Ação por incumprimento enquanto instrumento de defesa do Estado de direito na Polónia
Get PDFO Estado de direito, um dos mais importantes pilares de sustentação da União Europeia,
se encontra ameaçado pela crise do sistema judicial polaco. Nesse contexto, o presente
trabalho tem como temática a utilização da ação por incumprimento na restauração do
Estado de direito na Polónia. A pesquisa realizada teve por objetivo principal avaliar o
resultado das cinco ações por incumprimento que foram ajuizadas pela Comissão
Europeia. A investigação, que adotou o método dedutivo, utilizou os recursos
bibliográficos disponíveis e a jurisprudência afeta à temática. Para tal, foram
consultados textos clássicos da filosofia, manuais de direito, artigos científicos, teses de
doutoramento, documentos oficiais e os precedentes do Tribunal de Justiça. Os
resultados obtidos foram satisfatórios para a conclusão da pesquisa. Sendo assim, a
partir de uma abordagem teórica e prática, o trabalho lança luzes sobre a atual situação
do judiciário polaco e contribui para a compreensão do papel da ação por incumprimento
em um cenário de ameaça sistémica ao Estado de direito.The Rule of Law, one of the most crucial pillars supporting the European Union, is under
threat due to the crisis in the Polish judicial system. In this context, the present work
focuses on the use of infringement actions in restoring the Rule of Law in Poland. The
primary objective of the conducted research was to evaluate the outcomes of the five
infringement actions filed by the European Commission. The deductive methodology
employed in the investigation utilized available bibliographic resources and relevant
jurisprudence. Classical philosophy texts, legal manuals, scientific articles, doctoral
theses, official documents, and precedents from the Court of Justice were consulted.
The obtained results were satisfactory for concluding the research. Thus, through a
theoretical and practical approach, the study sheds light on the current state of the Polish
judiciary and contributes to understanding the role of infringement action in a scenario
of systemic threats to the Rule of Law

On the survival of a flawed theory of capital: Mainstream economics and the Cambridge capital controversies
Get PDFThe Cambridge controversies on capital theory opposed heterodox economists, mainly from the University of Cambridge, UK, to mainstream economists, mostly based at the Massachusetts Institute of Technology, Cambridge, USA. The controversies started in the 1950s and occupied the pages of some of the most influential journals. Their primary outcome was the broad acknowledgement of flaws, which we retrieve, in the concept of aggregate capital. Despite that acknowledgement, aggregate, homogeneous capital remains a staple of contemporary macroeconomics, as if the Cambridge controversies had never existed. To account for this apparent paradox is the aim of this article. We examine the arguments seeking to justify the enduring commitment to the aggregate capital approach and argue that they indicate an implicit commitment to instrumentalism. The indifference to the results of the Cambridge controversies is a consequence of methodological conformism and has shaky foundations
Navigating the herd: The dynamics of investor behavior in the Brazilian stock market
Get PDFWe investigated under-researched dimensions of market-wide herding behavior in the Brazilian stock market using a sample from January 2010 to December 2022. Employing OLS and quantile regressions, we found no evidence of herding in the sample or across market conditions, including return, trading volume, and volatility. However, dynamic analysis via rolling window regressions revealed intermittent herding behavior during various subperiods, including at the onset of the COVID-19 pandemic and around the beginning of the war in Ukraine. Additionally, regression results differentiate between herding driven by fundamental and non-fundamental factors, elucidating the predominance of negative herding attributable to non-fundamental influences. These findings underscore the presence of irrational behavior among investors, potentially leading to increased price instability and deviations from fundamental values. Moreover, the association of negative herding with diversifiable risk suggests potential implications for portfolio composition. Overall, this study contributes to understanding investor behavior in emerging markets and highlights the impact of herding on market dynamics and portfolio management strategies
Ajustamento psicossocial: Efeitos do teatro radiofónico em contexto de reclusão [abstract]
No full textA literatura contemporânea sugere que programas de intervenção artística em contextos de privação de liberdade influenciam positivamente o ajustamento psicossocial dos reclusos e as suas relações com os outros. No entanto, os estudos empíricos a nível nacional ainda são escassos. O presente estudo quasi-experimental objetivou analisar o efeito de um programa de intervenção artística, estruturada em formato de teatro radiofónico, na autoeficácia, autocontrolo e distress numa amostra de reclusos. A amostra foi constituída por 37 reclusos (21 do grupo de controlo; 16 do grupo de intervenção) de um estabelecimento prisional do interior do país. Os participantes completaram a Escala de Autoeficácia Geral, a Escala Breve de Autocontrolo e a Escala de Distress Psicológico de Kessler. Os resultados preliminares sugerem que o autocontrolo apresentou melhorias significativas da baseline para o período pós-intervenção apenas no grupo que recebeu o programa. Essa diferença apresentou um tamanho de efeito moderado (p=0,044; Cohen's d =0,55). Este estudo aponta assim que atividades artísticas como o teatro radiofónico apresentam potencial para melhorar aspetos psicossociais promotores da regulação emocional, sendo necessária a continuidade de investigação nesta área

Optimal Operation of Renewable Energy Resources and Electric Vehicles in Microgrids [comunicação oral]

Additionally, leveraging the timing and enhanced storage capacity of a significant number of EVs can significantly improve the flexibility of the electrical systems. In this study, an optimization model is developed for the operation of microgrids in the presence of EVs and solar power. To examine the role of EVs and solar power, different scenarios are considered for the arrival and departure state of charge of EVs, as well as winter and summer available solar power. The model is in the form of mixed-integer nonlinear programming and coded in General Algebraic Modelling System (GAMS) software. The output of the study indicates that scheduled integration of EVs in parking lots provides higher flexibility in the operation of the microgrid under study and even 3% cost savings, which is noteworthy

Get PDFThe Convention on the Rights of the Child - CRC -, adopted by the General Assembly of the United Nations – UN – on November 20, 1989, ratified by Portugal on September 21, 1990 Was a significant milestone in safeguarding and promoting children's rights throughout history. It is therefore essential that all those involved in civil society as a whole, encompassing the political sphere, and particularly entrusted with the direct responsibility of educating children, take every conceivable measures to ensure that these rights are guaranteed. The children themselves should also know when these rights are or are not being respected. This study aims to assess children’s awareness of the CRC and the extent to which their rights are being fulfilled. Furthermore, we aim to examine whether significant differences exist in the fulfilment of rights and their perception among children in the North, Center, and South of Portugal. A total of 123 teenagers ranging from 7th to 12th grade participated in this research. The students came from three different areas of the country: North, Center and South of Portugal. The survey "Being a Child with Rights - Convention on the Rights of the Child: Knowledge and Compliance" was applied as an instrument. The results indicate that many children continue to be disrespected in their rights
Determinantes internas do desempenho financeiro das PME: O papel do endividamento numa amostra alargada de empresas
Get PDFAs PME são parte fundamental do tecido económico e industrial de qualquer economia. No entanto, dados os seus recursos limitados, enfrentam alguns obstáculos, de entre os quais se destacam as dificuldades no acesso ao financiamento. Este artigo tem como objetivo investigar o desempenho financeiro e alguns dos seus determinantes, salientando os efeitos do endividamento. Para atingir os objetivos de investigação, recolheram-se dados referentes a 9521 PME, para o período 2010-2020. Relativamente à metodologia utilizada na investigação, foi usado o estimador dinâmico GMM System. Para a elaboração do modelo usou-se uma variável de desempenho financeiro como variável dependente, e os determinantes endividamento, dimensão, idade, crescimento, liquidez, tangibilidade e Covid-19 como variáveis explicativas. Os resultados evidenciam que o endividamento, a dimensão, o crescimento, a liquidez, a tangibilidade e a Covid-19 têm um impacto negativo e estatisticamente significativo no desempenho financeiro, enquanto que a idade apresenta um impacto positivo e estatisticamente significativo. A principal limitação do artigo reside na sua aplicação a um país, podendo os resultados não ser generalizáveis a outras economias. Não obstante, os resultados obtidos são úteis para perceber em que variáveis internas das PME se poderá atuar para incrementar o seu desempenho em termos financeiros
Integrating industrial tourism into active industrial companies: Advantages, barriers, and strategic approaches using the Delphi Method
Get PDFObjective: This article explores how to incorporate industrial tourism into active industrial companies, whose main focus is industrial production rather than tourism. In contrast to most of the research on industrial tourism, this article focuses on the point of view of active industrial companies, the so-called "living industry", to identify the impact of this product on industrial companies, as well as strategies and barriers to its implementation.
Theoretical Framework: Industrial tourism includes visits to industrial sites that have ceased their operations, industrial companies currently in operation and future industrial establishments, as well as visits to other destinations with an industrial theme, such as industrial technology hubs, museums, industrial tourist routes, educational institutions with industrial programs, laboratories and similar sites.
Method: The Delphi methodology was employed, involving 27 experts, both academics and practitioners, with different backgrounds, such as Anthropology, Tourism, Business Sciences, Marketing, Economics, International Public Relations, History, Museology, Cultural Heritage, Art and History.
Results and Discussion: The results provide new knowledge on the advantages, weaknesses, strategies and barriers to implementing Industrial Tourism in active industrial companies, promoting the development of l business strategies and future studies on this subject.
Implications of the Research: The research contributes to understanding the challenges to implementing this tourism product, offering a basis for analyzing and formulating successful business strategies.
Originality/Value: The study proposes a practical approach to the applicability of industrial tourism to industrial companies, providing relevant information for industrial companies, government bodies and other stakeholders
