No full textBakalářská práce zkoumá syndrom vyhoření u pěstounů na přechodnou dobu. Zaměřuje se na prozkoumání, analýzu a porozumění této problematice. Práce začíná teoretickým ukotvením pěstounské péče přes její rozdělení na dlouhodobou a přechodnou, kterou blíže identifikuje. Dále se soustředí na konceptualizaci pojmu syndromu vyhoření, až po identifikaci faktorů, které k němu vedou. Následně se také věnuje jeho prevenci z pozice přechodného pěstouna. Metodologická část kombinuje kvantitativní a kvalitativní přístup za pomoci využití dotazníkového šetření a rozhovorů s respondenty. Výsledky výzkumu naznačují propojení výskytu syndromu vyhoření s předchozí negativní zkušeností pěstounů při jednání s úřady, s pocitem nevyslyšení a rozhodnutím o následné péče dítěte, se kterou nesouhlasí. Jako nejúčinnější preventivní krok pěstouni volili vyhrazení si času pro sebe a své koníčky. Práce poskytuje základ pro další výzkum této problematiky a může sloužit jako inspirace pro pracovníky v oblasti pěstounské péče i pro samotné pěstouny.ObhájenoThe bachelor thesis examines the burnout syndrome in temporary foster parents, focusing on exploring, analyzing, and understanding this issue. The thesis begins with a theoretical grounding of foster care, distinguishing between long-term and temporary care, which is further identified. Then it focuses on conceptualizing the burnout syndrome and identifying factors leading to it. Additionally, it addresses its prevention from the perspective of temporary foster parents. The methodological part combines quantitative and qualitative approaches using questionnaire survey and interviews with respondents. The research results indicate a connection between the occurrence of burnout syndrome and previous negative experiences of foster parents in dealing with authorities, feelings of being unheard, and decisions about the subsequent care of the child with which they disagree. Foster parents identified reserving time for themselves and their hobbies as the most effective preventive measure. The thesis provides a basis for further research on this issue and can serve as inspiration for professionals in the field of foster care as well as for foster parents
Judicial Review in Austria
No full textDiplomová práce je zaměřena na rakouské ústavní soudnictví. V úvodní
kapitole autor zkoumá vývoj, strukturu a význam ústavního soudu v kontextu
federálního uspořádání Rakouska. Autor se dále zaměřuje především na
charakteristiku a postavení rakouského ústavního soudu v rámci právního systému,
a srovnává jeho praxi s praxí ústavních soudů v Německu a České republice. Autor
rovněž představuje klíčové aspekty z hlediska fungování rakouského ústavního
soudu v praxi, jeho vztah k obecným soudům a jeho roli v rámci federálního
rozhodčího systému. Zvláštní pozornost je věnována rovněž analýze vybrané
judikatury rakouského ústavního soudu, které přibližují způsob řešení konkrétních
případů a ukazují na specifické problémy spojené s federalistickým uspořádáním
v Rakousku.
Pro účely této diplomové práce byla použita metoda literární rešerše, díky
níž autor analyzuje teoretické poznatky a judikaturu ústavního soudu v kontextu
rakouského ústavního práva. Komparativní prvky výzkumu umožňují hlubší
pochopení jednotlivých zjištěných aspektů v porovnání s jinými zeměmi. Hlavní
závěry vyvozené z těchto metod ukazují na efektivní fungování samotného
ústavního soudu v Rakousku, přičemž identifikují i určité problémy vyplývající
z tamního federálního uspořádání. Srovnání s praxí Spolkového ústavního soudu
v Německu a Ústavním soudem ČR poskytuje cenné poznatky pro hodnocení
specifik rozhodovací praxe rakouského ústavního soudnictví.
Přínos této diplomové práce spočívá v hlubším porozumění role a významu
ústavního soudu v rakouském právním systému a federálním uspořádání, to samé
platí i pro pochopení jeho přínosu k řešení aktuálních společenských a politických
otázek v zemi.ObhájenoThe thesis focuses on the Austrian constitutional judiciary. In the
introductory chapter, the author examines the development, structure and
significance of the constitutional court in the context of Austria's federal structure.
The author then focuses primarily on the characteristics and position of the Austrian
Constitutional Court within the legal system, and compares its practice with that of
the constitutional courts in Germany and the Czech Republic. The author also
presents key aspects in terms of the functioning of the Austrian Constitutional Court
in practice, its relationship to the general courts and its role within the federal
arbitration system. Particular attention is also paid to the analysis of selected case
law of the Austrian Constitutional Court, which provide insights into the way in
which specific cases are dealt with and highlight the specific problems associated
with the federalist system in Austria.
For the purpose of this thesis, the author used the method of literature search,
through which the author analyses the theoretical knowledge and case law of the
Constitutional Court in the context of Austrian constitutional law. The comparative
elements of the research allow for a deeper understanding of the different aspects
found in comparison with other countries. The main conclusions drawn from these
methods point to the effective functioning of the Constitutional Court itself in
Austria, while also identifying certain problems arising from the federal structure
there. Comparisons with the practice of the Federal Constitutional Court in
Germany and the Constitutional Court of the Czech Republic provide valuable
insights for assessing the specificities of the decision-making practice of the
Austrian constitutional judiciary.
The contribution of this thesis lies in a deeper understanding of the role and
importance of the Constitutional Court in the Austrian legal system and federal
system, and the same applies to understanding its contribution to the resolution of
current social and political issues in the country
The right to life in the light of judicial case law
No full textTématem této diplomové práce je Právo na život ve světle soudní judikatury. Hlavním cílem je zejména charakterizovat základní pojetí práva na život v České republice, jakož i jeho jednotlivé části, a dále nabídnout porovnání legislativních úprav dílčích institutů (eutanazie či interrupce) se zahraniční právní úpravou a soudní praxí ve světě. V první polovině práce je pozornost věnována více globálním a teoretickým otázkám vývoje, a též národnímu a nadnárodnímu kontextu práva na život. Současně je zde poukázáno na řadu etických problémů pojících se s předmětnou tématikou otázky začátku a konce lidského života. Stěžejním jádrem této práce je pak zejména čtvrtá kapitola, která se věnuje konkrétním institutům interrupce a eutanazie, a to jak z pohledu české legislativy a judikatury, tak z pohledu legislativy a soudní praxe vybraných zahraničních států.ObhájenoThe topic of this diploma thesis is the right to life in the light of judical case law. The main goal of this diploma thesis is to characterize the basic concept of the right to life in terms of the Czech Republic ( including individual aspects of this right). It should also offer a comparison of the legislative regulations of sub-institutes (euthanasia or abortion) with foreign legal regulations and judicial practice in the world. The first part of the work is dedicated to more global and theoretical issues of development as well as to the national and international context of the right to life. Ethical issues related to the beginning and the end of the life will be mentioned here as well. The core of this work is captured in the fourth chapter, which deals with the specific institutes of abortion and euthanasia, both from the Czech legislation and jurisprudence point of view, and from the point of view of the legislation and judicial practice of selected foreign countries
Judicial review of emergency measures during an epidemic or the threat of its occurrence
No full textTato diplomová práce se zaměřuje na problematiku mimořádných opatření při epidemii nebo nebezpečí jejího vzniku v obecné rovině, avšak s přihlédnutím k epidemii onemocnění COVID-19, kdy byla hojně vydávána. Práce zkoumá právní formu těchto opatření, jejich obecnou právní úpravu a její vývoj. Dále se práce věnuje rozdílům mezi mimořádnými opatřeními vydávanými podle Zákona o ochraně veřejného zdraví a podle Pandemického zákona. Práce také analyzuje možnosti ochrany proti mimořádným opatřením a hodnocení těchto opatření soudy v rámci soudního přezkumu. Na základě provedené analýzy se autor pokouší navrhnout úpravy právního řádu České republiky, aby se do budoucna odstranily negativní aspekty současné právní úpravy. Tato práce tak přispívá k diskusi o právních aspektech mimořádných opatření v době epidemie.ObhájenoThis master's thesis focuses on the issue of emergency measures in a general context, but with regard to the COVID-19 epidemic, during which they were extensively issued. The thesis examines the legal nature of these measures, their general legal regulation, and its development. Furthermore, the thesis deals with the differences between emergency measures issued under the Public Health Protection Act and the Pandemic Act. The thesis also analyzes the possibilities of protection against emergency measures and the evaluation of these measures by courts within the framework of judicial review. Based on the analysis carried out, the author attempts to propose amendments to the legal order of the Czech Republic in order to eliminate the negative aspects of the current legal regulation in the future. This work thus contributes to the discussion on the legal aspects of emergency measures in times of an epidemic

Cílem práce je zvýšit efektivitu vybraných procesů.V práci je představena společnost, definovány základní pojmy procesního řízení a popsán význam optimalizace. Analytická část využívá nástroj ARIS Architect & Designer pro modelování a analýzu procesů, což vede k praktickým návrhům na zlepšení. Hlavním výstupem je soubor opatření, která zefektivňují vybrané procesy a snižují náklady. Tyto změny demonstrují, jak integrace teoretických znalostí s praktickou aplikací přispívá k trvalému zlepšení výkonnosti podniku.ObhájenoThe thesis focuses on the analysis and subsequent optimization of selected business processes at ROC - Galvanik s.r.o., where theory and practice are not divided, but are intertwined throughout the content. The aim of the work is to increase the efficiency of selected processes. The company is introduced, basic concepts of process management are defined, and the importance of optimization is described. The analytical part utilizes the ARIS Architect & Designer tool for modeling and analyzing processes, leading to practical proposals for improvement. The main output is a set of measures that enhance the efficiency of selected processes and reduce costs. These changes demonstrate how the integration of theoretical knowledge with practical application contributes to the sustainable improvement of company performance

S motivací jsou úzce spjaty pojmy spokojenost a angažovanost zaměstnanců, které významným způsobem ovlivňují dosahování podnikových cílů. Motivovaní, angažovaní a spokojení zaměstnanci jsou pro podnik klíčoví, protože odvádějí kvalitní práci, pracují s nadšením a mají zájem neustále zlepšovat své pracovní výsledky. Diplomová práce se zabývá tématem motivace pracovníků v podniku Konplan s.r.o. Cílem této práce bylo analyzovat a zhodnotit současný motivační systém ve vybrané společnosti a následně na základě získaných poznatků navrhnout opatření pro oblast motivování zaměstnanců. Pro vyhodnocení motivačního systému bylo využito dat ze zaměstnaneckého průzkumu, který společnost pravidelně provádí. Na základě informací vyplývajících z analýzy silných a slabých stránek a osobní komunikace s HR manažerkou, byla navržena opatření, která mohou společnosti pomoci zlepšit současný motivační systém.ObhájenoEmployee motivation is an important part of human resource management that should be given sufficient attention by the company. The concepts of employee satisfaction and engagement are closely related to motivation, which significantly affect the achievement of corporate objectives. Motivated, engaged and satisfied employees are key to a company because they do quality work, work with enthusiasm and are interested in continuously improving their performance. The master thesis deals with the topic of motivation of employees in the company Konplan s.r.o. The aim of this thesis was to analyse and evaluate the current motivation system in the selected company and then, based on the results, to propose measures for the area of employee motivation. To evaluate the motivation system, data from the employee survey that the company regularly conducts was used. Based on the information resulting from the strengths and weaknesses analysis and personal communication with the HR manager, measures were proposed that can help the company to improve the current motivation system
