The study of the characteristics of the right, understand as “objective right” in Villey and Hervada, allows us to understand how and when the subjective conception of right logically deviates from this objective meaning and to point out juridical consequences. Moreover, the comparison between these authors allows to determine more precisely the nature of the right: substance or relation?Quelle est la di érence entre droit objectif et droit subjectif? No full textNowadays, there is a growing awareness in the Church of the need for candidates for holy orders and ecclesiastical offices to be prepared properly. The question arises as to whether canon law encompasses the means required to verify the eligibility of candidates, as well as how they may be applied in practice. This article outlines the canonical tools that help assess candidate suitability, along with some theoretical and practical problems that may occur. The right to personal privacy is not in con ict with the right of the Church to verify compliance with the conditions of admission to public o ce and the sacrament of Holy Orders.En la Iglesia contemporánea existe una conciencia cada vez más clara de la necesidad de una adecuada preparación de los candidatos al orden sagrado y a los distintos o cios eclesiásticos. Cabe preguntarse si el derecho canónico tiene previsto adecuados instrumentos para veri car la idoneidad de los candidatos y cómo se aplican en la práctica. En este artículo se describen los instrumentos canónicos que ayudan a comprobar la idoneidad de las personas y también algunos problemas teóricos y prácticos que pueden plantearse. El derecho a la intimidad personal no se opone al derecho que tiene la Iglesia a comprobar el cumplimiento de las condiciones de acceso a los cargos públicos y al sacramento del orden

No full textThe contribution examines on the one hand the regulatory guidelines offered by the Pope about the prejudicial or pastoral inquiry in the wider context of the reform of the procedures for the declaration of marriage nullity, and on the other wants to emphasize the role of ecclesiastical lawyer in this particular inquiry, presenting the problematic aspects of the reform both in the judicial phase and in the broader pastoral horizon of the reform.
Il presente contributo intende offrire da un lato una lettura delle specifiche indicazioni normative promulgate dal Santo Padre con riferimento alla indagine pregiudiziale o pastorale, nel più ampio contesto della riforma delle norme sulle procedure di nullità matrimoniale, dall’altro vuole sottolineare il ruolo che l’avvocato nel foro ecclesiastico è chiamato a svolgere nell’ambito di tale specifica indagine, presentando i profili problematici che tale novità comporta sia nel giudizio in senso stretto, sia nel più ampio orizzonte pastorale cui la normativa fa esplicito riferimento
