Juridical Analysis of the Invalidity of Investigation Termination Due to the Cancellation of Restorative Justice through Pretrial Proceedings (A Study of Decision Number: 133/Pid.Pra/2023/PN.Jkt.Sel)
There is a paradigm change in the resolution of criminal cases from a retributive approach to restorative justice, which focuses on restoring the situation through a quick settlement outside the formal justice mechanism. The police as law enforcement officers have also adopted this approach as an alternative solution that is more inclusive and humanist. However, its implementation in the field does not always go straightforward, especially when the offender does not comply with the agreement that has been made. One case that reflects this is Pretrial decision number 133/Pid.Pra/2023/PN.Jkt.Sel, where the termination of investigation by police investigators was canceled because the offender did not fulfill the contents of the agreement. Although the restorative justice approach by the police aims to create participatory restorative justice, the absence of a strong legal basis and weak compliance with the agreement often become obstacles, and lead to disputes over whether or not the termination of the investigation is legal.
This research discusses three main problems, namely: (1) how is the regulation of the legality of the termination of investigation in Indonesia; (2) how is the restorative justice policy regulated in law enforcement agencies; and (3) how is the juridical analysis of the judge's consideration in deciding the case of canceling restorative justice through pretrial. This research uses normative juridical method with literature study to analyze the regulation of termination of investigation, restorative justice policy in law enforcement institutions, and judges' consideration in canceling restorative justice through pretrial mechanism. The data is analyzed using the theory of legal certainty and restorative justice.
The research results show that the termination of investigation is regulated in Criminal Procedure Code and National Police Chief Regulation Number. 6/2019, but the application of restorative justice still depends on internal regulations without a clear national legal umbrella. In the case studied, the judge stated that the termination of the investigation was invalid because the perpetrator did not fulfill the restorative justice agreement so that the investigation must continue. These findings emphasize the importance of establishing a comprehensive restorative justice law to provide legal certainty and legitimacy in restorative criminal case resolution.162 PagesSkripsi Sarjan

Synthesis And Characterization of Reduced Graphene Oxide (RGO) Doped with Iron Oxide Nanoparticles (Fe2O3) as Primary Battery Electrode
A study has been conducted on the Synthesis and Characterization of Reduced Graphene Oxide (RGO) Doped with Iron Oxide (Fe2O3) Nanoparticles as Primary Battery Electrodes. The purpose of this study was to analyze the characteristics of GO and RGO from commercial graphite, analyze the interaction of GO, RGO from commercial graphite with Fe2O3 metal and analyze the effect of the anode ratio (Fe2O3/GO and Fe2O3/RGO), cathode (GO and RGO) and electrolyte (NH4Cl) with variations in mass ratio (1:2:1; 1:2:2; and 2:2:1) on physical properties (current, voltage and electrical conductivity). This study used laboratory and descriptive experimental methods. GO was synthesized from commercial graphite by the Hummer method then RGO was produced after the addition of hydrazine. Fe2O3/GO and Fe2O3/RGO anodes were synthesized by impregnation method and each electrode Fe2O3/GO||Electrolyte||GO and Fe2O3/RGO||Electrolyte||RGO were synthesized by alloy method. Analysis of GO, RGO, Fe2O3/GO, Fe2O3/RGO and prototype electrodes Fe2O3/GO||Electrolyte||GO and Fe2O3/RGO||Electrolyte||RGO were analyzed using XRD, SEM-EDX and Multimeter. XRD data showed a sharp peak at C (001) at 2θ = 11.3° indicating that GO was successfully synthesized, then after the reduction process on GO the peak shifted to 2θ = 25.2° so that RGO was successfully synthesized. The diffraction patterns of Fe2O3/GO and Fe2O3/RGO show the same peaks where the dominant diffraction peaks are obtained at 2θ = 30.42°(220), 35.79°(311), 37.59°(222) and 43.45°(400) which prove that Fe2O3 has been successfully doped into GO and RGO. The existence and abundance of Fe2O3 in RGO are proven by SEM-EDX data. Electrical Conductivity (EDC) data from the Fe2O3/RGO||Electrolyte||RGO electrode with a mass ratio variation of 1:2:2 has the highest EDC value (632.00 µS/cm2), power density (144.00 W.Kg-1) and energy density (144 Wh.Kg-1) compared to other electrodes. The results of this study indicate that the correct ratio of anode : electrolyte : cathode mass and the type of material and composition used can improve the performance of primary battery electrodes.113 PagesSkripsi Sarjan
Analysis of Differences in Judges Verdicts in the Crime of Murder ( Study of Decision Number 59/Pid.B/2021 of LBH District Court and Decision Number 10/Pid/2022 of TTE High Court)
The Republic of Indonesia is a state of law based on Pancasila and the 1945
Constitution which truly upholds human rights and guarantees citizens together
with their position in law and government with no exceptions, while to ensure
obedience and compliance with the law is in the hands of all citizens, for this reason
the Criminal Code regulates Crimes Against Life so that the level of crime and
criminality in Indonesia can be controlled. This thesis contains several problem
formulations, namely as follows: 1) How is the Criminal Law Regulation on the
Crime of Murder in Indonesia?; 2) How are the Theories of Judges' Decisions in
Criminal Offenses in Indonesia?; 3) How is the Juridical Analysis of the Judge's
Decision in the Crime of Murder Based on District Court Decision No.
59/Pid.B/2021/PN LBH and PT Decision No. 10/Pid/2022/PT TTE? This research
aims to find out how the judge's decision on the murder case contained in District
Court Decision No. 59/Pid.B/2021/PN LBH and PT Decision No. 10/Pid/2022/PT
TTE. The research method used in writing this thesis is the normative juridical
research method, namely research using secondary data. In District Court Decision
No. 59/Pid.B/2021/PN LBH and Court Decision No. 10/Pid/2022/PT TTE, the
judge handed down a verdict of persecution resulting in death in the District Court
and handed down a verdict of murder in the Court of Appeal. The difference in the
decision is based on the different considerations of the Labuha District Court
Judges and the Court of Appeal which have been explained by the Appeal Judge
based on Jurisprudence Number 1/Yur/2018, that the defendant's actions are no
longer solely to weaken the victim so that he can rape her, but have led to the loss
of the victim's life. The government, law enforcement officials and the community
must work together to reduce the number of cases of murder or persecution in order
to create security and strict sanctions in the form of prison sentences and fines that
must be applied indiscriminately and the provisions in the Criminal Code should
provide strict understanding and limits on murder.116 PagesSkripsi Sarjan
