La tentativa y el nacimiento de la ciencia penal europea: Bases para una reconstrucción contemporánea
La presente tesis doctoral pone de manifiesto la necesidad de revisar el concepto de tentativa con el que trabaja la dogmática jurídico-penal contemporánea. Buena parte de los problemas que se discuten en ese ámbito son, bien mirados, irresolubles, siendo en realidad producto de la tensión entre principios contrapuestos. Para apreciar en qué medida ello es así, se lleva a cabo una aproximación histórica a la discusión sobre la tentativa centrada en los orígenes de la misma. Estos se encuentran en la obra de los juristas franceses, españoles y —sobre todo— italianos que escribieron entre los siglos XII y XVII, quienes ya debatieron intensamente acerca de la punibilidad del conatus. Los paradigmas que desarrollaron para abordar los problemas que detectaron siguen vigentes en la discusión actual sobre el concepto de tentativa. Ahora bien, la forma y el contenido que tomaron esos paradigmas estuvieron influenciados por los principios y necesidades de la época en la que fueron creados, y algunos de ellos no tienen ya cabida en los sistemas jurídico-penales contemporáneos. Las tensiones resultantes solo pueden disiparse mediante una reconstrucción del concepto de tentativa a la luz de los principios que deben regir nuestro ordenamiento jurídico.This doctoral thesis emphasizes the need to review the law of attempts as is currently understood in criminal law. A great deal of the problems surrounding this concept are unsolvable. In fact, they are the result of a tension between conflicting principles. To prove this, attention will be drawn to the origins of the scholarly debate concerning the law of attempts. These origins are to be found in the works of French, Spanish and (above all) Italian jurists between the twelfth and seventeenth centuries, who discussed a great deal about the conditions under which the ‘conatus’ was punishable. The paradigms they developed to address this problem are still present in our understanding of the law of attempts. However, the shape and content of these paradigms were influenced by the principles and needs of the time in which they were created, and some of these principles and needs are no longer acceptable in contemporary legal systems. The resulting tensions can only be dissipated by reconstructing the notion of attempt in accordance with the principles that should govern our legal systems.Programa de doctorat en Dre
Phylogenetic applications of ancient protein sequences
The resilience of proteins against degradation makes them the longest surviving resource for genomic information. Knowing how much information we can obtain from an ancient sample is crucial because most sampling strategies are destructive. However, we still lack a broad understanding of the potential and limitations of phylogenetic inference based on ancient protein sequences. This thesis investigates the utility of paleoproteomics for phylogenetic applications with a focus on dental enamel proteins. Simulated ancient protein sequence data from 232 extant primates shows that fragmented proteomes of ~600 - 1000 amino acids still produce trees that are accurate at family level, often even at genus level. However, the enamel proteome does not have sufficient information to separate species of the same genus. These findings were corroborated by examining 1 Ma - 10 ka protein remains from Iberian equids for their phylogenetic utility and amelogenin-based sex determination. The specimen’s broad age range also provides insight into mechanisms of protein degradation.La resiliència de les proteïnes envers la degradació les converteix en el recurs més llongeu per a l’obtenció d’informació genòmica. Saber quina informació podem obtenir d’una mostra antiga és crucial perquè la majoria de les estratègies de mostreig són destructives. Tot i això, encara no coneixem a fons el potencial i les limitacions de la inferència filogenètica basada en seqüències de proteïnes antigues. Aquesta tesi investiga la utilitat de la paleoproteòmica per a aplicacions filogenètiques, amb un enfocament en les proteïnes de l'esmalt dental. Les dades simulades de seqüències de proteïnes antigues a partir de 232 primats actuals mostren que els fragments de proteomes de ~600 - 1000 aminoàcids encara produeixen arbres que són precisos a nivell familiar, i fins i tot a nivell de gènere. No obstant això, el proteoma de l'esmalt no té prou informació per separar espècies dins del mateix gènere. Aquestes troballes s’han corroborat examinant restes de proteïnes de 1 Ma - 10 ka d'èquids ibèrics per la seva utilitat filogenètica i la determinació del sexe basada en l'amelogenina. L'ampli rang d’antiguitat dels espècimens també ens proporciona informació sobre els mecanismes de degradació de proteïnes.Programa de Doctorat en Biomedicin
Temporal resolution by multiomic approaches of acute myeloid leukemias
Acute myeloid leukemias (AMLs) are a type of cancer where undifferentiated myeloid cells abnormally proliferate. Such phenotype can be caused by the expression of chimeric proteins like PML-RARα and MLL-AF9. Many studies analyze the final stage of the disease, without focusing on its initiation and development, which start from healthy blood cells. Hence, we generated in vitro leukemic models that enabled us to measure the temporal transcriptomic changes orchestrated by PML-RARα and to evaluate the impact of an altered epigenetic landscape on MLL-AF9 leukemogenesis. Firstly, we studied the importance of Klf4 downregulation for the PML-RARα immortalization process. Secondly, we studied the role of a Polycomb-associated protein, called Phf19, whose depletion in healthy hematopoietic cells, prior expression of MLL-AF9, enhanced the acquisition of more aggressive traits. These data were thoroughly compared with AML patient’s datasets, which confirmed the molecular and functional results generated with these models. This study reveals how specific transcriptomics and epigenomic programs are intimately linked with AML prognosis.Las Leucemias mieloides agudas (LMA) son un tipo de cáncer donde células indiferenciadas de tipo mieloide proliferan de forma anormal. Este fenotipo se puede originar por la expression de proteínas de fusión como PML-RARα y MLL-AF9. Varios estudios han analizado sus estadios finales, sin enfocarse en su desarrollo a partir de células hematopoyéticas sanas. Por eso hemos generado modelos de leucemia in vitro para medir, a nivel transcriptómico, los cambios guiados por la expresión del oncogén PML-RARα y para evaluar el impacto que un perfil epigenético alterado pueda tener en las leucemias MLL-AF9. En primer lugar, hemos demostrado la importancia de la inhibición de Klf4 en el proceso de inmortalización guiado por PML-RARα. Luego, hemos analizado la función de una proteína asociada al complejo de Polycomb, llamada Phf19, en el desarrollo de las leucemias MLL-AF9. Los resultados enseñan como la depleción de Phf19 en células hematopoyéticas sanas, antes de expresar MLL-AF9, esté asociada con la generación de células malignas más agresivas. Estos datos fueron luego comparados con las bases de datos de pacientes LMA, las cuales confirmaron, a nivel molecular y funcional, los resultados observados con estos modelos. Long-term safety of OnabotulinumtoxinA treatment in chronic migraine patients: a five-year retrospective study
Background: Real-world studies have shown the sustained therapeutic effect and favourable safety profile of OnabotulinumtoxinA (BoNTA) in the long term and up to 4 years of treatment in chronic migraine (CM). This study aims to assess the safety profile and efficacy of BoNTA in CM after 5 years of treatment in a real-life setting. Methods: We performed a retrospective chart review of patients with CM in relation to BoNTA treatment for more than 5 years in 19 Spanish headache clinics. We excluded patients who discontinued treatment due to lack of efficacy or poor tolerability. Results: 489 patients were included [mean age 49, 82.8% women]. The mean age of onset of migraine was 21.8 years; patients had CM with a mean of 6.4 years (20.8% fulfilled the aura criteria). At baseline, patients reported a mean of 24.7 monthly headache days (MHDs) and 15.7 monthly migraine days (MMDs). In relation to effectiveness, the responder rate was 59.1% and the mean reduction in MMDs was 9.4 days (15.7 to 6.3 days; p < 0.001). The MHDs were also reduced by 14.9 days (24.7 to 9.8 days; p < 0.001). Regarding the side effects, 17.5% experienced neck pain, 17.3% headache, 8.5% eyelid ptosis, 7.5% temporal muscle atrophy and 3.2% trapezius muscle atrophy. Furthermore, after longer-term exposure exceeding 5 years, there were no serious adverse events (AE) or treatment discontinuation because of safety or tolerability issues. Conclusion: Treatment with BoNTA led to sustained reductions in migraine frequency, even after long-term exposure exceeding 5 years, with no evidence of new safety concerns
Problemas de Derecho interregional suscitados a raíz de la aprobación de la Ley 8/2021 por la que se reforma la legislación civil y procesal para el apoyo a las personas con discapacidad en el ejercicio de su capacidad jurídica
El trabajo analiza el impacto producido por la Ley 8/2021 sobre el ordenamiento plurilegislativo español, atendiendo primero a las dificultades para encajar los distintos planos normativos, estatal y autonómico, en función del carácter exclusivo de la competencia ejercida en materia de legislación civil. Se constata a continuación el alcance que puede tener la legislación procesal sobre la pluralidad legislativa y se abordan las consecuencias derivadas de la supresión del sistema procesal de modificación de la capacidad sobre los Derechos civiles autonómicos. Una vez se han fijado los límites de la pluralidad normativa en un ámbito tan complejo como el del apoyo a las personas con discapacidad en el que es preciso contar con instrumentos normativos de distinto orden material y procesal, se analiza la regulación de los conflictos de leyes internos suscitados a raíz de la pluralidad normativa en materia civil. El análisis está destinado a comprobar si en el ámbito interregional son operativas unas normas que están concebidas para el tráfico internacional
La forma-ritual del cine de Chantal Akerman: hacia un espectador encarnado
Esta investigación nace de la necesidad de repensar los aportes estéticos del cine de Chantal Akerman, a los cuales me aproximo tratando de dar una posible respuesta a la pregunta, ¿en qué forma el cine de Akerman llega al cuerpo del espectador activando algo que antes de enfrentarse a lo mostrado no tenía lugar? Para ello, abordo algunos motivos visuales y narrativos, además de procedimientos estilísticos y estructurales que se reiteran en sus películas, materializándose en lo que he llamado una forma-ritual. Una forma en la que se inscriben el modo de filmar y mostrar el espacio, lo ordinario, los cuerpos, los sonidos y los silencios, así como el tiempo que atraviesa sus filmes. Una forma profundamente vinculada a las búsquedas personales de Akerman, como hija de supervivientes de Auschwitz y como mujer cineasta, capaz de encarnarse en los espectadores atentos que permanecen frente a sus películas.This research arises from the necessity of rethinking the aesthetics contributions of Chantal Akerman’s films, to which I approach trying to answer the question: In which form does Akerman’s cinema connects with the body of the spectator showing him or her something invisible before going through her films? To this end, I disengage the visual and narrative motifs, in addition to stylistics and structural aspects that are reiterated in the films of the director and materialize in what I have termed a ritual-form. A form in which are inscribed the way the space, the ordinary, bodies, sounds and silences are presented, as well as the time that passes through Akerman’s films. A form deeply linked to her personal searches, as a daughter of Auschwitz survivors and as a woman who makes movies, able to cross the screen and embody herself in the attentive viewers who remain in front of her films.Programa de doctorat en Comunicaci
CSF proteins of inflammation, proteolysis and lipid transport define preclinical AD and progression to AD dementia in cognitively unimpaired individuals
This preclinical AD CSF proteome study identified a panel of 12-CSF markers detecting amyloid positivity and clinical progression to AD with high accuracy; some of these CSF proteins related to immune function, neurotrophic processes, energy metabolism and endolysosomal functioning (e.g., ITGB2, CLEC5A, IGFBP-1, CST3) changed before amyloid positivity is established.This research is part of the neurodegeneration research program of Amsterdam Neuroscience. Challenges in the practical implementation of blood biomarkers for Alzheimer's disease
Blood biomarkers have emerged as accessible, cost-effective, and highly promising tools for advancing the diagnostics of Alzheimer's disease. However, transitioning from cerebrospinal fluid biomarkers to blood biomarkers-eg, to verify amyloid ß pathology-requires careful consideration. This Series paper highlights the main challenges in the implementation of blood biomarkers for Alzheimer's disease in different possible contexts of use. Despite the robustness of measuring blood biomarker concentrations, the widespread adoption of blood biomarkers requires rigorous standardisation efforts to address inherent challenges in diverse contexts of use. The challenges include understanding the effect of pre-analytical and analytical conditions, potential confounding factors, and comorbidities that could influence outcomes of blood biomarkers and their use in diverse populations. Additionally, distinct scenarios present their own specific challenges. In memory clinics, the successful integration of blood biomarkers in diagnostic tests will require well-established diagnostic accuracy and comprehensive assessments of the effect of blood biomarkers on the diagnostic confidence and patient management of clinicians. In primary care settings, and even more when implemented in population-based screening programmes for which no experience with any biomarkers for Alzheimer's disease currently exists, the implementation of blood biomarkers will be challenged by the need for education of primary care clinical staff and clear guidelines. However, despite the challenges, blood biomarkers hold great promise for substantially enhancing the diagnostic accuracy and effectively streamlining referral processes, leading to earlier diagnosis and access to treatments. The ongoing efforts that are shaping the integration of blood biomarkers across diverse clinical settings pave the way towards precision medicine in Alzheimer's disease
Retroalimentación correctiva escrita en un corpus de traducción general. Estudio de caso
Los estudios sobre retroalimentación correctiva escritaen el ámbito de los Estudios de Traducción son escasos. En este trabajo analizamos cualitativamente un corpus de 100 traducciones evaluadas por docentes de una universidad española y nos centramos en la modalidad denominada comentarios globales. El análisis se interesa por las funciones pragmáticas y por los focos de las intervenciones de los docentes. Los resultados permiten identificar cinco categorías de funciones: señalización del error, valoraciones, advertencias, órdenes y consejos o sugerencias. Algunas de estas funciones son coherentes con el objetivo comunicativo de los comentarios globales, esto es, dar información al estudiante sobre el conjunto de su tarea y otras son más propias de la modalidad "comentarios focalizados" por lo que se puede concluir sobre la naturaleza híbrida de los discursos analizados. En cuanto al foco, este se orienta casi siempre a la tarea y raramente al proceso, a la autorregulación o a la persona. Los comentarios aluden a menudo a los errores cometidos por los estudiantes, principalmente de tipo lingüístico y ocasionalmente de tipo textual. Esta investigación permite describir empíricamente una práctica común en la formación de traductores a la vez que ofrece elementos de reflexión susceptibles de mejorar los procesos de enseñanza-aprendizaje en nuestro contexto
