As Above so Below: Vesting Pore Space Ownership with the Rights of the Surface Estate
In 2023, the United States emitted an estimated total of 4,807 million metric tons (“MMTs”) of Carbon dioxide, with only a 0.2% decrease in 2024. These figures are simply not up for debate. What is often debated, however, is how (and if) the U.S. should be tackling these carbon emissions. Many would argue that the U.S. must increase its reliance on renewable energy and decrease its consumption of fossil fuels, which are major contributors of Carbon Dioxide and other Green House Gas (“GHG”) emissions. Others would argue that the best way to limit carbon emissions is to implement some form of carbon tax. Others still recommend society as a whole use less energy, reducing the strain on the energy industry and infrastructure, thus decreasing carbon emission further. These opinions of singular focus are, to put it bluntly, foolish. The U.S., and indeed the world, has run out of time to rely on one measure or another. One tool that is growing in potential is the technology of carbon capture and sequestration (“CCS”).
However, the promise of CCS brings certain legal questions that have not been answered by the Federal government or by many states. These questions must be addressed before CCS can be widely implemented. This article is intended to prompt Arkansas lawmakers to pass legislation that clarifies these various issues. Part I of this article has provided an introduction to the topic of the article and its relation to climate change. Part II of this article will provide more context about pore space itself and the related technology of CCS. Part II will also focus on the value and purpose of pore space, not only for Arkansas, but nationally as well.25 Part III will discuss competing theories of ownership regarding pore space as well as which states have adopted which perspectives. Additionally, Part III will also address Arkansas’s current stance on pore space ownership. The penultimate Part IV will address the legal arguments surrounding why Arkansas should adopt a particular theory of ownership governing pore space. Concluding the article, Part V will provide a final call to action for Arkansas legislators and for all others who desire to protect future generations from the worst effects of climate change
Urbanization, Climate Change, and Water Quality in Northwest Arkansas Caves
The Ozark Cavefish is one of multiple species of conservation concern found in Cave Springs Cave and Logan Cave in Northwest Arkansas (NWA). Over the past two decades, the urbanization of NWA has negatively impacted the recharge areas of both caves, and in turn the water quality of both cave streams. The changing climate has also altered temperature and precipitation, which influence many aspects of karst groundwater. These effects are shown in the historical water quality records for both caves. However, these records are from varied sources and have never been comprehensively compiled and analyzed. This thesis approaches the issue of degraded water quality for these biologically significant caves through compiling a historical database of physical and chemical water measurements for analysis and comparing water quality trends with changes in land use and climate in the recharge areas, as well as comparing trends between each cave. The analysis identified significant differences, trends, and correlations with water temperature, dissolved load, nutrients, and metals. Total dissolved solids, alkalinity, pCO2, calcium, magnesium, and barium concentrations were significantly higher at Cave Springs compared to Logan Cave. Orthophosphate was significantly higher at Logan Cave compared to Cave Springs. At Cave Springs, water temperature, barium, and magnesium increased from 1999 to 2025. At Logan Cave, pH, inorganic nitrogen, and magnesium increased. Before 2015, nitrate concentrations were significantly higher at Cave Springs, but after 2015 the concentrations were higher at Logan Cave. Water temperature was positively correlated with air temperature at Logan Cave, but not at Cave Springs. Calcium was negatively correlated with discharge, and both barium and magnesium were positively correlated with discharge. Both land cover and climate change are likely to contribute to these results, especially with water temperature, nutrients, and metals. The similarities in climate conditions between the two caves indicate many of their differences can be attributed to the different land cover in their recharge areas, as well as to how those land cover differences exacerbate or buffer climate change signals. The analysis was limited by uncertainties in measurement data and constraints of the statistical calculations. Due to the various sources, measurement frequency, conditions, and methods were inconsistent. Both the chemical and statistical calculations required assumptions that simplified the actual conditions. Future research will need to continue monitoring both sites, as well investigate more comprehensively the agricultural operations and urban developments of the recharge areas beyond the scope of the National Land Cover Dataset. The data collected for this thesis will be publicly archived for future use in the conservation and management of these biologically significant caves
Advancing Social Sustainability in Operations and Supply Chain Management: A Multi-Theoretical Exploration of Technology, Task Familiarity, and Sustainability Interactions
Social sustainability in operations and supply chain management (OSCM) centers on generating economic value through practices that safeguard people, communities, and broader societal systems impacted by the supply chain. While the importance of such practices is increasingly recognized, firms face persistent challenges in embedding social sustainability into formal management systems. This dissertation tackles three such challenges, with a particular focus on safety in trucking—a vital yet underexamined aspect from the lens of social sustainability. Safety performance in this context is influenced by the complexities of using advanced safety technologies, the demanding and solitary nature of truck driving, and the temporal nature of managerial interventions such as feedback and incentives. Further, firms often struggle to align environmental and social sustainability initiatives, risking inefficiencies when these dimensions are combined under Corporate Social Responsibility (CSR) umbrella without strategic coherence. To address these issues, this dissertation comprises three essays, each examining a distinct facet of sustainability at the manager, worker and firm levels. The first essay uses narrative inquiry to qualitatively explore how safety technology influences driver behavior in the trucking industry from a managerial perspective. Drawing on the Theory of Technology Dominance (TTD), the findings highlight that while advanced safety technologies can promote compliance when supported by effective managerial communication, they can also undermine safety if cognitive misalignment occurs between drivers, managers, and the technology—or if drivers become overly reliant on automation. The second essay draws from self-efficacy theory to investigate how task familiarity impacts driver safety performance on a driver level. It further examines how the recency of managerial feedback and incentives moderates this relationship. Using a proprietary dataset from a Fortune 500 logistics provider, this essay empirically tests key hypotheses and finds that task familiarity is positively associated with safety performance. However, the analysis also reveals that the positive impact of task familiarity is weakened when managerial feedback or incentives are more recent. The third essay shifts focus to the firm level, examining how environmental and social sustainability commitments affect operational efficiency. Grounded in the resource-based view (RBV), this study tests whether the two dimensions act as complements or substitutes and how the sustainability practices of a firm’s supply base moderate these effects. This essay responds to earlier findings that firms often bundle environmental and social efforts under a general CSR umbrella without strategic alignment—potentially diluting their impact. Together, these three essays contribute to advancing social sustainability in OSCM by demonstrating how technology, routines, management interventions, and strategic alignment of sustainability goals can be integrated into formal organizational systems. The findings offer both theoretical insights and practical implications for improving safety, efficiency, and overall performance in supply chains
Time-Interleaved SAR ADC in 22nm FD-SOI CMOS
The advent of large language models [1] brought awareness to the importance of advances in high-performance computing and neural network algorithm design. These systems rely upon highly networked accelerator ASICs made on advanced nodes such as TSMC 4N, with NVIDA’s H100 having 80 billion transistors on-die [2]. However, the millions of parameters needed to arrive at satisfactory performance require massive parallelization of processing. This demands high-throughput networking, both from chip-to-chip and rack-to-rack. Currently, x86-type servers use 5-6 Ethernet switch ports per server, while typical AI/ML servers need 12+ ports [20]. Often, memory access and networking throughput can limit the overall performance of the system. Serializer/de-serializer (serDes) electrical and optical links are the primary way data is moved at high volume between these devices. Time-interleaved data converter-based receivers with digital equalization have led to electrical links with speeds up to 220Gb/s [3]. As this thesis will demonstrate via system modeling, they are robust over a higher channel loss. These receivers are implemented on highly scaled CMOS nodes of the accelerators. CMOS nodes below and at 28nm offer a unique set of design trade-offs when compared to long-channel CMOS. The design of mixed-signal circuits can make use of fast, efficient digital signal processing to reduce the performance requirements of analog circuits. On the other hand, a low supply voltage makes traditional linear amplification techniques challenging. Due to these constraints, the serial approximation register ADC has become advantageous, since it primarily consists of switches, latches, and capacitors, which all scale well in nanometer CMOS, however, this scaling does not include linear amplification. Serial approximation register (SAR) ADCs are well-suited to medium precision and medium speed applications, and have a high power efficiency. For these reasons, power and area-efficient SAR ADCs that can be arrayed easily for time-interleaving are of high interest
Rumination and Inhibitory Control in Suicidal Ideation: The Role of Explicit and Implicit Emotional Processing
Suicide is the tenth leading cause of death in the United States, and suicidal ideations (SI; thinking, considering, or planning suicide) are a strong predictor of suicide attempts. Prior literature describes inhibitory control as an important facet of regulating negative thoughts, and studies suggest that inhibitory control deficits and engagement in brooding rumination are risk factors of SI. Recent studies have found implicit cognitive markers of suicidality suggesting that level of processing may variably be linked to SI. This study examined the relation between aspects of inhibitory control across explicit and implicit emotional contexts and levels of brooding rumination among individuals with and without SI. Participants included 49 adults (21 ideators and 28 controls, M age=29.63, SD=10.07) recruited from the community. They completed a suicide risk interview, measures of rumination and suicidality, and a modified affective go/no-go task assessing response inhibition across emotional word stimuli in explicit and implicit contexts. Results indicated that ideators reported significantly higher brooding rumination than controls. Generalized linear mixed modeling revealed three main effects: ideators had faster RTs than controls, RTs were faster across implicit trials than explicit trials, and more commission errors and omission errors were made on explicit trials than implicit trials. No significant interactions emerged. Findings suggest that ideators exhibit heightened reactivity to stimuli, regardless of valence or level of processing. Explicit emotional processing is likely imposing a higher cognitive load, thereby disrupting inhibitory functioning. While brooding rumination was elevated across ideators, it did not directly impact aspects of response inhibition
