Ungdomsoppfølging og ungdomsstraff: En straffereaksjon som krever samarbeid

Innholdet av reaksjonen fastsettes i et ungdomsstormøte der konfliktrådet og en rekke andre aktører sammen med lovbryteren fastsetter en ungdomsplan med vilkår som kan bidra til å rehabilitere lovbryteren. Derfor er det viktig at alle som deltar i prosessen, samarbeider om å finne gode tiltak som kan bidra til å oppnå formålet med reaksjonen
Ekstremisters bruk av audiovisuelle filmelementer for å underbygge sitt fiendebilde på sosiale medier
Masteroppgave i politivitenskapI studien ble det benyttet en kvalitativ innholdsanalyse for å forsøke å finne svar på følgende problemstilling: «Hvordan bruker ekstremister audiovisuelle filmelementer for å underbygge sitt fiendebilde på sosiale medier?». Analyseobjektene er Facebook-gruppen til henholdsvis Profetens Ummah og SIAN. Analyseenhetene er filmene som deles i disse to gruppene. Det ble utarbeidet 3 delspørsmål for å svare på problemstillingen: (1)Hvilke filmelementer brukes for å identifisere fienden i de filmene analyseobjektene deler? (2)Hvilke egenskaper har inne-gruppen i de filmene analyseobjektene deler? (3)Hvilke egenskaper har ute-gruppen i de filmene analyseobjektene deler?
Gjennom analysen fant forfatteren at ekstremistene bruker audiovisuelle filmelementer til å identifisere og umenneskeliggjøre fiendene sine. For å få til dette bruker de filmelementer som settes sammen til en film. Til tider repeteres samme klipp flere ganger for å understreke budskapet. Hensikten er at seeren skal få bekreftet det narrativet som ekstremistene forfekter. Filmelementene hentes fra forskjellige kilder, alt fra profesjonelle nyhetskanaler til ute-gruppens propagandafilmer. Det er også noe gjenbruk av elementer fra tidligere filmproduksjoner
Globalization: A document study on the effects of globalization on police priorities and management in Norway
Masteroppgave i politivitenskapAs a society, we are bombarded every day by news from all over the world, which inform us about terror threats, illegal immigrants, refugees and asylum seeker and various types of cybercrime. The police are often criticized for not being prepared enough and able to respond adequately to these threats. As a public institution, the Police produces annual reports and these are often scrutinized and criticized. However, result do not just happen, they are a consequence of planning and prioritizing. Thus, one cannot expect the Police to deliver on an area of crime if they are not asked to prioritize it first. This spiked my interest in looking at the “orders” the police get and see if they change accordingly.
This study examines the way globalization affects police management and priorities. This is achieved by a document study of central governing documents for the Police for the period 2000 – 2010. The analysis looks at three sets of documents: the circulars that the Director of Public Prosecutions (DPP) that instructs the Police and the Regional Public Prosecution Authorities (PPO) on how to handle criminal cases and which targets and priorities to select; the general instructions to the police districts by the Police Directorate on what to prioritize; and the district specific instructions for Oslo police district.
The analysis shows that there is a change in this period that can be attributed to globalization. These changes can be divided into two groups: changes in how the police is organised and managed and changes in what types of crime the Police prioritize. There are three major changes in the organization of the Police: 1) The police district are reduced from 54 to 27; 2) The Police Directorate was established in 2002 as a result of the spreading of New Public management (NPM) and the need to a body to coordinate international police cooperation; 3) The Norwegian Immigration Police Services (NIPS) were established as a result of the changed nature of police work and the increased need for dedicated authority to deal with asylum seeker registrations and deportations.
The second group that I have identified is changes in what the Police are asked to prioritize. Crime types that can be related to the increased migration and technological development become an inseparable part of the priorities. Among those we find racially motivated crimes, international crimes, human trafficking, illegal work and others. Though I view these changes as attributed to globalization, there is no one to one cause-result relation to these and understanding them is much more complex than the scope of this project
Establishing and maintaining rapport in investigative interviews of traumatized victims: A qualitative study
This is the final text version of the article, it may contain minor differences from the publisher’s pdf version.The aim of the study was to explore the factors considered important and useful in facilitating safety and building rapport in police investigative interviews with traumatized interviewees. We conducted 21 semi-structured interviews of police investigators involved in investigative interviewing of victims after the Utøya massacre on 22 July 2011 in Norway. Using a thematic analysis based on a reflexive hermeneutic-phenomenological epistemology, four themes emerged: (i) preparation through planning, reflection, and openness: balancing knowing and being receptive; (ii) using first impressions, casual conversation, and communicating expectations to make the interviewee comfortable; (iii) getting closer to the experience of the interviewee through engagement, adaptation, and understanding; and (iv) handling negative feelings and being receptive in the interview relationship. We discuss the findings in relation to current theory and research on investigative interviewing and highlight the importance of working on an emotional level to facilitate rapport when interviewing traumatized interviewees
Unødig ventetid ved ungdomsoppfølging og ungdomsstraff: Påtalemyndighetens ansvar for saksflyten

Dette gjelder særlig når lovbryteren er ung. I slike saker er det ekstra uheldig om saken trekker ut i tid, siden tilværelsen endrer seg raskt for unge mennesker. Straffens individualpreventive virkning svekkes, og straffereaksjonen kan forstyrre rehabiliteringen hvis den kommer lang tid etter lovbruddet. I saker der lovbryteren var under 18 år på gjerningstiden, skal derfor en straffesak som hovedregel påtaleavgjøres innen seks uker fra ungdommen ble mistenkt (straffeprosessloven § 249 annet ledd)
"Som før, men tryggere": Politiets vurdering av 14 måneders midlertidig bevæpning
Engelsk noe forkortet utgave av rapporten, se PHS Forskning 2022: 6.I rapporten presenteres resultatet av en evaluering av den midlertidige generelle bevæpningen av norsk politi i perioden 25. november 2014 til 3. februar 2016. Hensikten med evalueringen var å få oversikt over tjenestepersoners erfaringer i perioden - først og fremst på hvordan politiet selv oppfatter at bevæpningen kan ha påvirket deres arbeidsutførelse og oppdragsløsning.
I kapittel 1 ”Innledning” gis en beskrivelse av mandatet for evalueringen, og hvordan Politihøgskolen (PHS) sin forskningsavdeling ble tildelt evalueringsoppdraget. I kapittel 2 gjøres det rede for den metode som er benyttet for å besvare mandatet. Kapittelet inneholder også en omfattende diskusjon av styrker og svakheter ved den metode som er valgt. I kapittel 3 presenteres resultatene av intervjuene, med en kort omtale av hovedinntrykkene og med gjengivelse av illustrerende utsagn fra intervjuene. Kapittel 4 angir hvilke svar evalueringsmetoden ga på spørsmålene i mandatet. Den midlertidige bevæpningens betydning for møte med publikum behandles i pkt. 4.2, og det dominerende resultatet er at bevæpningen ikke hadde noen betydning for hvordan politiet nærmet seg publikum eller utførte tjenesten. Når det gjelder risikovurdering og handleplikten (pkt. 4.3), er dette det temaet i mandatet som er dårligst besvart. Spørsmålet om 'risikokommunikasjonen' ble rimelig godt besvart, og den dominerende oppfatning er at bevæpningen ikke hadde påvirket kommunikasjonen med publikum. Hovedinntrykkene fra intervjuene fra alle de tre nivåene – operasjonsledere, innsatsledere, innsatspersonell – var at den generelle bevæpningen ikke hadde noen innvirkning på hvordan tjenesteoppdragene ble planlagt og ledet (jf. pkt. 4.4). Tjenestepersonene følte seg også tilstrekkelig kompetente til å være bevæpnet, selv om mange fremholdt at man aldri kunne få trent nok på bruk av skytevåpen. Den generelle bevæpningen hadde dessuten ikke påvirket tjenestepersonenes bruk av verneutstyr. Analysen av de innrapporterte hendelsene til POD fra politidistriktene, viser at det var flere vådeskudd og forsøk på å frata tjenestepersonene våpen i bevæpningsperioden enn i perioden etter at bevæpningen var avsluttet (jf. pkt. 4.5). Avslutningsvis omtales holdningene til permanent generell bevæpning (pkt. 4.6). Det dominerende inntrykket er at bevæpningsperioden har ledet til at tjenestepersonene i politiet i vesentlig større grad enn tidligere er positive til generell bevæpning.

Cross-border organised crime: Bulgaria and Norway in the context of the migrant crisis
The irregular migrant and refugee crisis poses serious challenges for Europe. The unprecedented migration pressure presents an opportunity for the generation of substantial profits by organised criminal networks. The large influx of irregular migrants looking for facilitation has led to the development of human smuggling as a substantial criminal market in Europe. On the other hand, some countries have experienced a concurrent rise in human trafficking cases. The current publication presents an analysis of recent developments in transnational organised crime in Norway and Bulgaria in the context of the migrant crisis. The study presents the first in-depth examination of human smuggling networks and operations in Bulgaria, as well as the synergies and differences between this illicit activity and other organised criminal enterprises, particularly human trafficking. The publication also reviews trends in Norway related to both human trafficking and smuggling, two crimes which have rarely been examined together, with the latter being the focus of little overall research
Gråsoner: Skillelinjer i forsvarets sikkerhetsavdeling sin polisiære virksomhet
Masteroppgave i politivitenskapOppgaven har som formål å belyse hvor grensene går mellom det som benevnes som «forvaltningssporet» og «etterforskningssporet» for den polisiære virksomheten som Forsvarets sikkerhetsavdeling (FSA) utøver gjennom militære kontraetterretning (mil.ke) og tilsvarende aktiviteter. Forenklet kan man si at FSA er en militær hybrid av Politiets sikkerhetstjeneste (i sitt fokus på trusler), Spesialenheten (i sitt fokus innad i militær sektor på eget personell) og Tollvesenet (i at man utfører alt unntatt etterforskning, og gjør dette ut fra et forvaltningsrettslig hjemmelsgrunnlag). Oppgaven er skrevet ut fra en rettsdogmatisk/juridisk metode, og har kun tatt utgangspunkt i rettskilder og andre offentlig tilgjengelige dokumenter. Ved å ha et bredt spekter av roller og hjemmelsgrunnlag vil det være en utfordring hvordan man på best mulig måte, og med et tilstrekkelig forvaltningsrettslig hjemmelsgrunnlag, kan løse pålagte oppdrag samtidig som en skal oppfylle en rekke forpliktelser og vernebestemmelser som offentlige myndigheter har ovenfor den enkelte borger. Kjernen i de rettslige problemstillingene dreier seg om hvordan man ut fra tilgjengelige kilder gjør løpende vurdering av formålet bak FSA sin mil.ke og lignende virksomhet i forhold til formålene nevnt i Straffeprosessloven. §226,1.ledd som avgjør hvorvidt det man driver med er etterforskning eller ikke - og om man ved en forvaltningsrettslig undersøkelse går over grensen for «rimelig tvil» i forhold til hvorvidt et forhold skal anmeldes eller ikke jf. Straffeprosessloven §224. I tillegg gjør forfatteren en vurdering av betydningen av grunnlovsrevisjonen i 2014 (økt krav til respekt for personvern og personlig integritet, legalitetsprinsippet m.m.) i forhold til FSA sin utøvelse av polisiær myndighet. Exploring the continuum of lethality: Militant islamists' targeting preferences in Europe
This article provides an in-depth analysis of the targeting preferences of militant Islamists operating in Western Europe. In addition to target types, this study has a particular focus on the degree of target discrimination, casualty focus, and soft versus hard target preferences. These features of intent constitute a warning triangle with regard to the lethality potential of terrorist acts. There is also a lone actor vs. group perspective included, as well as a comparative glance between the targeting preference of militant Islamists and actors from other ideological directions in Europe. The main findings are that a soft target focus is dominant and increasing, while particularly well-protected targets are almost totally avoided. There is a substantial mass casualty focus, but only few attacks lead to such results. Indiscriminate vs. discriminate targeting comes out evenly. The jihadists are more ambitious regarding targets in early planning stages, compared to later in the process. Furthermore, there are higher ambitions in launched attacks physically carried out by more than one perpetrator. Both lone actors and groups prefer soft targets, but individuals acting alone are more likely to act discriminately and with a limited casualty focus. Attacks directed against name-specific individuals are mostly a one-perpetrator phenomenon. Jihadists are generally conservative with regard to target preferences, attack approach and weaponry. There is no evidence supporting suggestions that there are modus operandi-related differences between AQ and ISIS-linked perpetrators. Shifts in trends seem rather to be influenced by practical and contextual factors.publishedVersio
Organizational climate and investigation performance in the Norwegian police: A qualitative study
This is the final text version of the article, it may contain minor differences from the publisher’s pdf version.The present study aimed to identify organizational climate dimensions that are salient for police investigation performance and to explicate the mechanisms of the relationship between organizational climate and investigation performance. We conducted 38 semistructured interviews with participants at three job levels of police investigative work (chiefs of police, n = 11, senior investigating officers, n = 14, detectives, n = 13) in 11 Norwegian police districts. We analyzed the interview data by using a model of organizational climate based on the competing values framework (Quinn & Rohrbaugh, 1983). Two types of climate, human relations climate and rational goal climate, were perceived to enhance investigation performance. The findings indicate that a human relations climate enhances investigation performance by developing collective human capital and by supporting internal and external cooperation and coordination of resources. Moreover, the findings suggest that a rational goal climate increases investigation performance by encouraging planning, goal setting, and task focus
