    Fuzzy Decision Mechanism for Stock Market Trading

    Investors utilize various methods to make buy/sell decisions depending on time-dependent stock market prices. In this study, a fuzzy decision mechanism that makes buy/sell decisions for stock market data is proposed. The proposed mechanism generates instant buy/sell decisions by evaluating three popular indicators which are the Moving Average Convergence/Divergence (MACD) Strategy, Chaikin Money Flow (CMF), and Stochastic Oscillator (SO). The fuzzy decision mechanism has three inputs and one output which are defined by using Gaussian membership functions. In the design of the decision mechanism, Mamdani inference method is used and the rule table is defined by nine rules. Therefore, the structure of the proposed fuzzy decision mechanism is simple and straightforward. The performance of the proposed fuzzy decision mechanism is compared with two classical decision mechanisms using MACD and CMF indicators separately. In the comparisons, the stock market data of Borsa Istanbul 100 Index (XU100), Dow Jones Industrial Average (^DJI), and S;P 500 (^GSPC) are used. The comparison results show that the proposed fuzzy decision mechanism provides significantly higher profit than the mechanisms using either MACD or CMF indicators for all stock market data

    A bridge “Maybe” too far: Granting legal personality to animals?

    Turkish legal system, like all other legal systems is developed by persons and thus, the >main distinction is made between persons and objects (persona and res). According to thistraditional distinction, animals which are not humans but being “other” species in our World,have mostly been considered as objects and thus subject to personal property. In these personorientedlegal systems, including the Turkish one, even the rules relating to animals essentiallyaims to protect the owner of the animals, but not the animals themselves.However, today this paradigm is slowly challenged as “right to life” (to some extent) isgranted to animals under many legal systems (for instance under the Turkish Law on Protectionof Animals dated 24 June 2004). Nevertheless, the boundaries of this right are the interests ofthe people. Unfortunately, the concepts of animal dignity and right to life do not provide enoughprotection to animals. But what could be the solution to better protect the animals? Grantinglegal personality to the animals? Perhaps it is a bridge too far…Throughout the history, personality have been granted to different objects if it isbeneficial and feasible to do so. Accordingly, this paper firstly aims to evaluate whether it isbeneficial and feasible to grant legal personality -partially or as a whole- to the animals. Underthis first sub-title we will discuss as well whether granting to each and every animal a separatepersonality or a sole conceptual one to the entire nature including the animals. Secondly ourwork further targets to reconsider the traditional distinction of persons and things to provide amore specific legal status for animals. Perhaps such a reconsideration could enable us to solveanother controversial issue of our contemporary world: that is the legal status of “strong”artificial intelligence. Moreover, our discussions will comprise the analyse of the legal statusof the “ancient roman law’s slave”, considered as an object though a human being, benefitingfrom different types of legal protection at different levels, at different times.     Blokzincir kavramının 2008 yılında Satoshi Nakamoto isimli kimliği bilinmeyen bir kişinin/kişilerin yayınladığı manifesto ile ortaya çıkması ve yaygınlaşması sonucunda, özellikle başta finans sektörü olmak üzere birçok yeni kavram ve terminoloji hayatımıza girmiştir. Bu kavramlara örnek vermek gerekirse, kripto varlıklar, akıllı sözleşmeler ve ICO’lar olmak üzere pek çok yeni kurumun hayata girmesi ile özellikle bu konulardaki regülasyonların ülkeler nezdinde yeni yeni yürürlüğe girmesi, bu kurumların nasıl regüle edilmesi gerektiği tartışmalarını da gündeme getirmiştir. Özellikle ICO’ların blokzincir teknolojisine özgü bir kitle fonlama vasıtası olması ve yatırımcıların ICO’lar ile çok kısa zamanda çok yüksek meblağ içeren yatırımlara imkan vermesi, ICO’ların adeta bu teknolojinin lokomotifi işlevi görmesini sağlamıştır. Ancak, ICO’ların bu efektif işlevlerine rağmen, aynı zamanda birçok ülkede regüle edilmemesi dolandırıcılık ve kara para aklama faaliyetlerine sebebiyet verip vermediği noktasında tereddüt uyandırmıştır. Bu çalışmada, özellikle ICO denilen kripto varlıkların ilk arzı, özellikle konunun başta kavramsal çerçevesi, ICO’ları temel itibariyle etkileyen kripto varlıkların türleri ve özellikleri, ICO’ların avantajları ve dezavantajları, ICO’ların aşamaları, ICO’lara yönelik Türk hukuku ve farklı bazı ülkelerdeki regülasyon ve uygulama örnekleri de dikkate alınarak incelenmiştir

    After 1980, financial markets took a share due to globalization trends in the world. In literature, many studies exist which show us that the financial crisis and financial globalizations started to appear more often than it did in the past. The market’s mood is reflected in the data when risks and incalculability increase in financial markets. Financial liberalization and the removal or significant reduction of inspections have increased the fragility of markets. A number of decisions were made and interfered with by many authorities after the financial crisis which was felt all around the world for a long time. Before the 2008 economic crisis price stability was a focus for central banks. However, the importance of financial stability came into prominence after thecrisis. The negative effects of Covid-19 crisis, which was not originated from economic reasons at the same time, which created a supply and demand shock, were seen fast. Like in every crisis politicians interfered in order to reduce the effects of the crisis. The connection between the 2008 global financial crisis and Covid-19 crisis is the need to increase declining total demand. By the reason of reduced economic activity on a global scale, monetary and fiscal policies and inventions that increase economic activity have been involved. The concept of globalizations has multifaceted effects ondeveloping countries. By the entering of funds into enhanced market economies, it helps developing countries to meet the need for financing that will provide economic growth and development, while reducing production and increasing dependence on external financing. With financial globalization direction and momentum of the movement of fund is changing according to countries’ macroeconomic appearance. Particularly development and decisions taken in countries like the United States and England, which have the right comment on world trade, have influenced all around the world. The policies implemented by these countries in times of crisis are closely followed by economic actors. In this study FED (Federal Reserve Bank), ECB (European Central Bank), BOJ (Bank of Japan), BOE (Bank of England), monetary easing policies implemented by central bank after the global crisis in 2008 and the Covid-19 crisis were examined and how developing countries are affected by these crisis and policies are discussed and the example of Turkey was examined

    Turkey has become a party to the Convention on the Contract for the International Carriage of Goods by Road ("CMR") on 4 January 1995, which was opened for signature by the Economic Commission for Europe ("ECE") on 19 May 1956 and has entered into force on 2 July 1961. Briefly, in accordance with Article 1 of the CMR, if one of the taking over of the goods or the place designated for delivery is a contracting country, the CMR shall be applied to the carriage by road. Therefore, the CMR shall be applied to all international carriages by road from and to Turkey. In our study, the liability of the carrier arising from its agents' and servants' and of any other persons' acts or omissions, especially the sub-carriers', of whose services it makes use for the performance of the carriage and additionally, the recourse relations between the carriers in the carriages by road falling within the scope of the CMR will be examined. In order to determine the liability of the carrier arising from the acts and omissions of its persons and the scope of the recourse relations between the carriers under the CMR, the scope of application of the CMR must first be determined. Accordingly, in the first part of the study, following the brief explanation on the history of the CMR, the conditions for a carriage to be subject to the CMR, the elements of the contract of carriage and who is deemed as a carrier within the scope of the CMR will be explained. Following that in order to specify the legal ground of the liability of the carrier arising from the acts or omissions of its persons under the CMR, Article 116 of the Turkish Code of Obligations numbered 6098 ("TCO") which regulates the liability of the debtor arising from the acts or omissions of its person will be discussed. Then Article 3 of the CMR will be examined in detail. Pursuant to Article 3 of the CMR, the carrier is responsible for the damages caused by its persons, as if such acts or omissions were his own. On the other hand, in order to hold the carrier liable in accordance with Article 3 of the CMR, the reason giving rise to the liability must fall within the scope of CMR in the first place. Accordingly, the legal basis, conditions and scope of the liability of the carrier for the damages caused by the carrier's persons under Art.3 of the CMR will be explained. Following that, the conditions of the lawsuit to be filed against the carrier and its persons for the claims falling under the scope of the CMR Art.3, especially the title to sue, will be clarified. Due to the fact that the fourth book of the Turkish Commercial Code numbered 6102 ("TCC") namely "Transport Affairs", was mostly acquired from the CMR and the German Transport Reform Law of 1998 ("1998 German-TRG") and due to the fact that the national law as a complementary legal rule shall be applied by taking into account the conflict of laws rules in case there is a gap in the CMR, the liability of the carrier arising from the acts and omissions of its persons under the TCC as well as under the former Turkish Commercial Code numbered 6762 will be analysed. In addition, according to certain opinions in the doctrine, as the title to sue is not regulated in the CMR, it is necessary to apply to the rules of conflict of laws and national legislation in order to determine the title to sue. In this respect, a brand-new provision in terms of Turkish Law, Article 871/1 of the TCC regulating the title to sue, will be discussed by way of comparing with HGB § 421/1. Except for the general regulation of the Art.3 of the CMR, the only regulation in the CMR with regard to the carriage performed by more than a single carrier and recourse relations between the carriers are the Provisions Relating to Carriage Performed by Successive Carriers stipulated between the Articles of 34 and 40 in the Chapter VI. However, in the doctrine and in the contracting countries, it is controversial whether the successive carriage provisions can be applied to all sub-carriages without taking into consideration the conditions specified in Art.34 of the CMR. In order to seek an answer to this problem, the provisions regarding the successive carriage, the approach in the doctrine and judicial decisions with regard to the successive carriages and sub-carriages will be explained. In the VI. Part of this study, recourse relations between the carriers subject to the CMR will be examined. For this purpose, first of all, the practices and opinions in the contracting countries, especially in the German Law, will be discussed. Then, conflicting court decisions and approaches in the doctrine in Turkish Law concerning the sub-carriages and recourse disputes between carriers subject to CMR will be put forward. Since there is no uniform application and doctrine opinion in Turkish Law in both liability and recourse cases with regard to the carriages performed by more than one carrier in the carriages subject to CMR, the ways that can be applied in such cases will be set forth taking into account the rule of legal certainty. Finally, due to the lack of a uniform application in Turkish Law in recourse cases between carriers subject to CMR, the solution method that we believe is the most suitable for Turkish Law and CMR will be suggested.Avrupa Ekonomik Komisyonu (ECE) tarafından 19 Mayıs 1956 tarihinde imzaya açılan ve 2 Temmuz 1961 tarihinde yürürlüğe giren Eşyaların Karayolundan Uluslararası Nakliyatı İçin Mukavele Sözleşmesi'ne ("CMR") Türkiye 4 Ocak 1995 tarihinde taraf olmuştur. CMR'nin 1. maddesi uyarınca yükleme veya boşaltma yerlerinden birinin âkit ülke olması halinde CMR'nin öncelikli olarak uygulanması taraf devletler bakımından zorunluluk teşkil etmekte olup yükleme veya boşaltma yeri Türkiye olan bütün karayolundan taşımalarda CMR hükümleri öncelikle uygulama alanı bulmaktadır. Çalışmamızda, CMR'ye tabi taşımalarda, taşıyıcının yardımcı kişilerin, özellikle de alt taşıyıcıların eylemlerinden doğan sorumluluğu ve yine CMR'ye tabi taşımalarda taşıyıcılar arası rücu ilişkileri incelenecektir. CMR'de taşıyıcının yardımcı kişinin eylemlerinden doğan sorumluluğunun ve taşıyıcılar arası rücu ilişkilerinin kapsamının tespit edilebilmesi için ilk olarak CMR'nin uygulama alanının belirlenmesi gerekmektedir. Bu doğrultuda, çalışmanın ilk bölümünde CMR'nin tarihçesinden bahsedildikten sonra bir taşımanın CMR'ye tabi olmasının şartları, taşıma sözleşmesinin unsurları ve CMR kapsamında kimin taşıyıcı olarak kabul edildiği açıklanacaktır. Bunu takiben, CMR m.3 hükmünde düzenlenen taşıyıcının yardımcı kişinin eylemlerinden doğan sorumluluğunun temellerinin ortaya konabilmesi için; borçlunun yardımcı kişinin eylemlerinden doğan sorumluluğunu düzenleyen 6098 s. Türk Borçlar Kanununun (TBK) 116. maddesi ele alınacaktır. Bu doğrultuda, borçlunun yardımcı kişinin eylemlerinden doğan sorumluluğunun hukuki temelleri ortaya konacaktır. Ardından CMR m.3 hükmü detaylı olarak incelenecektir. CMR m.3 hükmü uyarınca taşıyıcı kendi çalışanlarının, temsilcilerinin ve bağımsız yardımcı kişilerinin sebep olacağı zararlardan, bizzat kendi fiili gibi sorumludur. Beri yandan, CMR m.3 hükmü uyarınca taşıyıcının sorumluluğuna gidilebilmesi için, öncelikle sorumluluğu doğuran sebebin CMR kapsamında kalması gerekir. Bu doğrultuda, CMR m.3 hükmü kapsamında taşıyıcının çalışanları, temsilcileri ve bağımsız yardımcı kişilerinin sebep olduğu zararlardan taşıyıcının sorumluluğunun hukuki temeller, şartları ve kapsamı açıklanacaktır. Bunu takiben CMR m.3 uyarınca açılacak sorumluluk davasının şartları özellikle de davalardaki dava takip yetkisi incelenecektir. 6102 s. Türk Ticaret Kanununun ("TTK") dördüncü kitabı olan "Taşıma İşleri"nin büyük ölçüde CMR'den ve 1998 tarihli Alman Taşıma Reform Kanunundan ("1998 Alman-TRG") iktisap edilmiş olması ve CMR'de boşluk bulunan hallerde tamamlayıcı hukuk kuralı olarak kanunlar ihtilafı kuralları dikkate alınarak ulusal mevzuata başvurulacak olması gerekçeleriyle, TTK'da taşıyıcının yardımcı kişilerin eylemlerinden doğan sorumluluğu mülga 6762 s. Türk Ticaret Kanunu ile karşılaştırılarak incelenecektir. Ayrıca, doktrindeki bazı görüşlere göre CMR'de dava takip yetkisi düzenlenmemiş olup dava takip yetkisinin belirlenmesi açısından kanunlar ihtilafı kurallarına ve ulusal mevzuata başvurulması gerektiğinden TTK'ya tabi kara taşımalarından doğan uyuşmazlıklarda ikame ettirilecek sorumluluk davası ve Türk Hukuku bakımından yeni bir hüküm olan ve dava takip yetkisini düzenleyen TTK m.871 f.1 kaynak HGB § 421 f.1 ile birlikte hükmü ele alınacaktır. CMR m.3 hükmündeki genel düzenleme haricinde, birden fazla taşıyıcı tarafından gerçekleştirilen taşımalara ve taşıyıcılar arası rücu ilişkilerine ilişkin CMR'de yer alan tek düzenleme, CMR'nin VI. Bölümde m.34 ila 40 hükümlerinde düzenlenen müteakip taşıma hükümleridir (Resmi Türkçe tercümeye göre: Taşımacılar Tarafından Ortaklaşa Yapılan Taşımalarla İlgili Hükümler"). Bununla beraber, doktrinde ve âkit ülkelerde, müteakip taşımanın ayrı bir bölümde yer alması ve CMR m.34 hükmünün belli başlı şartlar getirmesi sebebiyle, müteakip taşıma hükümlerinin CMR'ye tabi bütün alt taşımalarda uygulanıp uygulanamayacağı, bir başka söyleyişle, CMR m.34 hükmünde öngörülen şartlar gerçekleşmeden müteakip taşıma hükümlerinin alt taşımalara ilişkin sorumluluk davalarına ve rücu davalarına tatbik edilip edilemeyeceği tartışmalıdır. Bu soruna bir yanıt aramak için müteakip taşıma hükümleri, bu düzenlemeye ilişkin doktrindeki ve yargı kararlarındaki yaklaşım açıklanacaktır. Çalışmamızın VI. ve son bölümünde ise, CMR'ye tabi taşımalarda taşıyıcılar arası rücu ilişkileri incelenecektir. Bu amaçla ilk olarak âkit ülkelerdeki özellikle de Alman Hukukundaki uygulama ve görüşler ele alınacaktır. Ardından, CMR'ye tabi alt taşımalara ve taşıyıcılar arası uyuşmazlıklara ilişkin Türk Hukukunda çelişkili mahkeme kararları ortaya konarak doktrindeki bu konudaki yaklaşımlara yer verilecektir. Türk Hukukunda CMR'ye tabi taşımalarda birden fazla taşıyıcının dahil olduğu taşımalara ilişkin hem sorumluluk hem de rücu davalarında Türk Hukukunda yeknesak bir uygulama ve doktrinde bir uzlaşı olmaması sebebiyle, sürpriz karar yasağı kuralına uygun olarak taşıyıcılar arası rücu davalarında başvurulabilecek yollar açıklanacaktır. Son olarak, CMR'ye tabi taşıyıcılar arası rücu davalarında Türk Hukukunda yeknesak bir uygulama olmaması sebebiyle, Türk Hukukuna ve CMR'ye en uygun düştüğünü düşündüğümüz çözüm yolu önerilecektir

    Increasing number of choices and competition in the markets, force companies to differ in services they provide to their customers. Offering better services have a positive impact on customer loyalty, and to do so, companies should understand their customers’ interests and act accordingly. One popular method for this purpose is building recommendation engines to make personalized suggestions. In this project, collaborative filtering methods with implicit feedback are used to make recommendations to users of theSteam platform. The recommendation systems are built using two different matrix factorization techniques, Alternating Least Squares and Bayesian Personalized Ranking. Different models are created with implicit playtime data of the users and the results are evaluated by using Precision at k metric. Additionally, similar items that are offered by the models are analyzed. Results show that the models are considerably successful at finding personal choices and similar items. The best model finds the item in the libraries of 33% ofthe users

    Gis-Based Assessment of Seismic Vulnerability Information of Old Masonry Buildings Using a Mobile Data Validation System

    This study proposes a geographic information system (GIS)–based rapid visual screening approach for seismic vulnerability assessment of masonry buildings in culturally and architecturally important historical regions. Through the application of the proposed methodology, a prioritization strategy for seismic vulnerability assessment of the heritage masonry buildings in Galata, a historical center of Istanbul, Turkey, was performed. This approach is based on an integrated methodology including a data collection process conducted through visual inspections and standard survey forms filled on site, generation of a georeferenced building database enabling the calculations and mapping of the vulnerability scores, and camera-based data validation process. The validation process provides an online collaborative mobile mapping system through georeferenced images gathered from the field. By the updatable data validation process, the reliability and efficiency of the GIS-based building database are enhanced by minimizing the errors during the visual screening and the cost of data correction due to reinspection is reduced
