Get PDFThe present paper is an extraordinary recension of Professor Zoltán Novotni's paper on ‘Some problems of liability of the motor vehicle operator’. As a central issue, I examine the interest-based definition of the operator, i.e. the person to be imposed with strict liability for the operation of motor vehicles as an activity involving an increased risk, in the light of the current statutory provisions, literature and judicial practice, briefly touching upon the difference between the operation of a motor vehicle and an ultrahazardous activity.A jelen írás Novotni Zoltán professzor úrnak a ’A gépjármű üzembentartói felelősség néhány problémája’ című tanulmánya rendhagyó recenziójául szolgál. Get PDFArticle 7 of the Vienna Sales Convention, which regulates international sales law with a need to uniformity, sets out three requirements for the courts in terms of the application and interpretation of the law. These require the courts, in applying and interpreting all the rules of the Vienna Sales Convention, to give effect to the international character of the Convention and to the principle of good faith and to promote uniform application. Article 7 thus plays a prominent and central role, since it is essentially a guideline in the coordinate system of the Convention. The aim of this study is to provide a true picture of the interpretation of the requirements of Article 7, by analysing the relevant case-law.A nemzetközi adásvételi jogot az egységesség igényével szabályozó Bécsi Vételi Egyezmény 7. cikke három jogalkalmazási és jogértelmezési követelményt fogalmaz meg a bíróságokkal szemben. Ezek alapján a bíróságok a Bécsi Vételi Egyezmény valamennyi szabályának az alkalmazása és értelmezése során kötelesek érvényesíteni az Egyezmény nemzetközi jellegét, és a jóhiszeműség elvét, valamint elősegíteni az egységes alkalmazást. A 7. cikk tehát kitüntetett és központi szerepet játszik, hiszen lényegében iránymutatóként funkcionál az Egyezmény koordináta rendszerében. Before testing our hypothesis was that in Hungary the internal migration is especially in connection with the conditions of economic development.
This initial hypothesis was confirmed, since it seems clear link between the Hungarian internal migration and utility-based accessibility, that’s mean that the driving force in our country's internal migration is clearly linked to economic reasons.Munkánkban az elérhetőségi modellezés egy, a hagyományos mutatóktól eltérő modelljét, a haszon alapú elérhetőségi modellt kívánjuk alkalmazni konkrét példán keresztül. E vizsgálatunkban azt kívántuk elemezni, hogy a hazai belföldi vándorlás mennyiben tükrözi az elérhetőségi viszonyokat, illetve mennyiben tér el attól, milyen főbb tendenciák mutathatók ki? A vizsgálat előtt az a hipotézisünk volt, hogy a belső vándorlási viszonyok mozgatórugója hazánkban elsősorban a gazdasági fejlettségi viszonyokban keresendő, ezért a következőkben a haszon alapú elérhetőség és a vándorlási viszonyok közötti kapcsolatot elemezzük
A Unique European Governance Structure – Office of the High Representative in Bosnia and Herzegovina Basis of Its Legitimacy and Controversial Accountability
Get PDFIn order to assess the successes and failures of Bosnia and Herzegovina’s (BiH) challenging road towards a fully functional democratic state aiming at membership in the European Union (EU), this paper examines the state-building process in BiH, and the transition from the post-Dayton political development, the work of the interim, ad-hoc political institution of the Office of the High Representative (OHR) in BiH, as well as the justification – if any - of its future existence and operation. Guided by the coordination dilemma, the research question of this paper is a reflection on the challenges of self-enforcing democratic institutions and how the OHR substitutes for it. This paper claims that the original purpose of the Dayton Peace Agreement (DPA) was to create a powerful yet limited institution of the OHR, one that is to be given sufficient power to institute behaviour, but is prevented from abusing its power. However, this purpose deviated in the years that followed the signing of the DPA, creating and institution which doings resemble liberal imperialism. The hypothesis of the paper is that the OHR has been abusing its power and that it is time to close it because it is no more a substitute for the self-enforcing democratic institutions. This paper claims that the problem of political officials’ lack of respect for the political and economic rights of citizens they administer, as investigated by Weingast, is one of the central features of the operation of the OHR in BiH. The novelty of the paper lies in the attempt to test if OHR could be a case that could serve as a very good field to test Weingast’s model (1997)
Human Resource Assessment and Sustainability - Investigating the Measurability of Human Activity
Get PDFSustainability, as a complex set of goals, has many possible interpretations and approaches the 17 Sustainable Development Goals (SDGs) set out in the document have 169 sub-goals, of which Goal 10 is "reduced inequalities". There are 10 sub-goals linked to this goal, the first of which is aimed at reducing income inequality. Employers have direct responsibility and considerable leeway to develop fair wage systems. For HR professionals, the practical implementation of this is a major task, and their knowledge can therefore be a key factor in achieving SDG 10. In our research, we sought to answer the question of what future HR professionals know about the accounting measurability of human performance and how they assess its monetary valuation. In our view, HR professionals who are aware of the issues of human performance measurement and recognize the fundamental problems can play a significant role in meeting SDG 10. In our primary research, we surveyed 448 undergraduate human resources students from early December 2022 to the end of January 2023 using an online questionnaire. The questionnaire contains closed and open questions in addition to demographic data. Our research shows that the value of human activity is not well expressed in monetary terms, which implies that wages and the value of work are not closely related
Vállalati környezetvédelmi célorientáció Magyarországon
Get PDFToday, the circular economy is receiving increasing attention as an integral model for sustainable development. In the present study, the authors have examined the content of environmental strategies. The variables were selected on the basis of the framework laid down in the circular economy literature, thus allowing the classification of enterprises in terms of environmental goal orientation. Following the analysis of the content of the strategies, the authors analysed the organisational embeddedness of the environmental aspects. The research results suggested that there is increasing pressure on companies to commit to environmental protection. Companies that take environmental goals into account gain recognition and thus become value creators. The research sample shows that even the largest companies have more to do to improve their day-to-day environmental performance. Overall, it can be concluded that rural businesses have a greater emphasis on environmental goal orientation, which is due to their efforts to counterbalance the strong role of the capital and their closer relationship with the environment.Jelen tanulmányban a szerzők a környezetvédelemmel kapcsolatos stratégiák tartalmi elemeit vizsgálták, a változók a körforgásos gazdaság szakirodalmában lefektetett keretrendszer alapján kerültek kiválasztásra. A kutatási eredmények arra engedtek következtetni, hogy azok a vállalatok, amelyek a környezeti célokat figyelembe veszik, elismerésre tesznek szert, értékteremtővé válnak. A főváros-vidék vizsgálatánál megállapítható, hogy a vidéki vállalatoknál nagyobb a hangsúly a környezeti célorientáltságon és ezzel igyekeznek ellensúlyozni a főváros erőteljes szerepét
Market Dynamics at Play: The Convergence Phenomenon in Carbon Credit Project Valuations
Get PDFThis study examines the capital market valuation of carbon trading projects in the growth stage, focusing on the impact of project size and classification. We analyze four projects launched in 2021 and 2022, using changes in market capitalization as a proxy for valuation, based on investor perception. A major conclusion of the paper is that the market capitalization of different projects converged over the study period. This phenomenon was evident despite the differences in the amount of capital raised, launching market caps, size of partner networks and timing of launching. We argue that the novelty of the sector fosters investor focus on sectoral narratives, leading to converging project valuations. This convergence in market capitalization should be factored into tokenomics design and market-making activities to ensure the financial sustainability of these blockchain projects

Get PDFIn this study, the author examines how the same legally relevant behaviour is covered by the concepts of discrimination and equal opportunities. According to the author, the former expresses the same thing from the side of prohibition, while the latter expresses the same from the side of the obligation to act. Considering this, the author examines the administrative and judicial procedures that can be conducted parallel, and the author makes suggestions to avoid any contradictory overlap between them.A tanulmányban a szerző azt vizsgálja, hogy ugyanazt a jogilag releváns magatartást hogyan fedi le a diszkrimináció és az esélyegyenlőség fogalma. A szerző szerint az előbbi ugyanazt fejezi ki a tiltás, míg az utóbbi a tevékenységre kötelezés oldaláról. Ennek figyelembevételével vizsgálja az ebből adódó egymás mellett párhuzamosan is folytatható közigazgatási és bírósági eljárásokat, és hogy ne legyen közöttük ellentmondásos átfedés, ennek elkerülésére tesz javaslatokat a szerző
