Determining the content of corporate reporting on human rights
Business enterprises have to report their activities to stakeholders in order to provide corporate transparency. Non-financial corporate reports provide a comprehensive coverage of environmental, socioeconomic, labor, health, and human rights issues. In the paper the author argues that a uniform definition of a sector-specific human rights issue in reporting frameworks, rather than self-identification by enterprises of salient human rights issues, would help to achieve standardization and thus the possibility of sanctions in the event of false or misleading reporting. The author analyzes existing international and regional non-financial reporting instruments regarding the human rights included in it. The main content issues of non-financial reporting are derived and given requirements to improve them. The author further analyzes whether the two main frameworks for human rights reporting (the GRI Standards and the UNGPs Reporting Framework) currently meet the requirements for content defined in the paper and, if not, how they can be changed

The role of ex aequo et bono in ICSID arbitration
Ovaj rad ispituje ulogu principa ex aequo et bono u arbitraži pred Međunarodnim centrom za rešavanje investicionih sporova (ICSID Centrom). Autor najpre uočava da je broj predmeta u kojima su stranke ugovorile primenu principa ex aequo et bono izuzetno mali. Ipak, uprkos njihovoj malobrojnosti, ovi predmeti omogućavaju izvođenje određenih zaključaka u pogledu načina na koji su stranke ugovarale odlučivanje po pravičnosti i postupanja arbitražnih veća u takvim okolnostima. Posebno se razmatraju dva scenarija: primena ex aequo et bono kao merodavnog pravnog okvira za rešavanje spora i pozivanje na ex aequo et bono u pokušaju da se isposluje poništaj arbitražne odluke. Autor zaključuje da se oprez stranaka u pogledu ugovaranja odlučivanja po pravičnosti može objasniti strahom od nedovoljne predvidljivosti ishoda spora, što je nužna posledica mehanizma primene pravičnosti kao izvora prava. S druge strane, može se očekivati da će stranke nastaviti da pokazuju kreativnost u pokušaju da dokažu da pogrešna primena merodavnog prava u meritornom postupku pred arbitražnim većem zapravo predstavlja neovalšćeno odlučivanje ex aequo et bono, čime bi se otvorio put za poništaj takve arbitražne odluke zbog prekoračenja ovlašćenja arbitražnog veća.This article examines the role of the principle of ex aequo et bono in arbitration before the International Centre for Settlement of Investment Disputes (ICSID). At the outset, the author remarks that the cases in which the application of ex aequo et bono was agreed upon by the parties are very scarce. Nevertheless, despite that scarcity, it is possible to draw some conclusions on the way in which equity was invoked by the parties and applied by the ICSID tribunals. Two scenarios are analyzed in particular: the use of ex aequo et bono as the applicable framework for dispute settlement and the reliance on ex aequo et bono in an attempt to nullify the award before an ad hoc Committee. The author concludes that the reluctance of the parties to agree on ex aequo et bono may be explained by the lack of predictability of outcomes that is inherent to this source of law. On the contrary, it might be expected that the parties will continue trying to come up with creative arguments aimed at proving the unauthorized application of ex aequo et bono by the tribunals in their attempts to annul the awards on the basis of excess of powers
Spite and strong reciprocity in the bargaining game: An experimental study
Predmet ovog rada je inat i inadžijsko ponašanje iz ugla biheviorističke ekonomije. Sprovedena je eksperimentalna studija korišćenjem "miniultimatum igre" sa potpunim informacijama o isplatama i nepovoljnoj spoljašnjoj opciji. Uzorak je formiran od 748 studenata Pravnog fakulteta Univerziteta u Nišu i Pravnog fakulteta Univerziteta u Beogradu. U eksperimentalnom dizajnu "između subjekata", 604 različitih učesnika testirano je u kontrolnoj i eksperimentalnoj grupi. U dizajnu "unutar subjekata", 144 učesnika predstavljalo je "sopstvenu kontrolnu grupu". Glavni nalaz je da postoji statistički značajna veza između spoljašnje opcije i izbora učesnika, pri čemu je oko jedne trećine njih pokazalo inadžijsko ponašanje. Takođe, ustanovljena je statistički značajna razlika između ispitanika iz Beograda i Niša u pogledu pravičnog tretmana, ali ne i razlika u udelu onih subjekata koji su ispoljili inat - bez regionalnih razlika u pogledu inata. Nije utvrđena razlika prema polu u pogledu pravičnog tretmana, ali su osobe ženskog pola u Nišu iskazale statistički neznatno veći nivo inadžijskog ponašanja. Studija otvara vrata daljim istraživanjima sa akcentom na subjekte različitih starosnih grupa i dodatne karakteristike inadžijskog ponašanja.The subject of this paper is spite and spiteful behaviour from the point of view of behavioural economics. We conducted an experimental study using a 'mini-ultimatum game' with complete information about payoffs and unfavourable outside option. The sample consists of 748 undergraduate students from the Faculty of Law of the University of Niš and the Faculty of Law of the University of Belgrade. In a between-subjects design, 604 different participants are tested in the control and treatment group. In the within-subjects experiment, 144 subjects served as their own control group. The main finding is that there is a statistically significant relationship between the outside option and the respondents' choice, with roughly one-third of respondents exhibiting spiteful behaviour. Also, we found a statistically significant difference between Belgrade and Niš concerning the insistence on fair treatment, but no difference when examining the share of spiteful respondents-no regional effects on spiteful behaviour. We did not find a difference between gender concerning fair treatment, but females in Niš exhibited weakly significant level of spiteful behaviour. The study opens the door to further research with an emphasis on other subjects aimed at covering different age groups and capturing additional characteristics of the spiteful behaviour
Law and economics of employee inventions
U disertaciji autor nastoji da odgovori na pitanje da li pravo na patentnu zaštitu i privrednu upotrebu pronalaska koji je stvoren u radnom odnosu treba priznati poslodavcu ili pronalazaču i pod kojim uslovima. Povod za istraživanje pružaju brojni radovi u kojima se zagovara bolja pravna zaštita pronalazača i zakonska rešenja u uporednom pravu koja priznaju poslodavcu pravo na patentnu zaštitu pod različitim uslovima. Kako bi došao do odgovora, autor analizira istorijski razvoj instituta patentne zaštite i relevantna zakonska rešenja iz uporednih patentnih sistema, pri čemu pored pravnih metoda primenjuje i ekonomske metode i modele. Na osnovu istraživanja, autor zaključuje da bi pravo na patentnu zaštitu pronalaska stvorenog u radnom odnosu trebalo priznati poslodavcu, pod obavezujućim uslovom da usvoji odgovarajući interni sistem podsticaja, koji bi pronalazačima omogućio da preuzimaju deo rizika (i koristi od) istraživanja i razvoja. Na taj način bi bili stvoreni bolji podsticaji za ulaganje u istraživanje i razvoj i za efikasnije obavljanje istraživačkih delatnosti kod poslodavca, što bi u krajnjem efektu moglo pozitivno da utiče na tehnološki i ekonomski razvoj društva.In the dissertation, the author tries to answer the question of whether the right to patent protection and commercial exploitation of employee inventions should be granted to employers or employed inventors, and under which conditions. The reason for the research lies within numerous papers advocating stronger legal protection of employed inventors, and comparative legal systems granting the right to patent protection to employers under different conditions. In order to provide an answer, the author analyzes the historical development of patent protection, and comparative legal solutions in modern patent systems, applying the legal methods, and economics methods and models. Based on the conducted analysis, the author concludes that the right to patent protection of employee inventions should be granted to an employer, under the mandatory condition to enact adequate internal incentive system for employed inventors, which would enable inventors to take a share of research and development risk (and profit). In that way, one could create better incentives for investments in research and development, and for more efficient conduct of scientific and research activities within employers’ organization, which could contribute to the technological and economic development of a society

Legal aspects of the Covid-19 pandemic and impact on the proceedings before Basketball Arbitral Tribunal (BAT)
Košarkaški arbitražni tribunal je međunarodno arbitražno telo oformljeno za rešavanje ugovornih sporova koji nastaju u košarkaškoj sportskoj industriji. BAT je već značajno slavljena arbitraža koja je dala veliki doprinos uređivanju pravnih odnosa u košarci kao profesionalnom sportu. Nove okolnosti u vidu globalne pandemije korona virusa stavile su ovu arbitražu na još jedan značajan ispit, a rezultati rada i odabranih rešenja i dalje podležu različitim mišljenjima i tumačenjima. BAT poseduje kvalitet organizacione nezavisnosti u odnosu na svetsku kuću košarke FIBA, ali postoji i rešava sporove u sadejstvu i pod pokroviteljstvom ove krovne organizacije. Efekti rada BAT-a pre pandemije su nesporni, a najčešće se njegove vrednosti opisuju kroz brzo, efikasno i sigurno rešavanje sporova sa jednostavnim BAT pravilima arbitraže koja podrazumevaju postojanje rešenja koja maksimalno ubrzavaju i pojednostavljuju sam postupak pred jednim arbitrom. Odluka Tribunala ima snagu presuđene stvari, a načelo po kojem se rešavaju sporovi je, u osnovi, načelo pravičnosti. Pre globalne pandemije korona virusa izgrađena je respektabilna praksa u rešavanju sporova, a slična praksa je nastavljena i na osnovu korišćenja uputstava koja su objavljena već u prvom dvomesečju pandemije. Upravo su ova pravila, njihovi efekti i opšti uticaj globalne pandemije na košarkašku sportsku industriju predmet istraživanja ovog rada.The coronavirus global pandemic has endangered basketball as a professional sport. Contractual Obligations have been shaded by the uncertainty of the global situation, and in that sense, many questions arose. The Basketball Arbitral Tribunal offered some answers to the situation quickly and paved some directions. The Basketball Arbitral Tribunal is an international arbitration body formed to resolve contractual disputes arising in the basketball sports industry. The BAT is already a significantly celebrated arbitration that has given a great contribution to the regulation of legal relations in basketball as a professional sport. New circumstances in the form of a global Covid-19 pandemic have put this arbitration to another important test, and all the results of the work and the solutions offered in the BAT Covid-19 Guidelines are still subject to different opinions and interpretations. The BAT responded to the situation by publishing the BAT Covid-19 Guidelines, which are the main focus of this article. The effects of the BAT before the pandemic are indisputable, and most often its values are described through fast, efficient and safe dispute resolution with simple BAT rules of arbitration, which imply the existence of solutions that speed up and simplify the procedure, all built around many factors. Before the global coronavirus pandemic, a respectable practice in resolving disputes was built, and a similar practice was continued based on the use of instructions published in the first two months of the pandemic
