Muslim Societies, Civil and Political Rights, and The Guarantee of Religious Freedom: A Comparative Study Between Indonesia and Turkiye Constitutions

Until the middle of the 20th century, many Muslim population countries became free and independent countries following the end of world colonization. Those countries try to adopt several modern political and legal values, including establishing democracy and state constitutions. One of the constitution's contents in a democratic country is guaranteeing and strengthening civil and political rights. Civil and political rights regulation should be written in a partial part of the constitution as a commitment to live in modern democratic circumstances. Philosophically, citizens' civil and political rights in democratic circumstances cannot be restricted by government. Nevertheless, a gap in the legal argument regarding the limitation of civil and political rights in constitutions is constantly discussed. This article looks at civil and political rights limitations in two cases in different countries: Indonesia and Turkiye. These two countries were chosen as subjective data based on the legal system's proximity pattern and socio-religious conditions. Both countries are also close to the civil law system and have historical references to Islam. In addition, both countries have experience with the restriction of religious organizations. Indonesia has dealt with the restriction of Hizbut Tahrir Movement. Meanwhile Turkiye has experience in banning Gulen Movement. By this background, some questions emerge: How do Indonesian and Turkish constitutions, as Muslim population countries, guarantee human rights issues? By using a comparative legal study and a sociological-empirical approach, this article compares the Indonesian and Turkiye constitutions to see how the two countries guarantee human rights, predominantly civil and political rights. The result of this article reveals that national consensus, national security, stability, and legitimate political power are some of the legal arguments that are always present in the discourse on restrictions on human rights. Under these conditions, human rights restrictions are commonly regulated in the constitution, which contains human rights laws

Islamization of Science: Ziauddin Sardar’s Critique of the Universality of Science

This qualitative research explores Ziauddin Sardar's critique of Western-influenced universal science. It employs a literature study to analyze Sardar's thoughts using various methods. The findings reveal that Islamic science, rooted in ethical principles, offers an alternative to Western science, which often overlooks diverse paradigms and local knowledge systems. While Islamic science excels in addressing region-specific issues, it may struggle with complex problems. In contrast, Western science, considered global, has historically caused environmental challenges by disregarding non-conventional paradigms. Therefore, Islamic science, with its inclusive approach to knowledge, presents a potential solution to the crises stemming from the dominance of Western scientific paradigms

معالم البناء السياسي عند ابن عاشور من خلال تفسيره التحرير والتنوير: دراسة موضوعية

    No full text
This research aims to clarify the milestones of political development according to Ibn ‘Āshūr in his interpretation of al-Taḥrīr wa Tanwīr through a thematic study. The problem with the research is that the Holy Qur'an's discussion of the milestones of developing politics is dispersed throughout its verses and chapters; therefore, acquiring a comprehensive understanding of those milestones was somewhat difficult. Thus, there was an urgent need to extrapolate the Holy Qur’ān to determine the milestones of political development according to Ibn ‘Āshūr and to present them in a clear and integrated manner. The importance of this research is evident in that it is concerned with showing the milestones of political development - which is one of the most important pillars of civilization development - in the light of the Qur’ānic view, and it is a subject that the nation greatly needs considering the decline it has been experiencing for a long time. The research will adopt the inductive approach by following the relevant Qur’ānic verses and Ibn ‘Āshūr 's interpretation of those verses, and then analysing them with the help of some relevant sources and references. The research concluded that the political system of the nation’s strength in the light of the Holy Qur’ān is represented in the principle of ruling with justice, which is the duty of rulers, the principle of obedience, which is the duty of the people, and the principle of ShËrā. Finally, politics and its purpose aim to ward off evil and bring interests (Jalb al-Maṣāliḥ wa dar’ al-Mafāsid). &nbsp

Furthermore, the Baayun Maulid tradition in Tapin Rantau Regency is also carried out in the month of Maulid to commemorate the birthday of the Prophet Muhammad SAW. This tradition is combined with the Maayun Anak tradition, the Banjar community custom of swinging children. (2) The relationship between Islam and the culture of Kerobok Maulid and Baayun Maulid is part of the manifestation of the existence of Islam in a culture. The reading of Sholawat and the Maulid as a form of Islamic identity in the Kutai and Banjar communities combined with customs shows the relationship between Islam and culture, which are inherently one unit and have harmony within them
