Perpetuum mobile: colour, sound and motion
The prison house of language, the penitentiary of print, as also the practices of precedent all encourage a degree of recidivism, of default repetition and so it not surprising that photograph and film are apprehended initially as being like texts and needing to the read. Visual literacy is frequently invoked as the desired state and method of looking and training the legal gaze. The point to be stressed is that in analytic and critical terms the image is secondary, requires careful “reading”, and is assumed to be somewhat removed or unloosed from rational analysis. The visual figure is to be restrained or brought back from the “theatre of shadows” or sciography of cinema and dream, phantasy and hallucination. This article examines the use of film and photographs in a recent UK case to evince the resistance to images and the blindness of judges to the affective force of colour.La prison du langage, le pénitencier de l’imprimé, aussi bien que les pratiques de celui-ci, incitent à une certaine récidive (recidivism), à la répétition par défaut ; il n’est donc pas étonnant que la photographie et le film soient appréhendés d’abord comme étant des textes et nécessitant la lecture. L’alphabétisation visuelle est souvent invoquée comme l’état et la méthode souhaités pour regarder et entraîner le regard légal. Ce qu’il faut souligner, c’est qu’en termes analytiques et critiques l’image est secondaire, exige une « lecture » attentive et est supposée quelque peu éloignée ou déliée de l’analyse rationnelle. La figure visuelle est à retenir ou à extraire du « théâtre d’ombres » ou la sciographie (sciography) du cinéma et du rêve, de la fantaisie et l’hallucination. Cet article examine l’utilisation de films et de photographies dans une affaire récente au Royaume-Uni pour mettre en évidence la résistance aux images et l’aveuglement des juges à la force affective de la couleur
Anthropocène, Sémiotique et Droit de l’Environnement. La remise en cause juridique des non-humains
L’Anthropocène n’est pas l’époque d’une crise de la nature, mais l’époque d’une crise épistémique qui stimule la sémiotique de la culture à reprendre le projet d’une archéologie du savoir. Dans cet article nous donnons quelques indications pour en faire état dans le discours du droit de l’environnement. Nous nous focaliserons sur le tournant des années ‘60 et ‘70, très significatif pour le développement de cette branche du droit. À partir d’un un corpus comprenant droit national français, droit international et régulations européennes, nous proposerons d’abord une généalogie sémiotique des espaces naturels ; ensuite, nous montrerons comment elle conduit à la reformulation des temporalités juridiques ; enfin, nous terminerons par évoquer ses retombées sur l’actorialisation des non-humains en tant que sujets de droit.The Anthropocene is not a time of a crisis of nature, but a time of an epistemic one. That stimulates the semiotics of culture to take up the project of an archaeology of knowledge. In this article, we give some indications of how to deal with this in the discourse of environmental law. We will focus on the turning point of the 1960s and 1970s, which is very significant for environmental law. Based on a corpus including French national law, international law and European regulations, we will start by proposing a semiotic genealogy of natural spaces ; then, we will show how it leads to the reformulation of legal temporalities ; finally, we will end by evoking its repercussions on the actorialisation of non-humans as subjects of law
De la prosodie fondamentale à la prosodie vocale et vice versa
Le concept de prosodie sera examiné dans cet article dans deux dimensions : d’une part, la prosodie fondamentale, issue de la syllabe et de l’intonation du langage naturel et guidant les principes théoriques de la sémiotique tensive actuelle, et, d’autre part, la prosodie vocale, responsable à la fois de la rencontre des unités linguistiques avec leurs inflexions intonatives dans le discours quotidien et de la relation entre mélodie et paroles dans les chansons médiatiques. Les deux prosodies trouvent leur origine dans les paramètres qui manifestent nos affects sur le plan de l’expression, notamment dans leurs notions essentielles d’accent et de modulation. Il n’y a pas de discours oral sans une composante mélodique, ascendante ou descendante, indiquant l’impulsion, le désir, le doute, la conviction ou l’émotion de celui qui parle, par le simple rapprochement ou éloignement de l’accent principal de la phrase ou du passage émis. Il en va de même pour la chanson, mais sa mélodie est encore stabilisée par l’action musicale, ce qui génère d’autres types de compatibilité avec les paroles, comme la thématisation et la passionnalisation. Les accents qui nous aident à appréhender les directions mélodiques sur le plan de l’expression sont les mêmes qui régissent notre compréhension et notre appréciation des sujets pertinents sur le plan du contenu, dans une échelle hiérarchique également ascendante ou décadente. On peut dire alors que les éléments de la prosodie vocale instruisent la prosodie fondamentale pour que celle-ci, d’autre part, rende compte des deux plans du langage.In this article, the concept of prosody will be examined in two dimensions: on the one hand, fundamental prosody, derived from the syllable and intonation of natural language and guiding the theoretical principles of current tensive semiotics, and, on the other, vocal prosody, responsible both for the encounter between linguistic units and their intonational inflections in everyday speech and for the relationship between melody and lyrics in media songs. Both prosodies have their origins in the parameters that manifest our affects at the level of expression, notably in their essential notions of accent and modulation. There is no oral discourse without a melodic component, ascending or descending, indicating the impulse, desire, doubt, conviction or emotion of the speaker, simply by moving the main accent of the sentence or passage emitted closer or further away. The same applies to the song, but its melody is further stabilised by the musical action, which generates other types of compatibility with the lyrics, such as thematisation and “passionnalisation”. The accents that help us to grasp the melodic directions at the level of expression are the same that govern our understanding and appreciation of the relevant subjects at the level of content, in a hierarchical scale that is also ascending or descending. We could say, then, that the elements of vocal prosody instruct fundamental prosody so that the latter, on the other hand, accounts for both levels of language
Les diamants de synthèse et la « joaillerie écologique » : étude de cas sémiotique sur la communication de la joaillerie et ses défis
Cet article vise à montrer à l’œuvre une forme de sémiotique engagée à augmenter l’intelligibilité de phénomènes culturels et sociaux contemporains. Pour ce faire, nous proposons une analyse d’un type de discours spécifique, celui qui travaille à la valorisation du diamant de synthèse ou de laboratoire, notamment en mobilisant la prise de responsabilité éthique et environnementale de l’industrie diamantaire. Soumise, comme beaucoup d’autres secteurs économiques, à des critiques sur le plan de la durabilité et de l’éthique, l’industrie des diamants et des joyaux produit en effet des « formations discursives » multimodales parfois très intéressantes, qui expriment des formes de construction de valeur dans un contexte polémique, face aux défis de l’habitabilité de la planète. C’est en analysant ces formations qu’une forme spécifique de sémiotique, liée à l’héritage de l’école d’A. J. Greimas, peut montrer sa vivacité et sa contribution à la construction du savoir autour des enjeux cruciaux de notre ère.The aim of this article is to approach a form of semiotics committed to increasing the intelligibility of contemporary cultural and social phenomena. To this end, we propose an analysis of a specific type of discourse, that which works to enhance the value of synthetic or laboratory diamonds, in particular by mobilizing the diamond industry’s assumption of ethical and environmental responsibility. Like many other economic sectors, the diamond and jewellery industry is subject to criticism in terms of sustainability and ethics, and produces some very interesting multimodal “discursive formations” that express forms of value construction in a polemical context, in the face of the challenges of the planet’s habitability. It is by analyzing these formations that a specific form of semiotics, linked to the legacy of the school of A. J. Greimas, can demonstrate its vitality and its contribution to the construction of knowledge around the crucial issues of our era
