Przyrzeczenie świadka w polskim procesie karnym jako (nie)zbędna czynność procesowa
No full textThis article discusses the issue of the institution of pledge that is given by the witness by the court in Polish criminal proceedings. In spite of the fact that the court shall base its judgment solely on the basis of findings of fact that are drawn inter alia on the witness’s testimony, there is no guarantee that witness’s testimony, despite to have a pledge given are truthful. Court practice shows that despite the formal obligation of having a pledge given, in reality, this institution, towards notorious presenting position of parties of the case that exempting the witnesses from having a pledge given, is solely on a paper. Hence, the main thesis of the Author about unnecessary such procedural action in Polish criminal procedure, that nowadays has lost its practial meaning.Tematem niniejszego opracowanie jest instytucja przyrzeczenia odbieranego od świadka przez sąd w polskim postępowaniu karnym. Instytucja ta ma swoje historyczne odniesienie, pierwotnie mając charakter religijny, a obecnie świecki, której zasadniczym celem jest zwiększenie gwarancji dla zgodnych z prawdą ustaleń faktycznych, czynionych w toku procesu przez sąd. Przyrzeczenie jako czynność symboliczna, nawiązująca bardziej do zasad etyki i moralności niż prawa, w swoim założeniu, miała wywierać emocjonalną presję na składającego zeznania świadka, w celu pozyskania prawdziwych zeznań. I jakkolwiek podstawę wyroku stanowić mogą tylko prawdziwe ustalenia faktyczne, oparte m.in. na zeznaniach świadka, to brak jest jednak gwarancji, że jego zeznania, pomimo odebrania przyrzeczenia, będą odpowiadały prawdzie. Praktyka sądowa pokazuje, iż mimo formalnego obowiązku odbierania takiego przyrzeczenia w rzeczywistości instytucja ta, wobec notorycznego stanowiska stron procesu zwalniającego świadków od składania przyrzeczenia jest jedynie papierowa. Stąd teza autora o zbędności tej czynności procesowej w polskiej procedurze karnej, która obecnie utraciła praktyczny sens. Nie bez znaczenia dla zasadności powyższej tezy jest także lekceważący stosunek społeczeństwa do poczucia odpowiedzialności za słowo, w tym także do instytucji wymiaru sprawiedliwości, w konsekwencji do obowiązującego prawa, co stanowi wyraz niskiej kultury prawnej tego społeczeństwa.

No full textThis article focuses on the issue of procedural guarantees for children acting as suspect or accused in criminal proceedings. Particular attention was paid to the two-pronged development of accountability standards – both in the context of universal acts and within the framework of regulations adopted at the European Union level. The key element of the study is an analysis of the judgment of the Court of Justice of the European Union of September 5, 2024, including a presentation of the facts of the case in which the preliminary questions were referred. The following part of the article assesses the impact of the ruling on the Polish legal order, with a particular focus on the April 14, 2023 amendments to the Code of Criminal Procedure. In this context, the fundamental problems of the Polish regulation were pointed out, including the issue of mandatory defense and the automatic termination of the obligation to provide it when the suspect reaches the age of majority.Niniejszy artykuł ma na celu weryfikację ewolucji gwarancji procesowych dzieci, będących podejrzanymi lub oskarżonymi w postępowaniu karnym. Zaprezentowano dwutorowy rozwój standardów odpowiedzialności, zarówno na poziomie uniwersalnych aktów prawnych, jak i na szczeblu Unii Europejskiej. Kluczowym elementem jest analiza wyroku Trybunału Sprawiedliwości Unii Europejskiej z dnia 5 września 2024 roku w sprawie C-603/22. Przedstawiono wnioski z perspektywy omawianego wyroku na tle nowelizacji Kodeksu postępowania karnego z dnia 14 kwietnia 2023 roku. Uwypuklono zasadnicze problemy, w szczególności aspekt obrony obligatoryjnej. Artykuł kończy się postulatem, iż omawiany wyrok będzie zobowiązaniem dla polskiego ustawodawcy do dalszych zmian prawnych. Praca może stanowić katalizator przyszłych badań nad aspektem zapewnienia dzieciom dopuszczającym się przestępstw najlepszej ochrony prawnej w postępowaniu karnym

No full textThis article examines Zygmunt Krasiński’s travels through the Alps between 1829 and 1830, as described in his letters, prose fragments, and French-language diary. The authors focus on how Krasiński depicted the places he visited, viewed through the lens of Romantic aesthetics, emotional sensibility, and – above all – his literary influences. The article also highlights the evolution of his writing from epigonic imitation to creative independence.L’articolo presenta il viaggio di Zygmunt Krasiński attraverso le Alpi nel 1829–1830 descritto in lettere, frammenti di prosa e nel suo diario. Gli autori del testo si sono concentrati sulle modalità di descrizione dei luoghi visitati, percepiti attraverso il prisma dell’estetica romantica, della sensibilità e (soprattutto) della lettura. Viene mostrata anche l’evoluzione della scrittura di Krasiński dall’imitazione epigona all’indipendenza creativa.Artykuł dotyczy podróży Zygmunta Krasińskiego po Alpach w latach 1829-1830. Zostały one przez niego opisane w listach, prozatorskich fragmentach i francuskim Dzienniku. Autorzy artykułu skupili się na sposobach opisywania odwiedzanych miejsc, postrzeganych przez pryzmat romantycznej estetyki, wrażliwości i (zwłaszcza) lektury. Autobusy autonomiczne – przyszłość komunikacji?
No full textThe article looks at a pilot project to introduce autonomous buses in the GZM Metropolis. Its aim was not only to test autonomous vehicles but also to examine public attitudes towards this form of transport. The research conducted by a team of scientists from the University of Silesia included an analysis of trust, safety, comfort, and emotions experienced by passengers travelling on an autonomous bus compared to traditional means of transport. The results indicate a generally positive attitude among test participants, especially among those interested in new technologies, although they also reveal concerns about the reliability of the system and the issue of legal liability.W artykule omówiono pilotażowy projekt wdrożenia autonomicznych autobusów w Górnośląsko-Zagłębiowskiej Metropolii. Jego celem było nie tylko przetestowanie pojazdów autonomicznych, ale również zbadanie postaw społecznych wobec tej formy transportu. Badania przeprowadzone przez zespół naukowców z Uniwersytetu Śląskiego objęły analizę zaufania, bezpieczeństwa, komfortu oraz emocji towarzyszących pasażerom podczas podróży autonomicznym autobusem w porównaniu do tradycyjnych środków transportu. Wyniki wskazują na ogólnie pozytywne nastawienie uczestników testów, szczególnie wśród osób zainteresowanych nowymi technologiami, choć jednocześnie uwidaczniają obawy związane z niezawodnością systemu i kwestią odpowiedzialności prawnej

Desiring-Machines, Community Politics and the Threat of Revolutionary Desire in Toni Morrison’s Paradise
No full textIn their work Anti-Oedipus: Capitalism and Schizophrenia, Gilles Deleuze and Felix Guattari offer an analysis on the formation of political and economic structures in capitalist societies based on the interpellation of subjects via a system of controlling physical and psychological desires. Their analysis showcases how desire control produces effective labor in a capitalist system, creates psychological massification and achieves political hegemony in a community of interpellated subjects. For the machine of society to function properly, desire needs to be filtered and commodified, otherwise it threatens the system with revolutionary ruptures. In Toni Morrison’s Paradise, the concept of community relates Ruby (a small all-black town cut off from the rest of the world) and the sign of its ontological other, the Convent (a house for wayward women), with the history of racial conflict and the politics of gender. Following Deleuze and Guattari’s analysis of how desire politics affect community politics, I attempt to examine how both the interpellating and revolutionary functions of their respective “desiring-machines” lead the communities in Paradise either to decay or evolution. I propose a parallelism between the signs of Ruby and the Convent with the sign of the despotic body (as explained by Deleuze and Guattari) in an attempt to represent the distorting and unifying processes that transform the experiences of both communities. By exploring the restoring flow of desire represented in the dance of the Convent women, I draw attention to the revolutionary changes desire causes in both the physical bodies of the character subjects and the organless bodies of the two communities. As a final point, by applying Deleuze and Guattari’s theory of the body without organs to the symbolic spaces of the Oven and the Convent’s cellar, I highlight the linearity of the process of social-production via desire-production

No full textMarking fifty years since the Fall/Liberation of Saigon, this issue of Review of International American Studies revisits the intertwined histories and memories of “Vietnam” and “America” through the lens of literature, visual culture, and transnational exchange. The introduction reflects on the enduring resonance of Hubert van Es’s 1975 rooftop photograph—an image that has come to symbolize both the end of the Vietnam War and the beginning of a global struggle over its remembrance. As state-sanctioned and diasporic narratives continue to diverge, Vietnam’s postwar landscape and its global diaspora reveal competing modes of memorialization: triumph and loss, exile and belonging, ideology and affect. The featured contributions trace how writers and artists—among them Marcelino Truong, Nguyễn Phan Quế Mai, Lan Cao, and Viet Thanh Nguyen—reconfigure these contested memories through narrative, philosophy, and art. The issue underscores how the “American War” must be reframed as a Vietnamese and transnational experience, extending beyond national or temporal boundaries. Engaging with the “transnational turn” in American Studies (Fishkin 2004), it argues that the afterlives of the war persist in literature’s ongoing negotiation of trauma, identity, and reconciliation—revealing “Vietnam” and “America” as interwoven cultural constructs on the ever-shifting battlefields of memory

Utilizing interdisciplinary sound research methods, it investigates how radio artists repurpose discarded materials and archival sounds to challenge traditional approaches to radio art, its forms of delivery, and aesthetics. By analyzing selected artistic cases and practices, the article elucidates how radio artists navigate the tensions between creation and destruction, continuity and disintegration.Artykuł bada found footage, odpady, pozostałości po innych programach i znaleziska w sztuce radiowej. Czerpiąc z interdyscyplinarnych metod badania dźwięku, artykuł sprawdza, w jaki sposób artyści radiowi ponownie wykorzystują wyrzucone materiały i archiwalne dźwięki, aby rzucić wyzwanie konwencjonalnemu podejściu do narracji radiowych, formom podawczym, estetyce dramatu radiowego.
