This article analyses the reconceptualization of the notion of “internal enemy” in the 21st century, as well as the current reconfigurations of the use of criminal law of the enemy as a mechanism of repression, criminalization and punishment of social movements in Guatemala, thus raising questions and argumentative lines that could also be applied to other Latin American countries. The analysis relies on the role played by the monopoly of "legitimate" violence in the reason of the State, as well as on the increasing relevance of multinational corporations and their “lex mercatoria” against the sovereignty of the State, not just as mere economic agents, but as forms of political authority.Received: 04 September 2019Accepted: 24 February 2020Published online: Articles in press 03 April 2020; No. 5 (2020) 26 June 2020El artículo analiza la reconceptualización de la noción de enemigo interno en el siglo XXI, así como las reconfiguraciones actuales del uso del derecho penal del enemigo como mecanismo de represión, criminalización y castigo a los movimientos sociales en Guatemala, desarrollando interrogantes y líneas argumentativas que se podrían aplicar a otros países latinoamericanos. Protegiendo el derecho a defender los derechos humanos en Colombia: el caso de Ríos Vivos Antioquia
This paper focuses on the case of Ríos Vivos Antioquia, a social and environmental movement that fights against the construction of Hidroituango —the largest dam in Colombia— which has produced serious environmental and social impacts on the population surrounding the project. This article analyzes the internationalization of the struggle by this movement through different strategies aimed at defending the Human Rights of its community. For that purpose, this research uses documents produced by the movement and reports of some NGOs as well as interviews with members of RVAM and external collaborators to know their main strategies in some depth. This paper concludes that the strategies of internationalization used by this movement have resulted in the strengthening of the social struggle and the empowerment of the population in that region, which has been particularly affected by the violence in Colombia.
Recibido: 19 abril 2020Aceptado: 06 noviembre 2020Este trabajo se centra en el caso de Ríos Vivos Antioquia, un movimiento social y ambiental que lucha contra la construcción de Hidroituango —la represa más grande de Colombia— y que ha producido graves impactos ambientales y sociales en la población circundante al proyecto. Este artículo analiza la internacionalización de la lucha de este movimiento a través de diferentes estrategias dirigidas a defender los Derechos Humanos de su comunidad. Para ello, esta investigación utiliza documentos producidos por el movimiento e informes de algunas ONG, así como entrevistas con miembros de RVAM y colaboradores externos para conocer en profundidad las principales estrategias. Este trabajo concluye que las estrategias de internacionalización de este movimiento han tenido como resultado el fortalecimiento de la lucha social y el empoderamiento de la población de esa región, una población que ha sido particularmente afectada por la violencia en Colombia.

Using the Internationally Recognized Frameworks of Nursing Competences to address the challenges of nurse refugees without documentation
Individuals seeking refuge in host countries is a global reality. Some of these individuals are qualified nurses. If, and when, the documents pertaining to a nurse qualification are not presented to the respective authorities of a host country, the challenges for these qualified nurses to secure registration and employment as nurses are numerous and often unsurmountable. Access to higher education opportunities is similarly compromised in the absence of relevant documents. This is happening against the backdrop of a widely reported global shortage of qualified nurses, and an extensive effort and investment to address this shortage in many countries. This paper explores the feasibility and appropriateness of applying internationally recognized frameworks of competences of nurses, to processes which seek to evaluate and verify the nurse training and qualification claimed by refugee nurses. The author seeks to determine whether such frameworks of nurse competences may effectively and efficiently contribute towards initiatives which are geared towards addressing the gap in (qualification) document availability, traceability, verification and reproduction of nurse refugees. A critical consideration of a few existent initiatives is presented in view of exploring, the identification of a tool which may enable a homogenous transnational approach which is consistent across salient parameters.

The Legal Advice In Course Of Cooperative Identity. Potential Contributions to Cuban Non-Agricultural Cooperatives
En Cuba, con el proceso de actualización del modelo socioeconómico, se han implementado nuevas formas de trabajo cooperado en sectores diferentes al agropecuario. Estas formas asociativas presentan dificultades que las apartan de la identidad cooperativa universalmente reconocida; sin embargo, la asesoría jurídica puede contribuir en este sentido. En el presente trabajo se explican estas potencialidades de la asesoría jurídica y, a continuación, se argumenta este propósito para las Cooperativas No Agropecuarias cubanas, de cara a los principios cooperativos enarbolados por la Alianza Cooperativa Internacional y a las recientes transformaciones legislativas implementadas en el país para el sector.Recibido: 30 marzo 2020Aceptado: 24 abril 2020Publicación en línea: 14 junio 2020In Cuba, with the process of updating the socioeconomic model, new forms of cooperative work have been implemented in sectors other than agriculture. These associative forms present difficulties that separate them from the universally recognized cooperative identity; however, legal advice can contribute in this regard. La fiscalidad de las cooperativas en Mexico
Con la reforma que se presenta, y que entrara en vigor a partir del próximo ejercicio fiscal, las Sociedades Cooperativas van a tener un verdadero régimen fiscal que las regule, debido a que sus actividades son propias del régimen general de personas morales las cuales deben de aplicar a futuro para el pago del impuesto del ejercicio como corresponde, esto es a través lo estipulado por el Artículo 10 de la propia Ley del Impuesto Sobre la Renta que se encuentra en vigor, y no así por lo dispuesto en el Artículo 177 que regula la forma de realizar el pago del impuesto como si se tratare del régimen de personas físicas.
Recibido: 16 octubre 2020Aceptado: 17 noviembre 2020With the reform that is presented and that will come into force as of the next fiscal exercise, the Cooperative Societies will have a true fiscal regime that regulates them, because their activities are typical of the general regime of legal entities which must apply in the future for the payment of the tax for the fiscal exercise as deserved, this is through the provisions of Article 10 of the Income Tax Law itself that is in force, and not by the provisions of Article 177 that regulates the way to pay the tax as if it were the regime for natural persons.

Radicalization of the Media and Abuse of the law in the Doctrine of the European Court of Human Rights
El Derecho de ser informado y de informar ha experimentado una auténtica revolución en cuanto a lo que se refiere al actual inmenso elenco de posibilidades. Si la liberación de los servicios de la información experimentó un paso decisivo con la apertura de la oferta informativa, la irrupción de Internet, y su inabarcable inmensidad de fuentes de información, ha terminado por sacralizar aquella tesis de Galeano en la que aseguraba que cada vez son más los que tienen el derecho de escuchar y de mirar, pero cada vez son menos los que tienen el privilegio de informar, opinar y crear.Este tipo de Derecho sui generis parece haber terminado transformando en los últimos años el Derecho fundamental de acceso a la información, y a informar, en una dictadura de la palabra y la imagen única que, este autor, consideraba aún más devastadora que aquella surgida del modelo del partido único.No solo por los riesgos que implica la divulgación de la falsedad; también por imponer un modo de vida que tiene por ciudadano ejemplar aquel consumidor dócil y el espectador pasivo que parece haber sido moldeado al capricho del modelo de la sociedad de la información comercial1.Un buen ejemplo de ello lo podemos encontrar en la gestión mediática de la crisis sanitaria en torno al COVID-19. Una epidemia con orígenes remotos pero que ha terminado por propagarse infinitamente más rápido de lo que ha pretendido la contención mediática con el fin de tranquilizar a la ciudadanía y tratar de asegurar la continuidad de los mercados. The liberation of the information services underwent a decisive step with the opening of the informative offer, but the arrival of the Internet, and its immeasurable immensity of information sources, has ended up forging Galeano’s thesis in which he assured that more and more people have the right to listen and look, but fewer and fewer people have the privilege to report, think and create.This type of law sui generis seems to have ended up transforming in recent years the fundamental right of access to information and to inform, into a dictatorship of the word and the unique image that Galeano considered even more devastating than that arising from a single-party system.Not only because of the risks involved in spreading falsehood; also for imposing a way of life that states as an exemplary citizen a docile consumer and a passive spectator who seems to have been molded at the whim of the commercial information society model.A good example of this is the media management of the health crisis around COVID-19. An epidemic with remote origins but which has ended up spreading infinitely more quickly than the media had intended in order to reassure citizens and try to ensure the continuity of the markets. El pensamiento utópico ha sido una constante en la formulación de los movimientos políticos así como en la configuración de los derechos individuales. Las revoluciones de los siglos XVII y XVIII ofrecieron notables ejemplos de sociedades articuladas a través de ideas elevadas en las que la redistribución de la riqueza y una mayor participación política eran signo común. Sin embargo, esas aparentes coincidencias escondían diferencias de planteamiento y de concepción, como exponemos en el análisis de las ideas de James Harrington y Gracchus Babeuf.

The revolutions of the seventeenth and eighteenth centuries offered notable examples of societies articulated through lofty ideas in which the redistribution of wealth and greater political participation were a common sign. However, these apparent coincidences concealed differences in approach and conception, as we show in the analysis of the ideas of James Harrington and Gracchus Babeuf.
