Keluarga dalam Bisnis dan Biaya Utang: Bukti dari Perusahaan Keluarga di Indonesia
The issue of efficiency in choosing funding sources has become a concern for researchers, especially during the Covid 19 pandemic. Our research seeks to investigate whether family involvement and ownership can contribute to funding efficiency, especially from debt. Then we extended the test to see if earnings management behavior could affect family involvement and ownership. For this purpose, we collect family companies that are listed on the Indonesia Stock Exchange for the period 2005 to 2020. The method we use is panel data regression analysis. The results of the study prove that family involvement in management and share ownership is able to contribute to reducing the cost of debt during the covid 19 pandemic. The results also provide empirical evidence that earnings management carried out through abnormal cash flows does not affect family involvement and ownership in contributing to lowering the cost of debt. This research is expected to provide implications for family companies, especially in determining funding decisions from debt schemes.Isu efisiensi dalam memilih pendanaan menjadi perhatian para peneliti, terlebih selama pandemic covid 19. Penelitian kami berupaya menginvestigasi apakah keterlibatan keluarga dalam bentuk kepemilikan berkontribusi terhadap struktur pendanaan perusahaan keluarga dan meningkatkan efisieni dalam pendanaan. Kemudian kami juga memperluas pengujian untuk melihat bagaimana aktivitas manajemen laba mempengaruhi keterlibatan keluarga tersebut. Kami mengumpulkan perusahaan keluarga yang terdaftar di Bursa Efek Indonesia selama periode 2005-2020. Kemudian kami menganalisis data dengan menggunakan regresi data panel. Hasil penelitian memberikan bukti empiris yang cukup kuat bahwa keterlibatan keluarga dan kepemilikan keluarga dalam manajemen mapu menurunkan dan memberikan efisiensi dalam pendanaan dari skema utang selama pandemic covid 19. Hasil penelitian kami juga memberikan bukti empiris bahwa manajemen laba yang dilakukan melalui arus kas abnormal tidak mempengaruhi keterlibatan dan kepemilikan keluarga dalam berkontribusi menurunkan biaya utang. Penelitian ini diharapkan memberikan implikasi yang cukup luas bagi perusahaan keluarga terutam adlaam menentukan keputusan pendanaan dari skema utang
Kebijakan Dividen Memoderasi Determinan yang Mempengaruhi Return Saham di Negara Asean-5
This research aims to determine the influence of the level of profitability, investment decisions, funding decisions and dividend policy on stock returns and also to determine the ability of dividend policy to moderate the level of profitability, investment decisions and funding policies on stock returns in manufacturing sector companies listed on S&P Capital IQ in ASEAN-5 countries (Malaysia, Indonesia, Philippines, Thailand and Singapore). This research is a quantitative research, using a purposive sampling method, 126 samples were obtained during the 8 year research period (from 2014 to 2021), so there were 1,008 observations. The research results show that dividend policy and profitability have a positive effect on stock returns, but investment and funding decisions have a negative effect. Dividend policy strengthens the positive influence of profitability levels on stock returns, but dividend policy does not strengthen the positive influence of investment decisions and funding decisions on stock returns. The practical implication of this research is that companies must strive to increase the level of profitability and carefully consider the company\u27s dividend policy because these two things will support the company\u27s stock returns. The theoretical implication is that this research supports the signaling theory that the level of profitability and dividend policy is information that provides signals on stock returns.Penelitian ini bertujuan untuk mengetahui pengaruh tingkat profitabilitas, keputusan investasi, keputusan pendanaan dan kebijakan dividen terhadap return saham dan juga untuk mengetahui mampukah kebijakan dividen memoderasi tingkat profitabilitas, keputusan investasi dan kebijakan pendanaan terhadap return saham pada perusahaan sektor manufaktur yang terdaftar di S&P Capital IQ di negara ASEAN-5 (Malaysia, Indonesia, Filipina, Thailand, dan Singapura). Penelitian ini merupakan penelitian kuantitatif, dengan menggunakan metode purposive sampling, diperoleh 126 sampel selama 8 tahun periode penelitian (mulai tahun 2014 sampai tahun 2021), sehingga ada 1.008 observasi. Hasil penelitian menunjukkan kebijakan dividen dan profitabilitas berpengaruh positif terhadap return saham, namun keputusan investasi dan keputusan pendanaan berpengaruh negatif. Kebijakan dividen memperkuat pengaruh positif tingkat profitabilitas terhadap return saham, akan tetapi kebijakan dividen tidak memperkuat pengaruh positif keputusan investasi dan keputusan pendanaan terhadap return saham. Implikasi praktis penelitian ini adalah perusahaan harus berupaya meningkatkan tingkat profitabilitas dan mempertimbangkan dengan hati-hati kebijakan dividen perusahaan karena kedua hal ini akan mendukung return saham perusahaan. Implikasi secara teoritis adalah penelitian ini mendukung teori signalling bahwa tingkat profitabilitas dan kebijakan dividen merupakan informasi yang memberikan signal terhadap return saham
Determinan Loyalitas Merek melalui Kepercayaan Merek di Kopi Janji Jiwa, Bekasi Timur
Abstract: This research aims to determine the influence of product quality, perceived value, and e-WOM on brand loyalty through brand trust as an intermediary variable. This population research was costumer at Kopi Janji Jiwa, East Bekasi. The research responden is customers who make two or repeat purchases. The data collection technique used a questionnaire for 175 respondents, which was then processed using SEM PLS version 3.2.9. This research found that there are variables that positively influence brand trust, including perceived value, e-WOM, and brand loyalty. Some variables can have a direct positive influence on brand loyalty, including product quality, perceived value, e-WOM, and brand trust. Those that have a direct negative influence on brand trust are product quality, and variables that can influence indirectly by mediating brand trust on brand loyalty include perceived value. Keywords: Brand Trust; Brand Loyalty; e-WOM; Perceived Value; Product Quality Abstrak: Tujuan dari penelitian ini adalah untuk mengetahui pengaruh kualitas produk, perceived value, dan e-WOM terhadap loyalitas merek melalui kepercayaan merek sebagai variabel perantara. Populasi penelitian ini adalah pelanggan Kopi Janji Jiwa, Bekasi timur. Responden penelitian ini pelanggan yang melakukan pembelian dua kali atau berulang. Teknik penarikan data menggunakan kuisioner terhadap 175 responden yang kemudian diolah menggunakan SEM PLS versi 3.2.9. Penelitian ini menemukan bahwa terdapat variabel yang mempengaruhi secara positif terhadap kepercayaan merek yang meliputi perceived value, e-WOM dan loyalitas merek. terdapat variabel yang dapat mempengaruhi secara langsung dengan nilai positif terhadap loyalitas merek meliputi kualitas produk, perceived value, e-WOM dan kepercayaan merek. Adapun yang berpengaruh negatif secara langsung terhadap kepercayaan merek adalah kualitas produk dan juga variabel yang dapat mempengaruhi secara tidak langsung dengan pemediasi kepercayaan merek terhadap loyalitas merek meliputi perceived value. Populasi penelitian ini pelanggan yang melakukan pembelian dua kali atau berulang pada bulan Oktober 2022 sampai Desember2022. Pengambilan sampel menggunakan purposive sampling dengan menggunakan kuesioner yang diisi oleh 175 responden dan data diolah menggunakan software Smart-PLS versi 3.2.9. Hasil penelitian menunjukan Kualitas Produk tidak berpengaruh signifikan terhadap Kepercayaan Merek; Kualitas Produk berpengaruh signifikan terhadap Loyalitas Merek; Perceived Value berpengaruh signifikan terhadap Kepercayaan Merek; Perceived Value berpengaruh signifikan terhadap Loyalitas Merek; e-WOM berpengaruh signifikan terhadap Kepercayaan Merek; e-WOM berpengaruh signifikan terhadap Loyalitas Merek; Kepercayaan Merek berpengaruh signifikan terhadap Loyalitas Merek; Kualitas Produk tidak berpengaruh signifikan secara tidak langsung terhadap Kepercayaan Merek melalui Loyalitas Merek dan Perceived value tidak berpengaruh signifikan secara tidak langsung terhadap Kepercayaan Merek melalui Loyalitas Merek dan Secara tidak langsung e-WOM berpengaruh signifikan terhadap Kepercayaan Merek melalui Loyalitas Merek.Â
PREVENTIVE EFFORTS OF THE NATIONAL CENTER FOR DRUG AND FOOD CONTROL (BBPOM) TO TACKLE THE CIRCULATION OF ILLEGAL BEAUTY COSMETICS PRODUCTS
This research is motivated by a growing phenomenon in society, where many people use and/or consume cosmetic products without knowing whether the product has a distribution permit or not, therefore the beauty service or product advertises itself as a quality product, is cheap, and can be easily reached or accessed. In this context, the Center for Food and Drug Control (BBPOM) has a very crucial role in realising a safe, healthy and clean Indonesia and free from all kinds of circulation of illegal beauty services or products. BBPOM in carrying out its duties, functions and authorities has been normatively regulated based on Law Number 88 of 1999 concerning Consumer Protection, along with the Implementing Regulations of the Law in the form of Presidential Regulation Number 80 of 2017 concerning the Center for Food and Drug Supervision. This research aims to find out how the role of BBPOM in order to prevent and overcome the circulation of illegal cosmetic products based on Law Number 88 of 1999 concerning Consumer Protection and Presidential Regulation Number 80 of 2017 concerning the Center for Food and Drug Supervision. The approach used in this research is to use the normative juridical method by examining and analysing between sources of material or literature data related to the role of BBPOM in preventing and overcoming illegal cosmetic products. Thus, the results of the study show that BBPOM has been equipped with the authority based on the Law to screen services or products both before circulation through fulfilling the prerequisites for product permits and after circulation through direct supervision and inspection along with follow-up in the form of administrative sanctions in the form of fines and revocation of distribution permits if products containing hazardous materials or not having an official distribution permit from BBPOM are found
JURIDICAL REVIEW OF GLOBAL TRENDS RESTRUCTURING THE BILATERAL INVESTMENT TREATY MODEL IN THE POINT OF VIEW OF THE INDONESIAN LEGAL SYSTEM
The economic growth of a country is inseparable from the economic system adopted by the country, not only that tactical and targeted steps are also important in increasing economic growth in a country, therefore in international associations, collaboration between countries is needed, with various forms, along with the times, treaty models and collaboration models, one of which is bilateral investment agreements. The purpose of this study is to find out what is the qualification of the Bilateral Investment Treaty itself, and how is the application of the Bilateral Investment Treaty between countries carried out by Indonesia. The research method used in this study is a normative juridical method, which prioritizes secondary data, such as legal rules, books and legal journals, both online and offline. The restructuring of this bilateral investment treaty is the key to the success of collaborative relations between States, this creates a stigma that large countries can no longer depend on clauses that are not in accordance with the times, or are no longer relevant to the current situation. This is a good momentum because relations between countries are no longer biased when making a treaty, but as the name implies, international agreements between two countries at this time can be truly bilateral, fair and agreed to find solutions that benefit both parties
THE DYNAMICS OF STATE ADMINISTRATIVE LAW IN INDONESIA: A CRITICAL STUDY AS A RESULT OF ANWAR USMAN\u27S LAWSUIT IN THE STATE ADMINISTRATIVE COURT
The legal action initiated by Anwar Usman before the State Administrative Court (PTUN) has become a very captivating case among Indonesian practitioners of Administrative Law. This matter is significant not only because it pertains to a Chief Justice of the Constitutional Court, but also because it gives rise to very serious inquiries concerning the concept of judicial independence. This study employs a normative legal research methodology, specifically a descriptive-analytical qualitative technique. The data study included content analysis methods to ascertain the primary topics in legal documents, and discourse analysis to investigate the narratives that have emerged in legal literature about judicial independence and administrative law. The study results suggest that the Jakarta Administrative Court Decision Number 604/G/2023/PTUN.JKT strengthens the concepts of legality and procedural fairness, therefore reinforcing the Administrative Court\u27s fundamental responsibility in upholding the integrity of Administrative Law. The results of this study have important practical consequences that emphasize the need of implementing procedural changes and increasing accountability in administrative activities. They also underscore the need of bolstering the function of the Administrative Court by providing more resources and authority. The present study enhances the advancement of state administrative law theory by providing a more flexible and comprehensive perspective on social and political transformations
LEGAL STUDY OF ELECTRONIC MEDICAL RECORDS FOR THE PROTECTION OF PATIENT RIGHTS
Electronic Medical Records have an important role in supporting the implementation of the National Health System. It is stated in the Regulation of the Minister of Health (PMK) Number 24 of 2022 concerning Medical Records that all Hospitals are required to implement an electronic patient medical history recording system as a form of implementing the transformation of health technology which is part of the 6th pillar of Health Transformation with the hope of being able to provide significant progress in patient accessibility in accessing information and the right to protection of personal data related to their health status. Patient rights are stated in Law Number 17 of 2023 Article 276, while policies in the process of accessing information and protecting personal data are regulated in Law of the Republic of Indonesia Number 14 of 2008 concerning Openness of Public Information and Law of the Republic of Indonesia Number 27 of 2022 concerning Protection of Personal Data. The purpose of this study is to analyze the legal aspects of electronic medical records for the protection of patient rights. This study uses a qualitative method with a normative legal approach. In its findings, Electronic Medical Records still need a lot of development both in terms of systems and users so that Hospitals need to strive to improve the capabilities of Human Resources by conducting training and organizing post-implementation evaluations of Electronic Medical Records. In addition, guarantees of data security in Electronic Medical Records must be regulated in special legislation to maintain aspects of data security that are the rights of patients considering that this digitalization era is very vulnerable to cybercrime
LEGAL ASPECTS OF DOCTORS\u27 RESPONSIBILITIES IN FILLING IN MEDICAL RECORDS ON LEGAL CERTAINTY PERSPECTIVE
Medical records have an important role in the world of health, besides that they can also be used as evidence in evidence in court. Medical records must be managed properly and filling in medical records must be in accordance with existing procedures, but sometimes the filling is not appropriate or the person writing is not at capacity. The medical records in it contain a legal relationship between hospitals and health workers. The problem is how the responsibility of doctors for writing the wrong diagnosis in filling out medical records and responsibility for delegating their duties to other health workers. The method used in this study, normative juridical, looks at the existing rules, on the work of doctors as the person responsible for filling in medical records. The data used is secondary data, Law No. 17 of 2023 concerning Health, Permenkes No. 24 of 2022 concerning Medical Records and other laws and regulations related to medical records. This study results that medical records must be made by the person in charge. medical records, doctors or other health workers. Filling in the wrong diagnosis and delegating the filling to other health workers, the doctor must be responsible for his actions on the patient if there is a lawsuit. the filling is handed over to another person, becoming a risk liability (risico aanspraklijkheid) based on Article 1367 paragraph (3) B.W. by the doctor. Since there is no lawsuit, this liability becomes an administrative liability
Car Parking Needs Analysis at Campus a Jakarta State University In The Construction Period
Parking is the main supporting facility in the campus environment. Jakarta State University (UNJ) is one of the state universities in the DKI Jakarta province. The increase in the number of UNJ students every year certainly causes an increase in the need for parking, especially on Campus A UNJ as the main campus. Coupled with a construction project in Campus A UNJ, the parking area, especially car parking, is getting narrower. Based on these problems, it is necessary to research parking arrangements at Campus A UNJ.
This study aims to determine the need for parking and arrange the car parking area for Campus A UNJ according to the demand for car parking space that existed during the construction period. The parking space arrangement for Campus A UNJ considers UNJ\u27s policy as the manager in allocating parking spaces in the future. Primary data was obtained by conducting a field survey using the number plate survey method and PSU calculation survey while secondary data was obtained from UNJ parking inventory data. Primary data were obtained by conducting field surveys on 29 May-31 May and 8-9 June.
The results showed that the value of the need for car parking in 2023 was 367 PSU cars, while the number of parking lots available at Campus A UNJ was 389 PSU. The peak day occurs on Tuesday 30 May 2023 and the peak hour for parking accumulation occurs at 13.00-14.00 WIB. With a parking index close to 100%, this can make it difficult for drivers to find an empty parking space, especially considering the pattern of car parking in the UNJ campus A parking area rotates in one direction so that the opportunity to find an empty parking space during peak parking hours only has a one-time or one-time chance. parking spaces at peak parking hours only have a one-time chance or the driver must first exit the parking lot and then enter again to find an empty parking space. The arrangement of car parking modeling will also be presented in this article. It is hoped that the results of this early-stage research can provide an overview and recommendations on parking management methods at Campus A UNJ
Analisis Pendapatan Petani Kopi Arabika Di Garut Jawa Barat
Coffee is one of the mainstay plantation commodities for Indonesian agriculture. Coffee plantations have quite high export opportunities and potential to be developed in Indonesia, therefore the demand for coffee in both the domestic and international markets is quite high. The high market demand for coffee commodities cannot be separated from the various problems faced by coffee farmers, including the low quality of coffee produced by farmers who are members of farmer groups, which can affect the income of farmers in the Karya Mandiri Farmer Group. For this reason, this research aims to analyze income. coffee farming. Based on the results of research conducted, the average income of coffee farmers in the Karya Mandiri Farmers Group is IDR 21,826,900 per year or IDR 1,818,908 per month, besides that the coffee farming run by the Karya Mandiri Farmers Group is profitable, where the R/C ratio which is more than one.Keywords : Farmer, Coffee, Revenue, Garut, West JavaKopi merupakan salah satu komoditas perkebunan andalan bagi pertanian Indonesia. Perkebunan kopi memiliki peluang ekspor yang cukup tinggi dan potensial untuk dikembangkan di Indonesia, oleh karena itu permintaan kopi baik pasar domestik maupun pasar internasional cukup tinggi. Tingginya permintaan pasar untuk komoditas kopi tidak terlepas dari berbagai masalah yang dihadapi oleh petani kopi, diantaranya adalah rendahnya kualitas kopi yang dihasilkan oleh petani anggota kelompok tani, sehingga dapat memengaruhi pendapatan petani di Kelompok Tani Karya Mandiri, untuk itu, penelitian ini bertujuan untuk analisis pendapatan usahatani kopi. Berdasarkan hasil penelitian yang dilakukan rata – rata pendapatan petani kopi di Kelompok Tani Karya Mandiri adalah sebesar Rp 21.826.900 per tahun atau Rp 1.818.908 per bulan, disamping itu usahatani kopi yang dijalankan oleh Kelompok Tani Karya Mandiri menguntungkan, dimana R/C rasio yang lebih dari satu.Kata Kunci : Petani, Kopi, Pendapatan, Garut, Jawa Bara
