OUTLINES OF THE RECENT BRAZILIAN LEGAL CHANGES IN THE FIELD OF LABOR AND INDUSTRIAL RELATIONS
No full textIn this article one drafts some tendential outlines of the recent Brazilian legal changes in the field of labor and industrial relations law. Due to a remarkably state-driven provisions of legal protection, that goes established since the early nineteen thirties populist Vargas dictatorship, the Brazilian labor law have suffered-and to a certain extent deserved-increasing criticism about its rigidity, the central role played by labor courts and litigation to assure its enforcement, at the same time revealing visible incapacity to address effective protection towards new and non-standard forms of labor arrangements. Holding the purpose of improving flexibility to the labor rights, inspired by free-market regulatory beliefs, and according to explicit demands and policies advocated by the economic elites, the recent legal changes come in a moment when the economy shows its worst and most persistent crisis since 1929, combined with high rates of unemployment and increasing precariousness in the labor market. This article asserts that, in order to draft reliable scenarios about the extent and the depth of these recent legal changes, considering the current instability of the economic and political environment, one shall consider, furthermore, the prevailing role played by the upper courts; particularly by the Brazilian Supreme Court, on its duty to eventually and definitely state the possible inconsistencies of the legal changes, in respect to constitutionalstandards.Article信州大学経法論集 5(ブラジル・日本国際セミナー特集号) : 23-35(2019)departmental bulletin pape
WHY DO WE HAVE SO MANY SOCIAL SECURITY CLAIMS IN BRAZIL?
No full textIn his Reading the Landscape of Disputes: What We Know (And Think We Know) about Our Allegedly Litigious Society, Marc Galanter suggests a different reading of the landscape of disputes in the United States, exchanging the "litigation explosion" reading for a more "contextual" approach. Based on some of Galanter's strategies, our paper tries, in its first section, to question the common core, rejecting three of the most commons arguments used to explain the so called "litigation explosion" in Brazil: that Brazilians are too litigious, that our Judiciary is too small and that access to courts is too easy. In the second section, using social security claims as an example, we try to provide a different reading of the causes for so many lawsuits in that area. We argue, although in an exploratory way, that the dispute resolution system for social security claims pretends to use two filters ‒ administrative agency and court-connected mediation ‒ that do not imply fewer lawsuits and, in fact, could act as propellers for more cases to be brought to the Judiciary.Article信州大学経法論集 5(ブラジル・日本国際セミナー特集号) : 91-115(2019)departmental bulletin pape
THE AMERICAN SYSTEM FOR REGULATING THE WORKPLACE
No full textThis article provides an overview of the legal system for regulating workers and the workplace in the United States. Broadly speaking, workplace protections are available on a somewhat unequal basis, depending on whether the worker is classified as an employee or an independent contractor. Independent contractors are not protected under various employment laws. For workers that qualify as employees, state and federal laws provide protection relating to discrimination, retaliation, and workplace safety. State and federal law also provide for minimum wage and overtime.Employees generally do not have additional legal protections relating to wages and hours unless their workplace is unionized. However, union membership in the United States has declined over the last several decades, and now stands at roughly 10.7% of the workforce.
