Internet Access as a Basic Human Right: An Ongoing European Legal Debate?
The pervasive use of Information and Communication Technology has inevitably interfered with human rights worldwide. This persistent interaction has led to questioning the legal nature of Internet access itself: is it an autonomous right or an implicit right? This paper examines the relevant case law of the European Court of Human Rights (ECtHR) and the Court of Justice of the European Union (CJEU) in order to assess whether Internet access is today a basic human right. The Strasbourg jurisprudence stems mainly from applications based on freedom of expression and the right to education. The ECtHR applies the binary axiological test: the right for which protection is sought and the competing interest/right provided by the European Convention on Human Rights. So far, it has not explicitly recognised the right to Internet access but rather the Internet’s widespread usage and importance. The Luxembourg case law constitutes proof of the economic dimension of the Union since the CJEU applies a threefold test, depending on the piece of legislation basing the application, and takes a moderate approach to questions involving human rights. Thus, the complementarity of ECtHR and CJEU case law proves that Internet access rather facilitates the exercise of other rights than is an autonomous right. For this reason, limitations are assessed on a case-by-case basis according to the requirements associated with each conventional right’s specific restrictions
The Impact of Multiple Crises on the Evolution of EU Law
Against the backdrop of the multiple crises that the EU has faced over the last two decades, this keynote speech, delivered by President Lenaerts to celebrate the 20th anniversary of Hungary’s accession to the EU, examines three areas of EU law in the light of the common values enshrined in Article 2 of the Treaty on European Union. First, it assesses the impact of the financial crisis, not only on the legal framework of Economic and Monetary Union but also on primary EU law more broadly. Second, it analyses how the case law relating to the COVID-19 pandemic has helped clarify the limits that may be imposed on free movement in the context of an exceptional public health crisis. Finally, it explores the rule of law crisis, considering its broader implications for understanding the scope and significance of the values enshrined in Article 2 TEU. This threefold examination supports the contention that, while these crises have raised new and complex legal questions – requiring the Court of Justice of the EU to resolve them expeditiously – the Court, in interpreting EU law, must remain respectful of the limits imposed on its jurisdiction by the Treaties and of the foundational values on which the EU is founded

Pursuant to the Fundamental Law of Hungary, every individual is vested with the right to property and inheritance. Succession may occur either by testamentary disposition or by operation of law. Testamentary dispositions may be effected through a public will or a holographic private will, whereas oral wills are admissible only under exceptional circumstances. A holographic private will composed of multiple separate sheets is valid only if each page is consecutively numbered. Such pagination serves the critical function of safeguarding against any alteration or manipulation of the testator’s intent. In the context of compulsory portion rights, the entitled heir is entitled to one-third of the statutory share to which they would otherwise be entitled as a lawful heir.The constitutional complaint (valódi alkotmányjogi panasz) offers a remedial avenue for addressing lacunae within inheritance law. The doctrine of favor testamenti, which favors the validity of form-deficient wills, is applicable in cases where formal defects exist. However, its application raises significant fundamental rights concerns.Magyarország Alaptörvénye alapján mindenkinek joga van a tulajdonhoz és az örökléshez. Örökölni végintézkedés alapján vagy törvény szerint lehetséges. Végrendelkezni közvégrendelettel vagy írásbeli magánvégrendelettel lehet, szóbeli végrendelkezésnek kivételesen helye. A több különálló lapból álló sajátkezűleg írt írásbeli magánvégrendelet akkor érvényes, ha minden lapját folyamatos sorszámozással látták el. Forgács Anna színésznő halála
Anna Forgács war in den 1920er Jahren ein aufstrebendes Talent des Budapester Vígszínház. Sie war nicht nur innerhalb des Theaters beliebt, sondern auch bei den Männern. Im Jahr 1925 lernte sie Béla Erdélyi, einen wohlhabenden Industriellen aus einer Fabrikantenfamilie, kennen und heiratete ihn.
Béla Erdélyi gab viel aus, zunächst finanziert von seinem Vater, später durch das Fälschen von Wechseln. Neben Wechseln versuchte er auch durch Versicherungen Geld zu beschaffen. So schlossen er und seine Frau gegenseitige Lebens- und Unfallversicherungen ab.
Etwas mehr als einen Monat nach Abschluss der Versicherung erkrankte Anna Forgács plötzlich und wurde mit Vergiftungssymptomen in ein Sanatorium eingeliefert. Nach dem Verlassen des Sanatoriums reiste das Paar nach Millstatt in Österreich, wo Béla Erdélyi bei einem Spaziergang versuchte, seine Frau in eine Klippe zu stoßen, doch die Schauspielerin kam mit leichten Verletzungen davon. Nach dem Unfall verabreichte Béla Erdélyi seiner Frau eine große Menge Veronal, woraufhin sie am 24. August 1927 starb.

She was not only popular within the theatre walls, but also among men. In 1925, she met and married Béla Erdélyi, a wealthy industrialist from a family of factory owners.
Béla Erdélyi spent a lot, financed initially by his father and later by forging bills of exchange himself. In addition to bills of exchange, he also tried to get money through insurance, so he and his wife took out mutual life and accident insurance.
Just over a month after the insurance was taken out, Anna Forgács suddenly fell ill and was taken to a sanatorium with symptoms of poisoning. After leaving the sanatorium, the couple travelled to Millstatt, Austria, where during a walk Béla Erdélyi tried to push his wife into a cliff, but the actress escaped with minor injuries. Following the accident, Béla Erdélyi gave his wife a large amount of veronal, which caused her death on 24 August 1927.
The Budapest Royal Criminal Court found Béla Erdélyi guilty of attempted murder, murder, several counts of forgery of private documents, forgery of public documents and fraud, while his accomplices in the forgery were found guilty of private forgery, public forgery and fraud.Forgács Anna a budapesti Vígszínház feltörekvő tehetsége volt az 1920-as években. De nemcsak a színház falai között örvendett nagy népszerűségnek, hanem a férfiak körében is. 1925-ben azonban megismerkedett a gazdag, gyártulajdonos családból származó Erdélyi Bélával, akivel házasságot is kötött.
Erdélyi Béla költekező életet élt, melyet kezdetben édesapja, később pedig váltók hamisítása útján maga finanszírozott. A váltók mellett biztosítás által is igyekezett pénzhez jutni, ezért a feleségével kölcsönös élet- és balesetbiztosítást kötött.
A biztosítás megkötése után alig több mint egy hónappal Forgács Anna hirtelen megbetegedett, mérgezéses tünetekkel szanatóriumba is szállították. A szanatóriumból való távozását követően a házaspár az ausztriai Millstattba utazott, ahol egy séta során Erdélyi Béla megpróbálta feleségét egy szakadékba lökni, de a színésznő a balesetet kisebb sérülésekkel megúszta. A balesetet követően Erdélyi Béla nagy mennyiségű veronált adott feleségének, amely következtében az asszony 1927. augusztus 24-én elhunyt.

In Ungarn wurden ab 1945 zunächst gezielt Personen und dann die zivile und militärische Strafjustiz in großem Umfang eingesetzt, nicht nur zur Beilegung politischer Kämpfe und zur Errichtung einer Einparteiendiktatur, sondern auch zur Erfüllung tagespolitischer Aufgaben. Das ungarische Strafvollzugssystem war mit der Zahl der unschuldig Inhaftierten überfordert. Ab Herbst 1955 durften mehr als 20.000 Häftlinge entgegen den gesetzlichen Begnadigungsmaßnahmen per Parteierlass ihre Zellen verlassen. Die während der Kádár-Repressalien Verurteilten wurden durch zwei Teilamnestien und eine Generalamnestie freigelassen. Die Maßnahme vom März 1963 stand im Zusammenhang mit der internationalen Lage des Landes. Die Freilassung von Gefangenen, die zuvor zum Tode verurteilt, aber glücklicherweise begnadigt worden waren, brachte die gegen sie begangenen Straftaten ans Licht, die verheimlicht worden waren. Diejenigen, die nicht freigelassen wurden, hatten ihre Strafe vollständig verbüßt und fielen nicht unter die Begnadigung von 1970.In Hungary, from 1945 onwards, first targeted persons and then the civil and military criminal justice systems were used on a massive scale not only to settle political struggles and establish a one-party dictatorship, but also to carry out day-to-day political tasks. The Hungarian penitentiary system was overwhelmed by the number of innocent prisoners. From the autumn of 1955, more than 20,000 prisoners were allowed to leave their cells by party decree, contrary to the pardon measures promulgated by law. Those sentenced during the Kádár reprisals were released by two partial and one general amnesty. The March 1963 measure was linked to the country\u27s international situation. The release of prisoners who had previously been sentenced to death but had fortunately been pardoned revealed the offences committed against them, which had been concealed.
