Manipulated Stocks and Corruption: Lessons from Three Indonesian Verdicts

    Get PDF
The Jiwasraya, Asabri, and DP4 cases are major financial scandals in Indonesia involving stock price manipulation and corruption. These crimes stemmed from weaknesses in capital market regulations, weak oversight, and conflicts of interest in the management of investment funds in state financial institutions. The perpetrators exploited regulatory loopholes to divert funds into low-quality stocks whose prices were manipulated through fraudulent transactions and misleading information. The state losses, reaching hundreds of trillions of rupiah, underscore the need for financial governance reform and regulatory strengthening. The legal verdicts in these cases have a deterrent effect, with severe penalties for perpetrators, including life imprisonment and the confiscation of assets. Furthermore, capital market regulations have been tightened, a risk-based oversight system has been implemented, and transparency in the management of public funds has been increased. To prevent similar crimes, stricter oversight of investments by state-owned insurance companies and pension funds, increased transparency in financial reporting, and synergy between institutions in financial law enforcement are needed. Stronger regulatory measures can curb stock price manipulation linked to corruption, thereby restoring trust in the capital market and the national financial system

Reimagining Criminal Liability in the Age of Artificial Intelligence: Toward a Comparative and Reform-Oriented Legal Framework

    Get PDF
As artificial intelligence (AI) systems increasingly permeate decision-making processes across sectors—from autonomous vehicles to predictive algorithms in finance and law enforcement—traditional frameworks of criminal liability face unprecedented challenges. This article critically examines the adequacy of existing criminal law doctrines in attributing liability when harm arises from autonomous or semi-autonomous AI actions. It explores the tension between actus reus and mens rea in cases involving algorithmic behavior, and interrogates whether AI entities can or should be treated as legal subjects under penal law. Through a comparative legal analysis of jurisdictions including the United States, the European Union, Japan, and Indonesia, the study identifies divergent approaches to regulating AI-related harm and assigning culpability. The article highlights emerging models such as strict liability, vicarious liability, and hybrid regulatory frameworks, and evaluates their potential for adaptation within Indonesia’s evolving legal system. Special attention is given to the role of developers, corporations, and state actors in shaping accountability mechanisms. The paper concludes by proposing a normative framework for reimagining criminal liability in the age of AI—one that balances innovation with legal certainty, and integrates ethical safeguards, technological transparency, and procedural fairness. This framework aims to inform future legislative reform in Indonesia and contribute to global discourse on AI governance and criminal justice

Juridical Implications of the Constitutional Court Decision Number 150/PUU-XXII/2024 on Legal Aid Provision in Indonesia

    Get PDF
The provision of legal aid is a crucial aspect of law enforcement and access to justice, especially for underprivileged communities. However, the limited number of advocates and their uneven distribution has hindered the effectiveness of legal aid. One potential solution is involving civil servant lecturers (PNS) as advocates, although this was previously obstructed by the provisions in Law Number 18 of 2003 concerning Advocates. The Constitutional Court Decision Number 150/PUU-XXII/2024 granted legal standing for PNS lecturers to become advocates and participate in providing legal aid. This study, using a normative juridical method with a qualitative approach, found significant legal implications, such as the conditional unconstitutionality of two articles in the Advocate Law, the expansion of the definition of “advocate,” and the recognition of PNS lecturers, including government-contracted lecturers (PPPK), as eligible to represent clients in court. Previously, ASN lecturers were restricted from litigating and lacked technical regulations to support such roles. Following this decision, there is a need to harmonize regulations, establish ethical oversight bodies, expand lecturers\u27 community service roles, improve teaching quality, and manage potential conflicts of interest. This study recommends revising the Advocate Law, issuing implementing regulations, strengthening university institutional frameworks, enhancing ministry-level oversight, and conducting public outreach on lecturers’ new role in expanding access to justice

Online Food Delivery (OFD) is a service where consumers can order food online through a specific platform or application, and the food is then prepared by restaurants or food service providers and delivered directly to the consumer\u27s address. Shopee is one of the largest and most popular e-commerce platforms in Indonesia, with one of its rapidly growing services being ShopeeFood, a food delivery service feature. Shopee has also expanded into several Southeast Asian countries and Taiwan since its launch in 2015. The aim of this research is to demonstrate the implementation of a combination of WebQual 4.0 and ECT in analyzing the relationship between CRM and customer loyalty and to determine the influence of the relationships among variables studied on ShopeeFood customer loyalty. This research adopts a quantitative approach with sample criteria including people from Java Island who have used ShopeeFood and are between 19-34 years old. This study obtained valid data from 186 respondents through a survey distributed via social media. The majority of respondents were female, aged 19-26, and were high school or vocational school graduates. The results show that of the 9 hypotheses tested, 7 were accepted and 2 were rejected. Among these hypotheses, several factors affecting user loyalty towards various online food delivery platforms include user satisfaction and CRM. Additionally, information quality, expectation, and CRM also influence user satisfaction. Expectation also affects confirmation. On the other hand, the tests conducted on the usability, service quality, and confirmation variables did not influence user satisfaction in this study.

This research explored the adoption of the HOT-Fit paradigm and its influence on the success of an academic information system application in higher education. Using the PLS-SEM multivariate data analysis approach, the HOT-Fit model was evaluated in order to investigate the foundations of theory from a prediction standpoint. This was done to find out more about the model\u27s potential applications. The HOT-Fit method takes various elements into account when performing a system analysis. Humans, organizations and technology are integrated elements and must be considered for the continued existence of an operating entity. This study uses hypothesis testing on a total of ten hypotheses to show the relationship between Academic Information System variables. The results show that six of the investigated hypotheses have a significant effect, while the other four are discarded because they are not relevant. 7.344 is the variable value of customer satisfaction. Program Features and Benefits The use of a variable with a value of 0.426 contributes little to the overall clarity of the situation. Based on the results of demo data processing, 121 participants (76.58%) reported good results, 13 (8.13%) rated this system as good, and 24 (15.19%) rated it as bad, resulting in a disparity between user expectations and the situation

    No full text
Background: ODT acetaminophen tablets are an alternative drug therapy for patients who have difficulty in swallowing tablets or capsules. Additional ingredients that play an important role in the ODT tablet formula are disintegrants. The disintegrants used in this study were avicel ph 102 and SSG. The use of disintegrants can help increase the dissolution rate and accelerate the destruction time. Aim: The purpose of this study was to determine the optimum formula of ODT acetaminophen tablets and analyse the effect of SSG and avicel ph 102 on dissolution and disintegration time. Material and Methods: Determination of acetaminophen ODT tablet formula was carried out running in design expert software with the simplex latice design method. Preparation of ODT acetaminophen tablets was carried out by direct felting. The evaluation of ODT acetaminophen tablets was IPC physical evaluation, determination of content, and dissolution. Determination of the optimum formula was done by simplex latice design method. Results: The results showed that all ODT acetaminophen tablet formulas fulfilled all the requirements of the IPC test, physical evaluation, dissolution, and determination of levels according to the Pharmacopoeia VI edition standards. Formula 3 produced the fastest disintegration time of 3 minutes, but the dissolution rate of 100% was reached in the 15th minute. It is suspected that gel formation in the SSG swelling mechanism slowed down the dissolution rate. While formulas 1, 2, and 4 which have a longer disintegration time reached >80% dissolution in the 10th minute. Conclusion: The optimum formula results with the simplex latice design method were SSG 8% and avicel ph 102 7%.  Avicel ph 102 and SSG had the effect of accelerating the destruction time and slowing down the dissolution rate
