    Spare Parts and Design Rights in the EU through the Acacia Case ―A Revisiting from Right to Repair Theory―

    The “right to repair” is defined as the user’s right to decide on her products, but current legislations take forms of obligations to provide repair parts and repair manuals from authorized product manufacturers to the users or the independent repair service providers. In other words, the current “right to repair” legislation does not address the prevention of the repair by the manufacturer’s intellectual property rights. Then, what measures can be taken to tackle that situation? In this respect, in EU design law, the “repair clause” which legalizes repair using spare parts has existed since before the “right to repair” was discussed. This paper follows the discussion of the repair clause through the leading case, the Acacia case, and explores whether the clause contributes to the “right to repair” and the pros and cons of such clauses. As a conclusion, the repair clause of EU can support the “right to repair”. On the other hand, the extensibility of the clause may differ depending on whether the rational of the exception provision is considered as the competition law and the exhaustion doctrine or, beyond the traditional those theories, given the meaning of an “environment-oriented” right to repair to promote the circular economy.論文(Article)departmental bulletin pape

    An evaluation of educational designs by students:Suggestions for individual optimal learning

    oai:fit.repo.nii.ac.jp:02000002applicationFor more than a decade, educators in higher education have been expected to become the designers of classes, courses, and curriculums in Japan in order to respond to social changes. However, there has been limited research on how to evaluate effective designs, without merely using average values. Thus, the present study examines a sample of student evaluations regarding the design of the subject “Psychology for Communication” and explores the tendencies of students to support individual optimal learning. For this purpose, a questionnaire survey was administered to 142 students after the final class. Using factor analysis, we divided the students into two groups according to scoring tendency: the learning-environmental oriented group and the content-understanding oriented (CUo) group. Further qualitative analysis revealed a clear indication of “relevancy” in the high CUo group regarding what they had learned in the class.     applicationUnder the university-wide Faculty Development policies for 2022, our university's Center for Liberal Arts conducted original workshops three times during the 2022-23 academic year. Three teachers gave presentations about what they did in the classroom to nurture learners’ autonomous learning attitudes. The topics covered how to raise learners’ motivation, practical ways to set up assignments, and how to increase students’ ownership in learning. In each workshop, participants exchanged opinions on what teachers can or should do to facilitate learners' autonomy, and this provided the participants with new insights toward teaching.論文(article)othe

    論文(Article)The purpose of this study is to examine inertial properties in baseball metal bats and wood bats. Mass, center of mass, and moment of inertia for rotation about the grip end of the bat (Igrip) were measured for 13 new regulation metal bats, 15 current regulation metal bats, and 7 wood bats. Igrip was determined by using the pendulum method. Although the average mass of wood bats was significantly smaller than mass of metal bats, the average value of Igrip of wood bats was significantly larger than that of metal bats. This result can be explained by the center of mass in wood bats which was located further than that of metal bats. Meanwhile, no significant difference in inertial properties between the two kinds of metal bats was found.departmental bulletin pape
