Get PDFThis paper is a reflection about the canonical sense of the penalties in the Codex Iuris Canonici since 1983 in force and, in particular, about the latae sententiae censures. It features the cast of its criminal types and examines some aspects of the excommunication penalty, to finally highlight the obligation on the Apostolic faith guarding as specifical missio for the hierarchs of Catholic Church.Este estudio es una reflexión sobre el sentido de las penas canónicas en el Codex Iuris Canonici de 1983 y, en particular, sobre las censuras latae sententiae.Presenta el elenco de sus tipos delictivos y examina algunos aspectos de la pena de excomunión, para destacar finalmente la obligación de custodiar la fe apostólica como missio específica de los jerarcas católicos

Los Exserpta de Sg y los orígenes de la ciencia del Derecho Canónico
Get PDFWho, when and where used the Exserpta Sanctorum Patrum? The paper explores these issues focussing on the glosses to the first part of the manuscript Sankt Gallen, Stiftsbibliothek, 673 (Sg). From the quantitative point of view, the glosses of Sg are scarce and do not form a joint mass. From the qualitative point of view, most of and they were not written at the same time. The oldest glosses are contemporary or very close to the copy of the Exserpta. This set of primitive glosses was not taken from a manuscript of the Decretum and precedes the erste Glossenkomposition (Bologna, 1150s). Another second series of glosses agree with the glosses of the erste Glossenkomposition. Two other marginal glosses of Sg agree with the comments of the Stroma Rolandi (Bologna, c. 1150 – 1160s). From the late forties to the late sixties at least six canon lawyers used the manuscript Sg to write down the lectures of the decretists in Bologna. This fact gives a certain degree of authority to the work that preserves the Sankt Gallen Stiftsbibliotek. them are Allegationen, Nota and Rubrikenglossen. There is also a significant number of Worterklärungen and some Diskursive Erörterung. They all are anonymous glosses¿Quién, dónde y cuándo utilizó los Exserpta Sanctorum Patrum? El ensayo responde a estas preguntas a partir de las glosas de la primera parte del manuscrito Sankt Gallen, Stiftsbibliothek, 673 (Sg). Las glosas de Sg son escasas y no forman una masa conjunta. Desde el punto de vista cualitativo, la mayoría son Allegationen, Nota y Rubrikenglossen. Hay también un número significativo de Worterklärungen y algunas Diskursive Erörterung. Son glosas anónimas y no fueron escritas al mismo tiempo. Las más antiguas son contemporáneas o muy cercanas a la copia de los Exserpta. Estas glosas no fueron tomadas de un manuscrito del Decretum y preceden a la erste Glossenkomposition (Bolonia, década de los años 1150). Una segunda serie de glosas coinciden con las glosas de la erste Glossenkomposition. Un par de glosas marginales de Sg son iguales a los comentarios de la Stroma Rolandi (Bolonia, c. 1150 – 1160). Desde el final de la década de los años cuarenta hasta el final de los años sesenta del siglo XII, al menos seis canonistas distintos aprovecharon los márgenes de la primera parte del manuscrito Sg para copiar enseñanzas de los decretistas boloñeses. Este hecho otorga a la obra que conserva la Stiftsbibliotek de Sankt Gallen un cierto grado de autoridad
