    Appellate Mechanism in Investment Arbitration: Novis Inventis or Sophistication of Existing Mechanism?

    In the past two decades, investment treaty arbitration has faced multiple challenges and criticism, which caused critics toward its efficiency and actual workability. However, it is still the main and the preferable method of dispute resolution between States and investors. Arbitration under the International Centre for the Settlement of Investment Disputes (ICSID) or UNCITRAL (The United Nations Commission on International Trade Law) allows an investor to sue a host state before an ad hoc arbitral tribunal for violations of bilateral investment treaties (BITs) or trade and investment agreements (e.g., the North American Free Trade Agreement (NAFTA)). Investor-State Dispute Settlement (hereinafter the “ISDS”) has been criticized for the lack of an appellate mechanism and the inconsistency and unpredictability of specific arbitration awards that are rendered. These shortcomings have often been attributed to the lack of a unified approach to ISDS and the lack of exact involvement of non-disputing parties in the proceedings.             This Article aims to examine the necessity of an appellate mechanism in investment treaty arbitration in the framework of legitimacy and complexity of the existing procedure. Part II briefly identifies the existing post-award process, including the final and binding nature of the awards, and annulment award procedures. Part III then explores the implementation and discussion of the initial draft presented by UNCITRAL Working Group III. The Article is both descriptive and normative in outlook.     A Critical Review of Problems Facing Higher Education in North-East Geo-Political Zone of Nigeria

    Higher education is the education after secondary school education. One of its objectives is for human resources development and training. Higher institutions in Nigeria are spread across the entire geo-political zone. The North- East political zone is home to many higher institutions both private and public. The public higher institutions in the zone are faced with many problems. This paper examined the problems public higher institutions are facing in North- East political zone of Nigeria. Qualitative and quantitative data were used in the paper. The concluded that, inadequate funding, insecurity, shortage of academic staff, corruption, inadequate infrastructural facilities, Brain-drain and strike actions were some of the problems higher institutions in the North- East political zone were faced with. In order to address these problems, the paper recommended that both federal and state government should increase the funding of public higher institutions in the region, more academic staff should be recruited and more infrastructure facilities should be provided. Lecture should be motivated and agreement reached with trade unions should be implemented and anti-corruption agencies should be deployed to higher institutions in the zone with aims of fighting corruption in the institutions

    Ikwerre Moral Values: A Panacea for Insecurity and Peaceful Co-Existence in Nigeria

    There is a high level of insecurity everywhere in Nigeria at the moment as no part of the country appears safe enough for any human activity. In the Northeast are the Boko Haram insurgents that have been terrorizing the entire Northern Nigeria for more than a decade now. In the Northwest are the cows’ rustlers and the bandits disquieting the society from the Sokoto, Katsina and Kaduna axis. Around Plateau and Benue States were first to appear the Fulani herdsmen who started by destroying the lives and properties of their hosts and seizing their lands but are now to be found everywhere in Nigeria and they are also into dastardly armed robbery and kidnapping. Cultism, Advance Fee Fraud (419) and Internet scammers (Yahoo Boys) and their nefarious ritual killings pervade the Southeast and Southwest geopolitical spaces. The militants in their various sprinter groups are making life unbearable in the Southsouth and some Southeast and Southwest States. Kidnapping and armed robbery dominate the North central States, particularly Niger and Kogi. It, in fact, looks like there is no place in Nigeria that is safe to live in or do any form of business

    Attaining Gender Equality in Post-Conflict Society: the Inexorable Course to Sustainable Peace-Building

    Ethnic, political, historical, economic, social and gender tensions within countries, and the quest for dominance by state and non-state actors are subsumed in a quantum of deleterious consequences. Despite, rivalry among global superpowers, there is no evidence of a decline in regional disputes or in organised violence by ethnic groups, religious fundamentalists, banditry, secessionist movements or terrorists. These internal conflicts are made more complex and lethal by modern technology and communications, international collaborations and the proliferation of cheap, but destructive weapons in the hands of young people. Contemporary conflict portends aggravated vulnerability of civilians, defined along gender and age strands, where women, girls, children and the aged are the most abused, raped, widowed, discriminated, debased and dehumanised. They are despondent, subjugated, traumatised and denied access to social good, status, education, health and equal rights - the fundamentals of equitable and just society. While data are derivatives of qualitative method, strands of feminist and social action perspectives offered latitude for theoretical analysis. It is alluded in the paper that peace-building in the post-conflict era would be elusive and ephemeral if gender equality is not actualised through social investment, gender intersectionality, masculinity connectivity, criminalisation of gender discrimination and violence
