An Analysis of the United Nations Human Rights Due Diligence Policy in Light of UN's Human Rights Obligations
Get PDF本稿は、近年国連において策定された「人権配慮政策」、つまり、国連による非国連保安部隊への支援において国家の人権侵害に加担しないよう相当な注意を払うための政策を取り上げ、その中で定式化された国連の人権義務の実体を探るものである。まず、「人権配慮政策」の背景を簡単に振り返った後で、関連する「人権配慮政策」文書の内容を紹介・検討し、国連による非国連保安部隊への支援に関する基本原則とされる「国連の人権義務」とは何か、及び、「非国連保安部隊」「支援」「リスク評価」といった鍵概念の定義について議論する。次に、より踏み込んだ分析に入り、国際法の一次規則（一次義務）と二次規則（国際責任）の両側面から、「人権配慮政策」における国連自身の人権「尊重」義務の内容を検討する。その結果、同義務は、国家による深刻な人権法違反を防止するため積極的に「リスク評価」を行う義務とされ、支援を提供「しない」消極的義務というよりも当該リスク評価を「行う」（しかも積極的にリスクを見つけ出す）という積極的義務を本旨とする点、及び、防止の対象が私人にも拘わらず一意味が異なることを指摘する。他方、国連が国家とどの程度同一の人権義務を負うのかについて「人権配慮政策」示唆せず、依然として、国連が国家と同じように人権義務を負う根拠は不明確なまま残されている。departmental bulletin pape
The MMU Freshmen English Reading Curriculum 2008-2013: Development, Implementation, and Assessment
Get PDFIn 2008, curriculum developers and English instructors at Miyazaki Municipal University (MMU) designed and implemented a new reading curriculum for all freshmen students. Building on the previous curriculum, this new approach attempted to provide a standardized framework of reading instruction that included both an intensive and extensive approach to improving English reading skills. Intensive Reading (IR) focuses on teaching students techniques and strategies to deal with text well beyond their current level. Extensive Reading (ER), on the other hand, requires learners to read vast amounts of material that has been simplified to the learner's appropriate reading level; thereby, improving motivation to read in a foreign language. By combining both an intensive and extensive approch, the MMU curriculum hoped to synthesize the best of both approaches. Get PDFこの小論は、マヤ・ユカテカ社会を時間の視座から分析することを目的とする。人間の思考と行動に根底から影響をおよぼす時間の分析は集団と個人の両面から分析することが望ましい。これまでマヤ・カトリック社会の時間感覚を集団の断面から分析してきた。聖堂や十字架の歴史と構造、祈りの内容、擬制的親子関係、マヤ儀礼慣習、共有地、などが分析の主な対象である。本小論では、質問紙（質問大項目2項目）、有意味カード（6枚）とTAT型の有意味写真（2枚）を使用して、時間感覚分析モデルおよび作業仮説にもとづいて個人の断面で時間感覚を分析した。主な分析結果は次のとおりである。マニのカトリックは自己把握、太鼓の神話的事実の現実化、「小さな時間（この世の日常的な時間）」における「大きな時間（キリストの誕生および死ならびにこの世の始まりと終わりなどを含む時間）」の再現（representation）と再融合（reintegration）などの場面で宗教的な理念や教えによる内調整（inner adjustment）を行っている。また、「聖母マリアと幼子イエス」と「イエス・キリストの磔刑」の写真への反応は、宗教が象徴を通じてその太古性を何千年という巨大な時間のなかで持続させてきていること、聖母マリアおよびイエスに関するきわめて古い知識と宗教的な教えが、時間の経過とともにマニのカトリックの内面に深く定着し、人々の暮らしのすべての面にさまざまな意味を与え続けていることを示している。departmental bulletin pape

Get PDF「交代寄合」は旗本身分のひとつで、かつては「三千石以上の無役の旗本で参勤する寄合」と定義され、幕末期には三三家があった。米良氏は米良山を領する交代寄合であったが「無高」で、参府はするものの江戸屋敷も持たず人吉藩江戸屋敷に寄居した。本稿では交代寄合である米良氏について、その系譜を整理・検討し、人吉藩との関係から人吉藩支配米良山の成立過程、米良氏の家督相続、参府状況、領主仕置権の観点から検討を加えた。そこで確認できたのは、米良氏の家督相続や参府額・暇願など、対幕府関係のほとんどすべてが人吉藩を通して行われていたこと、さらに米良氏の領内で起きた逃散などの事件でも、米良氏が独自に刑罰を科すことはできず、幕府や諸藩との交渉を含め人吉藩が主体となって処理がなされていたことである。また米良氏は「無高」とされ、米良山に設定された鷹巣山の管理が唯一の「役」であった。五年に一度参府をしたが、参府中は人吉藩江戸屋敷を仮住居とし、幕府の諸儀礼にも参列せずに一～二ヶ月で帰山したことなどを明らかにした。departmental bulletin pape
An Economic Analysis on Public Pension systems in two Regions
Get PDF本稿は、賦課方式公的年金制度の統合の有無、資本市場の統合の有無、子育て支援政策の有無によって特徴づけられた2地域において、内生的出生率と子供から親への世代間所得移転をもつ世代重複モデルの短期的、長期的な均衡について考察するものである。ここでの地域要因は全要素生産性、資本と労働の分配率、子育てコストや子育てコストの子供数に対する弾力性をとりあげている。さらに、定常状態で子育て支援政策や地域要因が個人の子供の需要に与える効果もシミュレーション分析して、地域統合の効果を考察している。その結果、資本市場開放経済下では、2地域の年金統合の有無にかかわらず、年金政策の先行研究と同様の結果となった。2地域に拡張したことにより、特定の経済下における地域統合のパターンによって、地域統合が出生数に与える効果が異なる結果を得た。departmental bulletin pape

Get PDF東日本大震災では、福島原発事故により、東北・関東などから全国各地へ避難・移住する人々が自主避難を含め多数発生した。この点はこれまでの災害にはなかった、東日本大震災の大きな特徴である。宮崎県への避難・移住者は少なくとも300世帯以上であるといわれるが、その実態ははっきりしない。東日本大震災や原発事故のような広域的・複合的災害においては、非被災地での支援が極めて重要になる。本研究では、宮崎県における避難・移住者のネットワークである『うみがめのたまご』～3.11ネットワーク～と共同して、東日本大震災から3年が経過した2014年2月に実施したアンケート調査の結果をもとに、非被災地である宮崎への避難・移住の実態や避難・移住者への支援の実態やその成果、および今後の支援ニーズを明らかにし、避難・移住者への長期的・効果的な支援のあり方を検討し、広域的避難や移住の特徴をふまえた支援を考えていきたい。departmental bulletin pape

Get PDFReligion provides a socially or culturally shared set of cognitions which enable members of a society to interpret real experiences in many-sided aspects of life and to provide a disciplined guide to such cognitive problems as self-identity or goals in life. The aim of this paper is to describe and clarify several aspects of space perception complex at the individual level from a working hypothetical concept of a small Catholic Community, Mani. The analysis of space perception should be done not only at the individual level but also at the collective level. The results of analysis at the collective level of the history and structure of Catholic church, prayers, blood or territorial relationships, public or private property and so forth have already been showed in other articles. In this paper only the main findings at the individual level are introduced as follows. In Mani, space perception centers around those places which are closely associated with God or sacred beings. In this case, ancient languages and symbols are recognized to be situated at the central zone of the community and the other cultural or social elements are in the peripheral zone. They describe various facts or actual situations of each place and location, the majority of which are adjusted to their ideas deeply related with God or sacred beings. What is more, their space perception is not closed or exclusive, but it is open and continuously expanding with more emphasis on common property than private property as well as on the right to use than the right to own.departmental bulletin pape
