.Sus/2023/PN Gto
Child sexual exploitation is a serious and complex problem that occurs globally, with profound physical, psychological, and social impacts on victims. This study analyzes cases of child sexual exploitation through the perspective of victimology, which highlights the vulnerability of victims and the mechanisms of victimization. The research method used is the juridical normative legal method. This study results in that the analyzed cases show how the perpetrators build manipulative relationships and conduct grooming systematically to exploit victims. Comprehensive prevention and prosecution efforts are needed, including preventive approaches in the form of education, improving family welfare, and environmental supervision, as well as repressive approaches through law enforcement and victim rehabilitation. Indonesia has adopted various international instruments and laws that support child protection and the fight against this crime. A victimological approach is essential to understand patterns of exploitation and formulate effective protection strategies to ensure children\u27s rights and welfare
Against the Demise of Discourse: Reclaiming Intellectual Culture in Indonesian Legal Education
In many parts of the world, the field of law is seen as one of rigour and law schools are seen as melting pots of critical thoughts. Such used to be the case in Indonesia, but a quick look at the state of legal education in the country today would proffer an indication of otherwise. The increasing quota in law faculties nationwide is not matched with improved human capital output quality. In fact, law faculties have been derisively stereotyped as a dumpster for the laziest of students in prior education. This is frankly and very unfortunately not uncorroborated as reading, despite being a rudimentary and logically inseparable component of the typical law school experience, is missing as a habit. This is not to mention ensuing issues like a lack of critical exchange in classrooms and proficiency in the production of scholarly works. This paper exposes the problem in detail from the author’s experiences and observations which are still fresh in memory as a recent graduate from one of Indonesia’s (supposedly) best law faculties. Subsequently, the author posits several highlights of recommendations pertaining to creating a culture of intellectualism among students from his experimentative efforts as a teaching assistant and editor-in-chief of the oldest and foremost student-run law review in the country. A slow but steady process of habitualization is needed to accomplish the objective, employing various learning sources to increase learning appetite following three stages of one’s scholarly journey in law: reading, thinking, and writing. Taking an age-old confab to a long-overdue next phase, this paper focuses on providing practical insights for legal educators and fellow students, not just in Indonesia but also anywhere in the world who face the same predicament in their classrooms, to contribute in realizing meaningful change

This article discusses the role of Kyai Arsantaka, who is considered one of the key figures in the formation of Purbalingga, a region in Central Java. As a revered historical figure, Kyai Arsantaka made significant contributions to the spread of Islamic teachings, as well as in establishing the social and cultural foundations of Purbalingga. Beyond his religious endeavors, his contributions can also be seen in infrastructure development, the strengthening of local traditions, and fostering harmonious social relationships within the community. This article explores the enduring legacy of Kyai Arsantaka spiritually, socially, and culturally which continues to be felt to this day. With a historical and anthropological approach, it provides an in-depth analysis of how the values championed by Kyai Arsantaka remain relevant and serve as guiding principles in the lives of the people of Purbalingga today
Can the State Administrative Court Shield Citizens from Government \u27Tort\u27? A Path to Justice in Dispute Resolution
In democratic governance, protecting citizens from wrongful acts by the government is crucial to maintaining public trust and ensuring justice. In Indonesia, the State Administrative Court (PTUN) serves as the primary forum for resolving disputes between individuals or legal entities and government authorities. However, when these disputes involve acts of "government tort"—illegal or wrongful actions by the state—citizens often face significant challenges in seeking redress. This research explores the role of the PTUN in protecting citizens against government torts, focusing on its capacity to provide timely and effective remedies. Using a normative juridical approach, this study analyzes the current legal framework and procedural mechanisms within the PTUN, highlighting the barriers citizens face when challenging government actions. The findings reveal that while the PTUN offers a critical platform for redress, its effectiveness is hindered by procedural complexities, limited legal remedies, and slow judicial processes. The research argues that reforms are urgently needed to enhance the PTUN’s role as a protector of citizens\u27 rights in the face of government torts. This research introduces the novel concept of "government tort" within the context of Indonesia\u27s administrative justice system, offering fresh insights into its application in legal practice. The urgency of reform lies in ensuring that citizens can effectively challenge government actions that harm their rights and freedoms. The study’s contribution is significant in providing recommendations for legal and procedural reforms aimed at strengthening the PTUN, ensuring that it can offer timely and accessible remedies for individuals harmed by government misconduct
