    Post Hoc Interventions: Prospects and Problems

    Since prejudice harms so many, it is natural to think that it must be stopped at its source. That it must itself be removed, to stop its undesirable effects. Or, at the very least, that it must be contained, to thereby stop its manifestations. But what if we can’t? What if prejudice proves too entrenched and its manifestations too difficult to stop? Then we must intervene where we can. We must look downstream from the manifestations of prejudice, yet upstream from its undesirable outcomes, for places where the stream can be rerouted. This is the key insight that motivates the pursuit of post hoc interventions. This volume collects nine contributions to the emerging literature on this novel approach to prejudice mitigation, composed by the members of a research incubator which took place in 2022 at the Pufendorf Institute of Advanced Studies in Lund, Sweden. It adopts a range of different perspectives, and draws on expertise in epistemology, ethics, law, psychology, statistics and computer science, as it explores various aspects of post hoc interventions.Since prejudice harms so many, it is natural to think that it must be stopped at its source.     This book examines court decisions about seizures of property by foreign states. It is divided into three main parts. The first part is devoted to preliminary problems. The examination of the requirements imposed on the courts by international law is followed by a discussion of the special status of foreign expropriatory and similar laws in private international law. The second part concerns the foreign state\u27s right to the property affected by the seizure. An examination of recognizing the expropriator\u27s title to property which has already been effectively seized is followed by a study of the enforcement of foreign expropriatory laws. This part also discusses foreign seizures marked by special defects, in particular seizures violating the law of nations. The focus of the book is on its third part, which handles the problems connected with distributing the losses caused by foreign seizures. Many lawsuits have considered which of the parties is to bear the consequences of the foreign action but this problem has been discussed in legal literature much less than the validity and enforcement of a seizure. Therefore, this part is more detailed than the previous ones.Abstrac

    När Thomas Brante skriver den lilla skriften Anthony Giddens och samhällsvetenskapen är Giddens ett självklart namn i en sociologisk kanon. Refererade man inte till Giddens fanns en risk att man inte betraktades som en ”riktig” sociolog. Att kritisera Giddens var närmast att kritisera ämnet. Enligt Giddens hade sociologin hamnat i en olycklig och teoretiskt improduktiv åtskillnad mellan subjektivism/aktör och objektivism/struktur, eller den mellan individ och kollektiv som Johan Asplund diskuterar i Människan som samhällsvarelse (2022). Hans eget teoretiska bidrag, struktureringsteorin, försöker lösa dikotomin mellan aktör och struktur genom att hävda att förhållandet måste betraktas som en strukturdualitet där strukturer är både medel för och resultatet av aktörers handlingar. Brante är positivt inställd till viljan att överskrida åtskillnaden mellan aktör och struktur men tycker att kritiken mot t.ex. strukturalister är missriktad. Den går för långt i sina antaganden om att strukturalister inte skulle kunna tänka sig att det är levande människor som både producerar och reproducerar strukturer. Den bortser också från att en undersökning av ett socialt fenomen kan isolera den ena eller andra aspekten av fenomenet utan vara antingen subjektivistisk eller objektivistisk. Brantes läsning av Giddens gjorde honom helt enkelt förbannad på Giddens argumentation – där syftet ofta handlar om att framhäva den egna teorin – även om han respekterade och höll med om varningarna mot tendenser till överdrifter åt antingen individualistiskt eller kollektivistiskt håll
