Cuerpos, almas y derechos: una revisión bioética de la gestación subrogada en el siglo XXI
Surrogacy raises ethical challenges concerning autonomy, social justice, and reproductive rights. This article takes a bioethical perspective to examine how feminism and utilitarianism can provide a foundation for fair regulatory frameworks governing this practice. Through a systematic review of academic literature (2015-2024) and a comparative analysis of international regulations (Canada, United Kingdom, Ukraine, United States), it identifies tensions between the protection of surrogate mothers and reproductive rights. The findings highlight that: (1) liberal feminism supports surrogacy under informed consent, whereas radical feminism criticizes it as a form of exploitation; (2) utilitarianism justifies the practice if it maximizes collective well-being, although it overlooks structural inequalities. The article concludes that a global regulatory framework should balance autonomy, protection against exploitation, and the rights of the child, while prioritizing human dignity.La gestación subrogada plantea desafíos éticos en torno a la autonomía, la justicia social y los derechos reproductivos. Este artículo analiza, desde una perspectiva bioética, cómo el feminismo y el utilitarismo pueden fundamentar marcos regulatorios justos para esta práctica. Mediante una revisión sistemática de literatura académica (2015- 2024) y un análisis comparativo de regulaciones internacionales (Canadá, Reino Unido, Ucrania, EE. UU.), se identifican tensiones entre la protección de las gestantes y los derechos reproductivos. Los resultados destacan que: (1) el feminismo liberal avala la subrogación con consentimiento informado, mientras el radical la critica como explotación; (2) el utilitarismo la justifica si maximiza el bienestar colectivo, aunque ignora desigualdades estructurales. Se concluye que un marco regulatorio global debe equilibrar autonomía, protección contra la explotación y derechos del niño, priorizando la dignidad humana
La crisis de la responsabilidad individual en las sociedades tecnológicas
Until the publication of The Principle of Responsibility (1979), most Western ethical systems focused on the exclusively intersubjective nature of actions and paid no attention to the way in which those actions related to the environment. The reason for this is that the environment had been conceived as something completely independent from actions taken or, at least, as a reality endowed with a determined and easily predictable behavior. The development of technology and the knowledge of complex systems have put that notion of the environment under strain, which has altered the type of ethical responsibility of certain actions. This article explains the way in which non-trivial systems challenge Hans Jonas’ notion of responsibility through a new understanding of responsibility suitable to understand the type of interconnection (subjective and objective) characteristic of complex systems.Hasta la publicación de El principio de responsabilidad (1979), la mayor parte de los sistemas éticos occidentales se centraron en el carácter exclusivamente inter-subjetivo de las acciones, sin prestar atención al modo en que dichas acciones se relacionaban con el medio, pues este último era concebido como algo completamente independiente de las mismas, o por lo menos con un comportamiento determinado y fácilmente previsible frente a ellas. Con el desarrollo de la tecnología y el conocimiento de los sistemas complejos ha entrado en crisis dicha concepción del medio, alterándose con ello el tipo de responsabilidad ética de las acciones. El presente artículo desarrolla el modo en que los sistemas no-triviales ponen en crisis la concepción de responsabilidad desarrollada por Hans Jonas, abriendo la puerta a una nueva concepción de la misma, apta para el tipo de inter-conexión (subjetiva y objetiva) propia de los sistemas complejos
El trasfondo spinocista del monismo de doble aspecto contemporáneo
Dual Aspect Monism (DAM) is a metaphysical theory about the relationship between the mental and the physical and about the constitution of nature in general. Contemporaneously it has been developed by various authors as an answer to the hard problem of consciousness. Some of them, such as Velmans or Strawson, mention that Spinoza\u27s metaphysics is found within the background of this theory, however, they don’t delve into the understanding of this relationship. The present work seeks to address this gap, evidencing not only that Spinoza\u27s metaphysics turns out to be a significant background for contemporary DAM, but also, exposing that such antecedents allow a better understanding of DAM in its current form.El Monismo de Doble Aspecto (MDA) es una teoría metafísica sobre la relación entre lo mental y lo físico y sobre la constitución de la naturaleza en general. Contemporáneamente ha sido desarrollada por diversos autores como una respuesta al problema difícil de la conciencia. Algunos de ellos, como Velmans o Strawson, mencionan que dentro de los antecedentes de esta teoría se encuentra la metafísica de Spinoza, sin embargo, no profundizan en la comprensión de dicha relación. El presente trabajo busca hacerse cargo de ese vacío, evidenciando no solamente que la metafísica de Spinoza resulta ser un trasfondo significativo para el MDA contemporáneo, sino, además, exponiendo que dichos antecedentes permiten una mayor comprensión del MDA en su forma actual
La dignidad humana: su significado y su relevancia en los Estados Unidos
«Human dignity» is a term that has been used after World War II to defend human beings from unjust treatment. In the United States, it was introduced to protect those who are unable to give or withhold consent for biomedical procedures. The term has been sharply criticized, however, by materialist philosophers such as Steven Pinker as well as by Thomist philosophers such as Alasdair MacIntyre. Both hold that the concept is useless and even harmful. Pinker’s main criticism is that since the term has so many meanings, it is rendered muddy and inapplicable. This paper will first show earlier responses to Pinker and then weave a new response by demonstrating that, although the term is really polysemic, it has a central meaning which has been tried and found indispensable by the central Western philosophical and juridical tradition for more than two millennia. It will be proved, thus, that the claim about its uselessness lacks ground.«Dignidad humana» es un término que se ha usado después de la II Guerra Mundial para proteger a los seres humanos de todo tratamiento injusto. En los Estados Unidos, fue introducido para proteger a quienes eran incapaces de otorgar o negar su consentimiento para ser sometidos a procedimientos biomédicos. El término ha sido duramente criticado tanto por filósofos materialistas, como Steven Pinker, como por filósofos tomistas, como Alasdair MacIntyre. Ambos sostienen que el concepto es inútil y aun perjudicial. La principal crítica de Pinker es que, pues el término tiene muy diversos significados, es turbio e inaplicable. Este artículo se propone mostrar, primero, algunas respuestas que se han formulado contra la crítica de Pinker, y luego elaborar una nueva respuesta: aunque el término es efectivamente polisémico, posee un significado central, probado y encontrado indispensable en la tradición central Occidental por más de dos milenios. Quedará así demostrado que el alegato de su inutilidad carece de fundamento
Tristeza y enfermedad. Un episodio del diálogo entre Isabel y Descartes
Based on the correspondence between René Descartes and Isabel de Bohemia, this article aims to show how the philosopher responds to the concerns of the princess regarding the relationship between health and happiness. In the epistolary exchange, it is gradually revealed that both the position of Descartes and that of Isabel, are being transformed. In fact, if in the first moment Descartes considers that he can advise her that it is possible to break the circle, which has formed in her case, between sadness and illness, the objections of the princess dissuade him from such an endeavor. Consequently, he suggests her to exercise her will to accept the illness and the little fortune as part of her life and to achieve the satisfaction of the spirit. This text will give an account of the change in the position of the two correspondents.A partir de la correspondencia que sostienen René Descartes e Isabel de Bohemia, este artículo se propone mostrar cómo el filósofo responde a las inquietudes de la princesa respecto a la relación entre la salud y la felicidad. En la exposición del intercambio epistolar se revela, de manera paulatina, que tanto la posición de Descartes como la de Isabel se van transformando. De hecho, si en un principio Descartes cree poder aconsejarla que es posible romper el círculo, que se ha formado en su caso, entre tristeza y enfermedad, las objeciones de la princesa lo disuaden de tal empeño y decide aconsejarla que asuma la enfermedad y la poca fortuna como parte de su vida; para ello deberá templar su espíritu para así lograr la satisfacción del espíritu. Este texto dará cuenta de la sutileza de dicho cambio en las posiciones de los dos corresponsales
El principio aristotélico «esse in subiecto» en la demostración de la inmortalidad del alma. El «De immortalitate animae» de san Agustín
Saint Augustine’s encounter with Aristotelianism had two paths: on the one hand, the Latin translations of the commentators, who sought the integration of Plato and Aristotle, although they pointed out the primacy of the Athenian; thus, Aristotelianism reached a new rise, but under the conceptual direction of Neoplatonism. On the other hand, the reading of the Categories, in some of the Latin translations that were circulating at that time. In this double framework of reception, we postulate the presence of the Aristotelian principle esse in subiecto, in the argument about the immortality of the soul, and we discern the consequences of this resource. Although the theory of reminiscence explained the origin of knowledge as the truest memory, it was an insuperable difficulty for a creationist mentality; we consider that the Aristotelian element acts on this Platonic structure: the experience of things is not memory, but evocation. Using the Aristotelian principle, Saint Augustine transmutes the immateriality of the Platonic-Aristotelian soul into spirituality.El encuentro de san Agustín con el aristotelismo tuvo dos vías: por un lado, las traducciones latinas de los comentaristas, que buscaban la integración de Platón y de Aristóteles, aunque señalando la primacía del primero; así el aristotelismo alcanzó un nuevo auge, pero bajo la dirección conceptual del neoplatonismo. Por otro lado, la lectura de las Categorías, en alguna de las traducciones latinas que circulaban en su época. En este doble marco de recepción, postulamos la presencia del principio aristotélico esse in subiecto, en la argumentación sobre la inmortalidad del alma, y discernimos las consecuencias de este recurso. Si bien la teoría de la reminiscencia explicaba la procedencia del conocimiento como el recuerdo más verdadero, esta constituía una dificultad insuperable para una mentalidad creacionista; consideramos que el elemento aristotélico actúa sobre esta estructura platónica: la experiencia de las cosas no es recuerdo, sino evocación. Mediante el recurso del principio aristotélico, san Agustín transmuta la inmaterialidad del alma platónico-aristotélica en espiritualidad
Vives y Vitoria sobre la guerra. Humanismo y escolástica
Juan Luis Vives and Francisco de Vitoria are two authors who published works on war almost at the same time. Vives in his Concordia et discordia in humano genere (1529) addresses the issue from a humanist and pacifist perspective, while Vitoria, in his relectione of De iure belli (1539), addresses the same problem but from a scholastic perspective, where the justification of an armed intervention is possible. In this article, both works are analyzed looking for points of agreement (for example, the coincidence in bad consequences of war) but also their differences (for example, Vivesian idealism versus the realism of Vitoria).Juan Luis Vives y Francisco de Vitoria son dos autores que publicaron casi a la vez sendos trabajos sobre la guerra. Vives en su Concordia y discordia del género humano (1529) aborda el tema desde una perspectiva humanista y pacifista, mientras que Vitoria en su relección sobre El derecho a la guerra (1539) aborda el mismo problema, pero desde una perspectiva escolástica, donde cabe la justificación de una intervención armada. En este trabajo se analizan ambas obras buscando puntos de acuerdo (por ejemplo, la coincidencia en la maldad de la guerra), pero también sus diferencias (por ejemplo, el idealismo vivesiano frente al realismo de Vitoria)
