Right of Residence in the European Union of Same-Sex Marriages
El estado civil de las personas físicas es competencia de cada Estado miembro. Por tanto, cada Estado miembro de la Unión Europea decide —con arreglo a su identidad nacional— si es válida, o no, la celebración en su país de un matrimonio entre personas del mismo sexo. Ahora bien, el no reconocimiento de esta situación limita el derecho de los ciudadanos de la Unión Europea y de los miembros de su familia a circular y residir libremente en el territorio de los Estados miembros. Ante esta situación, el presente trabajo valora si, una discriminación basada en la orientación sexual puede obligar a los Estados miembros de la Unión Europea a reconsiderar la institución jurídica del matrimonio, respecto del ejercicio del derecho a la libre circulación y residencia. La respuesta posibilitará, o no, que el nacional de un tercer Estado que contrae válido matrimonio homosexual con otro ciudadano de la Unión Europea pueda acompañarlo, en el caso de que, por cualquier motivo que cubra sus intereses, ambos decidan trasladar su residencia de un Estado miembro a otro.Recibido: 01 agosto 2018Aceptado: 15 enero 2020Publicación en línea: 02 abril 2020The marital status of natural persons fall under the remit of each Member State. Therefore, each Member State of the European Union decides - according to its national identity - whether or not the celebration in its country of a marriage between people of the same sex is valid. However, failure to recognize this situation limits the right of citizens of the European Union and their family members to move and reside freely within the territory of the Member States. In view of this situation, the present paper assesses whether discrimination based on sexual orientation can force the Member States of the European Union to reconsider the legal institution of marriage, with respect to the exercise of the right to free movement and residence. The answer will enable, or not, the third State national who contracts a valid homosexual marriage with another citizen of the European Union to accompany the spouse, in case, for any reason that covers their interests, both decide to move their residence from a Member State to another.Received: 01 August 2018Accepted: 15 January 2020Published online: 02 April 202

Tras las elecciones europeas de mayo de 2019, la Unión Europea (UE) abrió un nuevo ciclo político institucional para el período 2019-2024. El año 2020 inicia un tiempo clave para acometer cuestiones pendientes, como la salida del Reino Unido o el nuevo marco financiero plurianual 2021-2027, y afrontar nuevos retos, como la neutralidad climática y el desarrollo de la Europa de la Defensa. Además, el 9 de mayo de 2020, la UE conmemorará el 70.º aniversario de la Declaración Schuman, una evento importante y propicio para hacer balance y mirar hacia el futuro. The year 2020 initiates a new time when the EU will have to tackle pending issues, such as United Kingdom’s exit or the 2021-2027 multiannual financial framework, while addressing new challenges, such as the achievement of climate neutrality or the development of the European Defence. In addition, the EU will commemorate the 70th anniversary of the Schuman Declaration on 9 May 2020, which will be an important and propitious event to take stock of the European political project and look to the future. Liability claims against transnational corporations before the courts are one of the possible steps to take towards ensuring respect for human rights in their conduct of business in third States. As stated in Article 8 of the Universal Declaration of Human Rights and in Article 2 of the International Covenant on Civil and Political Rights, access to justice is a fundamental right. However, the human rights violations committed by corporations have an irretrievable connection with denial of justice. The existing order does not provide an adequate response, as ‘governability gaps’ and the scope of influence of companies escape the regulatory and coercive power of the State of origin. The host countries’ lack of capacity or will to ensure that companies operating in their territory respect human rights; the absence of effective judicial systems; and the legal obstacles created by complicated business structures all lead to the need for complementary, more regularised business behaviour at the operational level.Published online: 30 September 2020Las demandas de responsabilidad contra empresas transnacionales ante los tribunales constituyen una de las posibles vías para canalizar la voluntad de someterlas al respeto de los derechos humanos en el ejercicio de sus actividades en terceros Estados. El acceso a la justicia se erige en derecho fundamental, tal y como aparece recogido en el artículo 8 de la Declaración Universal de los Derechos Humanos o en el artículo 2 del Pacto Internacional de Derechos civiles y políticos. Sin embargo, las vulneraciones de derechos humanos cometidas por parte de empresas vienen irremediablemente unidas a la denegación de justicia. El orden existente no da una respuesta adecuada, los «vacíos de gobernabilidad» y el ámbito de influencia de las empresas escapa al poder regulatorio y coercitivo del Estado de origen. La falta de capacidad o voluntad de los países anfitriones de asegurar el respeto de los derechos humanos de las empresas que operan en su territorio; la ausencia de sistemas judiciales efectivos y los obstáculos legales que crean las complicadas estructuras empresariales, nos llevan a complementarlas con una mayor regularización de los comportamientos empresariales a nivel operativo
Aproximación jurídica internacional al ejercicio de la jurisdicción civil universal frente a violaciones graves de derechos humanos
It seems that there is no international legal obligation, neither in international treaties nor in general international law, that confirms the existence of state legal obligations on the exercise of universal civil jurisdiction against gross violations of human rights. However, while its implementation is not prohibited (thanks to the permissive principle), it seems necessary to reconcile the state jurisdiction with the right to justice of victims, which creates a shared erga omnes commitment to prevent the denial of justice. Private international law offers jurisdictional paths that have served to ensure such access in practice and, in this sense, the forum of necessity, as a alternative institution, would be perhaps one of the most effective means. As the Naït- Liman v. Switzerland case presented before the European Court of Human Rights demonstrate, though, the requirements prescribed to submit a claim through the necessity forum can become an excessive burden from the point of view of the right to justice.Received: 30 January 2020 Accepted: 20 May 2020 Published online: 26 June 2020No es reconocible ni en el Derecho internacional general ni en el convencional una obligación jurídica internacional que exija el ejercicio de la jurisdicción civil universal frente a violaciones graves de derechos humanos. Considerando que su implementación no está prohibida (principio permisivo), parece necesario conciliar el alcance de las jurisdicciones estatales con el derecho a la justicia de las víctimas, lo que comporta un compromiso solidario erga omnes de evitar la denegación de justicia a toda víctima. El Derecho internacional privado puede ofrecer cauces para garantizar ese acceso y, en ese sentido, el foro de necesidad como institución subsidiaria (residual) es uno de ellos. Sin embargo, visto el asunto Naït-Liman c. Cooperative education as a basis for an integral development of the cooperative phenomena
El presente trabajo de investigación centra su análisis en diversos mecanismos para un desarrollo integral del cooperativismo, con especial atención al principio de educación cooperativa. En primer lugar, se realiza un análisis histórico de este principio y su formulación, en relación a los orígenes del cooperativismo moderno y sus aspiraciones de conquista, como método explicativo para la justificación de su indivisibilidad. A continuación, se esbozan una serie de mecanismos para un desarrollo integral del fenómeno cooperativo. Por último, se trata la educación cooperativa como base para dicho desarrollo.

In the first part of this project, a formulation and a historical analysis of this principle has been done. This first analysis has been related to the origin of modern cooperativism and to its aim of conquer as an explicative method in order to justify its undivisibility. Secondly, a combination of mecanisms that allow the integral developement of the cooperative phenomena have been proposed. And finally, cooperative education is taken into account as the basis of the previously mentioned development.

Sobre la limitación de la responsabilidad de los socios cooperativistas
This paper addresses the study of the regulation of liability of cooperative partners within the framework of the current legislation. It analyses the main problems of interpretation that arise from the proliferation of laws for each Autonomous Community and the lack of standardized treatment. The author contrasts his thesis on the limited liability of partners with a selection of our Courts case law.

Legal Barriers to Transnational Civil Liability Claims for Business- Related Human Rights Abuses: a Rightsholder’s Approach
El objeto del presente estudio se focaliza en los procesos civiles internacionales en materia de responsabilidad empresarial por abusos de los derechos humanos. Desgranamos cronológicamente las fases del proceso ejemplificándolas a través de un caso muy conocido (Akpan contra Shell) en el que fue competente un tribunal de un Estado miembro de la UE (Países Bajos) respecto de los daños sufridos en un tercer Estado (Nigeria). Exponemos las principales trabas jurídicas en este tipo de litigio, desde la interposición de la demanda, pasando por la lengua del proceso, hasta plantear una hipotética ejecución transnacional de la sentencia neerlandesa en Nigeria. Ello con una doble finalidad, por un lado, proporcionar desde la perspectiva del titular del derecho en este tipo de procesos (víctimas y ONGs) información previa para poder planificar y advertir las dificultades jurídicas que plantea una demanda transnacional por daños contra una multinacional. Por otro lado, para evidenciar la desigualdad existente entre las partes en litigio desde el punto de vista económico y procesal, alentando a que las normas internas e internacionales cumplan con los derechos fundamentales a un proceso equitativo y a la tutela judicial efectiva (art. 6 CEDH y art. 47 CDFUE) en este tipo de litigios.Recibido: 06 abril 2020Aceptado: 05 junio 2020Publicación en línea: 30 septiembre 2020The article sets out to identify key barriers that rightsholders face when bringing a business human rights claim against a corporate opponent. It points out each barrier with an illustration from the Akpan & Milieudefensie v. Shell Nigeria & Netherlands case. It presents the main legal obstacles in this type of litigation, such as the filing of the lawsuit, the language of the process, a hypothetical transnational execution of the Dutch judgement in Nigeria. It has a double purpose, namely, to provide the rightsholders in this sort of process (victims and NGOs) information about legal difficulties caused by a transnational claim for damages against a multinational corporation. Investigating the effect of clicker use on problem-solving among adult learners: A cross-sectional survey
Classroom response systems (clickers) have been found to engage and attract student attention and facilitate the practical application of key ideas to solve problems. This study was designed to investigate the effects of clicker use on problem-solving among adult learners. A self-administered questionnaire was distributed to 60 students after giving them actual case studies for problem-solving using PowerPoint slides. An equal number of participants were assigned to each of the control (n=30) and experimental groups (n=30). Although both groups engaged in the same problem-solving tasks, the experimental group used clickers as a learning tool in the classroom. Data were analyzed using frequency, means, exploratory factor analysis, the Friedman ranking test, and linear regression analysis. The study findings revealed overall positive responses toward using clickers in the classroom. They also suggested that clickers encouraged thinking and problem-solving. It is concluded that problem-solving learning in adult education appears to be more effective when accompanied by clicker use than through conventional teaching methods.Received: 26 September 2019Accepted: 04 March 2020Published online: 19 May 202
The crime of rape in the Spanish Criminal Code: analysis of the difficult delimitation between intimidation of sexual assault and «prevalimiento» of sexual abuse. A revision in the light of the international regulations
Caracterizado por un alto porcentaje de victimización de la mujer, el delito de violación se trata de uno de los crímenes sexuales históricamente más sancionados. Su regulación, tanto a nivel internacional como nacional, sigue en constante evolución, pues se trata de una conducta típica profundamente relacionada con el progresivo proceso de concienciación sobre la deconstrucción del sistema patriarcal que impacta profundamente en la sensibilidad social colectiva. El objetivo principal del trabajo consiste en arrojar luz al amplísimo debate doctrinal y jurisprudencial generado en torno a la consideración de la violencia y la intimidación como elementos definitorios de este delito. En esta línea, el Código penal español exige la concurrencia uno de dichos medios comisivos para llegar a denominar como violación al ataque a la libertad sexual con acceso carnal, lo que supone la creación de una línea divisoria muy sutil entre la violación intimidatoria y el abuso sexual por prevalimiento. Dicha regulación no se adecúa a los estándares legales internacionales, y concretamente europeos, que España ha ratificado hace ya cinco años a través del Convenio de Estambul. Por ello, se concluye que la legislación nacional, a pesar de haber experimentado una intensa metamorfosis, todavía hoy en día precisa una revisión y reformulación del crimen de violación dirigida hacia su consideración en torno a la falta de consentimiento de la víctima como elemento definitorio. Finalmente, se colige además que en el enjuiciamiento de dicho crimen urge una formación en perspectiva de género dirigida a jueces y magistrados cuyas motivaciones jurídicas, se observa, tienen un poder decisivo.Recibido: 05.02.2020Aceptado: 08.06.2020Publicación en línea: 03.07.2020Characterized by a high percentage of victimization of women, the crime of rape is historically one of the most sanctioned sex crimes. Its regulation, both at an international and national level, keeps on evolving since it is a criminal behaviour deeply related to the progressive process of awareness about the deconstruction of the patriarchal system that greatly impacts on the collective social sensitivity. The main aim of the work consists on shedding light on the doctrinal and jurisprudential broad debate generated around the consideration of violence and intimidation as defining elements of the crime. In this line, the Spanish Criminal Code requires one of both methods in which to commit the crime to consider that any attack against sexual freedom including sexual intercourse constitutes rape, what implies the creation of a dividing, though extremely subtle, line between rape through intimidation and sexual abuse through prevalimiento. This regulation is not conformed to the international legal standards, and specifically European, that Spain ratified five years ago by virtue of the Istanbul Convention. In consequence, it can be concluded that the national legislation, despite having experienced an intense metamorphosis, is still in need of a review and reformulation of the crime of rape aimed to its consideration around the absence of consent of the victim as the only defining element. Finally, it is also deduced that the prosecution of the mentioned crime urges the implementation of a gender perspective training addressed to judges and magistrates whose legal motivations have decisive power.Received: 05.02.2020Accepted: 08.06.2020Published online: 03.07.202
El marco jurídico de los datos relativos a la salud en el ámbito de la salud y de la investigación en salud tras la entrada en vigor del Reglamento General de Protección de Datos y de la Ley de Protección de Datos Personales y garantía de los derechos
The treatment of health-related data is relevant not only at the individual level in the environment of individual health care, but also from the collective point of view, valuing health as a social good. In the health aspect as a community good, the use of data in research must be surrounded by adequate guarantees to protect the rights of subjects, but with the necessary flexibility and rationality so as not to hinder the work of public health research, which also includes epidemiological research.
Received: 22.09.2020Accepted: 21.12.2020El tratamiento de los datos relativos a la salud tiene relevancia no solo a nivel individual en el entorno de la asistencia sanitaria personal, sino también desde el punto de vista colectivo, valorando la salud como un bien social. En la vertiente de la salud como bien comunitario, el empleo de los datos en investigación ha de rodearse de las garantías adecuadas para proteger los derechos de los sujetos, pero con la flexibilidad y racionalidad necesarias para no obstaculizar la labor de investigación en salud pública, que incluye también la investigación epidemiológica.
