As lutas pelos direitos queer em África: Examinar o papel do direito e da política na formação dos discursos LGBTQ+ em África [comunicação oral]
Este painel tem como objetivo discutir o direito e a política relativamente aos africanos queer. Em 2023, o Uganda esteve no centro das preocupações mediáticas internacionais quando o Parlamento do país votou e aprovou uma nova lei que criminaliza a homossexualidade e as identidades queer, quase dez anos depois da primeira lei, em 2014 (CNN, 2023). Vários países adoptaram legislação semelhante em meados da década de 2010, nomeadamente a Nigéria e a Gâmbia, e muitos outros estão agora a discutir novas formas de criminalizar o que é entendido como sexualidades desviantes e identidades queer. Num estudo comparativo entre o Uganda e a Nigéria, Amusan, Saka e Adekeye (2019) concluíram que a legislação anti-homossexualidade em ambos os países incutiu políticas conservadoras e religiosas. Da mesma forma, um estudo inicial de Rita Schäfer & Eva Range (2014) demonstrou a politização da homossexualidade em alguns países (incluindo o Uganda). Estudos recentes continuam a corroborar as mesmas conclusões e sublinham uma situação agravante para as pessoas LGBTIQ em toda a África (Nkom et al, 2023). Neste contexto jurídico e social, os direitos fundamentais das pessoas LGBTIQ estão no limite, uma vez que alguns países simplesmente negam o acesso a direitos básicos a pessoas suspeitas de serem homossexuais (Matebeni, 2021). A resposta da comunidade internacional a estes movimentos deve ser conduzida com cautela, pois pode ser entendida como imperialismo e interferência externa (Brown, 2023). Mas a África não é uma peça única neste xadrez. Outros países estão a seguir um caminho muito diferente, repelindo a legislação colonial e adoptando legislação mais protetora. É o caso da África do Sul (Christiansen, 2019), do Botswana (Lekgowe, 2023) e de Angola (Garrido, 2019). Apesar de os sul-africanos demonstrarem melhores resultados em matéria de orientação sexual, mudar a lei é apenas parte do caminho para a igualdade e a dignidade. Tendo este cenário como pano de fundo, este painel coloca as seguintes questões: Que lugar ocupam as pessoas queer nas sociedades africanas? Como é que a lei pode ser um instrumento útil para a inclusão das pessoas queer? As leis africanas podem ser maricas? E como é que os movimentos sociais podem utilizar o direito e a política para dialogar e defender a diversidade, o respeito e a dignidade? São bem-vindos artigos que discutam o queer em África a partir de perspectivas legais e políticas
Research in human memory: Past, present and future [abstract]
The presentation explores the evolution of memory studies, highlighting historical mi lestones, recent advancements, and future perspectives. In the past, research focused on foundational models, such as those by Ebbinghaus, which introduced concepts like forgetting curves and repetition. Currently, research encompasses areas such as cognitive neuroscience, revealing the role of brain structures like the hippocampus and me chanisms of synaptic plasticity. The integration of technologies, such as neuroimaging and artificial intelligence, has enabled more detailed analyses of memory functioning in real-world contexts, from a translational perspective. The present and the future point towards interdisciplinary investigations combining biology, psychology, and data science, addressing ethical concerns and practical applications, such as the treatment of neurodegenerative diseases. This presentation emphasizes the importance of understanding human memory to tackle contemporary challenges and foster scientific and societal advancements
Determinants of Banking Profitability in Angola: A panel data analysis with Dynamic GMM Estimation
This study aims to analyze the determinants of bank profitability in Angola by employing panel data econometric models, specifically, the Generalized Method of Moments (GMM), to assess the impact of internal and external factors on the financial indicators ROE, ROA, and NIM for the period 2016 to 2023. The results reveal that credit risk, operational efficiency, and liquidity are critical determinants of banking performance. Effective credit risk management and cost optimization are essential for the sector’s stability. Banking concentration presents mixed effects, enhancing net interest income while potentially undermining efficiency. Economic growth supports profitability, whereas inflation exerts a negative influence. The COVID-19 pandemic worsened asset quality, increased credit risk, and led to a rise in non-performing loans and provisions. Reforms implemented by the National Bank of Angola have contributed to strengthening the banking system’s resilience through restructuring and regulatory improvements. The rise of digitalization and fintech presents opportunities to enhance financial inclusion and efficiency, although their success relies on advancing financial literacy. This study contributes to the literature by providing updated empirical evidence on the factors influencing bank profitability within an emerging economy’s distinctive institutional and economic context
A suspensão provisória do processo nos crimes de violência doméstica
Esta dissertação tem como objeto de estudo o instituto da suspensão provisória do processo no contexto dos crimes de violência doméstica em Portugal. A análise deste instituto é especialmente relevante pois a violência doméstica constitui uma violação dos direitos humanos com impactos profundos e duradouros, exigindo uma resposta judicial que consiga equilibrar a proteção da vítima com a possibilidade de reabilitação do agressor. No entanto, a aplicação deste instituto em crimes de violência doméstica levanta diversas questões éticas e jurídicas, uma vez que envolve medidas que, por vezes, podem ser vistas como insuficientes para assegurar a segurança da vítima e a responsabilização efetiva do agressor.
Neste contexto, é essencial analisar não só a legislação em vigor e os princípios subjacentes ao instituto da suspensão provisória do processo, mas também as práticas judiciais que moldam a sua aplicação. O instituto visa, entre outros objetivos, suspender o prosseguimento do processo penal mediante o cumprimento de determinadas injunções ou regras de conduta pelo agressor. Neste sentido demonstra ser importante avaliar até que ponto a suspensão provisória do processo se revela eficaz na prevenção de futuras agressões e na promoção da responsabilização. Adicionalmente, cumpre ponderar e avaliar a eficácia e as repercussões dessa medida, considerando tanto a proteção das vítimas como a reabilitação dos agressores, especialmente no que respeita à resposta penal a crimes de violência doméstica, uma vez que decisões que possam parecer brandas podem enfraquecer a confiança da sociedade no sistema judicial.
Apesar da aplicação da suspensão provisória do processo ser uma prática relativamente comum, a sua utilização nos crimes de violência doméstica pode suscitar controvérsia. Ao longo desta dissertação, serão analisadas várias decisões jurisprudenciais com o intuito de proporcionar uma compreensão do tema e avaliar o enquadramento do instituto no contexto da violência doméstica em Portugal.
A violência doméstica, embora não seja um problema novo, continua a ser um fenómeno persistente que atravessa gerações e afeta relações de intimidade em diversas sociedades. Em Portugal, trata-se de um problema grave, cujas consequências são profundas e multifacetadas, afetando a vida de inúmeras famílias e impondo desafios sérios aos sistemas de justiça e apoio social. A resposta judicial a estes crimes exige um delicado equilíbrio entre a proteção das vítimas e a reabilitação dos agressores, objetivos que, por vezes, podem parecer conflituantes.
Com base nessa perspetiva, este estudo inicia-se com uma análise da admissibilidade e aplicabilidade do instituto da suspensão provisória do processo no direito processual penal português, com particular relevância nos crimes de violência doméstica. A análise deste instituto é fundamental para entender sob quais condições este mecanismo pode contribuir para a justiça sem comprometer a segurança da vítima. Além disso, será realizada uma breve comparação com o instituto equivalente de suspensão provisória do processo no direito alemão, visando identificar abordagens e práticas alternativas que possam enriquecer o debate sobre a aplicação deste instituto em Portugal.
Após essa análise comparativa, será realizada uma análise do regime vigente de suspensão provisória do processo nos crimes de violência doméstica em Portugal, incluindo a análise da sua eficácia à luz das práticas judiciais e das taxas de reincidência. Finalmente, serão apresentadas propostas de melhoria para reforçar a proteção das vítimas e promover uma reabilitação efetiva dos agressores, visando uma resposta judicial mais eficaz e socialmente justa. Essas propostas visam contribuir para um sistema penal que equilibre adequadamente a proteção das vítimas e a reabilitação dos agressores, e que, ao mesmo tempo, reforce a confiança pública nas instituições judiciais.The object of this dissertation is to study the institute of provisional suspension of proceedings in the context of crimes of domestic violence in Portugal. The analysis of this institute is especially relevant because domestic violence is a violation of human rights with profound and lasting impacts, requiring a judicial response that balances the protection of the victim with the possibility of rehabilitating the aggressor. However, the application of this institute in crimes of domestic violence raises a number of ethical and legal questions, since it involves measures that can sometimes be seen as insufficient to ensure the safety of the victim and the effective accountability of the aggressor.
In this context, it is essential to analyze not only the legislation in force and the principles underlying the institute of provisional suspension of proceedings, but also the judicial practices that shape its application. The institute aims, among other things, to suspend the continuation of criminal proceedings by means of compliance with certain injunctions or rules of conduct by the aggressor. In this sense, it is important to assess the extent to which the provisional suspension of proceedings is effective in preventing future aggression and promoting accountability. In addition, the effectiveness and repercussions of this measure must be considered and evaluated, taking into account both the protection of victims and the rehabilitation of aggressors, especially with regard to the criminal response to crimes of domestic violence, since decisions that may seem lenient can weaken society's trust in the justice system.
Although the application of the provisional suspension of proceedings is a relatively common practice, its use in crimes of domestic violence can be controversial. Throughout this dissertation, several case law decisions will be analyzed in order to provide an understanding of the subject and assess the framework of the institute in the context of domestic violence in Portugal.
Although domestic violence is not a new problem, it remains a persistent phenomenon that spans generations and affects intimate relationships in many societies. In Portugal, it is a serious problem whose consequences are profound and multifaceted, affecting the lives of countless families and posing serious challenges to the justice and social support systems. The judicial response to these crimes requires a delicate balance between the protection of victims and the rehabilitation of perpetrators, objectives that can sometimes seem conflicting.
Based on this perspective, this study begins with an analysis of the admissibility and applicability of the institute of provisional suspension of proceedings in Portuguese criminal procedural law, with particular relevance to crimes of domestic violence. The analysis of this institute is fundamental to understanding under what conditions this mechanism can contribute to justice without compromising the victim's safety. In addition, a brief comparison will be made with the equivalent institute of provisional suspension of proceedings in German law, with the aim of identifying alternative approaches and practices that can enrich the debate on the application of this institute in Portugal.
Following this comparative analysis, an analysis will be made of the current system of provisional suspension of proceedings in crimes of domestic violence in Portugal, including an analysis of its effectiveness in the light of judicial practices and recidivism rates. Finally, proposals for improvement will be put forward to strengthen the protection of victims and promote the effective rehabilitation of aggressors, with a view to a more effective and socially just judicial response. These proposals aim to contribute to a penal system that adequately balances the protection of victims and the rehabilitation of offenders, while at the same time strengthening public confidence in judicial institutions
Human Capital in the Tourism and Hospitality Industry: A bibliometric approach
Human capital is a prolific research topic in tourism and hospitality, given its decisive role in this industry’s competitiveness, sustainable growth and development. This chapter contributes to the current theoretical understanding of human capital in the tourism and hospitality field through thematic knowledge mapping. This study adopts a bibliometric analysis using VOSviewer software to examine 451 studies published from 2008 to 2023, retrieved from the Scopus database. Emerging themes, leading authors and academic institutions were mapped using co-citation and keyword co-occurrence analyses. Five clusters were identified within the human capital research landscape, including business outcomes, economic growth, tourism development, models of human capital development and technology. The results show that human capital research in hospitality and tourism has gained momentum in recent years and is expanding
Generation Z and travel motivations: The impact of age, gender, and residence
This study investigates the relationship between demographic factors and travel motivations among Generation Z leisure tourists through the lens of the Travel Career Pattern (TCP) theory. More specifically, the research focuses on how gender, age, and area of residence influence the travel motivations of Generation Z. Using a quantitative approach, data were collected from 303 respondents aged 18 to 28 through an online survey. The questionnaire assessed 14 motivational factors and analyzed them in relation to the participants’ demographic characteristics using linear regression models. Results indicate that gender and age significantly influence travel motivations, with women showing higher interest in personal development and social relationships, while men prioritize nature and adventure. Furthermore, rural residents exhibit greater motivation for autonomy, self-development and self-realization, while urban residents lean towards novelty and social interactions. The findings offer valuable insights for tourism marketers, emphasizing the importance of creating segmented marketing campaigns based on demographic factors. It also contributed to overcoming the lack of studies that specifically cover this interrelation between the motivational factors of Generation Z and the demographic factors of age, gender and area of residence. Nevertheless, this study also has limitations, such as the use of a non-representative sample and the focus on quantitative methods, suggesting that future research should adopt qualitative approaches and examine additional demographic variables to gain deeper insights into youth travel motivations
Igualdade e poder local: Legados da revolução, pilares da democracia: A representação política das mulheres no cargo de Presidente no mandato 2021-2025
Apesar de vigorar em Portugal, desde 2006, um mecanismo legal destinado a equilibrar a representatividade política de ambos os sexos – a Lei da Paridade – subsistem importantes faixas do poder político que se desenvolvem totalmente à sua margem. De entre tais poderes, destaca-se, pela sua importância no panorama político-constitucional português, o de Presidente da Câmara, em virtude de um fenómeno crescente de presidencialismo do poder local. Com recurso a evidência empírica, procurará questionar-se a adequação da Lei da Paridade ao modelo do poder local em Portugal. Com isso, procurará igualmente verificar-se o cumprimento pelo Estado português da tarefa constitucionalmente imposta de promoção da igualdade real entre homens e mulheres no exercício de direitos políticos, nos termos das disposições conjugadas dos arts. 9.º, alíneas d) e h), e 109.º da Constituição da República Portuguesa. Igualdade e poder local são dois importantíssimos legados da Revolução, que alteraram drasticamente o estatuto do cidadão português. Embora titulares de direitos e deveres iguais, e organizados em comunidades locais com autonomia constitucional para prosseguirem interesses próprios, distintos dos interesses do Estado, homens e mulheres portugueses continuam a posicionar-se de forma muito diferente enquanto titulares de cargos políticos, sobretudo no poder local. O presente artigo visa analisar o papel da Lei da Paridade na realização da igualdade de género no poder local, evidenciando a sua ineficácia nos cargos para-paritários
