Get PDFVarious legal and social scholars have observed an increasing juridification and pluralization of society, that our current justice system has not yet adapted to. There are a number of new approaches that try to address the increasingly diverse and dynamic context in which the justice system must function. In this thesis two of these alternative legal approaches are brought together. By bringing literature from both fields together, I aim to explore to what extent preventive law and restorative justice might complement each other in addressing the new challenges the justice system must adapt to, if it is to be a humanizing system that generates durable solutions that are conducive to the well-being of a pluralist society. The hypothesis is that together they might inform a justice system with values and practices that accommodate the complexity of current social reality and actively involve citizens in solving their conflicts in a more humane way.
The literature study shows that both preventive law and restorative justice offer approaches to justice that are mindful of the relational and contextual nature of conflicts, allowing the stakeholders involved to actively participate in formulating durable solutions. Preventive law covers the necessary competences of legal professionals and is focussed on civil law, while restorative justice provides a framework for deliberative practices and an alternative to the current criminal justice system. The two approaches therefore have considerable potential to be complementary to one another and their possible combination should be of interest to anyone wishing to reform the current justice system

Gemeenten zouden beter weten aan wat voor langdurige zorg of jeugdzorg mensen behoefte hebben, of hoe ze willen participeren. Burgers zouden ook meer gaan zorgen voor mensen in hun nabijheid. Maatwerk, zelfredzaamheid, vertrouwdheid, dat waren een paar van de grote beloften van de nieuwe nabijheid. In dit boek laten we zien hoe dit uitpakt. We analyseerden beleid, observeerden 127 keukentafelgesprekken en interviewden tientallen professionals en cliënten in zes gemeenten

Het adagium van de participatiesamenleving, waarin ieder zoveel mogelijk op eigen kracht en met hulp van familie, vrienden en buren meedraait in - en bijdraagt aan de samenleving, heeft zijn invloed op de dagelijkse werkelijkheid van mensen met een beperking, de sociale professionals en het gemeentelijk bestuur. Hoe vertaalt zich dit naar de praktijk en wat is ervoor nodig om daadwerkelijk te bevorderen dat mensen meedoen in de samenleving? Sweet delight and endless night: a qualitative exploration of ordinary and extraordinary religious and spiritual experiences in bipolar disorder.
No full textThe authenticity of religious and spiritual experiences during mania is an important subject for bipolar patients. The exploration of such experience in bipolar disorder is the central point of this qualitative study. A psychiatrist and a hospital chaplain conducted 35 semi-structured interviews with recovered participants, recruited from mental health care institutions in the Netherlands, the patients’ association and via the internet, about their religious and spiritual experiences during illness episodes and in stable times. A variety in types (such as divine presence, unity, mission, meaningful synchronicity) during mania was reported, which were on a sliding scale with experiences/views in stable times in more than half of the interviews. During depression, absence of religious or spiritual experience was predominant. The reported experiences were viewed by most participants as both authentically religious or spiritual but also related to the disorder, requiring therefore language that transcended medical terminology. Also indicated is the relevance of the results for fundamental discussions about the nature or religious experience
