    NPE Power Reversal: Amending ITC Standing Under Section 337 and Domestic Industry

    The International Trade Commission (ITC or Commission) is an adjudicative agency thatsafeguards intellectual property (IP) rights among patent litigants. Notably, when an importinfringes a U.S. patent, the ITC investigates the unlawful act under Section 1337 of the Tariff Act of1930 (Section 337) rather than the Patent Act of 1952 (Patent Act). Today, the ITC and the federalcourts comprise a parallel patent system but support varying standing rules. Section 337proceedings only require that one ITC complainant demonstrate standing; the federal courts requireall plaintiffs. This difference favors non-practicing entities (NPEs)—a term encompassing patenttrolls. Section 337’s broader standing interpretation, supplemented with the ITC’s domestic industryrequirement, helps NPEs exploit the Commission’s purpose. Even though the ITC does not awardmonetary damages, trolls litigating before the Commission may threaten respondents with exclusionorders—nevertheless forcing settlements and achieving financial relief. Therefore, to reverse NPEpower at the ITC, amendments to Section 337’s current standing and domestic industry requirementsmerit consideration

    The Resurrection of the St. George Incorporation Movement in Southeastern Louisiana

    In the mid-2010s, a second attempt of a school district secession movement dubbed “St. George” resurfaces in the state of Louisiana, eventually morphing into an urban breakawaymovement where hundreds of wealthy, white residents fight to separate from the current City- Parish governance model of the City of Baton Rouge and the East Baton Rouge (EBR) Parish. Simultaneously, sizzling tensions rise as countless debates and conversations about Critical Race Theory (CRT) and anti-racism flood classrooms and legislatures across the United States. Mayor- President Sharon Weston Broome serves as the Chief Executive Officer of the racially divided city and parish. This case examines Mayor-President Broome\u27s struggle in staving off the resurgence of St. George incorporation efforts. Becoming a trailblazer when it comes to addressing a plethora of challenges, Mayor-President Broome exemplifies the values of perseverance and self- confidence in her unwavering attempts to maintain a united Baton Rouge with the goals of revitalizing race relations, ensuring a stable financial status for the City-Parish, and strengthening the East Baton Rouge Parish public education system for all

    Fight or Flight: A Story of Survival and Justice in Cancer Alley

    Grandmother and retired special education teacher Sharon Lavigne lives with her familyin St. James Parish, a part of Louisiana called “Cancer Alley” for its notorious rates of respiratoryillnesses and other diseases. Home to many predominately Black, low-income communities, this stretch of the Mississippi River has become overrun with industrial plants in the last several decades. As a result, harmful pollutants, including carcinogens, have inundated the air and water of the surrounding neighborhoods and induced staggering rates of sickness and death. In 2018, Formosa Plastics Group announced its plans to construct one of the largest plants yet—the monstrous “fourteen-in-one” chemical facility would stand only a mile and a half from Sharon’sproperty. Faced with the potentially deadly consequences of environmental racism, Sharon contemplated a difficult choice: should she abandon her lifelong home to protect her health, or stay and organize against Formosa Plastics? Her story underscores the importance of confronting histories of racialized violence as well as the critical relationship between social justice and healthy environments
