No full textThe article focuses on selected rulings of German courts that deal with behaviour defined in the German Criminal Code as the crime of incitement to popular hatred. The purpose of this article is to present how courts have assessed specific statements from the point of view of the occurrence of prohibited acts characteristics in hate speech. The article presents the facts and legal evaluation of the behaviour to indicate which behaviors fulfill the characteristics of the criminal act of inciting to popular hatred under German laws.Also selected rulings of Polish courts, which relate to the interpretation of the characteristics of the hate speech crime, are taken into consideration. The author has selected some rulings of Polish courts, which are thematically similar to the rulings of German courts. In conclusion, the author has pointed out the differences between the characteristics of criminal acts in German laws and Polish laws, and thus a different approach of two judicial systems to some specifically indicated contents.The article focuses on selected rulings of German courts that deal with behaviour defined in the German Criminal Code as the crime of incitement to popular hatred. No full textThe presented article focuses on International Tracing Service (from 2019 operating under the name The Arolsen Archives – International Center on Nazi Persecution), world’s biggest archive on Holocaust victims and survivors, which activity is analyzed in the context of individual and collective memory of the Shoah. The article references, among others, concepts introduced by Jan Gross, Marianne Hirsch and Dan Stone in order to depict International Tracing Service as an important agent in shaping the European memory of the Holocaust.Prezentowany artykuł przedstawia funkcjonowanie International Tracing Service (Międzynarodowej Służby Poszukiwań, od 2019 r. pod nazwą The Arolsen Archives – International Center on Nazi Persecution), największego na świecie archiwum dokumentów dotyczących ofiar i ocalałych z Holokaustu. Działalność tej instytucji jest analizowana w kontekście indywidualnej i zbiorowej pamięci Zagłady. Autorka sięga do koncepcji zaproponowanych m.in. przez Jana Grossa, Marianne Hirsch i Dana Stone’a, aby ukazać znaczenie International Tracing Service dla kształtowania europejskiej pamięci Shoah

No full textThe encyclical Fides et Ratio is a continually inspiring document in which John Paul II sought to answer the question of the relationship between faith and reason, and thus between theology and philosophy. It follows the tradition of the Church, but at the same time reflects the post-Conciliar view of the autonomy of the empirical sciences and the humanities. The present study deals with philosophy which John Paul II calls “Christian philosophy.” The concept of metaphysics, which has influenced Christian philosophy, is crucial here. Despite a lot of criticism concerning metaphysics since the modern period, John Paul II defends the metaphysical position as an integral part of the Christian philosopher’s thinking. His understanding of metaphysics will be discussed in the following study

Get PDFThe references to the Jewish theme selected from Babel\u27s text, occurring in the form of sentences and phrases, formed the subject of analysis, the meaning of which was determined by the representation of the image of Jewish existence against the background of looting, military operations during the civil war of the early 20s of the twentieth century. The events are taking place on the territory of eastern Poland and western Ukraine. The appearance of representatives of the local Jewish environment, their appearance, occupations, clothes, actions, behavior, as well as attitudes towards them from others, their relationships with these others, their internal relationships – in the family, in the community, between communities, among themselves – all this becomes the object of a consistent semantic distribution. There are distinguished groups and subgroups, the visual, viewable description and characteristics of which make it possible to see and understand not only what is happening, but also what the world of Jewish existence depicted by Babel in his work represented. The consequence of the proposed consideration could be a semantic, according to the highlighted features, characterizing the description of what constitutes Jewish features and Jewish specifics, both in relation to the time and space shown in Babel, and in a broader perspective.Obiekt analizy stanowią tu wybrane z tekstu Babela zdania i połączenia wyrazowe, w których zawarte są odniesienia do tematyki żydowskiej w kontekście egzystencji Żydów na tle grabieży, działań wojennych w okresie wojny domowej na początku lat 20-ych XX wieku. Omawiane wydarzenia rozgrywają się na terytorium wschodniej Polski oraz zachodniej Ukrainy. Pojawienie się przedstawicieli lokalnego środowiska żydowskiego, ich wygląd zewnętrzny, zajęcia, odzież, zachowanie, jak również stosunek otoczenia do nich, wzajemne relacje wewnątrz rodziny i wspólnoty oraz pomiędzy wspólnotami są tu obiektem stopniowej klasyfikacji semantycznej. Autor wydziela grupy i podgrupy, których ilustratywny opis i charakterystyka pozwalają zauważyć i zrozumieć nie tylko zachodzące wydarzenia, lecz także to, czym jest przedstawiony w utworze Babela świat żydowskiej egzystencji. Skutkiem takiego podejścia jest semantyczny, oparty na wyróżnianych cechach opis tego, co składa się na żydowskie właściwości i żydowską specyfikę zarówno w odniesieniu do opisanego w tekście utworu czasu i przestrzeni, jak i w szerszej perspektywie.Выбранные из текста Бабеля, встречающиеся в форме предложений и словосочетаний, упоминания еврейской темы, составили предмет анализа, смысл которого определялся представлением образа еврейского существования на фоне разграбления, военных действий в период гражданской войны начала 20-х годов ХХ столетия. События разыгрываются на территории восточной Польши и западной Украины. Появление представителей местной еврейской среды, их внешний облик, занятия, одежда, действия, поведение, равно как и отношения к ним со стороны других, их отношения с этими другими, а также отношения внутренние – в семье, в общине, между общинами, между собой, – все это становится объектом последовательного семантического распределения. Выделяются группы и подгруппы, наглядное, просматриваемое описание и характеристика которых делает возможным увидеть и понять не только то, что происходит, но и то, что представлял собой отображенный Бабелем в его произведении мир еврейского существования. Следствием предложенного рассмотрения могло бы быть семантическое, по выделяемым признакам, характеризующее описание того, что составляет еврейские особенности и еврейскую специфику, как в отношении показанного у Бабеля времени, пространства, так и в более широкой перспективе.  
Odpowiedzialność odszkodowawcza związana z ruchem pojazdów autonomicznych

Get PDFhe article describes the basis for criminal liability of drivers who commit intentional violations of basic safety rules. The analysis is carried out in terms of the possibility of assigning responsibility for a disaster in land traffic, and bringing a direct risk of disaster in land traffic (article 173 and 174 of the Penal Code respectively) – in the case of “accident-free” driving in violation of safety rules; in terms of assigning criminal liability for murder (article 148 of the Penal Code) in the event of causing the death of another road participant. This paper also discusses the issue of extending liability for a criminal consequence to several road participants (e.g. participants in an illegal race) and the legal significance of the injured party or another road participant contributing to causing a criminal act. The text contains de lege ferenda postulates.Artykuł opisuje podstawy odpowiedzialności karnej kierowców dopuszczających się umyślnych naruszeń podstawowych zasad bezpieczeństwa w ruchu lądowym. Analiza odbywa się pod kątem możliwości przypisania odpowiedzialności za katastrofę w ruchu lądowym (art. 173 k.k.), sprowadzenie bezpośredniego niebezpieczeństwa katastrofy w ruchu lądowym (174 k.k.) – w przypadku „bezwypadkowej” jazdy z naruszeniem zasad bezpieczeństwa; pod kątem przypisania odpowiedzialności karnej za zabójstwo (art. 148 k.k.) w przypadku spowodowania śmierci innego uczestnika ruchu. Tekst odnosi się także do kwestii rozszerzenia odpowiedzialności za przestępny skutek na kilku uczestników ruchu (np. uczestników nielegalnego wyścigu) oraz prawnego znaczenia przyczynienia się pokrzywdzonego lub innego uczestnika ruchu do spowodowania przestępnego skutku. Generalized polynomials on semigroups
Get PDFThis article has two main parts. In the first part we show that some of the basic theory of generalized polynomials on commutative semigroups can be extended to all semigroups. In the second part we show that if a sub-semigroup S of a group G generates G in the sense that G = S·S−1, then a generalized polynomial on S with values in an Abelian group H can be extended to a generalized polynomial on G into H. Finally there is a short discussion of the extendability of exponential functions and generalized exponential polynomials

In addition, exact expressions for the first and second Zagreb indices of the subset-strong products of two graphs are reported.
