Al-Būṭī vs. Al-Qaraḍāwī: A Comparative Study of Thought on Al-Khurūj 'Alā Al-Ḥukkām
This study examines the polemic of al-khurūj ‘alā al-ḥukkām (rebellion against rulers) as debated by Yūsuf al-Qaraḍāwī and Muḥammad Sa‘īd Ramaḍān al-Būṭī, particularly in the context of the Syria crisis and the Arab Spring. The theoretical framework employed is maqāṣid al-sharīʿah, encompassing the hierarchy of maṣlaḥah based on ḍarūriyyāt, ḥājiyyāt, and taḥsīniyyāt; the preservation of the kulliyyāt al-khams (religion, life, intellect, lineage, and property); the balancing of conflicting mafsadah; the application of sadd al-dharāʾiʿ (blocking the means to harm); and the consideration of maʾālāt (future consequences). Methodologically, the study employs a qualitative textual analysis of fatwa, jurisprudential writings, and theological arguments by scholars, situating their views within the broader maqāṣid framework. Within this framework, al-Qaraḍāwī justifies rebellion against unjust rulers as both a moral duty and a religious obligation to uphold justice, framing it within the maqāṣid imperative of resisting tyranny. Conversely, al-Būṭī employs the same maqāṣid tools to prohibit rebellion, prioritising the avoidance of bloodshed and societal collapse over immediate political reform. The findings reveal that although both scholars engage maqāṣid al-sharīʿah, their divergent prioritisation leads al-Qaraḍāwī to emphasise justice and activism as central to preserving Islam’s dignity. At the same time, al-Būṭī underscores stability and unity as essential safeguards against greater chaos
Digital Communication Strategy to Increase Visibility of Women's MSMEs: A Case Study of Padang City
Women's participation in Indonesia's economy has long been a focus of attention. Notably, more than 60 percent of MSMEs (Micro, Small, and Medium Enterprises) in Indonesia are managed by women. While numerous studies have examined how digitalization impacts MSME performance in Padang City, there has been little to no specific research on effective communication strategies in the digital realm. Therefore, this study aims to provide comprehensive and relevant insights for developing effective digital communication strategies to enhance the marketing performance of women-owned MSMEs in Padang City. The study includes an in-depth analysis of the types of digital platforms used, the messages conveyed, and the ways interactions with customers are conducted through social media, websites, or e-commerce platforms. The research methodology involves the collection of primary data through in-depth interviews and surveys, as well as secondary data related to the profiles of women-owned MSMEs. The data analysis employs multivariate regression analysis to identify the influence of several independent variables on multiple dependent variables simultaneously.The results indicate that strategies involving the use of social media and online advertisements are highly effective in increasing the visibility of MSMEs on social media platforms. Meanwhile, using websites and online advertisements proves to be more effective in driving visitors to the MSME websites
Integration of Islamic Values in Learning Evaluation to Improve the Quality of Islamic Education
Learning evaluation is a central component in determining educational quality; however, evaluation practices in Islamic education often remain dominated by cognitive and summative orientations, limiting their ability to support holistic educational goals. This study explores the integration of Islamic values into learning evaluation as a strategy for improving the quality of Islamic education. Using a qualitative literature review, this research analyzes and synthesizes findings from 20 selected national and international journal articles on learning evaluation, Islamic education, and value-based assessment. Data were examined through descriptive tabulation and thematic analysis to identify dominant patterns and conceptual relationships. The findings reveal that learning evaluation in Islamic education is gradually shifting toward more holistic practices that integrate cognitive, affective, and spiritual dimensions. The integration of Islamic values, such as honesty, responsibility, discipline, and moral integrity, enables evaluation to function not only as a technical measurement tool but also as a pedagogical and moral process that supports character formation. Evidence from program evaluation, instructional assessment instruments, and subject-based learning indicates that value-based evaluation can be applied across educational levels and disciplines. This study concludes that integrating Islamic values into learning evaluation is a foundational approach to strengthening the quality of Islamic education by aligning academic achievement with ethical and spiritual development
Willful Blindness sebagai Mens Rea Telaah Filsafat Hukum H.L.A. HART
Perkembangan kejahatan modern menunjukkan meningkatnya praktek penghindaran pengetahuan (willful blindness) oleh pelaku untuk terlepas dari atribusi mens rea, sehingga menimbulkan tantangan bagi asas legalitas dan prinsip kesalahan (sculd) pada sistem hukum pidana. Persoalan utamanya adalah mens rea yang berbasis kesadaran hukum dapat dikonstruksikan pada kondisi, ketika pelaku secara sengaja memilih untuk tidak mengetahui fakta yang dilarang. Penelitian ini bertujuan untuk menganalisis legitimasi normatif dan moral dari doktrin willful blindness dalam kerangka filsafat hukum H.L.A. Hart, dengan fokus pada hubungan antara kondisi epistemik pelaku, struktur pertanggungjawaban pidana, dan prinsip keadilan substantif. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan filosofis, konseptual, dan perbandingan hukum, serta mengkaji teori H.L.A. Hart mengenai internal point of view, kapasitas mengikuti aturan, dan struktur norma primer dan sekunder. Hasil penelitian menunjukkan bahwa willful blindness dapat dikualifikasi sebagai bentuk mens rea yang sah, jika memenuhi standar rasional mengenai kesadaran resiko tinggi, tindakan aktif menghindari pengetahuan, dan motivasi instrumental memperoleh manfaat atau menghindari hukum. Penerapan willful blindness konsisten dengan prinsip pertanggungjawaban pidana yang adil, karena pelaku tetap memiliki kapasitas deliberatif untuk menaati hukum, tetapi secara sadar menolak menggunakannya. Namun, penerapannya harus dibatasi oleh asas legalitas, rule of recognition, dan instrumen pembuktian yang ketat, agar tidak berubah menjadi kriminalisasi terhadap ketidaktahuan yang tidak bersalah. Dengan demikian, konstruksi willful blindness dalam perspektif H.L.A. Hart memberikan dasar positivistik dan moral yang simultan bagi pemidanaan kejahatan berstruktur tanpa mengabaikan kepastian hukum dan perlindungan hak asasi pelaku
Madzhab Hukum Pembangunan Mochtar Kusumaatmadja dalam Dinamika Hukum Indonesia Masa Kini : Perspektif Budaya Hukum dan Kesadaran Masyarakat
Seiring dengan perubahan sosial yang semakin kompleks, hukum dituntut berperan tidak hanya sebagai aturan, tetapi sebagai kekuatan yang mampu mendorong transformasi masyarakat secara adil dan terarah. Teori hukum pembangunan Mochtar Kusumaatmadja menegaskan bahwa hukum harus menjadi sarana pembaruan sosial, namun implementasinya masih menghadapi hambatan seperti lemahnya budaya hukum, rendahnya kesadaran masyarakat, serta potensi penyalahgunaan hukum sebagai alat kekuasaan. Penelitian ini bertujuan menilai relevansi hukum pembangunan dalam konteks kontemporer serta menawarkan kerangka evaluatif baru untuk mengukur keberhasilannya. Metode yang digunakan adalah pendekatan yuridis normatif melalui studi pustaka dan analisis deskriptif. Hasil penelitian menunjukkan bahwa keberhasilan hukum pembangunan tidak cukup dinilai dari regulasi, tetapi harus dilihat melalui kualitas substansi hukum, efektivitas penegakan, penerimaan masyarakat, integritas kekuasaan, dan dampak sosial. Rumusan indikator ini menjadi kontribusi baru agar hukum pembangunan tetap relevan dan berkelanjutan
Pengembangan Handout Bahasa Indonesia Bermuatan Kearifan Lokal Pada Siswa Kelas V di MI DDI Tani Aman Samarinda
This study is a research and development (R&D) study that adapts the ADDIE model with adjustments based on the needs of the researcher. The purpose of this study is to produce an Indonesian handout product containing local wisdom and the level of validity of the Indonesian handout containing local wisdom for fifth grade students at MI DDI Tani Aman Samarinda. The implementation of this study includes validation tests by material experts and media experts, readability tests by small groups and large groups, and teacher responses related to the products developed.
The results of the study showed that the developed product was said to be feasible by material experts and media experts with a percentage of material expert assessment of 73.68% and a media expert assessment of 90.93%. The results of the readability test in the
small group were 90% and the large group was 89.16%. The results of the responses of teachers who teach the Indonesian Language study field for fifth grade were 81.54%. This indicates that the Indonesian handout containing local wisdom produced in this study is declared feasible to be implemented in the learning process in Indonesian at MI DDI Tani Aman Samarinda
Implementation of the Village Zakat Index in the Moncongloe Lappara Village Community, Moncongloe District, Maros Regency
This Study aims to determine the priority scale regarding the eligibility of Moncongloe Lappara village to receive zakat funds. This study uses a mixed method research approach, which combines qualitative and quantitative methods. Quantitative data was obtained through IDZ measurements based on five main dimensions: economy, education, health, social, and da'wah, while qualitative data was collected through in-depth interviews and direct observation of the social conditions of the community.The IDZ calculation results obtained by the researcher in Moncongloe Lappara Village were 0.57, which is classified as “fairly good.” The details of each dimension index are as follows: the economic dimension scored 0.38. The health dimension scored 0.67, the education dimension scored 0.75, the social dimension scored 0.60, and the da'wah dimension scored 0.54. This shows that Moncongloe Lappara Village can be considered or has the opportunity to receive assistance from zakat funds, especially to improve the welfare of villagers in terms of economy. The main program recommendations prioritized for implementation in the Moncongloe Lappara Village community are the establishment of an integrated creative industry community, the provision of a flea market, the provision of a sharia cooperative or other types of financial institutions, assistance, and financing for MSMEs
Protection of Human Rights in the Framework of Global Judicial Reforms
The purpose of the article is to analyse the relationship between judicial reforms and human rights protection, especially in the light of global and international changes. The article examines how judicial reforms carried out in different countries, aimed at improving the efficiency, accessibility, and fairness of the judicial process, affect the exercise and protection of fundamental human rights and freedoms. The authors examine the case studies of Colombia and Turkey in the context of their judicial reforms to understand whether reforms are always sufficient to ensure human rights. Based on the study, it is established that reforms alone are not enough. Sustained political will and international influence are also needed. It is established that the protection of human rights in the context of global judicial reforms is a relevant and significant topic that requires attention and improvement in the modern world. Protection of human rights through judicial reforms only meets the needs of modern society
The Relationship Between Social Engagement and Social Awareness Among Students in an Islamic Education Program
The globalization era with digital communication technology has led to a decline in social awareness within society. As agents of change, university students play an important role in building social concern through involvement in various activities. This research aims to examine the extent of influence that social activities have on the social awareness of Islamic Religious Education (PAI) students at UIN Sultan Aji Muhammad Idris Samarinda, who have demonstrated active participation in community service programs organized by HMPS PAI and the "Teman Panti" program by the EPIC community. This research employed a quantitative approach with correlational research design, while sampling was conducted using purposive sampling technique based on predetermined criteria. Data analysis included tests of normality, linearity, simple regression, correlation, coefficient of determination, and t-test to measure the influence and significance of relationships between variables. The research results demonstrate that social activities have a positive and significant effect on the social awareness of PAI students, with a significance value of 0.003 < 0.05 and t-count (3.156) > t-table (1.675). The correlation between the two variables falls in the medium category (Pearson Correlation 0.408), with social activities contributing 16.6% to students' social concern. These findings affirm the importance of social activities as an effective strategy in fostering social concern among university students
Efforts To Improve Math Learning Outcomes Through Problem Solving Learning Models
This study aims to improve the mathematics learning outcomes of fifth-grade students through the implementation of a problem-solving learning model that emphasizes the ability to understand, analyze, and solve problems independently or in groups. The method used is Classroom Action Research (CAR), conducted in two cycles with 32 students as subjects at an elementary school in Jakarta. Data were collected through learning outcome tests, observations, and interviews. The results showed an increase in the average student score from 58.50 before the intervention to 65.00 in the first cycle and 75.50 in the second cycle, along with an increase in the percentage of students meeting the Minimum Mastery Criteria (MMC) from 43.75% to 87.50%. Additionally, there was an improvement in students’ learning motivation, logical thinking skills, and collaboration. These findings indicate that the problem-solving learning model is effective in enhancing mathematics learning outcomes and is therefore recommended for continuous application by teachers in the learning process
