For a few dollars more: Overcharging and misconduct in the legal profession of the Zuid-Afrikaansche Republiek
Legal professionals of the Zuid-Afrikaansche Republiek (ZAR) have been accused of being unscrupulous and underqualified, and of overcharging their clients. This article investigates some of these accusations, focussing on the regulation of the requirements for qualification as a legal professional and admission to the profession, the regulation of legal costs as well as related matters such as dual practice and the impact of the Board of Examiners on the quality of legal training. In addition, a few cases of misconduct in the legal profession of the ZAR are briefly discussed
The money or the box: Perspectives on reckless credit in terms of the National Credit Act 34 of 2005
The National Credit Act 34 of 2005 introduced the concept of reckless credit for the first time in South African consumer protection legislation. The Act aims to prevent reckless credit lending by making pre-agreement assessments mandatory in terms of section 81 and providing for various debt relief remedies where credit has been extended recklessly. The courts have been granted various powers depending on the type of reckless credit which has been granted. Considerable uncertainty exists as to the bases upon which the court’s power to order a partial or total setting aside of the rights and duties of the consumer to whom reckless credit has been granted, as set out in section 80(1)(a) and 80(1)(b)(ii), should be exercised. Furthermore, regarding the aforementioned types of reckless credit lending, it is not clear on what basis a court should decide between a partial setting aside of the consumer’s rights and obligations and a suspension of the force and effect of the agreement. This discussion undertakes a practical investigation into the nature of reckless credit and the manner in which a pre-agreement assessment should be done. The remedies for reckless credit lending are analysed in an effort to determine the practical impact of the court’s powers in respect of the different cases of reckless credit for which the NCA provides. The procedural implications of reckless credit are also investigated
Colonialism, justice and the rule of law: a Southern African and Australian narrative
Kolonialisme het ’n groot impak op die regstelsels van lande regoor die wêreld gehad. Die historiese impak van die Britse Ryk kan vandag nog steeds gevoel word in lande so uiteenlopend soos Australië en Suid-Afrika. Hierdie impak word in beide hierdie lande ondersoek, in sowel sy historiese vorm van rassediskriminasie, as die moderne gevolge van die koloniale verlede. Hierdie artikel ontleed hoe formele opvattings van die oppergesag van die reg en regsekerheid, pogings om geregtigheid vir gedane historiese onreg te bewrkstellig, kan ondermyn. Voorbeelde hiervan kan gevind word in die Aboriginal grondregte litigasie in Australië, sowel as litigasie in die Verenigde State van Amerika onder die Alien Tort Act.*

Judicial oversight for sales in execution of residential property and the National Credit Act
Praktiese uitvoering word gegee aan ’n hofbevel wanneer ’n huis in eksekusie verkoop word. Verkope in eksekusie stel ’n party in staat om ’n hofbevel teen ’n skuldenaar af te dwing. So ’n afdwinging is belangrik vir regswerking. Die Nasionale Kredietwet 34 van 2005** is uitgevaardig om (meestal) prosedurele beskerming te bied aan skuldenaars, terwyl sake soos Jaftha v Schoeman en Gundwana v Steko Development verg dat howe geregtelike toesig het by bevele wat lei tot verkope van huise in eksekusie. Die pad tot hier was lank en soms deurmekaar. Howe het geworstel met die vraag of ’n bevel om ’n huis te verkoop in eksekusie sonder ’n hofbevel inbreuk maak op die grondwetlike reg tot toegang tot genoegsame behuising. Verskillende howe het tot verskillende gevolgtrekkings gekom. Alhoewel die probleem meestal opgelos is deur die Jaftha en Gundwana beslissings, is die sake waarin die howe met die vraagstuk geworstel het steeds belangrik om in die toekoms die howe te help om ’n balans te vind tussen die regte van die skuldeiser om haar hofbevel af te dwing, en die skuldenaar se grondwetlike regte.
In die artikel word die impak van die Nasionale Kredietwet op die skuldeiser se vermoë om ’n hofbevel te bekom teen ’n skuldenaar, sowel as die mees belangrike sake tot Gundwana wat handel oor die skuldeiser se vermoë om so ’n bevel af te dwing, bespreek. Die fokus is op hoe die hof die mededingende regte moet opweeg.

In hierdie artikel ondersoek en vergelyk ons aspekte van die beperking sowel as die beskerming van taal- en kultuurregte in skoolverband (onafhanklike skole in die Verenigde State en openbare skole in Suid-Afrika). Ons doen dit deur grondwetlike en ander bepalings te bespreek en geselekteerde regspraak in die twee lande onder die vergrootglas te plaas. Ons ondersoek ook die samehang of gebrek aan samehang tussen die konsepte taal en kultuur in wetgewing en in regspraak. Ten slotte dui ons enkele besluitnemings- en bestuursimplikasies vir rolspelers in die onderwys aan en oorweeg ons ook die rol wat wetgewing en regspraak sou kon speel in die voortbestaan of ondergang van minderheidstale en -kulture
