Terekenin Tespiti İstemi ve Mirasın Hükmen Reddinin Tespiti Davasının Yargıtay Hukuk Genel Kurulunun T. 22.09.2010 E.2010/2-379 K. 2010/413 Sayılı Kararı Kapsamında Değerlendirilmesi
Yargıtay Hukuk Genel Kurulunun 22.09.2010 tarihli ve E. 2010/2-379, K. 2010/413 sayılı kararına konu uyuşmazlıkta davacı, mirasbırakanın terekesinin borca batık olduğunun tereke tespit davasında ortaya çıktığını ve bu sebeple mirası reddettiklerini ileri sürerek mirasın reddine karar verilmesini talep etmiştir. Yerel Mahkemece süresi içerisinde mirasın reddi istenmediğinden, açılmış olan dava ile davacıların mirası örtülü olarak kabul etmiş sayılacakları ve terekenin borca batık olduğu hususunun ispatlanmadığı gerekçesi ile davanın reddine karar verilmiş, Yargıtay Hukuk Genel Kurulu ise mirasçıların Türk Medenini Kanununun 610. maddesinin ikinci fıkrasında açıklanan davranışlarla mirası kabul etmiş sayılmadığı müddetçe hükmî reddin sonuç doğurması için herhangi bir irade açıklaması gerekmediğini, terekenin tespiti için davacılar tarafından açılan davanın, davacıların mirası örtülü olarak kabul ettikleri sonucunu doğurmayacağını belirterek Yerel Mahkeme kararını bozmuştur. Söz konusu karar bir ilke kararı olması sebebiyle gerek öğreti gerekse uygulama açısından önemli bir karar olmakla beraber, terekenin tespiti istemi ve mirasın hükmen reddinin tespiti davasının, birbirleriyle olan bağlantısını ve sınırlarını ve yine mirasın gerçek reddi süresi ile bu iki kurumun ilişkisini ayrıntılı olarak açıklamaması nedeniyle uygulamada belirsizliğe yol açmaktadır. Bunun yanında, her iki hukukî kurum ile ilgili hâkimin re’sen araştırma ödevinin de açıklığa kavuşturulması gerekmektedir. Son olarak, terekenin tespiti istemi ve mirasın hükmen reddinin tespiti davasının Türk Medeni Kanununun m.619 vd. hükümleriyle düzenlenen resmi defter tutma kurumu ile de beraber ele alınması bu üç hukukî kurumun kesişme noktalarının belirlenmesi yönünden önem taşımaktadır. Bu çalışmayla, Yargıtay Hukuk Genel Kurulu kararından yola çıkılarak söz konusu hukukî kurumların ayırt edici özelliklerinin ve kesişim noktalarının aydınlatılması, uygulamada ortaya çıkmış veya çıkabilecek çeşitli uyuşmazlık hâllerinin yol açabileceği belirsizliklerin giderilmesi hedeflenmektedir
A Study on the Operational Functioning of Ground Services Companies' Departments in Civil Aviation and the Equipment They Use: The Example of Sabiha Gökçen Airport
Bu çalışmada, sivil havacılığın başlangıcından günümüze kadar olan sürecinin, dünya ve Türkiye'de tarihsel gelişimi içerisinde yer alan önemli kilometre taşları, havalimanlarının genel şeması, yer hizmetlerinin operasyonel yapısının unvan skalası ve hiyerarşi açısından irdelenip; temsil hizmetleri, ramp hizmetleri, temizlik hizmetleri, ikram, gözetim ve yönetim hizmetleri, yolcu hizmetleri, harekat, Operasyon Kontrol Merkezi hizmetleri, çeşitli idari birimler ve departman hizmetleri, yer hizmetleri iş ortakları, yer hizmetlerinin kullandığı sistemler ve iletişim mesajları, operasyonlarda kullanılan teçhizat ve ekipmanlar gibi konulara değinilip analiz edilmiştir. Bu tez çalışmasının amacı, havacılık sektörüne ilgi duyan öğrencilere, araştırmacılara ve sektörde çalışan profesyonellere saha gözlemlerinin tecrübeler ile sentezlenmesinden doğan bilgi aktarımının daha anlaşılabilir ve faydalı olabileceği düşüncesidir. Bu bağlamda, havacılık sektörünün dinamik yapısına katkı sağlayacak yeni araştırmalara ve çalışmalara ilham kaynağı olmasını; özellikle yer hizmetleri alanındaki operasyonel süreçlerin daha verimli hale getirilmesine ve sektöre olan katkıların artmasına yönelik önemli bir adım olması da amaçlanmaktadır. Sonuç olarak, bu çalışmamda nitel araştırma yöntemleri benimsenmiş, yer hizmetleriyle ilgili global trendlerden faydalanılarak karşılaşılan zorluklar ve çözüm önerileri de çalışmanın önemli bulguları arasında yer almaktadır. Sabiha Gökçen Havalimanı örneği üzerinden yapılmış araştırma ve derlemeler olup, havacılık sektörüne dair çeşitli literatür kaynaklarından yararlanılarak ve sektörde çalışan uzmanların bilgi, deneyim ve tecrübeleri doğrultusunda hazırlanmıştır. Tezde yer alan bilgilerin doğruluğunu ve güncelliğini sağlamak amacıyla titizlikle literatür taramaları ve alan araştırmalarının yapılmasıyla birlikte, sektördeki gelişmelere yönelik öneriler sunulup, önem teşkil eden konulara cevapların verilmesi sağlanmıştır. The study explores the general layout of airports, the organizational structure of ground handling services with respect to title hierarchy, and provides a detailed analysis of various service components, including representation, ramp handling, cleaning, catering, supervision and management, passenger services, flight operations, Operations Control Center services, administrative units and departmental operations, ground handling partners, systems and communication protocols used in ground operations, as well as the equipment and tools utilized in these processes. The primary objective of this thesis is to offer comprehensible and practical knowledge derived from the synthesis of field observations and professional experiences to students, researchers, and professionals within the aviation sector. In this regard, the study aims to serve as a source of inspiration for future research and scholarly work that contribute to the dynamic nature of the aviation industry. Specifically, it seeks to promote more efficient operational processes in the field of ground handling services and enhance the sector's overall impact. Qualitative research methods were employed in the preparation of this study. The research incorporates global trends in ground handling services, identifying key challenges and proposing viable solutions. The analysis is grounded in case studies and field data collected at Sabiha Gökçen International Airport, and is supported by a thorough review of relevant literature as well as insights obtained from industry experts. To ensure the accuracy and currency of the information presented, extensive literature reviews and field investigations were conducted. The study concludes with recommendations addressing critical issues and ongoing developments within the aviation sector. Cancer Stem Cell Enrichment in in Vitro Models: Techniques, Insights, and Applications
Vosough, Massoud/0000-0001-5924-4366; Zarrabi, Ali/0000-0003-0391-1769Due to the substantial role of cancer stem cells (CSCs) in therapeutic resistance and metastasis, the study of them is of great importance. However, their low abundance within the tumor cells makes it challenging to study their molecular pathophysiology. This limitation highlighted the critical need for reliable enrichment techniques to provide enough cells for in vitro tests. This review focuses on various methods that implemented for enrichment of cancer stem-like cells' subpopulations from the heterogeneous population of cancer cells. In this regard, various key physicochemical parameters such as hypoxia, shear stress, high glucose concentration, autophagy, and chemotherapy-induced stress have been explored for their potential to enhance CSC enrichment. The results presented in the literature confirmed that modifying these parameters can improve the enrichment of CSCs by promoting stem-like cells phenotype. However, there is still a necessity for comprehensive studies that compare the impact of these parameters on CSC enrichment, which should be addressed in future works.Science Citation Index Expande
1924 Anayasası ve Kurucu İktidar Tartışmaları
1924 Anayasası yapılmadan önce Birinci Türkiye Büyük Millet Meclisi (TBMM) seçimlerin yenilenmesi kararı almıştır. Bu kararın 1921 Anayasası’nın Madde-i Münferidesine ve Nisab-ı Müzakere Kanunu’na uygun olup olmadığı doktrinde tartışma konusu olmuştur. Söz konusu tartışma çerçevesinde bu işlemin, meclise karşı bir darbe olduğu ve 1924 Anayasası’nı yapan iktidarın bir asli kurucu iktidar niteliği taşımadığı yönünde görüşler öne sürülmüştür. Bu noktada hem seçimlerin yenilenmesi kararı alınırken hem de 1924 Anayasası yapılırken Mecliste gerçekleşen tartışmalar ve Meclisin bu işlemleri gerçekleştirme yöntemi önemlidir. Dönemin hukukî ve siyasî koşulları dikkate alındığında seçimlerin yenilenmesi kararının hukuka uygun alındığı ve 1924 Anayasası’nı yapan İkinci TBMM’nin demokratik asli kurucu iktidar yetkilerini kullandığı sonucuna varılmaktadır
Investigation of the Effect of Job Security on Job Satisfaction of Biomedical Employees in Healthcare Institutions and Organizations
Sağlık sektöründe çalışanların iş memnuniyeti ve iş güvencesi, sağlık hizmetlerinin etkinliği ve kalitesi üzerinde doğrudan etkiye sahiptir. Biyomedikal çalışanlar, hastanelerde tıbbi teknoloji ve cihazların yönetimi, bakımı ve onarımı gibi kritik görevleri üstlenmekte olup bu grubun iş memnuniyeti düzeyi ile işinin güvencede olduğuna dair algısı hem kendi performanslarını hem de hasta bakımının sürekliliğini etkilemektedir. Bu nedenle bu tez çalışmasında, sağlık kurum ve kuruluşlarında görev yapan biyomedikal çalışanların iş güvencesi ve iş memnuniyetine ilişkin görüşleri incelenmiştir. Araştırmanın temel amacı, biyomedikal personelin algıladığı iş güvencesi ile deneyimlediği iş memnuniyeti düzeylerini ve bu iki değişkeni şekillendiren faktörleri belirlemek ve aralarındaki ilişkiyi analiz etmektir. Araştırma nicel ve tanımlayıcı tasarımla yürütülmüştür. Çalışma kapsamında, sağlık kurumlarında görev yapan 219 biyomedikal mühendis ve teknikerden çevrimiçi anket yoluyla veri toplanmıştır. Anket formu sosyodemografik sorular ile iş güvencesi ve memnuniyetine ilişkin ifadeler içermektedir; veriler istatistiksel tekniklerle analiz edilerek grup farklılıkları ve değişkenler arası ilişkiler incelenmiştir. Bulgular, katılımcıların cinsiyet, görev unvanı ve eğitim durumu gibi demografik özelliklerine göre iş güvencesi ve iş memnuniyeti algılarında anlamlı bir farklılık olmadığını göstermiştir. Biyomedikal personelin algıladığı iş güvencesi ile iş memnuniyeti arasında pozitif yönde anlamlı bir ilişki saptanmıştır. Biyomedikal çalışanların iş güvencesi beklentilerinin karşılanmasının iş memnuniyetini artıracağı değerlendirilmektedir. Bu bağlamda, sağlık kurumlarındaki biyomedikal personelin iş güvencesine yönelik uygulamalarının sürekli güçlendirilmesi ve çalışanlara tanınan sosyal hakların geliştirilmesi önerilmektedir.Job satisfaction and job security of employees in the healthcare sector have a direct impact on the efficiency and quality of healthcare services. Biomedical employees undertake critical tasks such as management, maintenance and repair of medical technology and devices in hospitals, and the level of job satisfaction of this group and their perception that their job is secure affect both their performance and the continuity of patient care. For this reason, this thesis examines the views of biomedical employees working in health institutions and organizations on job security and job satisfaction. The main purpose of the research is to determine the levels of job security perceived and job satisfaction experienced by biomedical personnel and the factors shaping these two variables and to analyze the relationship between them. The research was conducted with a quantitative and descriptive design. Within the scope of the study, data were collected from 219 biomedical engineers and technicians working in health institutions through an online survey. The questionnaire included sociodemographic questions and statements on job security and satisfaction; the data were analyzed with statistical techniques to examine group differences and relationships between variables. The findings showed that there was no significant difference in the participants' perceptions of job security and job satisfaction according to their demographic characteristics such as gender, job title and educational level. A significant positive relationship was found between job security and job satisfaction perceived by biomedical personnel. It is evaluated that meeting the job security expectations of biomedical employees will increase job satisfaction. In this context, it is recommended to continuously strengthen the job security practices of biomedical personnel in health institutions and to improve the social rights granted to employees

The jet axis decorrelation is defined as the angular difference between two definitions of the jet axis. It is obtained by applying two recombination schemes on all the constituents of a given jet reconstructed by the anti-k(T) sequential algorithm with a distance parameter of R = 0.4. The data set, corresponding to an integrated luminosity of 0.66 nb(-1), was collected in 2018 with the CMS detector at the CERN LHC. The jet axis decorrelations are examined across collision centrality selections and intervals of jet transverse momentum. A centrality dependent evolution of the measured distributions is observed, with a progressive narrowing seen in more central events. This narrowing could result from medium-induced modification of the internal jet structure or reflect color charge effects in energy loss. A Multi-Layer Neural Network Approach for Solving Fractional Heat Equations
In this study, a new multi-layer neural network (MLNN) approach designed to solve fractional heat equations (FHEs) is introduced. To handle the fractional derivative, the Laplace transform for approximation was applied. The results of our approach with those obtained using the finite difference method(FDM) are compared. The findings highlight the flexibility and computational efficiency of the proposed approach, making it a promising technique for solving FHEs. © 2025 Elsevier B.V., All rights reserved
Effects of Hybrid Nanofluids on Boosting Heat Transfer within Curved Helical Tubes: A Computational Investigation
This study numerically investigates the thermal performance of a heat exchanger featuring a curved helical tube and hybrid nanofluids using water as the base fluid. The simulations are conducted using a Computational Fluid Dynamics (CFD) code based on the Finite Volume Method (FVM). Three working fluids-pure water, Water/AgMgO, and Water/Al2O3-CuO-are examined across a range of Reynolds numbers (Re = 500-2000), under steady, laminar, Newtonian, and three-dimensional flow conditions. Results indicate that hybrid nanofluids exhibit higher pressure drops compared to pure water across all volume fractions and Reynolds numbers. Notably, Water/Ag-MgO with higher volume fractions shows the greatest pressure drop. As volume fraction increases, differences in performance become more pronounced. The thermal efficiency for certain volume fractions of Water/Ag-MgO and Water/Al2O3-CuO exceeds one, indicating improved thermal performance over pure water, while lower fractions yield efficiencies below one. Therefore, the selection of an appropriate volume fraction is critical. As the Reynolds number increases up to 1000, thermal efficiency improves significantly; beyond this point, the growth rate slows. Concerns of Earthquake Survivor Mothers for Their Children and the Role of School Leadership in Addressing Them
Introduction This study aims to examine the change in the concerns of mothers with preschool children before and after the earthquake and the role of school administrators in relieving these concerns. Understanding these concerns is essential for improving post-disaster support strategies for families.Methods The research was carried out in a holistic multi-case study design, which is one of the qualitative methods, with a study group consisting of 20 mothers and 5 school administrators living in the temporary housing area in Hatay. The data were collected through semi-structured interview forms and analyzed by content analysis method.Results The findings showed that games and entertainment activities were at the forefront of mother-child relationships, but they were also a reflection of the earthquake. It has been revealed that mothers' future plans focused on positive goals such as their children growing up in a healthy environment before the earthquake and becoming successful individuals by receiving a good education, but after the earthquake, these plans were negatively affected due to financial and social losses, uncertainties and disruptions in education. It has been shown that mothers had general concerns about the education, security and social development of their children before the earthquake, but these concerns became more concrete and intense after the earthquake. Mothers reported serious concerns, particularly about living conditions, psychological effects, education, and the future. School administrators, on the other hand, resorted to methods such as summer schools, social activities, guidance services and financial support to alleviate the concerns of mothers. They suggested improving housing conditions, opening vocational courses, strengthening infrastructure and involving psychosocial support teams.Conclusion The research emphasized that the physical, social and psychological effects of natural disasters on individuals are multidimensional and revealed the critical role of school administrators in crisis management. Prevalence of Left Kidney Vein Entrapment Signs on Computed Tomography Angiography Images of Kidney Donors
Background: The nutcracker phenomenon (NC-P) is the entrapment of the left kidney vein (LKV) between the superior mesenteric artery and the abdominal portion of the aorta. We aimed to evaluate the frequency of significant left renal vein compression in a healthy population. Materials and methods: The computed tomography angiography images of 131 healthy patients who underwent living kidney donor nephrectomy at our institution were enrolled in this retrospective, descriptive anatomic study. Results: Three (2.3%) cases had severe stenosis, and 26 (19.8) cases had moderate stenosis. The mean aorto-mesenteric angle was narrower in females (p < 0.05). The mean LKV diameter ratio and beak angle were shorter and narrower in females (p < 0.05, p < 0.01, respectively). Thirteen cases (9.9%) showed 3 or 4 positive criteria for NC-P. Younger pateitns and those with body mass index (BMI) < 30 kg/m(2) had increased rates of positive criteria determination (p < 0.05, p < 0.01, respectively). Conclusions: The NC-P criteria were seen with a high frequency in healthy individuals. Female and younger individuals with lower BMI showed a greater prevalence of positive criteria. Revision of the current standards for NC-P with a distinct classification between sex, age, and BMI is required to better assess LKV compression.Science Citation Index Expande
